CARB Releases Scoping Plan to Reduce Greenhouse Gas Emissions

Morrison & Foerster reports that the California Air Resources Board (CARB) has developed a proposed Scoping Plan to implement measures intended to reduce the state's greenhouse gas (GHG) emissions. Pursuant to California's Global Warming Solutions Act (AB 32), the measures are aimed at reducing emissions to 1990 levels by 2020.

CARB is expected to approve the plan in December; drafting and adopting regulations will follow. Three general measures are included in the plan:

  1. A cap-and-trade market-based program that fits within the Western Climate Initiative (WCI), expected to join four Canadian provinces and seven states in the efforts
  2. "Transformational" measures that alter existing regulations, including the Low Carbon Fuel Stsandard and reforming land developments and transportaion planning
  3. Addressing measures that restrict adherance, such as lack of information and coordination

By participating in the WCI, California hopes to benefit regulated industries by implementing a firm cap on 85% of emissions via a larger regional carbon trading market. The state model and measures for reaching the GHG reduction targetsĀ are expected to influence the structure of an eventualĀ federal cap-and-trade initiative.
