Indiana AG Files Suit Against Companies for Fax Advertising Practices

The Indiana AG Office announced that charges alleging violations of the state's Do Not Fax Law have been filed against Five Star Advertising, Inc., Sportex, Inc. and Jessie Daniel Casares of SOS Marketing. The defendants are accused of faxing unwanted advertisements for discounted healthcare plans and other products to Indiana businesses and residents.

Unsolicited fax advertisements are considered a deceptive act, punishable by up to $1,500 per violation.  Existing laws indicate that any fax ad must follow an existing business relationship, contain an opt-out clause with a contact number and the date and time, business name, and originating number on the document.

The Indiana AG has filed 10 similar cases since the January 2007 inception of the Do Not Fax Law; 333 companies have voluntarily complied.
