Missouri Judge Lifts Halloween Ban on Sex Offenders

The New York Times reports that a Missouri federal judge has temporarily blocked certain parts of a state law requiring sex offenders to stay home on Halloween. The law was passed in an attempt to avoid contact between the offenders and children on the holiday, but Judge Carol E. Jackson stated that the details of the ban were unclear. Requirements include that offenders should avoid all "Halloween-related contact with children," and do not allow them to leave their home from 5:00 to 10:30 p.m. without "just cause."

Four convicted sex offenders suing the state questioned whether the law prevented them from celebrating with their own children and family, as well as what defined the just cause for leaving home during the stated hours. The offenders were represented by the ACLU, who claimed they should not be punished for a crime for which they have already served sentences.

Judge Jackson upheld the requirement for offenders to post a sign stating that no candy would be handed out at that residence, as well as turning off any porch lights.
