And have back years of child support reimbursed to him if the test proves the child is not his biological child?

<description>&#60;p&#62;I don't see the relevance of the safe surrender law to what is, in essence, a financial obligation you may have vis-a-vis the father to pay child support. Safe surrender means the parent bringing in the child is safe from prosecution for crimes related to abandonment or neglect.  &#60;/p&#62;

There is no support ordered as I am afraid for my safety and that of my child. Could I legally ask for him to give up his parental rights? Or could they be terminated due to abandonment? I'm just looking for the best options, he has not been a part of, seen, or even asked about our daughter in 9 months, she has no idea who he is as the last time he saw her she was only 4 months old. I than stopped contact after he tried to kidnap her. He is not on her birth certificate as of this moment.

The letter received was notifiying him that he was sent monies in 1999 and 2000 as a tax intercept from his x-wife who was ordered to pay child support. There was no documention provided. Only the threat of sending his 'account' to collections if the money  (1,556.00)was not paid. After many calls, made all the more difficult during the holidays, he finally was told that his x wife, Ms. Sellers, amended her taxes therefor money forward by BOSE to my husband, the custodial parent, actually belonged to Ms. Sellers  2nd husband (who had custoday of thier children)  My husband was also told, as a result, the state had to reimbure Mr Sellers the tax intercept monies. Keep this in mind. Ms Sellers was always in arrears of a 25.00 per week child support order. Twelve years later those children are now 29 and 26 year old adults, Ms Sellers still carries an arrears balance, and to top it off, the state of Maryland is saying my Husband has to pay back money that was owed to him. We feel if anyone owes the money, Ms Sellers owes it. And finally, the manner in which this has been handled adds insult to injury. To make threat of destroying the good credit we have worked 25 years to establish. How is this fair?&#60;/p&#62;</description>

<description>&#60;p&#62;I'm in New Mexico, Bernalillo county.  Under Child Support Guidelines Statute 40-4-11 states'&#34;income&#34; means actual gross income of a parent if employed to full capacity or potential income if unemployed or underemployed.' Yet the 'court' says this is subjective (or interpretive) and does not impute my ex's income at full time, but rather about 60 percent of what the statute clearly defines the amount should be - a difference of $260/month!  Consultations with lawyers I hear the judge is wrong - yet they admit even if they were present the lack of compliance with this law would most likely happen.  Judges are allowed to do whatever they want...right or wrong. (Lawyers' remarks!)  IF I were to win I would probably still pay more in fees than what I'd gain.&#60;/p&#62;
&#60;p&#62;I have met many fathers who are imputed at full time if working under full time or ended up with a lessor paying job.  So why is it this court will not read the statute the same way for a mother paying child support?&#60;/p&#62;
&#60;p&#62;What I need is an example case that addresses this - and clearly defines just what the statute already does: That a parent voluntarily working less than full time - capable of working full time (and the mother even stated this in court) means their income is imputed at full time.&#60;/p&#62;
&#60;p&#62;It seems this should have already been clarified somewhere...but I'm not sure where to find it.  The only option I see now is trying to go the way of an appeal.&#60;/p&#62;
&#60;p&#62;Any suggestions?  How do I go about searching through cases of appeals (in Santa Fe)?&#60;/p&#62;
&#60;p&#62;When I find this out I'm going to post it everywhere I can...no doubt I'm not the only one this has been done to.
