302@http://www.lawserver.com/forums/ I have a neighbor, both are corrections officers for the county and his father is a retired sheriff from the same county, who purchased thier home from the jail administrator of the same county. We have hunting hounds and when Mike's girlfriend moved in, she started to complain to the county. They issued us 2 citations for loud and unnecessary noise, but dropped the citations. Then the ordiance was amended to howling or barking dogs allowing 5 minutes at night and 15 minutes during the day, but excluding kennels from procecution. We were issued a warning and 2 citations. We hold a kennel license that we purchased from the county (thier web site stated they were the exclusive outlet for a kennel license), and took the matter to a jury trial, spent 8 hours in court and won the case against the DA, as a pro per. They are now stating that the Cty made a mistake with the kennel license and that they are multiple dog licenses and will no longer issue a kennel license to us. They have again amended the ordinance allowing 15 minutes at night and 30 minutes during the day, but have taken out the provision for a personal kennel to be exempt. So once again, we were issued a warning and two citations. They state in the ordinance that if the dogs are incited, that the barking would be allowed, and we can prove that snowmobiles were reving causing the dogs to bark. I have also performed a study of how many others have received warnings or citations and found that some people have received several complaints and no warnings, only 7 warnings have been issued (one of which is us) and we are the only ones in the whole county that have received any citations for the ordinance as originally written and as amended. What type of case do we have. We feel as though they are pushing us out of having our hounds and we have made an investment of approximately $27000.00 into the equipment and dogs themselves. Because kickbacks violate most companies' policies, simply bringing the practice to light with the insurance company could solve the problem.
