Are retirement plan assets considered "community property" or are they exempt?

I am a Realtor who has worked with clients who are married to first cousins in Colorado and other states that allow this. I am concerned that if I sell them property here that even though they are 30 years old or older they might be prosecuted under Utah's incest laws?

They are not the Warren Jeff's polygamist people that you read about but people who are adults and as adults fell in love, married and had children. Utah allows this marriage if you are both over 55 and sterile so it can't be a moral thing (I know that Joseph F Smith married his first cousin).

Also I have with their help looked into several reports that state that the chances of problems with a baby are virtually nil or much lower than women who conceive after age 35 (my mother) or who smoke, drink, are overweight etc.. Here is a easy chart: http://www.cousincouples.com/?page=overview

I have researched cases in Utah that were prosecuted and only found polyg cases where on party was a minor.

What are the chances of being prosecuted for this third degree felony?

Hello,
I have been married to a man for 1 1/2 months. I am looking to annull the marriage because he has not fulfilled his part of the initial agreement. The agreement was that he would be a sperm donor for me, now he has renegged out of going through with the procedure. I had him added on to my health insurance so that we could complete the IVF process. We are now a week from going through the procedure and he has decided to go back to the mainland in 3 days. Can I get this marriage annulled?

Many people use golf as a form of relaxation, an enjoyable activity, or a way to compete and have fun. Whatever your reason for playing, insider tips will give you the edge that you need to accomplish your goal. true religion outletWhen playing golf, see to it that you keep the game rolling. If you are playing a round slowly, the group behind you may get angry. If your group contains a novice golfer, be ready to invite faster groups who come up behind you to play through. true religion outlet store If you want to get the most out of each game, you must be prepared both mentally and physically. This is the time to rid your mind of all of the stress and to focus solely on the game at hand.If you take the time to practice, you can keep yourself from making common errors like slicing. When your club comes through the ball improperly, it can be prone to spinning wildly off to the right. Align your shoulders, knees and hips parallel to where you want the ball to end up. Engage your hands and arms during the downswing, rather than your shoulders and torso. true religion outlet online Don't assume your gloves are worn out if your hands slip off the club while swinging. Look at the grips on your clubs and replace them if they show wear and tear. It is cheap and easy to replace grips on your clubs, and doing so will only make your swing that much better.Adjust your stance to make sure your front foot is a little more close to the ball, if you have a tendency to slice the ball. "Closing" your stance like this can balance out any spin that initiates your ball slicing, which means you have better odds of sending your ball into the fairway for a better second shot.true religion jeans outlet Maintain a neutral grip with your hands on the golf club. If you grip the handle of your club too tightly, your shot will veer off towards the right. On the other hand, holding your golf club with a grip that is too loose will tend to send your ball towards the left. Use what directions your shots go to find the appropriate middle ground in your grip.Altering your stance by moving your front foot closer to where the ball is set will improve the way you slice the golf ball off the tee. With this adjustment and "closing" your stance, you'll be more likely to counteract the spin that sends the ball into a slice. You'll be better able to control the ball's trajectory so that it stays in the fairway.Don't worry about impressing other players with your clubs; instead, focus on getting a set that works well for you and helps you play your best game. To put this into perspective, early 20th century golfers used wooden clubs. Surely, titanium is nice, but it does not make or break your game.Implement what you've learned here to improve your overall game. Watch your scores improve as you practice what you just learned. You may even amaze that formerly unbeatable opponent with your new skill level. Use what you have learned to be successful in golf!

Im no Lawyer but my guess is yes, based on my pending divorce. I had some Whole Life Insurance policies that I purchased Prior to even dating my soon to be ex-wife and she is entitled to a large portion of the cash value these policies are worth because the cash value they accrued was gained mostly during the time we were married (31 yrs.). She also is entitled to half of every 401K and other investments I have, which seems unfair since I was 85% of our household income.

In turn, you are entitled to 1/2 her 401K and any other retirement funds she has unless they were given to her as an inheritance. I'm speaking to Louisiana Laws as I am not sure where you live.

A spouse in Florida may take what is known as a 30% "elective share" of the other spouse's estate, despite a will that leaves everything to others. The total assets that are added up as part of the "elective estate" can be more than what is included just in the probate case, such as property given away within one year of the spouse's death, and property in a living trust. You can find details by reading the Florida elective share law and by consulting with a Florida estate planning attorney.
