I was recently charged with injury to real property. I lived in a home that was completely dilapidated and on heir property. The house was vacant fro over 20 years and even had structural issues. I did ask for and receive permission from the family to repair the house and live in it. I spent almost 25K repairing this house when one day, one of the heirs said I needed to move out because I was not authorized to live there and I needed to leave all of the stuff I repaired because he had another family member he wanted to move into the house. I removed about 90% of the things I had repaired, including sheetrock on the walls, expensive light fixtures, kitchen cabinets and sinks, etc. I was later arrested for injury to real property because I took these things out of the house. I still have receipts for all the things I purchased and even for some of the labor I paid others to do. The person that took the warrant out on me does not own the property although he stated under oath that he was the owner. I never had a contract with teh family that stated I would repair the house then move out and leave it completely intact or any other type of contract. How is it I can be forced (by harassment) to move from a property that I clearly had permission to live in, then told I have to pay again for all the repairs that I originally made, then undid?

Theoretically, this might be prosecuted as perjury and punished with a fine of up to $15,000 or prison up to 7 years. It is more likely the judge would hold the person in contempt of court, in which case the judge has broad authority to decide on a suitable punishment. It could include monetary penalties or jail time. I hope this helps.
