While I cannot give you any legal advice and don't have the specific facts of your situation such as the state where you are employed, the general rule is that non-union employees do not have a right to an attorney at a disciplinary meeting, or to any specific documents such as complaints. You can try requesting a copy of your personnel file, but the employer will likely be allowed to remove any complaints from the file before turning it over. You should consult with an employment attorney to discuss your specific situation.

I have been accused of certain allegations and have been placed on adminastative leave. My Fire department does not have a Union, or collective bargaining agreement.

1) Can I be denied to have lawyer present to represent my interests?

2) Are they required to provide the statements of complaint to me so I can see the direct accusations, or are they only required to provide me the names of the accusers?

Thanks for any help.
