I am a professional Land Surveyor in the State of Indiana. I am performing a survey whereby I need to locate Public Land Survey Monuments (Section Corners) in order to comply with IN State Law (IAC Title 865 Aricle 1 Rule 12). Several property owners have tinstructed me to get off their property when I am within the roadway searching for and locating Section Corners. The property owners believe that because their legal descriptions run to Section Lines (which are someetimes in the center of the roadway) that they own the roadway and that I am trespassing by working in the roadway on their side of the Section Line. What does IN Law stipulate regarding prescritive roadway easements?? What rights does a Land Surveyor have regarding locating Section Corners located in the pavement of a Public Road??
