A spouse in Florida may take what is known as a 30% "elective share" of the other spouse's estate, despite a will that leaves everything to others. The total assets that are added up as part of the "elective estate" can be more than what is included just in the probate case, such as property given away within one year of the spouse's death, and property in a living trust.
