Key Elements of an Arbitration Agreement

While arbitration agreements can run to many pages, there are certain critical elements that should always be covered:
  • the scope what disputes are subject to arbitration
  • the arbitration organization that will used
  • whether either side is entitled to be reimbursed for filing costs and legal fees
  • the time in which an arbitration dispute must be filed
  • whether an arbitration decision can be appealed to another arbitrator or panel of arbitrators

Management at my company apparently does not like arbitration. We have grievances well over a year old. When our regional union rep calls our HR dept, she has to leave a message as their caller ID alerts HR as to who is calling. Our HR dept returns the calls AFTER normal buisness hours when the union rep is not in. We probably have 10 grievances that can be arbitrated right now. My question is: How can we force management to arbitrate in a timely manner?
