Simplified Probate for Small Estates in New Jersey

Written by Dianne Rosell, LawServer Attorney-Editor

In general, when someone dies, the estate must go through probate which can be a complicated and lengthy process. But many states provide less complicated options for smaller estates.

New Jersey law provides for simplified probate when the value of the real and personal assets of a decedent who dies with a will does not exceed $20,000, or $10,000 if the decedent leaves no surviving spouse or domestic partner.  The surviving spouse or domestic partner shall be entitled to all real and personal assets without administration of the estate, and up to $5,000 will be free from any debts of the decedent.
