Arizona Supreme Court Rejects Challenge to Green Energy Tariff

On September 23, the Arizona Supreme Court rejected a challenge by the Phoenix-based Goldwater Institute to the green energy tariff. The Goldwater Institute challenged the Arizona Corporation Commission's requirement that public utilities obtain at least 15 percent of their electricity from renewable sources by 2025.
The Commission approved a green energy tariff, in which residential APS customers can be charged a maximum of $1.32 a month.

On June 27, 2008, the Goldwater Institute filed a special action petition with the Arizona Supreme Court, challenging the Arizona Corporation Commission's ability to promulgate environmental regulations. Read the Press Release
