Statute 316.123. When does it not apply to an accident? The car crosses the intersection after stopping at a stop sign.

I would like to take a look at some Florida statutes regarding engagement rings. If a relationship ended with an engagement ring being presented does the ring get returned back to the man who presented it? What if the ring cost $14,000 and the female put in $400 of the money paid?

We live on a semi sharp corner and a friend comes over on weekends and parks at the foot of our driveway but happens to be in front of the neighbor's house. Our company's vehicle does not block the neighbor's driveway or mailbox and is always in the curb. Never have we littered nor do they ever walk in the neighbor's yard, but he is demanding we move or be sued. Can you please tell me of any laws that we may be breaking?

ladyjulie, Can you please give more details as to your question. I don't follow what you are asking. The statute you refer to is located here, so please add your question on that page. Thanks
There is no Florida statute dealing with return of engagement rings. This is a matter of case law (also known as judge-made law). In Florida, engagement rings are generally considered conditional gifts, so that the ring must be returned if the marriage does not take place. There are sometimes exceptions made where the fiance is the sole cause of the engagement being broken off.
I don't think the fact that the finacee contributed $400 is going to change the outcome.
Jen, If the road is a public road, then homeowners cannot "claim" certain parts of it as their own. It belongs to the municipal government, which may set regulations as to proper parking and post them on signs. In this case, unless there is a sign reading "Parking restricted to residents of [address of your neighbor]" then your neighbor is wrong.

I was stopped for a DUI in my driveway after cops followed me for .4 miles. Is that legal? Cop could have pulled me over anytime he wanted to. He said I swerved in the back roads when I wasn't. I was following the swerve in the road maintaining my lane. I pulled into the gas station .2 miles away. Cop still didn't pull me over after sitting for a few minutes. I decided to drive out of there and made it back to my place, looked back and the cop wasn't following me. Cop said in the report that he had followed me from the gas station and that I failed to pull over when he flashed his emergency lights. I looked back and the cop wasn't even pulling out of the gas station when I made the turn. He pulled me over because he got an anonymous tip that I was drinking. Is that even legal? I'm in Florida.

Michael, So a police officer receives a tip that you are driving drunk, follows your car and observes that you are swerving (though you deny it), and ignoring his flashing lights, then tickets you for DUI. What is it that you think might be illegal about this? Are you saying he should have ticketed you sooner, before you reached your driveway?

Hello, I was wondering if you could tell me anything about the current FL laws concerning smoke detectors in apartments? I feel silly but I just noticed, after living in our two-story town home for 10 months, that there is only 1 smoke detector. It is at the top of the stairs several feet outside each bedroom. Normally there is one in or just outside the kitchen as well, correct? (It seems to be one of those things that I am so used to seeing one by the kitchen that my brain assumes there is one.) I am trying to find the current laws myself but am having difficulty. Thank you for your time and any information you may have!
