Current as of: Dec. 2011 (1) “Department building” means any building or that portion of a building owned, leased, or rented by the Department. (2) “Non-smoker” means a person who is not a smoker. (3) “Smoker” means a person who uses a lighted tobacco product. (4) “Smoking” or “to smoke” means possession of a lighted cigarette, lighted cigar, lighted pipe, or any other lighted tobacco product, except temporarily possessing a tobacco product lighted by another for purposes of immediate extinguishment.
