Check for Updates to the Florida Statutes

The Florida Statutes as hosted by LawServer come from the Florida Legislature, and are updated when the Legislature updates its own version of the Code.  The Legislature does not immediately update the Code when a new law is enacted, however. So to bring your research up to the date it is sometimes necessary to look for laws enacted since the latest version of the Code was published. That information is available here.

Browse the Florida Statutes or search by keyword or section number.

I am a professional photographer. I went to my 3 year old niece's ballet recital. All patrons were allowed to take pictures. The only stipulation was that the patrons could not use flash. I payed $35 dollars to enter. I posted the images on Facebook and my sister sent the ballet company a link to the folder. They wrote her back asking me to take it down. I guess they look "Too Professional." What are my rights? I was allowed entrance to the recital. I showed the person at the door my camera. I never used flash. I am not promoting these pics for sale.
thanks,
Christian

Christian,
It sounds like the dance company considers your publication of the photographs on the Web to be outside the bounds of "fair use" under copyright law. "Fair use" is not always clear-cut, but in this case it seems to me that they might have some justification for insisting that the photos be taken down to protect their copyright. Taking a few snapshops for personal use in a family album is one thing. Publishing a "folder" on the Internet with professional high-res photographs arguably crosses the line. I don't think the fact that you were allowed to bring a camera and take pictures complete nullifies their case. It is what you did with the pictures that is more problematic.

Similar arguments come up with original paintings. High-quality, high-resolution images of a painting by someone, published on the Internet are more likely to land you in copyright trouble than a low-resolution amateurish snapshot you put in your scrapbook.

This should not be construed as legal advice. Consult an attorney.

William,
There are different definitions of "family" under Florida law but none of them would include two unrelated persons sharing living quarters.

My neighbor fires his weapons in his backyard, sometimes 100 rounds. The noise is terrible. We live in a residential area. The local s.o. says there in nothing they can do. I read 790.15 the 2011 addition, no help. Has that law changed?

Wynn,
I suggest you visit the local public library and check for local and county ordinances related to noise. Perhaps there is something in your favor that was overlooked by the Sheriff's office. If you come up with nothing, another avenue is to talk to neighbors and your local elected representatives about creating some kind of noise ordinance that would help you.

My question is: Are all residents of a mobile home park in FL required to follow the rules currently set in place? Just wanting to confirm that board members are not exempt from any rules OR can not enforce them when they see fit (specific day or time)?
