Nothing in the law prohibits a landlord from carrying out an otherwise proper eviction just because the tenant is incarcerated. A landlord might not even know that a tenant is incarcerated. Furthermore, a landlord could not reasonably be expected to hold rental property off the market indefinitely without receiving rent. Put another way, being incarcerated does not give one special privileges to free rental property.
