If a person is charged with the habitual offender but makes a deal for the habitual offender to be removed as part of a plea agreement and that person is givin a 5 yr sentance and sent to a half way house and leaves the half way house 3 weeks befor his or her release and that person decides to later take care of that charge is he or she still in violation of habitual offeneder
