Sec. 44.

(1) "Private driveway" means any piece of privately owned and maintained property which is used for vehicular traffic, but is not open or normally used by the public.

(2) "Private road" means a privately owned and maintained road, allowing access to more than 1 residence or place of business, which is normally open to the public and upon which persons other than the owners located thereon may also travel.

I parked on a private road, by a vacant piece of property that is for sale. My daughter and I were parking there, and then walking for exercise on the road. A homeowner approached us, asked what we were doing, and told us to leave. Does he have the right to do that?

He certainly has the right to tell you to leave, but whether you have to obey him is another story. It sounds like this homeowner was probably not the actual owner of the private road. He just owned a property served by the private road. If he thought you didn't belong, his recourse was to contact the owner of the private road and convince them to make you leave. The owner might be a homeowners' association or some other body, but homeowners cannot just presume to speak for that organization unless they have been authorized to do so. I hope this helps.

There is a private road across the street that is nice place to take a walk. But one day a maintance worker who was mowing along it yelled at me to leave and that it was illegal to walk on the road unless you lived there. So can you not walk on private roads?

While a private road is "normally" open to the public, this road might be closed to the public, in which case you should see signs to that effect. An example would be a private road into a gated community. The whole point of the gate is to keep the general public out and only allow residents, guests, etc.

we live on a private road/driveway and with two other property owners further up the drive who have easement rights. We own 60 feet on the other side of the drive. On the second lot, which is now vacant, there is a cut though in the woods, made by owners of property on another street. That cut through ends at our road and we are having problems with 3 and 4-wheel vehicles using our private drive as a playfield for their sporting fun. We and the two other residents are responsible for the upkeep of this drive/road. Is there any legal way we can we keep the 3 and 4 wheelers off our private drive/road?

I along with 12 other home owners live on a private road, and the road is marked private. The school bus stops on the county road at the end of our private road and picks up children from the surrounding area. There are no school children in any residence on our private road. The parents from the surrounding area drive into residents private driveways, using them as turnarounds and then park on both sides of the private road awaiting the bus. Many times knocking down roped off areas and driving on lawns. At times making it almost impossible for homeowners to access the county road. In order for a resident to access the county road we have to drive between two lines of vehicles, proceed slowly because the visibility is blocked by vehicles and natural growth. This is twice as complicated during winter months. I have contacted the school superintendant but as of today have no resolution. What recourse do we have as private property owners?

we too live on a private road i talked to the police and they said i couldnt put up no parking sign i think they are wrong i think i need to call my lawyer the school board wont move the bus stop at the end of the road cars park in are road and wont move and the police wont do anything

There is a school bus, an 18 wheeler and a business with two employees who cut across my drive to turn into the private road. Like a shortcut. What can I do about this activity. My concrete pipe which I own has cracked and my driveway is deterioting.

hi. Heres my mothers problem.. there is a road on their property.. Anyway it is a private property.. And she wanted that the city government will pay her.. By using the property an acces.. And if the city government wont pay.. She will close the road.. And ask payments ..

With this.. Imm worrying if shes right of what her decission. If not what shes goin to do? Anyway she think that because she already donated 5000 sq.meters for the school.. .
