  • Acquittal:
    1. Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
    2. A verdict of "not guilty."
     
  • activation: means a request by the emergency management coordinator appointed pursuant to section 8 or 9 of the emergency management act, 1976 PA 390, MCL 30. See Michigan Laws 418.161
  • Active duty: means active duty pursuant to an executive order of the president of the United States, an act of congress, or an order of the governor. See Michigan Laws 445.1012
  • Address: means the residence or principal business address of the person. See Michigan Laws 445.1
  • Adjacent area: means the area measured from the nearest edge of the right-of-way of an interstate highway, freeway, or primary highway and, in urbanized areas, extending 3,000 feet perpendicularly and then along a line parallel to the right-of-way line or, outside of urbanized areas, extending perpendicularly to the limit where a sign is visible and then along a line parallel to the right-of-way line.   • Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
  • Adjusted gross receipts: means the gross receipts less winnings paid to wagerers. See Michigan Laws 432.202
  • Adjusted gross receipts: means gross receipts less a deduction equal to the amount of free play provided and wagered by authorized participants as an incentive to place or as a result of placing internet wagers under this act. See Michigan Laws 432.303
  • Adjusted gross sports betting receipts: means gross sports betting receipts less a deduction for the monetary value of free play wagered by authorized participants as an incentive to place or as a result of their having placed internet sports betting wagers. See Michigan Laws 432.403
  • Administrator: means a third party other than the warrantor who is designated by the warrantor to be responsible for the administration of vehicle protection product warranties in this state. See Michigan Laws 257.1243
  • Administrator: means the secretary of state or any individual designated by the secretary of state to act in his or her place. See Michigan Laws 257.1302
  • Administrator: means the director of commerce or his or her designated representative. See Michigan Laws 429.31

  • Adult driver training: means instruction that is provided to an individual 18 years of age or older in the operation of a motor vehicle, other than a commercial motor vehicle as defined in section 7a of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 256.623
  • Adverse information: means information indicating that the cosigner has not complied with the contractual provisions of an obligation. See Michigan Laws 445.271
  • Advertise: means the use or dissemination of an advertising by a person that is subject to this act. See Michigan Laws 445.312
  • advertisement: means a communication or representation that is disseminated in any manner by any means for the purpose of inducing, or that is likely to induce, directly or indirectly, the purchase of a consumer item, good, merchandise, or commodity. See Michigan Laws 445.312
  • Advertising: means all printed matter, handouts, flyers, radio broadcasts, television broadcasts, signs, billboards, and other media used to promote an event. See Michigan Laws 432.102
  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Adviser: means a person who, at the request of the issuer, a confirmer, or another adviser, notifies or requests another adviser to notify the beneficiary that a letter of credit has been issued, confirmed, or amended. See Michigan Laws 440.5102
  • Affected municipality: means a city or village in which a proposed interstate highway route or alternate route would wholly or partly lie. See Michigan Laws 252.151
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Affiliate: means a person that, directly or indirectly, through 1 or more intermediaries, controls or is controlled by a sports betting operator. See Michigan Laws 432.403
  • Affiliate: means a person who, directly or indirectly, controls, is controlled by, or is under common control with; is in a partnership or joint venture relationship with; or is a co-shareholder of a corporation, co-member of a limited liability company, or co-partner in a limited liability partnership with a person who holds or applies for a race meeting or track license under this act. See Michigan Laws 431.302
  • Affiliate: means a person or group of persons that directly or indirectly through 1 or more intermediaries controls, is controlled by, or is under common control with another person and engaged in a business or transaction regulated by this act. See Michigan Laws 445.1651a
  • Affiliate: means a person who, directly or indirectly, through 1 or more intermediaries, controls a casino licensee under this act. See Michigan Laws 432.202
  • Affiliate: means a person who, directly or indirectly, through 1 or more intermediaries, controls, is controlled by, or is under common control with; is in a partnership or joint venture relationship with; or is a co-shareholder of a corporation, a co-member of a limited liability company, or co-partner in a limited liability partnership with a person who holds or applies for a casino license under this act. See Michigan Laws 432.272
  • Affiliate: means a person that, directly or indirectly, through 1 or more intermediaries, controls or is controlled by an internet gaming operator. See Michigan Laws 432.303
  • Affiliated company: means any form of business organization that controls, a casino licensee under this act. See Michigan Laws 432.202
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • after-tax average weekly wage: means average weekly wage as defined in section 371 reduced by the prorated weekly amount which would have been paid under the federal insurance contributions act, 26 U. See Michigan Laws 418.313
  • Aftermarket crash part: means a replacement part for a nonmechanical sheet metal part or plastic part that constitutes part of the exterior of a motor vehicle, including, but not limited to, an inner or outer panel. See Michigan Laws 257.1362
  • Agency: means a department, board, commission, office, agency, authority, or other unit of state government of this state. See Michigan Laws 445.63
  • Agent: means an individual who, for compensation or valuable consideration, is employed either directly or indirectly by a dealer. See Michigan Laws 257.1351
  • Agent: means any person who is employed by any agency of this state, other than the board, the state police, or the department of attorney general, who is assigned to perform full-time services on behalf of or for the benefit of the board regardless of the title or position held by that person. See Michigan Laws 432.202
  • Agent or employee: means a person who, for compensation or valuable consideration, is employed either directly or indirectly by a dealer. See Michigan Laws 445.482
  • Agent orange: means that term as defined in section 5701 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 421.151
  • Aggrieved party: means a party entitled to resort to a remedy. See Michigan Laws 440.1201
  • agreement: means an instrument prescribing the terms of home improvement charge sales, whether secured or unsecured, which may be made under the agreement from time to time and under the terms of which a time price differential is to be computed in relation to the buyer's unpaid balance from time to time. See Michigan Laws 445.1102
  • Agreement: means a written, oral, or implied contract, sales agreement, security agreement, or franchise agreement between a supplier and a dealer by which the dealer is authorized to engage in the business of the retail sale and service, wholesale sale and service, or the distribution of tractors and equipment as an authorized outlet of the supplier or in accordance with methods and procedures provided for or prescribed by the supplier. See Michigan Laws 445.1452
  • Alcohol: means the product of distillation of fermented liquid, whether or not rectified or diluted with water, but does not mean ethyl or industrial alcohol, diluted or not, that has been denatured or otherwise rendered unfit for beverage purposes. See Michigan Laws 436.1105
  • Alcohol vapor device: means any device that provides for the use of air or oxygen bubbled through alcoholic liquor to produce a vapor or mist that allows the user to inhale this alcoholic vapor through the mouth or nose. See Michigan Laws 436.1105
  • Alcoholic liquor: means any spirituous, vinous, malt, or fermented liquor, powder, liquids, and compounds, whether or not medicated, proprietary, patented, and by whatever name called, containing 1/2 of 1% or more of alcohol by volume that are fit for use for food purposes or beverage purposes as defined and classified by the commission according to alcoholic content as belonging to 1 of the varieties defined in this chapter.   • Allegation: something that someone says happened.
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • American aircraft: means an aircraft registered under the laws of the United States. See Michigan Laws 421.56
  • American vessel: as used in this act means a vessel documented or numbered under the laws of the United States, or a vessel which is neither documented nor numbered under the laws of the United States nor documented under the laws of any foreign country, if its crew is employed solely by 1 or more citizens or residents of the United States or corporations organized under the laws of the United States or of any state. See Michigan Laws 421.56
  • Amortization: Paying off a loan by regular installments.
  • Animals: means cattle, horses, sheep, swine, mules, burros, or goats. See Michigan Laws 433.11
  • annual meeting: when applied to townships, mean the annual meeting required by law to be held on the Saturday immediately preceding the first Monday in April. See Michigan Laws 8.3d
  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Appliance: means a refrigerator, dehumidifier, freezer, oven, range, microwave oven, washer, dryer, dishwasher, trash compactor, or window room air conditioner. See Michigan Laws 445.832
  • Appliance: means an item of equipment which provides heating, cooling, cleaning, washing, drying, entertainment, or other services by converting energy in the form of fossil fuels or electricity into thermal energy or work and is generally used in or around a permanent or temporary household or residence, or in a commercial establishment. See Michigan Laws 429.351
  • Applicant: means a person that applies for a license or for registration under this act. See Michigan Laws 432.403
  • Applicant: means a person at whose request or for whose account a letter of credit is issued. See Michigan Laws 440.5102
  • Applicant: means the person filing an application for registration of a trademark or service mark under this act, his or her legal representatives, successors, or assigns. See Michigan Laws 429.31
  • Applicant: means any person who applies for a license or for registration under this act. See Michigan Laws 432.202
  • Applicant: means a person that applies for a license or for registration under this act. See Michigan Laws 432.303
  • Appraisal: A determination of property value.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Approved educational institution: means a school, academy, or other similar establishment approved by the administrator under section 13a to provide training to mechanics or mechanical trainees under this act. See Michigan Laws 257.1302
  • Approved laboratory: means a laboratory that has been evaluated by the department and is approved to perform tests on manufacturing milk and milk products. See Michigan Laws 288.570
  • Approved tasting room: means a tasting room that is approved by the commission. See Michigan Laws 436.1105
  • Armed forces: means that term as defined in section 2 of the veteran right to employment services act, 1994 PA 39, MCL 35. See Michigan Laws 445.1012
  • Arraignment: A proceeding in which an individual who is accused of committing a crime is brought into court, told of the charges, and asked to plead guilty or not guilty.
  • Arrest: Taking physical custody of a person by lawful authority.
  • Art dealer: means a person engaged in the business of selling works of fine art, other than a person exclusively engaged in the business of selling goods at public auction. See Michigan Laws 442.311
  • Art merchant: means a person who deals in works of fine art or by his occupation holds himself out as having knowledge or skill peculiar to works of fine art or to whom such knowledge or skill may be attributed by his employment of an agent or broker or other intermediary who by his occupation holds himself out as having such knowledge or skill. See Michigan Laws 442.321
  • Art merchant: means a person who deals in multiples, or who by his or her occupation holds himself or herself out as having knowledge or skill peculiar to a person who deals in multiples, or who employs a broker, agent, or other intermediary who holds himself or herself out as having knowledge or skill peculiar to a person who deals in multiples. See Michigan Laws 442.351a
  • Artist: means the creator of a work of fine art or, if the creator is deceased, the creator's heirs or personal representatives. See Michigan Laws 442.311
  • Artist: means the creator of an image depicted by or in a master. See Michigan Laws 442.351a
  • Asbestos: means chrysotile, amosite, crocidolite, tremolite asbestos, anthophyllite asbestos, actinolite asbestos, asbestiform winchite, asbestiform richterite, asbestiform amphibole minerals, and any of these minerals that have been chemically treated or altered. See Michigan Laws 600.3011
  • Asbestos action: means a claim for damages or other civil or equitable relief presented in a civil action that arises out of, is based on, or is related to the health effects of exposure to asbestos, and any other derivative claim made by or on behalf of an individual exposed to asbestos or a representative, spouse, parent, child, or other relative of the individual. See Michigan Laws 600.3011
  • Asbestos trust: means a government-approved or court-approved trust, qualified settlement fund, compensation fund, or claims facility that is created as a result of an administrative or legal action, a court-approved bankruptcy, or under 11 USC 524(g), 11 USC 1121(a), or another applicable provision of law and that is intended to provide compensation to claimants arising out of, based on, or related to the health effects of exposure to asbestos. See Michigan Laws 600.3011
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Assignment: means any written stock power, bond power, bill of sale, deed, declaration of trust or other instrument of transfer. See Michigan Laws 441.101
  • Assumed: means transfers of real property subject to a real property loan by assumptions, land contracts, wrap-around loans, or transfers subject to the mortgage or similar lien, and other like transfers. See Michigan Laws 445.1621
  • Athletic event: means a sports activity that involves the athletic skill of 1 or more players or participants. See Michigan Laws 432.403
  • Athletic event: means a real world professional, collegiate, or nationally recognized sports game, contest, or competition that involves the physical exertion and skill of the participating individual athletes, as to which each participant is physically present at the location in which the sports game, contest, or competition occurs, and the outcome of the sports game, contest, or competition is directly dependent on the performance of the participating athletes. See Michigan Laws 432.502
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Attachments: means machinery or any part of a piece of machinery designed to be used on or in conjunction with farm tractors, farm equipment, utility tractors, and utility equipment. See Michigan Laws 445.1452
  • Attorney-at-law: A person who is legally qualified and licensed to practice law, and to represent and act for clients in legal proceedings.
  • Authority: means the international bridge authority of Michigan created by section 2 of 1935 PA 237, MCL 254. See Michigan Laws 254.221
  • authority: shall mean the Mackinac bridge authority herein created. See Michigan Laws 254.301
  • Authority: means the Mackinac bridge authority created in 1950 (Ex Sess) PA 21, MCL 254. See Michigan Laws 254.311
  • Authorized distribution agent: means a person approved by the commission to do 1 or more of the following:
  (a) To store spirits owned by a supplier of spirits or the commission. See Michigan Laws 436.1105
  • Authorized local official: means a police officer or other personnel of a county, city, village, township, or regional parks and recreation commission created under section 2 of 1965 PA 261, MCL 46. See Michigan Laws 600.8701
  • Authorized participant: means an individual who has a valid internet sports betting account with a sports betting operator and is at least 21 years of age. See Michigan Laws 432.403
  • Authorized participant: means an individual who has a valid internet wagering account with an internet gaming operator and is 21 years of age or older. See Michigan Laws 432.303
  • authorship: refers to the creator of a work of fine art or to the period, culture, source or origin with which the creation of the work is identified in the description of the work. See Michigan Laws 442.321
  • Automated payment: means an electronic payment method authorized by the state court administrative office at the direction of the supreme court, including, but not limited to, payments made with credit and debit cards. See Michigan Laws 600.1985
  • Automated recycling kiosk: means an interactive device that meets all of the following:
  •   (i) Is installed in a secure retail space. See Michigan Laws 445.403
  • Automatic checkout system: means an electronic device, computer, or machine that determines the price of a consumer item by using a product identity code. See Michigan Laws 445.312
  • Automobile graveyard: means any establishment or place of business which is maintained, used or operated for storing, keeping, buying or selling wrecked, scrapped, ruined or dismantled motor vehicles or motor vehicle parts. See Michigan Laws 252.201
  • Automobile or light truck: means a motor vehicle that has a gross vehicle weight rating of less than 14,000 pounds. See Michigan Laws 257.1302
  • Automotive recycler: means a person that engages in business primarily for the purpose of selling retail salvage vehicle parts and secondarily for the purpose of selling retail salvage motor vehicles or manufacturing or selling a product of gradable scrap metal or a person employed as a salvage vehicle agent as that term is defined in section 56c of the Michigan vehicle code, 1949 PA 300, MCL 257.   • average weekly wage: means the weekly wage earned by the employee at the time of the employee's injury in all employment, inclusive of overtime, premium pay, and cost of living adjustment, and exclusive of any fringe or other benefits which continue during the disability. See Michigan Laws 418.371
  • BAIID: means that term as defined in section 20d of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 257.1302
  • BAIID mechanic: means a specialty mechanic who holds a certification from the department under section 10 to perform BAIID service. See Michigan Laws 257.1302
  • BAIID service: means the installation, removal, repair, or other servicing of breath alcohol ignition interlock devices. See Michigan Laws 257.1302
  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • Bailiff: a court officer who enforces the rules of behavior in courtrooms.
  • Balance: means :
  •   (1) As applied to an employer's experience account or to the nonchargeable benefits account, the initial balance of that account plus the credits and minus the charges that are made in accordance with this act. See Michigan Laws 421.18
  • Bank: means a person engaged in the business of banking and includes a savings bank, savings and loan association, credit union, and trust company. See Michigan Laws 440.1201
  • Banking institution: means a bank, bank and trust company, trust company, savings bank, private bank, or a national banking association, organized and doing business under the provisions of any law of this state, or of any other state of the United States, or under the provisions of any law of the United States of America. See Michigan Laws 445.1102
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Bar: means a barrier or counter at which alcoholic liquor is sold to, served to, or consumed by customers. See Michigan Laws 436.1105
  • Bargaining representative: means a labor organization recognized by an employer or certified by the commission as the sole and exclusive bargaining representative of certain employees of the employer. See Michigan Laws 423.201
  • Bed and breakfast: means that term as defined in section 4b of the Stille-DeRossett-Hale single state construction code act, 1972 PA 230, MCL 125. See Michigan Laws 427.301
  • Beer: means a beverage obtained by alcoholic fermentation of an infusion or decoction of barley, malt, hops, sugar, or other cereal in potable water. See Michigan Laws 436.1105
  • Behind-the-wheel instruction: means instruction to which either of the following applies:
  •   (i) A student is in control of a motor vehicle on a public street or highway in real and varied traffic situations and a driver education instructor is the only other occupant in the front passenger seating area with the student. See Michigan Laws 256.623
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Beneficiary: means a person who under the terms of a letter of credit is entitled to have its complying presentation honored. See Michigan Laws 440.5102
  • Benefit year: means any consecutive 12-month period used by an employer to calculate an eligible employee's benefits. See Michigan Laws 408.962
  • Beverage: means a soft drink, soda water, carbonated natural or mineral water, or other nonalcoholic carbonated drink; beer, ale, or other malt drink of whatever alcoholic content; or a mixed wine drink or a mixed spirit drink. See Michigan Laws 445.571
  • Beverage container: means an airtight metal, glass, paper, or plastic container, or a container composed of a combination of these materials, which, at the time of sale, contains 1 gallon or less of a beverage. See Michigan Laws 445.571
  • Beverage container: means that term as defined in section 1 of the beverage container law, MCL 445. See Michigan Laws 445.653

  • Bingo: means a game of chance commonly known as bingo in which prizes are awarded on the basis of designated numbers or symbols conforming to numbers or symbols selected at random. See Michigan Laws 432.102
  • Blended rate period: means a period of time commencing on the date that a residential window period loan contract is amended as provided in Section 4 and ending either on a date selected by the lender at least 3 years after the period commences or on the date the loan was originally scheduled to become due and payable in full, whichever date is earlier.   • Board: means the Michigan gaming control board created by section 4 of the Michigan gaming control and revenue act, 1996 IL 1, MCL 432. See Michigan Laws 432.102

  • Board: means the Michigan gaming control board created under section 4 of the Michigan Gaming Control and Revenue Act, 1996 IL 1, MCL 432. See Michigan Laws 432.502
  • Board: means the highway location arbitration board. See Michigan Laws 252.151
  • Board: means the mortgage industry advisory board created in section 33. See Michigan Laws 445.1651a

  • Bona fide member: means a member who participates in the qualified organization to further its lawful purposes and the spouse of such a member. See Michigan Laws 432.132
  • Bona fide purchaser: means a person who in good faith makes a purchase without notice of any outstanding rights of others. See Michigan Laws 442.311
  • bonds: means all bonds authorized to be issued by this act. See Michigan Laws 254.311
  • bottling: means a process, separate from manufacturing, using owned or leased equipment to fill and seal a container, including a keg, with alcoholic liquor for sale at wholesale or retail in accordance with this act. See Michigan Laws 436.1105
  • Branch: includes a separately incorporated foreign branch of a bank. See Michigan Laws 440.1201
  • Brand: means any word, name, group of letters, symbol, trademark, or combination thereof adopted and used by a supplier to identify a specific beer, malt beverage, wine, mixed wine drink, or mixed spirit drink product and to distinguish that product from another beer, malt beverage, wine, mixed wine drink, or mixed spirit drink product that is produced or marketed by that or another supplier. See Michigan Laws 436.1105
  • Brand extension: means any brand that incorporates all or a substantial part of the unique features of a preexisting brand, regardless of whether the extension is beer, wine, mixed wine drink, or mixed spirit drink. See Michigan Laws 436.1105
  • Brandy: means an alcoholic liquor as defined in 27 C. See Michigan Laws 436.1105
  • Brandy manufacturer: means a wine maker or a small wine maker licensed under this act to manufacture brandy. See Michigan Laws 436.1105
  • Breaks: means the cents over any multiple of 10 otherwise payable to a patron on a wager of $1. See Michigan Laws 431.302
  • Brewer: means a person located in this state that is licensed to manufacture beer and sell at retail in accordance with section 537 and to licensed wholesalers beer manufactured by the person. See Michigan Laws 436.1105
  • Brewpub: means a license issued in conjunction with a class C, tavern, class A hotel, or class B hotel license that authorizes the person licensed with the class C, tavern, class A hotel, or class B hotel to manufacture and brew not more than 18,000 barrels of beer per calendar year in this state and sell at its licensed premises the beer produced for consumption on or off the licensed brewery premises in the manner provided for in sections 405, 407, and 537. See Michigan Laws 436.1105
  • bridge: shall mean the project for the acquisition of which this act is adopted and shall mean a bridge or structure extending from the upper peninsula to the lower peninsula of Michigan, and shall be understood to include all of the following forming any part thereof or connected with or used or useful in the operation thereof: causeways, bridges, tunnels, roads, fills and approaches, or any combination thereof, parking space and facilities, park and recreation facilities, lighting facilities, terminal facilities, consisting of areas, structures and buildings in which rest rooms, waiting rooms, restaurant and similar facilities and other accommodations for the traveling public may be installed, including all fixtures, utility lines, accessories and equipment relating to any or all of the above, and including the improvement and beautification of such terminal areas at each end of the structure as may be designed to increase the use thereof, and including in all of the foregoing all real and personal property, tangible or intangible, licenses, franchises, easements and rights-of-way necessary thereto. See Michigan Laws 254.301
  • Bridge: means the project for the acquisition of which this act is adopted and means a bridge or structure extending from the Upper Peninsula to the Lower Peninsula of Michigan, and includes all of the following forming any part of the bridge or connected with or used or useful in the operation of the bridge, causeways, bridges, tunnels, roads, fills and approaches, or any combination thereof, parking space and facilities, park and recreation facilities, lighting facilities, terminal facilities consisting of areas, structures, and buildings in which rest rooms, waiting rooms, restaurant and similar facilities, and other accommodations for the traveling public may be installed, including all fixtures, utility lines, accessories, and equipment relating to any or all of the above, and including the improvement and beautification of terminal areas at each end of the structure as may be designed to increase the use of the structure, and including all real and personal property, tangible or intangible, licenses, franchises, easements, and rights-of-way necessary thereto. See Michigan Laws 254.311
  • Budget authority: Authority provided by law to enter into obligations that will result in outlays of Federal funds. Budget authority may be classified by the period of availability (one-year, multiyear, no-year), by the timing of congressional action (current or permanent), or by the manner of determining the amount available (definite or indefinite).
  • Bulk milk pickup tanker: means a vehicle including a truck, tank, and those appurtenances necessary for its use used by a bulk milk hauler/sampler to transport bulk raw milk for pasteurization from a dairy farm to a dairy plant, receiving station, or transfer station. See Michigan Laws 288.571
  • Bureau: means the bureau of state lottery as created by section 5 of the McCauley-Traxler-Law-Bowman-McNeely lottery act, 1972 PA 239, MCL 432. See Michigan Laws 432.102
  • Bureau: means the bureau of state lottery created by this act. See Michigan Laws 432.3
  • Business area: means an adjacent area that is zoned by a state, county, township, or municipal zoning authority for industrial or commercial purposes, customarily referred to as "b" or business, "c" or commercial, "i" or industrial, "m" or manufacturing, and "s" or service, and all other similar classifications and that is within a city, village, or charter township or is within 1 mile of the corporate limits of a city, village, or charter township or is beyond 1 mile of the corporate limits of a city, village, or charter township and contains 1 or more permanent structures devoted to the industrial or commercial purposes described in this subdivision and that extends along the highway a distance of 800 feet beyond each edge of the activity. See Michigan Laws 252.302
  • Business day: means Monday through Friday and does not include Saturday, Sunday, or the following business holidays: New Year's day, Martin Luther King's birthday, Washington's birthday, Memorial day, Independence day, Labor day, Columbus day, Veterans' day, Thanksgiving day, and Christmas day. See Michigan Laws 445.111
  • Business entity: means a corporation, trust, estate, partnership, cooperative, or association or a natural person who furnishes to the extender of the credit a sworn statement in writing specifying the type of business and business purpose for which the proceeds of the loan or other extension of credit will be used. See Michigan Laws 438.61
  • business opportunity: means the sale or lease of any products, equipment, supplies, or services for the purpose of enabling the purchaser to start a business, and in which the seller represents 1 or more of the following:
  •   (i) That the seller will provide locations or assist the purchaser in finding locations for the use or operation of vending machines, racks, display cases, or other similar devices, or currency operated amusement machines or devices, on premises neither owned nor leased by the purchaser or seller. See Michigan Laws 445.902
  • Butter: means the product usually known as butter that is made exclusively from wholesome milk or cream, or both, with or without common salt, and with or without additional coloring matter and containing not less than 80% by weight of milk fat. See Michigan Laws 288.571
  • buyer: means a person that buys or agrees to buy goods or obtain services or agrees to have services rendered or furnished from a retail seller. See Michigan Laws 445.852
  • buyer: means a person who buys goods and services, or services from a contractor pursuant to a home improvement installment contract, or goods and services from a contractor pursuant to a home improvement charge agreement. See Michigan Laws 445.1102
  • Carbonic gas: means carbon dioxide. See Michigan Laws 429.111
  • Carnival or amusement ride: means a device that carries or conveys passengers along, around, or over a fixed or restricted route or course for the purpose of giving its passengers amusement, pleasure, thrills, or excitement. See Michigan Laws 408.652
  • Carrier: means a self-insurer or an insurer. See Michigan Laws 418.601
  • Carrier pigeon: means homing and racing pigeons which have the name of the owner stamped upon the wing or tail, or are banded upon the leg with the name or initials of the owner or with an identification or registration number stamped on the band. See Michigan Laws 433.351
  • Cash price: means the cash sales price stated in a home improvement installment contract, or the cash sales price of goods and services that are the subject of a home improvement charge sale, for which the contractor would sell or furnish to the buyer and the buyer would buy or obtain from the contractor the goods and services which are the subject of the contract or home improvement charge sale, if the sale were a sale for cash, instead of a home improvement installment sale or home improvement charge sale, and may include any taxes. See Michigan Laws 445.1102
  • Cash sale price: means the price of a good or service a retail buyer would pay if he or she paid for the good or service in cash, and that is stated in a retail installment contract or in a sales slip or other memorandum furnished by a retail seller to a retail buyer pursuant to a retail charge agreement for that good or service. See Michigan Laws 445.852
  • Casino: means a building or buildings in which gaming is lawfully conducted under the Michigan Gaming Control and Revenue Act, 1996 IL 1, MCL 432. See Michigan Laws 432.403
  • Casino: means a building or buildings in which gaming is conducted. See Michigan Laws 432.202
  • Casino: means a building in which gaming is conducted. See Michigan Laws 432.252
  • Casino: means a building or buildings in which gaming is lawfully conducted under the Michigan Gaming Control and Revenue Act, 1996 IL 1, MCL 432. See Michigan Laws 432.303
  • Casino enterprise: means the buildings, facilities, or rooms functionally or physically connected to a casino, including but not limited to any bar, restaurant, hotel, cocktail lounge, retail establishment, or arena or any other facility located in a city under the control of a casino licensee. See Michigan Laws 432.202
  • Casino enterprise: means the buildings, facilities, or rooms functionally or physically connected to a casino, including but not limited to any bar, restaurant, hotel, cocktail lounge, retail establishment, or arena, or any other facility located in a city under the control of a casino licensee or an affiliate of a casino licensee company. See Michigan Laws 432.272
  • casino gaming: means to deal, operate, carry on, conduct, maintain or expose or offer for play any gambling game or gambling operation. See Michigan Laws 432.202
  • Caucus: From the Algonquian Indian language, a caucus meant "to meet together." An informal organization of members of the legislature that exists to discuss issues of mutual concern and possibly to perform legislative research and policy planning for its members. There are regional, political or ideological, ethnic, and economic-based caucuses.
  • Certificate: means documentation issued by the certifying agency to an individual who is vocationally disabled. See Michigan Laws 418.901
  • Certified development agreement: means a development agreement that has been certified by a city and submitted to the board. See Michigan Laws 432.202
  • Certifying agency: means the division of vocational rehabilitation of the department of education. See Michigan Laws 418.901
  • Chairperson: means the chairperson of the board. See Michigan Laws 432.202
  • Chambers: A judge's office.
  • Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
  • Charity game: means the random resale of a series of charity game tickets. See Michigan Laws 432.102
  • Charity game ticket: means a ticket commonly referred to as a break-open ticket or pull-tab that is approved and acquired by the bureau and is distributed and sold by the bureau or a supplier to a qualified organization, a portion of which is removed to discover whether the ticket is a winning ticket. See Michigan Laws 432.102
  • Cheese: means natural cheeses, processed cheeses, blended cheeses, cheese foods, cheese spreads, nonstandard cheese products, and related foods described in 21 C. See Michigan Laws 288.571
  • Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority.
  • Child or spousal support: means support for a child or spouse, paid or provided pursuant to state or federal law under a court order or judgment. See Michigan Laws 445.63
  • Child or spousal support: means support for a child or spouse, paid or provided pursuant to state or federal law under a court order or judgment. See Michigan Laws 445.82
  • Citation: means a written complaint or notice to appear in court upon which an authorized local official records the occurrence or existence of 1 or more municipal civil infractions by the person cited. See Michigan Laws 600.8701
  • Citation: means a written complaint or notice to appear in court upon which a law enforcement officer records the occurrence or existence of 1 or more state civil infractions by the person cited. See Michigan Laws 600.8801
  • City: means a local unit of government other than a county that meets all of the following criteria:
  •   (i) Has a population of at least 800,000 at the time a license is issued. See Michigan Laws 432.202
  • Civil action: means an action that is not a criminal case, a civil infraction action, a proceeding commenced in the probate court under section 3982 of the estates and protected individuals code, 1988 PA 386, MCL 700. See Michigan Laws 600.1985
  • Civil action concerning prison conditions: means any civil proceeding seeking damages or equitable relief arising with respect to any conditions of confinement or the effects of an act or omission of government officials, employees, or agents in the performance of their duties, but does not include proceedings challenging the fact or duration of confinement in prison, or parole appeals or major misconduct appeals under section 34 or section 55 of 1953 PA 232, MCL 791. See Michigan Laws 600.5531
  • Civil air patrol: means the civilian auxiliary of the United States Air Force. See Michigan Laws 408.921
  • Civil infraction: means an act or omission that is prohibited by a law and is not a crime under that law or that is prohibited by an ordinance, as defined in section 8701, and is not a crime under that ordinance, and for which civil sanctions may be ordered. See Michigan Laws 600.113
  • Civil infraction action: means a civil action in which the defendant is alleged to be responsible for a civil infraction. See Michigan Laws 600.113
  • Civil violation: means a violation of a law of this state or a local ordinance, other than a criminal offense or a violation that is defined or designated as a civil infraction, that is punishable by a civil fine or forfeiture under the applicable law or ordinance. See Michigan Laws 600.4801
  • Claim of beneficial interest: means a claim of any interest by a decedent's legatee, distributee, heir or creditor, a beneficiary under a trust, a ward, a beneficial owner of a security registered in the name of a nominee, or a minor owner of a security registered in the name of a custodian, or a claim of any similar interest, whether the claim is asserted by the claimant or by a fiduciary or by any other authorized person on his behalf, and includes a claim that the transfer would be in breach of fiduciary duties. See Michigan Laws 441.101
  • Class III gaming: means that term as defined in 25 USC 2703. See Michigan Laws 432.303
  • Class of appliances: means a group of appliances whose functions or features are similar, and whose range of energy use or energy efficiency may be of interest to consumers. See Michigan Laws 429.351
  • Classroom instruction: means that part of a driver education course that occurs in a classroom environment that enables a student to learn through varied instructional methods, under the direct guidance of a driver education instructor. See Michigan Laws 256.623
  • Clearinghouse: means the youth employment clearinghouse created in section 3. See Michigan Laws 409.202
  • Clerk: means the clerk of the court referenced in the rules of the supreme court and includes the clerk of the supreme court, chief clerk of the court of appeals, county clerk, probate register, district court clerk, or clerk of the court of claims where the civil action is commenced, as applicable. See Michigan Laws 600.1985
  • Clerk of court: An officer appointed by the court to work with the chief judge in overseeing the court's administration, especially to assist in managing the flow of cases through the court and to maintain court records.
  • Close contact: means that term as defined in the United States Centers for Disease Control and Prevention's guidelines regarding COVID-19 at the time the contact occurred. See Michigan Laws 419.401
  • Co-occurring disorder: means having 1 or more disorders relating to the use of alcohol or other controlled substances of abuse as well as any serious mental illness, serious emotional disturbance, or developmental disability. See Michigan Laws 600.1090
  • Co-occurring disorder: means having 1 or more disorders relating to the use of alcohol or other controlled substances of abuse as well as any serious mental illness, serious emotional disturbance, or developmental disability. See Michigan Laws 600.1099b
  • Codicil: An addition, change, or supplement to a will executed with the same formalities required for the will itself.
  • Collateral costs: means expenses incurred by a consumer in connection with the repair of a nonconformity in a wheelchair, including the cost of an alternative wheelchair or other assistive device or service for mobility. See Michigan Laws 445.1081
  • Collectible currency: means a medium of exchange including coins, bank notes, government notes, and paper money that has a value greater than face value. See Michigan Laws 434.21
  • Collection action: means requesting a cosigner to pay all or part of the obligation. See Michigan Laws 445.271
  • Collection agency: means a person that is directly engaged in collecting or attempting to collect a claim owed or due or asserted to be owed or due another, or repossessing or attempting to repossess a thing of value owed or due or asserted to be owed or due another person, arising out of an expressed or implied agreement. See Michigan Laws 445.251
  • Commercial vehicle driver training: means instruction equivalent to or exceeding entry-level driver training in 49 C. See Michigan Laws 256.623
  • Commission: means the Michigan liquor control commission. See Michigan Laws 445.571
  • Commission: means the fee, compensation, or percentage of actual selling price of a work of fine art, agreed upon by the artist and art dealer, which the art dealer may retain after sale of the artist's work of fine art to a third party. See Michigan Laws 442.311
  • Commission: means the employment relations commission created by section 3. See Michigan Laws 423.2
  • Commission: means the employment relations commission created in section 3 of 1939 PA 176, MCL 423. See Michigan Laws 423.201
  • Commission: means the Michigan public service commission. See Michigan Laws 429.351
  • Commission: means the state highway commission or its designated representative. See Michigan Laws 252.151

  • commission: shall mean the state bridge commission hereinafter created, or, if said state bridge commission shall be abolished, any board or officer succeeding to the principal functions thereof or upon whom the powers given by this act to said commission shall be given by law.   • Commissioner: means the department of labor and economic opportunity. See Michigan Laws 408.1101

  • Commissioner: means the commissioner of state lottery. See Michigan Laws 432.3
  • Commissioner: means the director of commerce or an authorized representative of the director. See Michigan Laws 408.322
  • Commissioner: means the director of the department of licensing and regulatory affairs. See Michigan Laws 408.412
  • Committee: means the Michigan civilian conservation corps partnership steering committee created in section 22. See Michigan Laws 409.321
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Community foundation: means an organization that meets all of the following requirements:
  •   (i) Has been in existence for at least 10 years. See Michigan Laws 128.3
  • Community-based organization: means a private, nonprofit organization that is representative of a community or of a significant segment of a community and which provides employment and job training services. See Michigan Laws 421.151
  • Compact: means a tribal-state compact governing the conduct of gaming activities in this state that is negotiated under the Indian gaming regulatory act, Public Law 100-497, 102 Stat 2467. See Michigan Laws 432.403
  • Compact: means a tribal-state compact governing the conduct of gaming activities that is negotiated under the Indian gaming regulatory act, Public Law 100-497, 102 Stat 2467. See Michigan Laws 432.303
  • Company: means a sole proprietorship, corporation, partnership, limited liability partnership, limited liability company, trust, association, joint stock company, joint venture, tribal corporation, or other form of business organization. See Michigan Laws 432.202
  • Company union: includes any employee association, committee, agency, or representation plan, formed or existing for the purpose, in whole or in part, of dealing with employers concerning grievances or terms and conditions of employment, which in any manner or to any extent, and by any form of participation, interference, or assistance, financial or otherwise, either in its organization, operation, or administration, is dominated or controlled, sponsored or supervised, maintained, directed, or financed by the employer. See Michigan Laws 423.2
  • Compensation: means any money, thing of value, or financial benefit conferred on or received by a person in return for services rendered, or to be rendered, whether by that person or another. See Michigan Laws 432.202
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Comprehensive job training and related services: includes recruitment, counseling, motivational prejob training, vocational training, job development, job placement, and other appropriate services enabling individuals to secure and retain employment at their maximum capacity. See Michigan Laws 421.151
  • Computation date: means June 30 of each year. See Michigan Laws 421.18
  • Concurrent resolution: A legislative measure, designated "S. Con. Res." and numbered consecutively upon introduction, generally employed to address the sentiments of both chambers, to deal with issues or matters affecting both houses, such as a concurrent budget resolution, or to create a temporary joint committee. Concurrent resolutions are not submitted to the President/Governor and thus do not have the force of law.
  • Confidential telephone record: means any of the following:
  •   (i) Information that relates to the quantity, technical configuration, type, destination, location, and amount of use of a service offered by a telecommunication provider subscribed to by any customer of that telecommunication provider. See Michigan Laws 445.65a
  • Confirmer: means a nominated person who undertakes, at the request or with the consent of the issuer, to honor a presentation under a letter of credit issued by another. See Michigan Laws 440.5102
  • Conflict of interest: means a situation in which the private interest of a member, employee or agent of the board may influence the judgment of the member, employee, or agent in the performance of his or her public duty under this act. See Michigan Laws 432.202
  • Consent decree: means any relief entered by the court that is based in whole or in part upon the consent or acquiescence of the parties but does not include private settlements. See Michigan Laws 600.5531
  • Consignor: means a person who delivers or causes to be delivered a work of fine art to an art dealer on consignment. See Michigan Laws 442.311
  • Construction mechanic: means a skilled or unskilled mechanic, laborer, worker, helper, assistant, or apprentice working on a state project but shall not include executive, administrative, professional, office, or custodial employees. See Michigan Laws 408.1101
  • Consumer: means 1 or more of the following:
  •   (i) A person who purchases or leases a new motor vehicle for personal, family, or household use and not for the purpose of selling or leasing the new motor vehicle to another person. See Michigan Laws 257.1401
  • Consumer: means any of the following:
  •   (i) The purchaser of a wheelchair, if the wheelchair was purchased from a wheelchair dealer or manufacturer for purposes other than resale. See Michigan Laws 445.1081
  • Consumer: means the first person who purchases a new appliance for purposes other than resale. See Michigan Laws 429.351
  • Consumer item: means an article of tangible personal property used or consumed, or bought for use or consumption, primarily for personal, family, or household purposes. See Michigan Laws 445.312
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contraband: means any property that is prohibited by any law to be owned, carried, concealed, or possessed. See Michigan Laws 434.21
  • Contract: means a written or oral agreement, or a similar understanding or arrangement, in which a person agrees that another person will perform work, labor, diagnosis, repair, reconditioning, replacement, adjustment, or alteration, directly or indirectly, on a motor vehicle. See Michigan Laws 257.1302
  • contract: means an agreement covering a home improvement installment sale, whether contained in 1 or more documents, together with any accompanying promissory note or other evidence of indebtedness, pursuant to which the buyer promises to pay in installments all or any part of the time sale price or prices of goods and services, or services. See Michigan Laws 445.1102
  • Contract: A legal written agreement that becomes binding when signed.
  • Contracting agent: means any officer, school board, board or commission of the state, or a state institution supported in whole or in part by state funds, authorized to enter into a contract for a state project or to perform a state project by the direct employment of labor. See Michigan Laws 408.1101
  • contractor: means a person who sells goods and services, or agrees to furnish or render services, to a retail buyer pursuant to a home improvement installment contract, or sells goods and services to a retail buyer pursuant to a home improvement charge agreement, but not in connection with construction of new homes. See Michigan Laws 445.1102
  • Control: means having a greater than 15% direct or indirect pecuniary interest in the casino gaming operation with respect to which the license is sought. See Michigan Laws 432.202
  • Controlled substance: means that term as defined in section 7104 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 431.302
  • Conviction: A judgement of guilt against a criminal defendant.
  • Conviction: means a conviction for a crime or attempted crime whether under a law of this state, a local ordinance substantially corresponding to a law of this state, or a law of another state substantially corresponding to a law of this state. See Michigan Laws 256.623
  • cooperating instructor: means a driver education instructor approved by the secretary of state to participate in a practicum course to mentor an uncertified driver education instructor in the practicum. See Michigan Laws 256.627
  • Corporation: means a private or public corporation, association or trust issuing a security. See Michigan Laws 441.101
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Corps: means the Michigan civilian conservation corps established under this chapter. See Michigan Laws 409.302
  • Corps: means the Michigan civilian conservation corps established pursuant to this chapter. See Michigan Laws 409.321
  • Corpsmember: means a participant in the corps. See Michigan Laws 409.302
  • Corpsmember: means a participant in the corps. See Michigan Laws 409.321
  • Cosigner: means a natural person who renders himself or herself liable for the obligation of another person without compensation. See Michigan Laws 445.271
  • Cost: includes the cost of construction or acquisition, the cost of the acquisition of all land, rights-of-way, property, rights, easements, and interests acquired by the authority for the construction, the cost of demolishing or removing any buildings or structures on land acquired, including the cost of acquiring any lands to which buildings or structures may be moved, the cost of acquiring the existing ferry system or any portion of that ferry system, operating between Sault Ste. See Michigan Laws 254.221
  • Cost of the bridge: includes all expenditures made in connection with the acquisition and construction of the bridge, financing charges, interest to accrue on the bonds during the period occupied by the construction of the bridge and for a period after construction of the bridge as determined by the board, the aggregate of such periods, however, not to exceed 7 years, cost of engineering and legal expenses, plans, specifications and surveys, other expenses necessary or incidental to determining the feasibility of the project, the cost of all land, property, rights, easements and franchises, reimbursement of all money that may have been or will be paid or advanced by the state of Michigan or any of its agencies, departments, or subdivisions, and all other expenses properly incident to the acquisition of the bridge and the issuance of the bonds.   • Costs: means any monetary amount that the court is authorized to assess and collect for prosecution, adjudication, or processing of criminal offenses, civil infractions, civil violations, and parking violations, including court costs, the cost of prosecution, and the cost of providing court-ordered legal assistance to the defendant.   • Counterclaim: A claim that a defendant makes against a plaintiff.

  • Counterfeit: means a work of fine art made or altered, with intent to deceive, in a manner that it appears to have an authorship which it does not in fact possess. See Michigan Laws 442.321
  • Court funding unit: means that term as defined in section 151e of the revised judicature act of 1961, 1961 PA 236, MCL 600. See Michigan Laws 600.1090
  • Court funding unit: means that term as defined in section 151e. See Michigan Laws 600.1099b
  • Court funding unit: means 1 of the following, as applicable:
  •   (i) For circuit or probate court, the county. See Michigan Laws 600.1985
  • Court reporter: A person who makes a word-for-word record of what is said in court and produces a transcript of the proceedings upon request.
  • Coverall pattern: means a pattern required to win a bingo game in which all numbers on a bingo card are required to be called. See Michigan Laws 432.102
  • Cream: means any of the following:
  •   (i) Light cream containing not less than 18% but not more than 30% milkfat. See Michigan Laws 288.571
  • Credit bureau: An agency that collects individual credit information and sells it for a fee to creditors so they can make a decision on granting loans. Typical clients include banks, mortgage lenders, credit card companies, and other financing companies. (Also commonly referred to as consumer-reporting agency or credit-reporting agency.) Source: OCC
  • Credit card: means that term as defined in section 157m of the Michigan penal code, 1931 PA 328, MCL 750. See Michigan Laws 445.63
  • Credit granting institution: means a state or nationally chartered bank, a state or federally chartered savings and loan association, a state or federally chartered credit union, the Michigan state housing development authority, or a business entity making or purchasing mortgage loans, that has a main office, branch office, or service center in the state of Michigan at which it conducts that business. See Michigan Laws 445.1601
  • Credit report: A detailed report of an individual's credit history prepared by a credit bureau and used by a lender in determining a loan applicant's creditworthiness. Source: OCC
  • Crime: means committing, attempting to commit, conspiring to commit, or soliciting another person to commit any of the following offenses in connection with which the forfeiture of property is sought:
  •   (i) A violation of part 111 of the natural resources and environmental protection act, 1994 PA 451, MCL 324. See Michigan Laws 600.4701
  • culvert: as used in this act shall be considered as synonymous terms. See Michigan Laws 254.30
  • Currency: means a medium of exchange including coins, bank notes, government notes, and paper money that has a value not greater than face value. See Michigan Laws 434.21
  • Current net price: means the price listed in the supplier's printed price lists, catalogs, microfiche, price tapes, invoices, or any other printed or electronically recorded data in effect at the time an agreement is canceled or discontinued, less all applicable discounts.   • Curriculum: means a written plan that guides the instruction given in a driver education course and includes performance objectives, a content outline, detailed learning activities, and assessment tools. See Michigan Laws 256.623
  • Customer: means the owner or operator of a motor vehicle. See Michigan Laws 257.1302
  • Customer: means a member of the general public who seeks the services of a service dealer for the repair, maintenance, or service of an appliance that he or she uses personally and not as part of a business or commercial enterprise. See Michigan Laws 445.832
  • Dairy animal: means any domesticated lactating mammal, including a cow, goat, sheep, water buffalo, or other hooved mammal, which is managed and milked to obtain milk for human consumption. See Michigan Laws 288.572
  • Dairy farm: means any place or premises where 1 or more dairy animals are kept for milking purposes, and from which a part or all of the milk is provided, sold, or offered for sale. See Michigan Laws 288.572
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Data: means computerized personal information. See Michigan Laws 445.63
  • Dating relationship: means that term as defined in section 2950. See Michigan Laws 600.1060
  • Day of operation: means a period of 24 hours beginning at 12 noon and ending at 11:59 a. See Michigan Laws 431.302
  • Dealer: means a person who sells or offers for sale to consumers within this state a beverage in a beverage container, including an operator of a vending machine containing a beverage in a beverage container. See Michigan Laws 445.571
  • Dealer: means that term as defined in section 1 of the beverage container law, MCL 445. See Michigan Laws 445.633
  • Dealer: means that term as defined in section 1 of the beverage container law, MCL 445. See Michigan Laws 445.653
  • Dealer: means any person that engages in the ordinary course of repeated and recurrent transactions of buying or receiving used motor vehicle parts from persons other than a licensee. See Michigan Laws 257.1351
  • Dealer: means an individual who does any of the following in a millionaire party game:
  •   (i) Performs the act of dealing. See Michigan Laws 432.132
  • Dealer: means a person engaged in the business of the retail sale of farm tractors and equipment, utility tractors and equipment, or the attachments to or repair parts for that equipment. See Michigan Laws 445.1452
  • Dealer: means any person, corporation, partnership, or association, which, in whole or in part, engages in the ordinary course of repeated and recurrent transactions of buying or receiving precious items from the public within this state. See Michigan Laws 445.482
  • Dealer supplies: means any display, machinery, signage, book, manual, computer, microfiche, microfilm, communication device, or tool that a dealer purchased from a supplier, or from a third party upon the request or requirement of the supplier, and which is used by the dealer to facilitate the sale or repair of inventory furnished by the supplier and no other product line sold or serviced by the dealer.   • debt: means an obligation or alleged obligation for the payment of money or thing of value arising out of an expressed or implied agreement or contract for a purchase made primarily for personal, family, or household purposes. See Michigan Laws 445.251
  • debtor: means an individual who is obligated or allegedly obligated to pay a debt. See Michigan Laws 445.251
  • Decedent: A deceased person.
  • Deed: means a written instrument entitled to be recorded in the office of the register of deeds that purports to convey or transfer title to a freehold interest in any lands, tenements, or other realty in this state by way of grant or bargain and sale from the named grantor to the named grantee. See Michigan Laws 445.1032
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Delivery: means either of the following:
  •   (i) With respect to an electronic document of title, a voluntary transfer of control. See Michigan Laws 440.1201

  • Depository financial institution: means a state or nationally chartered bank, a state or federally chartered savings and loan association, savings bank, or credit union, or an entity of the federally chartered farm credit system. See Michigan Laws 445.1651a
  • Depository institution: means a state or nationally chartered bank or a state or federally chartered savings and loan association, savings bank, or credit union. See Michigan Laws 445.63
  • Descendent: One who is directly descended from another such as a child, grandchild, or great grandchild.
  • Designated representative or coordinator: means the individual that a driver education provider employs, enlists, or appoints, or contracts with to supervise, manage, and administer the day-to-day responsibilities of the provider's driver education school operation. See Michigan Laws 256.623
  • Destroyed sign: means a nonconforming sign that has been damaged by storm, fire, or other casualty that requires customary maintenance and repair in excess of 60% of the replacement cost of a new sign structure constructed of equivalent materials and equipment. See Michigan Laws 252.302
  • Development agreement: means a written agreement between a city and a person naming the person as the designated developer of a casino in the city and covering certain subjects including, but not limited to, all of the following:
  •   (i) Approval by the city of the location of the casino. See Michigan Laws 432.202
  • Developmental disability: means that term as defined in section 100a of the mental health code, 1974 PA 258, MCL 330. See Michigan Laws 600.1090

  •   (i) A public or private activity or attraction that is owned or operated by the federal or a state or local government or an agency of the federal or a state or local government. See Michigan Laws 252.302
  • Director: means the director of the department or his or her designee. See Michigan Laws 408.652
  • director: means the director of the bureau or his or her duly authorized representative. See Michigan Laws 418.201
  • Director: means the director of the department or the director's designee. See Michigan Laws 408.962
  • Director: means the director of the department. See Michigan Laws 409.302

  • Document: means a draft or other demand, document of title, investment security, certificate, invoice, or other record, statement, or representation of fact, law, right, or opinion that is not oral which is both of the following:
  •   (i) Presented in a written or other medium permitted by the letter of credit or, unless prohibited by the letter of credit, by the standard practice referred to in section 5108(5). See Michigan Laws 440.5102
  • Document of title: means a record that in the regular course of business or financing is treated as adequately evidencing that the person in possession or control of the record is entitled to receive, control, hold, and dispose of the record and the goods the record covers and that purports to be issued by or addressed to a bailee and to cover goods in the bailee's possession which are either identified or are fungible portions of an identified mass.   • Driver education course certificate of completion: means a written or electronic authorization issued by a certified driver education provider to a student who has successfully completed segment 1, segment 2, or entry-level driver training of a driver education course offered by the provider.   • Driver education instructor: means a person who the secretary of state certifies has met the instructor qualifications of this act to instruct a student in a driver education course. See Michigan Laws 256.623
  • Driver education instructor certificate: means a written or electronic authorization issued by the secretary of state to indicate that a person has met the instructor qualifications of this act to instruct a student in a driver education course. See Michigan Laws 256.623
  • driver education instructor preparation courses: means the courses that are required to obtain a driver education instructor certificate. See Michigan Laws 256.625
  • Driver education instructor preparation program: means a program of driver education instructor preparation courses offered by a college or university or by a person approved by the secretary of state. See Michigan Laws 256.625
  • Driver education provider certificate: means a written or electronic authorization issued by the secretary of state to indicate that a person has met the driver education provider qualifications of this act. See Michigan Laws 256.625
  • Drug: means any of the following:
  •   (i) A substance intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease in humans or other animals. See Michigan Laws 431.302
  • Drug treatment court: means a court supervised treatment program for individuals who abuse or are dependent upon any controlled substance or alcohol. See Michigan Laws 600.1060
  • Dry milk product: means a product resulting from the drying of milk or a dairy product. See Michigan Laws 288.572
  • Dryer: means equipment that dries milk or a dairy product. See Michigan Laws 288.572
  • Due-on-sale clause: means a contract provision which authorizes the lender, at its option, to declare due and payable sums secured by the lender's security instrument if all or any part of the property, or an interest in the property, securing the real property loan is sold or transferred without the lender's prior written consent. See Michigan Laws 445.1621
  • Early termination cost: means an expense or obligation that a wheelchair lessor incurs as a result of both the termination of a written lease before the termination date of the lease and the return of a wheelchair to a manufacturer under section 3. See Michigan Laws 445.1081
  • Early termination savings: means an expense or obligation that a wheelchair lessor avoids as a result of both the termination of a written lease before the termination date of the lease and the return of a wheelchair to a manufacturer under section 3. See Michigan Laws 445.1081
  • Economically disadvantaged: means an individual who meets at least 1 of the following criteria:
  •   (i) Receives, or is a member of a family which receives, cash welfare payments under a federal, state, or local welfare program. See Michigan Laws 421.151
  • Educational institution: means a public school, nonpublic school, or public school academy as those terms are defined in section 5 of the revised school code, 1976 PA 451, MCL 380. See Michigan Laws 256.625
  • Electric patrol vehicle: means an electrically powered motor vehicle designed to carry not more than 4 persons at a speed of not more than 25 miles per hour and having an unloaded weight of not more than 1,300 pounds. See Michigan Laws 257.1572
  • Electronic filing system: means a system authorized after the effective date of the amendatory act that added this chapter by the supreme court for the electronic filing of documents using a portal contracted for by the state court administrative office for the filing of documents in the supreme court, court of appeals, circuit court, probate court, district court, and court of claims. See Michigan Laws 600.1985
  • Electronic filing system fee: means the fee described in section 1986. See Michigan Laws 600.1985
  • Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash. (Wire transfers, checks, drafts, and paper instruments do not fall into this category.) Source: OCC
  • Eligible employee: means an individual engaged in service to an employer in the business of the employer and from whom an employer is required to withhold for federal income tax purposes. See Michigan Laws 408.962
  • Eligible recipient: means a city, village, county, township, school district, intermediate school district, university, community college, private nonprofit organization, public school academy, or governmental authority, or an agency or department of a city, village, county, township, school district, intermediate school district, or a private nonprofit organization.   • Emancipated minor: means a minor who is emancipated under section 4 of 1968 PA 293, MCL 722. See Michigan Laws 427.301
  • Embedded electronic message device: means an accessory that is made part of a sign, sign face, or sign structure with a total area that is less than that of the sign face to which it is attached, and displays only static messages containing text or numbers that are directly associated with the current advertiser.   • Employer: means a person, firm, or corporation, including this state and its political subdivisions, agencies, and instrumentalities, and a person acting in the interest of the employer, who employs 2 or more employees at any 1 time within a calendar year. See Michigan Laws 408.412
  • employment: includes service performed in the employ of an Indian tribe or tribal unit, if the service is excluded from employment as that term is defined in the federal unemployment tax act, chapter 23 of subtitle C of the internal revenue code of 1986, 26 U. See Michigan Laws 421.13l
  • Employment in the logging industry: means employment in the logging industry as described in the section in the workmen's compensation and employers liability insurance manual, entitled, "logging or lumbering and drivers code no. See Michigan Laws 418.501
  • Employment plan: means the full employment plan required by section 3. See Michigan Laws 408.902
  • Empty returnable container: means a beverage container which contains nothing except the residue of its original contents. See Michigan Laws 445.571
  • Encrypted: means transformation of data through the use of an algorithmic process into a form in which there is a low probability of assigning meaning without use of a confidential process or key, or securing information by another method that renders the data elements unreadable or unusable. See Michigan Laws 445.63
  • End-user: means that term as defined in section 16901 of the natural resources and environmental protection act, 1994 PA 451, MCL 324. See Michigan Laws 257.1351
  • Endowment fund: means the Michigan civilian conservation corps endowment fund created in section 12a. See Michigan Laws 409.302
  • Energy efficiency: means the energy use of a product relative to its output of services, as determined through test procedures contained or identified in a rule promulgated under this act. See Michigan Laws 429.351
  • Energy use: means the energy resources used by a product under conditions of use approximating actual operating conditions insofar as practical, as determined through test procedures contained or identified in a rule promulgated under this act. See Michigan Laws 429.351
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Entry fee: means cash or cash equivalent paid by a participant to a fantasy contest operator in order to participate in a fantasy contest. See Michigan Laws 432.502
  • Equal Credit Opportunity Act: Prohibits creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex, marital status, age, or because an applicant receives income from a public assistance program. Source: OCC
  • Equipment: means the objects and mechanical, electromechanical, or electronic devices used to determine or assist in determining the winners of prizes at an event. See Michigan Laws 432.102
  • Equipment: means motorized machines designed for or adapted and used for agriculture, horticulture, livestock raising, forestry, grounds maintenance, lawn and garden, construction, materials handling, and earth moving. See Michigan Laws 445.1452
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Erect: means to construct, build, raise, assemble, place, affix, attach, create, paint, draw, or in any other way bring into being or establish. See Michigan Laws 252.302
  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Established office location: means a building that meets all of the following requirements:
  •   (i) Is of a permanent nature where the provider's communications and notices are received. See Michigan Laws 256.625
  • Estimate: means a written statement that itemizes as closely as possible the price for labor, by showing the labor price per hour, the number of hours required to perform the work, and the price of parts necessary for a specific repair. See Michigan Laws 257.1302
  • Event: means , in article 1, an occasion of bingo games, a raffle, a charity game, or a numeral game conducted under a license issued under article 1, and in article 2, an occasion of a millionaire party conducted under a license issued under article 2. See Michigan Laws 432.102
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Evidence: means any property that furnishes or tends to furnish proof in a legal matter. See Michigan Laws 434.21
  • Ex officio: Literally, by virtue of one's office.
  • Ex parte communication: means any communication, direct or indirect, regarding a licensing application, disciplinary action, or a contested case under this act other than communication that takes place during a meeting or hearing conducted under this act. See Michigan Laws 432.202
  • Executive director: means the executive director of the board, appointed under section 4 of the Michigan gaming control and revenue act, 1996 IL 1, MCL 432. See Michigan Laws 432.102
  • Executive officer: means an officer, member, or partner of a licensee or registrant. See Michigan Laws 445.1651a
  • Executor: A male person named in a will to carry out the decedent
  • Existing customer: means an individual who has purchased goods or services from a person, who is the recipient of a voice communication from that person, and who either paid for the goods or services within the 12 months preceding the voice communication or has not paid for the goods and services at the time of the voice communication because of a prior agreement between the person and the individual. See Michigan Laws 445.111
  • Experience account: means an account in the unemployment compensation fund showing an employer's experience with respect to contribution payments and benefit charges under this act, determined and recorded in the manner provided in this act. See Michigan Laws 421.3
  • Express warranty: means an express warranty as determined under the uniform commercial code, Act No. See Michigan Laws 445.1081
  • Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state.
  • Facility: means any actual physical improvement to real property owned, or leased, directly or through a building authority, by a governmental unit, including, but not limited to, roads; bridges; runways; rails; or a building or structure along with the building's or structure's grounds, approaches, services, and appurtenances. See Michigan Laws 408.873
  • Fair: means a county, district, or community fair or a state fair. See Michigan Laws 431.302
  • Fair Credit Reporting Act: A federal law, established in 1971 and revised in 1997, that gives consumers the right to see their credit records and correct any mistakes. Source: OCC
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • False pretenses: includes , but is not limited to, a false, misleading, or fraudulent representation, writing, communication, statement, or message, communicated by any means to another person, that the maker of the representation, writing, communication, statement, or message knows or should have known is false or fraudulent. See Michigan Laws 445.63
  • Fantasy contest: means a simulated game or contest with an entry fee that meets all of the following conditions:
  •   (i) No fantasy contest team is composed of the entire roster of a real-world sports team. See Michigan Laws 432.403
  • Fantasy contest: means a simulated game or contest with an entry fee that meets all of the following conditions:
  •   (i) No fantasy contest team is composed of the entire roster of a real world sports team. See Michigan Laws 432.502
  • Fantasy contest: means that term as defined in section 2 of the fantasy contests consumer protection act, 2019 PA 157, MCL 432. See Michigan Laws 432.303
  • Fantasy contest adjusted revenues: means the amount equal to the total of all entry fees that a fantasy contest operator collects from all fantasy contest players minus the total of all sums paid out as prizes or awards to all fantasy contest players, multiplied by the in-state percentage. See Michigan Laws 432.502
  • Fantasy contest operator: means a person that operates, carries on, conducts, maintains, exposes, or offers for play fantasy contests and awards prizes of value and includes a licensed fantasy contest operator, a casino licensee under the Michigan Gaming Control and Revenue Act, 1996 IL 1, MCL 432. See Michigan Laws 432.502
  • Fantasy contest platform: means any digital or online method through which a fantasy contest operator provides access to a fantasy contest. See Michigan Laws 432.502
  • Fantasy contest player: means an individual who participates in a fantasy contest offered by a fantasy contest operator. See Michigan Laws 432.502
  • Fantasy contest team: means the simulated team composed of multiple individual athletes, each of whom is a member of a real world sports team, that a fantasy contest player selects to compete in a fantasy contest. See Michigan Laws 432.502
  • Farm tank: means the farm bulk milk tank, milk tank truck, or silo used for the storage or cooling of milk, or both, before pickup and transport from the farm. See Michigan Laws 288.573
  • Federal Reserve System: The central bank of the United States. The Fed, as it is commonly called, regulates the U.S. monetary and financial system. The Federal Reserve System is composed of a central governmental agency in Washington, D.C. (the Board of Governors) and twelve regional Federal Reserve Banks in major cities throughout the United States. Source: OCC
  • Federally insured depository institution: means a state or national bank, state or federal savings bank, state or federal savings and loan association, or state or federal credit union that holds deposits insured by an agency of the United States. See Michigan Laws 445.111
  • Fee: means any monetary amount, other than costs or a penalty, that the court is authorized to impose and collect pursuant to a conviction, finding of responsibility, or other adjudication of a criminal offense, a civil infraction, a civil violation, or a parking violation, including a driver license reinstatement fee. See Michigan Laws 600.4801
  • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
  • Ferrous metal: means a metal that contains significant quantities of iron or steel. See Michigan Laws 445.423
  • FHLBB mortgage index rate: means the national average contract interest rate on conventional 25 plus year fixed rate mortgages charged by all major lenders on mortgage loans for previously occupied homes, as most recently published by the federal home loan bank board in its journal or news releases. See Michigan Laws 445.1621
  • Fiduciary: A trustee, executor, or administrator.
  • Fiduciary: means an executor, administrator, trustee, guardian, committee, conservator, curator, tutor, custodian or nominee. See Michigan Laws 441.101
  • Finance charge: The total cost of credit a customer must pay on a consumer loan, including interest. The Truth in Lending Act requires disclosure of the finance charge. Source: OCC
  • Financial institution: means a depository institution, an affiliate of a depository institution, a licensee under the consumer financial services act, 1988 PA 161, MCL 487. See Michigan Laws 445.63
  • Financial transaction device: means that term as defined in section 157m of the Michigan penal code, 1931 PA 328, MCL 750. See Michigan Laws 445.63
  • financially interested: means any interest in investments, awarding of contracts, grants, loans, purchases, leases, sales, or similar matters under consideration or consummated by the board. See Michigan Laws 432.202
  • Financing agency: means a person other than a home improvement contractor engaged, directly or indirectly, as principal, agent, or broker in the business of purchasing, acquiring, financing, soliciting, or arranging for the financing or acquisition of home improvement installment contracts or home improvement charge agreements or any obligation in connection therewith. See Michigan Laws 445.1102
  • Fine art: means an original art or craft work which is:
  •   (i) A visual rendition including, but not limited to, a painting, drawing, sculpture, mosaic, video tape, or photograph. See Michigan Laws 442.311
  • Fine art: means a painting, sculpture, drawing or work of graphic art. See Michigan Laws 442.321
  • fire department: means lawfully organized fire fighting forces, however constituted, including personnel. See Michigan Laws 419.201
  • firearm: except as otherwise specifically defined in statute, includes any weapon which will, is designed to, or may readily be converted to expel a projectile by action of an explosive. See Michigan Laws 8.3t
  • First purchaser: means the first buyer of a manufactured item that contains ferrous or nonferrous metal in a retail or business-to-business transaction. See Michigan Laws 445.423
  • First responder: means any of the following:
  •   (i) A law enforcement officer. See Michigan Laws 419.401
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Fixed location: means a place of business where the seller or an agent, servant, employee, or solicitor of that seller primarily engages in the sale of goods or services of the same kind as would be sold at the residence of a buyer. See Michigan Laws 445.111
  • Fixed Rate: Having a "fixed" rate means that the APR doesn't change based on fluctuations of some external rate (such as the "Prime Rate"). In other words, a fixed rate is a rate that is not a variable rate. A fixed APR can change over time, in several circumstances:
    • You are late making a payment or commit some other default, triggering an increase to a penalty rate
    • The bank changes the terms of your account and you do not reject the change.
    • The rate expires (if the rate was fixed for only a certain period of time).
  • Forbearance: A means of handling a delinquent loan. A
  • Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
  • Foreign subpoena: means a subpoena issued under authority of a court of record of a foreign jurisdiction. See Michigan Laws 600.2202
  • Foreign substance: means a substance, or its metabolites, that does not exist naturally in an untreated horse or, if natural to an untreated horse, exists at an unnaturally high physiological concentration as a result of having been administered to the horse. See Michigan Laws 431.302
  • Forgery: The fraudulent signing or alteration of another's name to an instrument such as a deed, mortgage, or check. The intent of the forgery is to deceive or defraud. Source: OCC
  • Fraternal organization: means an organization in this state, other than a college fraternity or sorority, that meets all of the following criteria:
  •   (i) Is organized not for pecuniary profit. See Michigan Laws 432.102
  • Fraud: Intentional deception resulting in injury to another.
  • Freedom of Information Act: A federal law that mandates that all the records created and kept by federal agencies in the executive branch of government must be open for public inspection and copying. The only exceptions are those records that fall into one of nine exempted categories listed in the statute. Source: OCC
  • Freeway: means a divided highway of not less than 2 lanes in each direction to which owners or occupants of abutting property or the public do not have a right of ingress or egress to, from, or across the highway, except at points determined by or as otherwise provided by the authorities responsible for the freeway. See Michigan Laws 252.302
  • Freezer: means mechanical equipment used to lower the temperature of a mix while, at the same time, incorporating air into the mix. See Michigan Laws 288.573
  • Fringe benefits: means compensation due an employee pursuant to a written contract or written policy for holiday, time off for sickness or injury, time off for personal reasons or vacation, bonuses, authorized expenses incurred during the course of employment, and contributions made on behalf of an employee. See Michigan Laws 408.471
  • Frivolous: means that term as defined in section 2591 of the revised judicature act of 1961, 1961 PA 236, MCL 600. See Michigan Laws 600.5531
  • Frozen desserts: means desserts made from dairy products described in 21 C. See Michigan Laws 288.573
  • Full employment: means the highest level of employment which would provide an employment opportunity for every person able and willing to work, which, consistent with other public needs, can be attained during a given period of time by maximizing the investment of public resources toward that end. See Michigan Laws 408.902
  • Fund: means the beverage container redemption antifraud fund created in section 7. See Michigan Laws 445.633
  • Fund: means the internet sports betting fund created under section 16. See Michigan Laws 432.403
  • Fund: means the motor vehicle accident claims fund. See Michigan Laws 257.1102
  • Fund: means the second injury fund created in chapter 5. See Michigan Laws 418.901
  • Fund: means the internet gaming fund created under section 16. See Michigan Laws 432.303
  • Future damages: means damages arising from personal injury which the trier of fact finds will accrue after the damage findings are made and includes damages for medical treatment, care and custody, loss of earnings, loss of earning capacity, loss of bodily function, and pain and suffering. See Michigan Laws 600.6301
  • Gambling game: means any game played with cards, dice, equipment or a machine, including any mechanical, electromechanical or electronic device including computers and cashless wagering systems, for money, credit, or any representative of value, including, but not limited to, faro, monte, roulette, keno, bingo, fan tan, twenty one, blackjack, seven and a half, klondike, craps, poker, chuck a luck, Chinese chuck a luck (dai shu), wheel of fortune, chemin de fer, baccarat, pai gow, beat the banker, panguingui, slot machine, any banking or percentage game, or any other game or device approved by the board. See Michigan Laws 432.202
  • Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
  • Genuine: means free of forgery or counterfeiting. See Michigan Laws 440.1201
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Glass beverage container: means a beverage container composed primarily of glass. See Michigan Laws 445.653
  • Going out of business sale: means any sale, whether described by such name or by any other name such as, but not limited to, "closing out sales" "liquidation sales" "lost our lease sale" "forced to vacate sale" held in such a manner as to indicate a belief that upon disposal of the stock of goods on hand, the business will cease and discontinue at the premises where the sale is conducted. See Michigan Laws 442.211
  • Gold: means elemental gold having an atomic weight of 196. See Michigan Laws 445.482
  • Good faith: means honesty in fact in the conduct or transaction concerned. See Michigan Laws 440.5102
  • Goods: means all tangible chattels purchased primarily for personal, family, or household use and not for commercial, agricultural, or business use. See Michigan Laws 445.852
  • Goods: means chattels which are furnished or used in the modernization, rehabilitation, repair, alteration, or improvement of real property, but not in the construction of new homes. See Michigan Laws 445.1102
  • Goods: means all goods, wares, merchandise and other personal property, excepting, choses in action and money. See Michigan Laws 442.211
  • Governmental agency: means an agency of the federal government, a state government, a county, city, village, or township, or a combination of any of these entities. See Michigan Laws 256.625
  • governmental entity: means this state or any of its instrumentalities, a county, city, township, village, school district, community college district, community hospital district, any agency authorized to exercise a governmental function in a limited geographical area, or other political subdivision, any instrumentality of 1 or more of these units, or any of these units and 1 or more other states or political subdivisions of those states. See Michigan Laws 421.50a
  • Governmental unit: means this state, a county, city, township, village, school district, intermediate school district, community college, or public university that receives appropriations from this state, or any agency, board, commission, authority, or instrumentality of the foregoing. See Michigan Laws 408.873
  • Governmental unit: means a subdivision, agency, department, county, parish, municipality, or other unit of the government of the United States, this state, another state, or a foreign country. See Michigan Laws 445.423
  • Graduated driver license: means a license issued by the secretary of state under section 310e of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 256.625
  • Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage,
  • grantee: may be construed as including every person to whom any such interest or estate passes in like manner. See Michigan Laws 8.3e
  • Grantor: The person who establishes a trust and places property into it.
  • grantor: may be construed as including every person from or by whom any estate in lands passes in or by any deed. See Michigan Laws 8.3e
  • Gross receipts: means the total of all sums including valid or invalid checks, currency, tokens, coupons, vouchers, or instruments of monetary value whether collected or uncollected, received by a casino licensee from gaming, including all entry fees assessed for tournaments or other contests, less a deduction for uncollectible gaming receivables not to exceed the uncollectible amounts owed as a result of wagers placed at or through a gambling game or 4% of the total gross receipts, whichever is less. See Michigan Laws 432.202
  • Gross receipts: means the total of all sums, including, but not limited to, valid or invalid checks, valid or invalid credit or debit card deposits, valid or invalid ACH deposits, currency, coupons, free play or promotional credits, redeemable credits, vouchers, entry fees assessed for tournaments or other contests, or instruments of monetary value whether collected or uncollected, in each case actually wagered by an authorized participant at or with an internet gaming operator on an internet game, less all of the following:
  •   (i) Winnings. See Michigan Laws 432.303
  • Gross sports betting receipts: means the total of all sums, including, but not limited to, valid or invalid checks, valid or invalid credit or debit card deposits, valid or invalid ACH deposits, currency, coupons, free play or promotional credits, redeemable credits, vouchers, entry fees assessed for tournaments or other contests, or instruments of monetary value whether collected or uncollected, in each case actually wagered by an authorized participant at or with a sports betting operator on sports betting, less all of the following:
  •   (i) Winnings. See Michigan Laws 432.403
  • Guarantor: A party who agrees to be responsible for the payment of another party's debts should that party default. Source: OCC
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Habeas corpus: A writ that is usually used to bring a prisoner before the court to determine the legality of his imprisonment. It may also be used to bring a person in custody before the court to give testimony, or to be prosecuted.
  • Hazardous material: means explosives, pyrotechnics, flammable gas, flammable compressed gas, nonflammable compressed gas, flammable liquid, oxidizing material, poisonous gas, poisonous liquid, irritating material, etiologic material, radioactive material, corrosive material, or liquefied petroleum gas. See Michigan Laws 434.21
  • Health care facility: means any of the following facilities, including those that may operate under shared or joint ownership, and a facility used as surge capacity by any of the following facilities:
  •   (i) An entity listed in section 20106(1) of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 419.401
  • Heavy-duty truck: means a motor vehicle that has a gross vehicle weight rating of 14,000 pounds or more and includes both single-unit and combination tractor trailer or tractor semitrailer vehicles. See Michigan Laws 257.1302
  • Highly experienced player: means a fantasy contest player who has done at least 1 of the following:
  •   (i) Entered more than 1,000 fantasy contests offered by a single fantasy contest operator. See Michigan Laws 432.502
  • Highway or street: means a highway or street as defined in section 20 of Act No. See Michigan Laws 257.1702
  • Hobby: means an interest or activity that an individual pursues without compensation in his or her leisure time. See Michigan Laws 408.652
  • Holder: means any of the following:
  •   (i) A person in possession of a negotiable instrument that is payable either to bearer or to an identified person that is the person in possession. See Michigan Laws 440.1201
  • Holder: means a retail seller of goods or services covered by a retail installment contract or retail charge agreement, or an assignee of that seller. See Michigan Laws 445.852
  • Holder: means a person, including a contractor, currently entitled to the rights of a contractor under a home improvement installment contract or home improvement charge agreement. See Michigan Laws 445.1102
  • Holding company: means a corporation, firm, partnership, limited partnership, limited liability company, trust, or other form of business organization that is not an individual and that directly or indirectly does either of the following:
  •   (i) Holds an ownership interest of 5% or more, as determined by the board, in a fantasy contest operator. See Michigan Laws 432.502
  • Home improvement charge sale: means the sale of goods and furnishing of services by a contractor to a retail buyer pursuant to a home improvement charge agreement and as to which sale the cash price is stated to be in excess of $300. See Michigan Laws 445.1102
  • Home improvement loan: means a secured or unsecured loan used for the purpose of repairing, rehabilitating, or remodeling an existing residential dwelling designed for occupancy by 4 or fewer families, as stated by the borrower in the loan application and as recorded on the books of the credit granting institution. See Michigan Laws 445.1601
  • Home solicitation sale: means a sale of goods or services of more than $25. See Michigan Laws 445.111
  • Hotel: means that term as defined in section 1 of 1913 PA 188, MCL 427. See Michigan Laws 427.301
  • Identity theft: means engaging in an act or conduct prohibited in section 5(1). See Michigan Laws 445.63
  • Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate.
  • improvements: shall mean such repairs, replacements, additions and betterments of and to works acquired by purchase as are deemed necessary to place them in a safe and efficient condition for the use of the public, if such repairs, replacements, additions and betterments are ordered prior to the sale of any bonds for the acquisition of such works. See Michigan Laws 254.152
  • in writing: shall be construed to include printing, engraving, and lithographing; except that if the written signature of a person is required by law, the signature shall be the proper handwriting of the person or, if the person is unable to write, the person's proper mark, which may be, unless otherwise expressly prohibited by law, a clear and classifiable fingerprint of the person made with ink or another substance. See Michigan Laws 8.3q
  • In-game betting: means placing an internet sports betting wager after an athletic event has started. See Michigan Laws 432.403
  • In-state percentage: means for each fantasy contest, the percentage, rounded to the nearest tenth of a percent, equal to the total entry fees collected from all in-state participants divided by the total entry fees collected from all participants in the fantasy contest, unless otherwise prescribed by the board. See Michigan Laws 432.502
  • Incidental costs: means expenses specified in a warranty incurred by a warranty holder and related to the failure of a vehicle protection product to perform as provided in the warranty. See Michigan Laws 257.1243
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Index: means the Detroit consumer price index for all urban consumers published by the United States bureau of labor statistics or, if that index ceases to be published by the United States bureau of labor statistics, the published index that most closely measures inflation, as determined by the department. See Michigan Laws 252.302
  • Indian lands: means that term as defined in 25 USC 2703. See Michigan Laws 432.403

  • Indian tribe: means that term as defined in 25 USC 2703 and any instrumentality, political subdivision, or other legal entity through which an Indian tribe operates its casino in this state. See Michigan Laws 432.403
  • Indian tribe: means that term as defined in section 3306(u) of the federal unemployment tax act, chapter 23 of subtitle C of the internal revenue code of 1986, 26 U. See Michigan Laws 421.13l
  • Indian tribe: means that term as defined in 25 USC 2703 and any instrumentality, political subdivision, or other legal entity through which an Indian tribe operates its casino in this state. See Michigan Laws 432.303
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Industrial or commercial customer: means a person that operates from a fixed location and is a seller of scrap metal to a scrap metal dealer under a written agreement that provides for regular or periodic sale, delivery, purchase, or receiving of scrap metal. See Michigan Laws 445.423
  • Industrial scrap: means materials that are a direct product or by-product of any form of manufacturing, shaping, or cutting process from a person whose principal business is the manufacturing, shaping, or cutting of materials at a fixed place of business. See Michigan Laws 445.403
  • inhabitant: means a resident of a city, township, village, district or county. See Michigan Laws 8.3f
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Install vision technology: means to equip an existing, new, or replacement reverse vending machine with vision technology for designated metal, plastic, or glass containers, including all reasonable and necessary technology, equipment, hardware, software, and labor, and 1 year of service directly related to the vision technology by the reverse vending machine vendor. See Michigan Laws 445.633
  • installation: means to equip an existing, new, or replacement reverse vending machine with vision technology for designated metal, plastic, or glass containers, including all reasonable and necessary technology, equipment, hardware, software, and labor and including 1 year of service by the reverse vending machine vendor. See Michigan Laws 445.653
  • Installer: means an individual who replaces or repairs parts of a motor vehicle. See Michigan Laws 257.1362
  • Institutional investor: means a person that is any of the following:
  •   (i) A retirement fund administered by a public agency for the exclusive benefit of federal, state, or local public employees. See Michigan Laws 432.403
  • Institutional investor: means any retirement fund administered by a public agency for the exclusive benefit of federal, state, or local public employees, an employee benefit plan, or pension fund that is subject to the employee retirement income security act of 1974, as amended, an investment company registered under the investment company act of 1940, 15 USC 80a-1 to 80a-64, a collective investment trust organized by a bank under part 9 of the rules of the comptroller of the currency, a closed end investment trust, a chartered or licensed life insurance company or property and casualty insurance company, a chartered or licensed financial institution, an investment advisor registered under the investment advisers act of 1940, 15 USC 80b-1 to 80b-21, or any other person as determined by the board for reasons consistent with this act. See Michigan Laws 432.202
  • Institutional investor: means a person that is any of the following:
  •   (i) A retirement fund administered by a public agency for the exclusive benefit of federal, state, or local public employees. See Michigan Laws 432.303
  • Instrumentality of a crime: means any property, other than real property, the use of which contributes directly and materially to the commission of a crime. See Michigan Laws 600.4701
  • Insurer: means an organization that transacts the business of worker's compensation insurance within this state. See Michigan Laws 418.601
  • Insurer: means an insurance company authorized to transact property, fire, or casualty insurance in this state and an agent of the insurer and includes an insurance association, pool, or facility created under the insurance code of 1956, Act No. See Michigan Laws 257.1362
  • Intangible property: Property that has no intrinsic value, but is merely the evidence of value such as stock certificates, bonds, and promissory notes.
  • Interactive computer service: means an information service or system that enables computer access by multiple users to a computer server, including, but not limited to, a service or system that provides access to the internet or to software services available on a server. See Michigan Laws 445.63
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Intermediate school district: means that term as defined in section 4 of the revised school code, 1976 PA 451, MCL 380. See Michigan Laws 423.201
  • Internet: means the international computer network of interoperable packet-switched data networks, inclusive of additional technological platforms, such as mobile, satellite, and other electronic distribution channels. See Michigan Laws 432.403
  • Internet: means that term as defined in 47 U. See Michigan Laws 445.82
  • Internet: means the international computer network of interoperable packet-switched data networks, inclusive of such additional technological platforms as mobile, satellite, and other electronic distribution channels. See Michigan Laws 432.303
  • Internet drop-off store: means a person that contracts with other persons to offer its personal property or other valuable thing for sale, purchase, consignment, or trade through means of an internet website and meets the conditions described in section 1(3). See Michigan Laws 445.403
  • Internet drop-off store: means a person, corporation, or firm that contracts with other persons, corporations, or firms to offer its precious items for sale, purchase, consignment, or trade through means of an internet website and meets the conditions described in section 3(3). See Michigan Laws 445.482
  • Internet game: means a game of skill or chance that is offered for play through the internet in which an individual wagers money or something of monetary value for the opportunity to win money or something of monetary value. See Michigan Laws 432.303
  • Internet gaming: means operating, conducting, or offering for play an internet game. See Michigan Laws 432.303
  • Internet gaming operator: means a person that is issued an internet gaming operator license from the board. See Michigan Laws 432.303
  • Internet gaming operator license: means a license issued by the board to a person to operate, conduct, or offer internet gaming. See Michigan Laws 432.303
  • Internet gaming platform: means an integrated system of hardware, software, applications, including mobile applications, and servers through which an internet gaming operator operates, conducts, or offers internet gaming. See Michigan Laws 432.303
  • Internet gaming platform provider: means an internet gaming supplier that contracts with an internet gaming operator to provide an internet gaming platform. See Michigan Laws 432.303
  • Internet gaming supplier: means a person that the board has identified under the rules promulgated by the board as requiring a license to provide internet gaming operators goods or services that directly affect wagering, play, and results of internet games offered under this act. See Michigan Laws 432.303
  • Internet gaming supplier license: means a license issued by the board to an internet gaming supplier. See Michigan Laws 432.303
  • Internet sports betting: means operating, conducting, or offering for play sports betting through the internet. See Michigan Laws 432.403
  • Internet sports betting account: means an electronic ledger in which all of the following types of transactions relative to an authorized participant are recorded:
  •   (i) Deposits and credits. See Michigan Laws 432.403
  • Internet sports betting platform: means an integrated system of hardware, software, or applications, including mobile applications and servers, through which a sports betting operator operates, conducts, or offers sports betting through the internet. See Michigan Laws 432.403
  • Internet sports betting platform provider: means a sports betting supplier that contracts with a sports betting operator to provide an internet sports betting platform. See Michigan Laws 432.403
  • Internet sports betting wager: means the cash, or cash equivalent, including free play, loyalty points, and other redeemable sports betting credits, risked by an authorized participant on sports betting through the internet. See Michigan Laws 432.403
  • Internet wager: means money or something of monetary value risked on an internet game. See Michigan Laws 432.303
  • Internet wagering: means risking money or something of monetary value on an internet game. See Michigan Laws 432.303
  • Internet wagering account: means an electronic ledger in which all of the following types of transactions relative to an authorized participant are recorded:
  •   (i) Deposits and credits. See Michigan Laws 432.303
  • Interrogatories: Written questions asked by one party of an opposing party, who must answer them in writing under oath; a discovery device in a lawsuit.
  • Interstate highway: means a highway route on the interstate system as defined in and designated pursuant to Title 23 of the United States Code, prior to the effective date of this act. See Michigan Laws 252.151
  • Interstate highway: means a highway officially designated as a part of the national system of interstate and defense highways by the department and approved by the federal government under 23 USC 103. See Michigan Laws 252.302
  • Intestate: Dying without leaving a will.
  • Inventory: means farm tractors, utility tractors, equipment, and accessories for attachments to and repair parts for those tractors and that equipment. See Michigan Laws 445.1452
  • Investigative hearing: means any hearing conducted by the board or its authorized representative to investigate and gather information or evidence regarding pending license applications, applicants, licensees, or alleged or apparent violations of this act or rules promulgated by the board. See Michigan Laws 432.202
  • IP-enabled voice service: means an interconnected voice over internet protocol service that enables real-time, 2-way voice communications, requires a broadband connection from the user's location using internet protocol-compatible equipment, and permits users generally to receive calls that originate on the public switched telephone network and to terminate calls to the public switched telephone network. See Michigan Laws 445.65a
  • Isolation period: means the recommended number of days that an individual be in isolation after the individual first displays the principal symptoms of COVID-19 as prescribed in the United States Centers for Disease Control and Prevention's guidelines regarding COVID-19. See Michigan Laws 419.401
  • Issuer: means a bank or other person that issues a letter of credit, but does not include an individual who makes an engagement for personal, family, or household purposes. See Michigan Laws 440.5102
  • Issuing officer: means the chief administrator of a school district, intermediate school district, public school academy, or nonpublic school, or a person authorized by that chief administrator in writing to act on his or her behalf. See Michigan Laws 409.102
  • Jewelry: means an ornamental item made of a material that includes a precious gem. See Michigan Laws 445.482
  • Job training partnership act: means the job training partnership act, Public Law 97-300, 96 Stat. See Michigan Laws 421.151
  • Job upgrading: means the specialized training that is given to an identified level of employees to enable them to advance to a higher level of employment. See Michigan Laws 421.222
  • Joint committee: Committees including membership from both houses of teh legislature. Joint committees are usually established with narrow jurisdictions and normally lack authority to report legislation.
  • Joint enterprise: means any lottery activity in which the bureau participates pursuant to a written agreement between the state of Michigan and any state, territory, country, or other sovereignty as executed by the commissioner. See Michigan Laws 432.3
  • Joint tenancy: A form of property ownership in which two or more parties hold an undivided interest in the same property that was conveyed under the same instrument at the same time. A joint tenant can sell his (her) interest but not dispose of it by will. Upon the death of a joint tenant, his (her) undivided interest is distributed among the surviving joint tenants.
  • Judgment: means a final judgment of 1 of the following:
  •   (i) A court of record of this state. See Michigan Laws 600.2801
  • judgment: as used in this act , includes decree. See Michigan Laws 600.112
  • Judgment lien: means an encumbrance in favor of a judgment creditor against a judgment debtor's interest in real property, including, but not limited to, after acquired property. See Michigan Laws 600.2801
  • Junk: means any property that does not have any fair market value or worth. See Michigan Laws 434.21
  • Junk: means old or scrap copper, brass, rope, rags, batteries, paper, trash, rubber debris, waste, or junked, dismantled or wrecked automobiles, or parts of automobiles, iron, steel and other old or scrap ferrous or nonferrous material. See Michigan Laws 252.201
  • junk dealer: means a person whose principal business is that of purchasing, selling, exchanging, storing, or receiving second hand articles of any kind, scrap metals, cast iron, old iron, old steel, tool steel, aluminum, copper, brass, lead pipe or tools, or lighting and plumbing fixtures. See Michigan Laws 445.403
  • Junkyard: means an establishment or place of business which is maintained, operated or used for storing, keeping, buying or selling junk, or for the maintenance or operation of an automobile graveyard, including garbage dumps and sanitary fills. See Michigan Laws 252.201
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Juror: A person who is on the jury.
  • Juvenile mental health court: means all of the following:
  •   (i) A court-supervised treatment program for juveniles who are diagnosed by a mental health professional with having a serious emotional disturbance, co-occurring disorder, or developmental disability. See Michigan Laws 600.1099b
  • Key employee: means an employee of a fantasy contest operator who has the power to exercise significant influence over decisions concerning the fantasy contest operator. See Michigan Laws 432.502
  • Label: means an article of printed matter attached to an appliance or printed material appearing in a catalog from which a product may be purchased by order. See Michigan Laws 429.351
  • Label: means a display of written, printed, or graphic matter upon the immediate container of any article conforming to a requirement imposed under this act that any word, statement, or other information appearing on the label also appears on the outside container or wrapper of the retail package of the article or be easily legible through the outside container or wrapper. See Michigan Laws 288.573
  • Labeling: means all labels and other written, printed, or graphic matter upon an article or any of its containers or wrappers or accompanying the article. See Michigan Laws 288.573
  • labor dispute: include but are not restricted to any controversy concerning terms, tenure, or conditions of employment, or concerning the association or representation of employees in negotiating, fixing, maintaining, or changing terms or conditions of employment, regardless of whether the disputants stand in the proximate relation of employer and employee. See Michigan Laws 423.2
  • Labor organization: means any organization of any kind, or any agency or employee representation committee or plan, in which employees participate and that exists for the purpose, in whole or in part, of dealing with employers concerning grievances, labor disputes, wages, rates of pay, hours of employment, or conditions of work. See Michigan Laws 423.2
  • Large bingo: means a series of bingo occasions that occur on a regular basis during which the total value of all prizes awarded for bingo games at a single occasion does not exceed $3,500. See Michigan Laws 432.103
  • Large raffle: means an event at which the total value of all prizes awarded through raffle drawings exceeds $500. See Michigan Laws 432.103
  • Late model vehicle: means that term as defined in section 24b of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 257.1302
  • Late model vehicle: means a motor vehicle manufactured in the current model year or the 5 model years immediately preceding the current model year. See Michigan Laws 257.1351
  • Law: includes the federal or a state constitution, a federal or state statute, a judicial decision or order, a court rule, an executive order, and an administrative rule, regulation, or order. See Michigan Laws 600.2182
  • Law clerk: Assist judges with research and drafting of opinions.
  • Law enforcement agency: means the attorney general or a law enforcement agency as defined in section 2804 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 445.653
  • Law enforcement agency: means the sheriff of a county, or the law enforcement agency of a city, village, or township. See Michigan Laws 434.181a
  • Law enforcement agency: means that term as defined in section 2804 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 445.63
  • Law enforcement officer: means any of the following:
  •   (i) A sheriff or deputy sheriff. See Michigan Laws 600.8801
  • Lawful purpose: means a purpose that would qualify an organization to be exempt from taxation under subsection 501(c) of the internal revenue code of 1986, 26 USC 501. See Michigan Laws 432.132
  • Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.
  • Lease: includes a written or verbal lease or license agreement for use or possession of premises. See Michigan Laws 600.5701
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Lease contract: means a contract for the lease of a motor vehicle by a natural person for a term exceeding 30 days. See Michigan Laws 445.991
  • Lease price: means the actual vehicle sales price paid by the lessor including any cash payment by the consumer and the sum equal to any allowance for any trade-in but excludes debt from any other transaction as well as any manufacturer to consumer discount, rebate, or incentive appearing in the agreement or contract that the consumer received or that was applied to reduce the purchase or lease cost.   • Legacy: A gift of property made by will.
  • Legal owner: means any individual, organization, partnership, company, corporation, or governmental agency who had care, custody, or control over the property and can establish ownership to the satisfaction of the law enforcement agency by description, title, sales receipt, bill of goods, or other means. See Michigan Laws 434.21
  • Legal tender: coins, dollar bills, or other currency issued by a government as official money. Source: U.S. Mint
  • Legatee: A beneficiary of a decedent
  • Legislative session: That part of a chamber's daily session in which it considers legislative business (bills, resolutions, and actions related thereto).
  • Lender: means a person or governmental agency, other than the Michigan state housing development authority, making real property loans, including, but not limited to, an individual, a federal or state chartered savings and loan association or savings bank, a state or national bank, a federal or state chartered credit union, an insurance company, or other lender approved as a mortgagee under the national housing act, 12 U. See Michigan Laws 445.1621
  • Lessee: means a person who leases property pursuant to a rental-purchase agreement. See Michigan Laws 445.952
  • Lessee: means a person who, under a lease, acquires the right to possession and use of a new motor vehicle. See Michigan Laws 257.1401
  • Lessee: means a natural person who leases a motor vehicle under a lease contract. See Michigan Laws 445.991
  • Lessee: means that term as defined in section 1 of 1990 PA 169, MCL 445. See Michigan Laws 445.1012

  • Lessor: means a person who rents a location to a millionaire party licensee for the purpose of conducting an event. See Michigan Laws 432.132
  • Letter of credit: means a definite undertaking that satisfies the requirements of section 5104 by an issuer to a beneficiary at the request or for the account of an applicant or, in the case of a financial institution, to itself or for its own account, to honor a documentary presentation by payment or delivery of an item of value.   • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • License: means a license issued under this act. See Michigan Laws 445.1651a
  • Licensed fantasy contest operator: means a fantasy contest operator that is licensed by the board under this act. See Michigan Laws 432.502
  • Licensee: means a person, including a qualified organization, licensed under this act. See Michigan Laws 432.103
  • Licensee: means a person that is licensed under section 248 of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 257.1351
  • Licensee: means a person licensed or required to be licensed under this act. See Michigan Laws 445.1651a
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Lien: means a security interest in or other encumbrance on a motor vehicle. See Michigan Laws 257.1302
  • Limited edition: means a number of multiples which are produced from a single master, all of which depict the same image, and which bear numbers or other markings to denote that production of multiples from that master is limited to a stated maximum number, or which are otherwise held out as limited to a maximum number. See Michigan Laws 442.351a
  • Lineal descendant: Direct descendant of the same ancestors.
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Loan application: means a written application for a mortgage loan or home improvement loan. See Michigan Laws 445.1601
  • Loan officer: means an individual who is an employee or agent of a mortgage broker, mortgage lender, or mortgage servicer; who originates mortgage loans; and who is not an employee or agent of a depository financial institution or a subsidiary or affiliate of a depository financial institution. See Michigan Laws 445.1651a
  • Loan secured by a lien on real property: means a loan on the security of any instrument which makes the interest in real property specific security for the payment of the obligation secured by the instrument. See Michigan Laws 445.1621
  • Loan secured by a lien on stock in a residential cooperative housing corporation: means a loan on the security of the following:
  •   (i) A security interest in stock or a membership certificate issued to a tenant stockholder or resident member by a cooperative housing organization. See Michigan Laws 445.1621
  • Local governmental unit: means a city, village, township, or county. See Michigan Laws 445.482
  • Local law enforcement agency: means the police agency of the city, village, or township, or if none, the county sheriff of the county, in which a second hand dealer, junk dealer, or internet drop-off store conducts business. See Michigan Laws 445.403
  • Local police agency: means the police agency of a city, village, or township, or if none, the county sheriff. See Michigan Laws 257.1351
  • Local police agency: means the police agency of the city, village, or township, or if none, the county sheriff of the county, in which the dealer or internet drop-off store conducts business. See Michigan Laws 445.482
  • Local registrar: means that term as defined in section 2804 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 445.63
  • Local unit of government: means a county, township, city, or village. See Michigan Laws 445.591
  • Locality: means the county, city, village, township, or school district in which the physical work on a state project is to be performed. See Michigan Laws 408.1101
  • Location: means a building, enclosure, part of a building or enclosure, or a distinct portion of real property that is used for the purpose of conducting an event. See Michigan Laws 432.103
  • Location owner: means the person that owns a location or an employee or agent of the person. See Michigan Laws 432.132
  • Lockout: means the temporary withholding of work from a group of employees by shutting down the operation of the employer to bring pressure upon the affected employees or the bargaining representative, or both, to accept the employer's terms of settlement of a labor dispute. See Michigan Laws 423.201
  • Loft: means any structure in which carrier pigeons are housed. See Michigan Laws 433.351
  • Mail: means a letter, postal card, package, bag, or any other article or thing contained therein, or other sealed article addressed to a person. See Michigan Laws 445.32
  • Mailed: means delivered by United States mail or other delivery service that does not require the signature of recipient indicating actual receipt. See Michigan Laws 445.82
  • Main-traveled way: means the traveled way of a highway on which through traffic is carried. See Michigan Laws 252.302
  • Maintain: means to allow to exist and includes the periodic changing of advertising messages, and customary maintenance and repair of signs and sign structures. See Michigan Laws 252.302
  • Major component part: means any of the following parts of a motor vehicle:
  •   (i) The engine. See Michigan Laws 257.1302a
  • Major component part: means any of the following subassemblies of a motor vehicle regardless of its actual market value: front end assembly, including fenders, grills, hood, bumper, and related parts; engine; transmission; T-tops; rear clip assembly, including quarter panels and floor panel assembly; or doors. See Michigan Laws 257.1351
  • Majority leader: see Floor Leaders
  • Management company: means a person retained by a fantasy contest operator to manage a fantasy contest platform and provide general administration and other operational services. See Michigan Laws 432.502
  • Managerial employee: means a person who by virtue of the level of his or her remuneration or otherwise holds a management, supervisory, or policy making position with any licensee under this act, a vendor, or the board. See Michigan Laws 432.202
  • Manufacturer: means a person who bottles, cans, or otherwise places beverages in beverage containers for sale to distributors, dealers, or consumers. See Michigan Laws 445.571
  • Manufacturer: means a person licensed under section 11c that manufactures numeral game tickets for sale to suppliers for use in an event. See Michigan Laws 432.103
  • Manufacturer: means that term as defined in section 1 of the beverage container law, MCL 445. See Michigan Laws 445.653
  • Manufacturer: means a person who manufactures, assembles, or is a distributor of new motor vehicles and includes an agent of a manufacturer but does not include a new motor vehicle dealer. See Michigan Laws 257.1401
  • Manufacturer: means a person who manufactures or assembles wheelchairs and agents of that person, including an importer, a distributor, factory branch, distributor branch, and any warrantors of the manufacturer's wheelchairs, but does not include a wheelchair dealer. See Michigan Laws 445.1081
  • Mark: includes any trademark or service mark. See Michigan Laws 429.31
  • Markup: The process by which congressional committees and subcommittees debate, amend, and rewrite proposed legislation.
  • Master: means a printing plate, stone, block, screen, photographic negative, or other material which contains an image used to produce multiples. See Michigan Laws 442.351a
  • Master mechanic: means any of the following:
  •   (i) A motor vehicle mechanic or specialty mechanic who is certified by the department under this act in all of the specific repair or service categories applicable to automobiles or light trucks described in section 10(5). See Michigan Laws 257.1302a
  • Material fact: means a fact that is used by a person as a premise on which a conclusion is based. See Michigan Laws 257.1302a
  • Mechanic trainee: means an individual who desires to become a motor vehicle mechanic, a specialty mechanic, or a master mechanic and receives a permit from the administrator under this act. See Michigan Laws 257.1302a
  • Medical records or information: includes , but is not limited to, medical and mental health histories, reports, summaries, diagnoses and prognoses, treatment and medication information, notes, entries, and x-rays and other imaging records. See Michigan Laws 445.63
  • Member: means an individual who qualified for membership in a qualified organization under its bylaws, articles of incorporation, charter, rules, or other written statement. See Michigan Laws 432.103
  • Member: means a board member appointed to the board under this act. See Michigan Laws 432.202
  • Member of the immediate family: means the spouse, child, parent, or sibling. See Michigan Laws 431.302
  • Mental health court: means any of the following:
  •   (i) A court-supervised treatment program for individuals who are diagnosed by a mental health professional with having a serious mental illness, serious emotional disturbance, co-occurring disorder, or developmental disability. See Michigan Laws 600.1090
  • Mental health professional: means an individual who is trained and experienced in the area of mental illness or developmental disabilities and who is 1 of the following:
  •   (i) A physician. See Michigan Laws 600.1099b
  • Mental illness: means a substantial disorder of thought or mood that significantly impairs judgment, behavior, capacity to recognize reality, or ability to cope with the ordinary demands of life, including, but not limited to, post-traumatic stress disorder and psychiatric symptoms associated with traumatic brain injury. See Michigan Laws 600.1200
  • Metal beverage container: means a beverage container composed primarily of metal. See Michigan Laws 445.653
  • Michigan gaming control board: means the Michigan gaming control board created in the Michigan gaming control and revenue act, the Initiated Law of 1996, MCL 432. See Michigan Laws 432.252
  • Michigan national guard: means that term as defined in section 105 of the Michigan military act, 1967 PA 150, MCL 32. See Michigan Laws 445.1012
  • Michigan progressive jackpot: means a bingo game conducted in conjunction with a licensed large bingo occasion in which the value of the prize is carried forward to the next bingo occasion if no player wins in a predetermined number of allowable calls. See Michigan Laws 432.103
  • Milk: means the lacteal secretion, practically free from colostrum, obtained by the complete milking of 1 or more healthy cows, goats, sheep, or other dairy animals. See Michigan Laws 288.574
  • Milk buyer: means any milk producer, milk producer marketing organization, dairy plant, receiving station, transfer station, or bulk milk hauler that either takes delivery of raw milk or a raw milk product or manages the sale of the raw milk or raw milk product, or both. See Michigan Laws 288.574
  • milk plant: means any place, premises, or establishment where milk or dairy products are collected, handled, processed, stored, pasteurized, aseptically processed, packaged, or prepared for distribution. See Michigan Laws 288.572
  • milk product: means products that include, but are not limited to, evaporated milk, condensed skim milk, condensed milk, condensed buttermilk, condensed milk solids, concentrate milk, nonfat dry milk, dry milk, dry cream, dry whey, dry buttermilk, butter, buttermilk, cheese, cheese products, ice cream, sherbet, frozen desserts, dairy confections, or novelties, related dairy products with butter fat or milk solids substitutions, filtered milk components, infant formula manufactured with dairy ingredients, whey, whey cream, and other products for human consumption not regulated under the grade A milk law of 2001 or as determined appropriate by the director. See Michigan Laws 288.572
  • Milk tank truck: means both a bulk milk pickup tanker and a milk transport tank. See Michigan Laws 288.574
  • Milk transportation company: means the company that is the person responsible for a milk tank truck. See Michigan Laws 288.574
  • Millionaire party: means an event at which wagers are placed on games of chance customarily associated with a gambling casino through the use of imitation money or chips that have a nominal value equal to or greater than the value of the currency for which they can be exchanged. See Michigan Laws 432.103
  • Minimum finance charge: The minimum, or fixed, finance charge that will be imposed during a billing cycle. A minimum finance charge usually applies only when a finance charge is imposed, that is, when you carry over a balance. Source: Federal Reserve
  • Minor: means a person under 18 years of age. See Michigan Laws 409.102
  • Minor: means an individual under 18 years of age. See Michigan Laws 427.301
  • Minor repair services: means lubrication; oil changes; installing, changing, or otherwise servicing the antifreeze or other coolant; body repairing, except for unitized body structural repair; or the replacement, adjustment, repair, or servicing of any of the following parts and assemblies:
  •   (i) Air cleaner element. See Michigan Laws 257.1302a
  • Minority leader: See Floor Leaders
  • Mix: means ice cream mix, yogurt mix, sherbet mix, and any other unfrozen pasteurized liquid mixture which is to be manufactured into a frozen dessert including a liquid mixture intended for processing into quiescently frozen confections. See Michigan Laws 288.575
  • Mixed spirit drink: means a drink containing 10% or less alcohol by volume consisting of distilled spirits mixed with nonalcoholic beverages or flavoring or coloring materials and which may also contain water, fruit juices, fruit adjuncts, sugar, carbon dioxide, or preservatives; or any spirits based beverage, regardless of the percent of alcohol by volume, that is manufactured for sale in a metal container. See Michigan Laws 445.571
  • Mixed wine drink: means a drink or similar product marketed as a wine cooler and containing less than 7% alcohol by volume, consisting of wine and plain, sparkling, or carbonated water and containing any 1 or more of the following:
  •   (i) Nonalcoholic beverages. See Michigan Laws 445.571
  • Mobile application: means an application on a mobile phone or other device through which an individual is able to place an internet sports betting wager. See Michigan Laws 432.403
  • Mobile home: means a mobile home as defined in section 2 of the mobile home commission act, Act No. See Michigan Laws 600.5771
  • Mobile home park: means a mobile home park as defined in section 2 of Act No. See Michigan Laws 600.5771
  • Money: means a medium of exchange authorized or adopted by a domestic or foreign government. See Michigan Laws 440.1201
  • month: means a calendar month; the word "year" a calendar year; and the word "year" alone shall be equivalent to the words "year of our Lord". See Michigan Laws 8.3j
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Mortgage broker: means a person that, directly or indirectly, does 1 or both of the following:
  •   (i) Serves or offers to serve as an agent for a person in an attempt to obtain a mortgage loan. See Michigan Laws 445.1651a
  • Mortgage lender: means a person that, directly or indirectly, makes or offers to make mortgage loans. See Michigan Laws 445.1651a
  • Mortgage loan: means a loan secured by a mortgage on real property designed for occupancy by 4 or fewer families, including an individual unit of a condominium or cooperative, a refinancing of an existing mortgage loan on real property designed for occupancy by 4 or fewer families involving an increase in the outstanding balance of the principal due, or a loan secured by a junior lien on real property designed for occupancy by 4 or fewer families undertaken for any purpose.   • Mortgage loan: means a loan or home improvement installment contract secured by a first or subordinate mortgage or any other form of lien or a land contract that covers real property located in this state that is used as the borrower's principal dwelling and is designed for occupancy by 4 or fewer families. See Michigan Laws 445.1632
  • Mortgage loan: means a loan secured by a first mortgage on real property located in this state and used, or improved for use, as a dwelling and designed for occupancy by 4 or fewer families or a land contract covering real property located in this state used, or improved for use, as a dwelling and designed for occupancy by 4 or fewer families. See Michigan Laws 445.1651a
  • Mortgage loan: A loan made by a lender to a borrower for the financing of real property. Source: OCC
  • Mortgage servicer: means a person that, directly or indirectly, services or offers to service mortgage loans. See Michigan Laws 445.1651a
  • Mortgagee: The person to whom property is mortgaged and who has loaned the money.
  • Mortgagor: The person who pledges property to a creditor as collateral for a loan and who receives the money.
  • Motor vehicle: means a vehicle that is self-propelled, a vehicle that is propelled by electric power, a motorcycle, or a trailer as those terms are defined in the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 257.1302a
  • Motor vehicle: means that term as defined in section 2 of the motor vehicle sales finance act, 1950 (Ex Sess) PA 27, MCL 492. See Michigan Laws 445.852
  • Motor vehicle: means a motor vehicle as defined in section 33 of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 257.1351
  • Motor vehicle: means a self-propelled device by which a person or property may be transported upon a public highway. See Michigan Laws 257.1362
  • Motor vehicle: means a vehicle, including passenger vans and minivans, that is self-propelled, that is capable of being operated on a highway or street in this state, and that is primarily intended for the transport of persons. See Michigan Laws 445.991
  • Motor vehicle: means a motor vehicle as defined in section 33 of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 257.1401
  • Motor vehicle: means that term as defined in section 1 of 1990 PA 169, MCL 445. See Michigan Laws 445.1012
  • Motor vehicle: means a motor vehicle as defined in section 33 of Act No. See Michigan Laws 257.1702
  • Motor vehicle lease: means a lease contract as that term is defined in section 1 of 1990 PA 169, MCL 445. See Michigan Laws 445.1012
  • Motor vehicle mechanic: means a technician or other individual who, for compensation, repairs motor vehicles, including the reconditioning, replacement, adjustment, or alteration of the operating condition, of any component or subassembly of a motor vehicle. See Michigan Laws 257.1302a
  • motor vehicle repair facility: means a place of business that is required to register under this act and that, for compensation, is engaged in the business of performing, or employs individuals who perform, maintenance, diagnosis, vehicle body work, or repair service, or, beginning July 1, 2016, BAIID service, on a motor vehicle. See Michigan Laws 257.1302
  • Motor vehicle repair facility: means a place of business that engages in the business of performing or employing persons who perform maintenance, diagnosis, or repair service on a motor vehicle for compensation. See Michigan Laws 257.1351
  • Multiple vehicle driving facility: means that part of a driver education course that enables the driver education instructor, from a position outside the vehicle, and using electronic or oral communication, to teach and supervise several students simultaneously, each of whom is operating a vehicle at an off-street facility specifically designed for that type of instruction. See Michigan Laws 256.625
  • Multiples: means prints, photographs, photographic negatives, or other objects of visual art which are produced in more than 1 copy and sold, offered for sale, or consigned in, into, or from the state for value exceeding $100. See Michigan Laws 442.351a
  • Municipal civil infraction: means a civil infraction involving a violation of an ordinance, as defined in section 8701. See Michigan Laws 600.113
  • Municipal civil infraction action: means a civil action in which the defendant is alleged to be responsible for a municipal civil infraction. See Michigan Laws 600.113
  • Municipality: means a city, village, township, or county. See Michigan Laws 128.3
  • National Bank: A bank that is subject to the supervision of the Comptroller of the Currency. The Office of the Comptroller of the Currency is a bureau of the U.S. Treasury Department. A national bank can be recognized because it must have "national" or "national association" in its name. Source: OCC
  • National Credit Union Administration: The federal regulatory agency that charters and supervises federal credit unions. (NCUA also administers the National Credit Union Share Insurance Fund, which insures the deposits of federal credit unions.) Source: OCC
  • Neighborhood: means either of the following:
  •   (i) A census tract as defined by the United States bureau of the census in census of population, if located within a standard metropolitan statistical area as defined by the United States office of management and budget. See Michigan Laws 445.1601
  • Net commission: means the amount determined under section 17(3), after first deducting from the licensee's statutory commission the applicable state tax on wagering due and payable under section 22 and the actual verified fee paid by the licensee to the sending host track to receive the simulcast signal. See Michigan Laws 431.302
  • Net cost: means an amount equal to the original invoice price that the dealer paid for the merchandise to the supplier, less all applicable discounts allowed and received, plus the freight cost incurred by the dealer from the location of the supplier to the location of the dealer. See Michigan Laws 445.1452
  • New motor vehicle: means a motor vehicle that is purchased or leased in this state or purchased or leased by a resident of this state and is covered by a manufacturer's express warranty at the time of purchase or lease. See Michigan Laws 257.1401
  • New motor vehicle dealer: means a person or that person's agent who holds a dealer agreement for the sale of new motor vehicles, who is engaged in the business of purchasing, leasing, selling, exchanging, or dealing in new motor vehicles, and who has an established place of business in this state. See Michigan Laws 257.1401
  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
  • Nominated person: means both of the following:
  •   (i) A person whom the issuer designates or authorizes to pay, accept, negotiate, or otherwise give value under a letter of credit. See Michigan Laws 440.5102
  • Nonconforming sign: means a sign or sign structure, other than a nonstandard sign or a sign that is erected and maintained in a business area along a scenic byway prior to the designation as a scenic byway, that satisfies 1 of the following:
  •   (i) Was legally erected before March 31, 1972 but could not be legally erected under the current provisions of this act. See Michigan Laws 252.302
  • Nonconformity: means a condition or defect that substantially impairs the use, value, or safety of a wheelchair and that is covered by an express warranty applicable to the wheelchair or to a component of the wheelchair, but does not include a condition or defect that is the result of abuse, neglect, or unauthorized modification or alteration of the wheelchair by a consumer. See Michigan Laws 445.1081
  • Nonferrous metal: means a metal that does not contain significant quantities of ferrous metal but contains copper, brass, platinum group-based metals, aluminum, bronze, lead, zinc, nickel, or alloys of those metals. See Michigan Laws 445.423
  • nonpublic continuing care retirement center: means a residential community that, as determined by the commission, meets both of the following conditions:
  •   (a) Provides full-time residential housing predominantly for individuals over the age of 62. See Michigan Laws 436.1545
  • Nonrecourse carveout: means a specific exception, if any, to the nonrecourse provisions set forth in the loan documents for a nonrecourse loan that has the effect of creating, if specified events occur, personal liability of the borrower or a guarantor or other surety of the loan for all or some amounts owed to the lender. See Michigan Laws 445.1592
  • Nonrecourse loan: means a commercial loan secured by a mortgage on real property located in this state and evidenced by loan documents that meet any of the following:
  •   (i) Provide that the lender will not enforce the liability or obligation of the borrower by an action or proceeding in which a money judgment is sought against the borrower. See Michigan Laws 445.1592
  • Nonrecourse provisions: means 1 or more of the provisions described in subdivision (b)(i) to (v), whether or not the loan is subject to a nonrecourse carveout or carveouts. See Michigan Laws 445.1592
  • Nonrefillable container: means a returnable container which is not intended to be refilled for sale by a manufacturer. See Michigan Laws 445.571
  • Nonreturnable container: means a beverage container upon which no deposit or a deposit of less than 10 cents has been paid, or is required to be paid upon the removal of the container from the sale or consumption area, or for which no cash refund or a refund of less than 10 cents is payable by a dealer or distributor in this state of that beverage in beverage containers, as further provided in section 2. See Michigan Laws 445.571
  • Nonstandard sign: means a sign or sign structure other than a nonconforming sign, that is subject to this act, was legally erected before March 23, 1999, is not a nonconforming sign, and does not comply with the spacing requirements in section 17(1), but otherwise complies with this act. See Michigan Laws 252.302
  • Numeral game: means the random resale of a series of numeral game tickets. See Michigan Laws 432.103
  • Numeral game ticket: means a paper strip on which preprinted numerals are covered by folding the strip and banding the folded strip with a separate piece of paper, so that on breaking the paper that bands the folded strip the purchaser discovers whether the ticket is a winning ticket. See Michigan Laws 432.103
  • Oath: A promise to tell the truth.
  • oath: shall be construed to include the word "affirmation" in all cases where by law an affirmation may be substituted for an oath; and in like cases the word "sworn" shall be construed to include the word "affirmed". See Michigan Laws 8.3k
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Obligation: means an indebtedness incurred by an individual for personal, family, or household purposes. See Michigan Laws 445.271
  • Occasion: means the hours of the day for which a license is issued. See Michigan Laws 432.103
  • Occupational license: means a license issued by the board to a person to perform in a casino or a casino enterprise an occupation that directly impacts the integrity of gaming and that the board has identified as requiring a license to perform the occupation in a casino or casino enterprise in this state. See Michigan Laws 432.202
  • Offering for sale: means selling, offering to sell, holding for sale, preparing for sale, trading, bartering, offering as a gift as an inducement for sale of, and advertising for sale in any media. See Michigan Laws 288.576
  • Office of the racing commissioner: means the horse racing section of the horse racing, audit, and gaming technology division of the Michigan gaming control board created by section 4 of the Michigan gaming control and revenue act, 1996 IL 1, MCL 432. See Michigan Laws 431.302
  • Official fees: means fees prescribed by law and charged and paid by the seller or holder for filing, recording, or otherwise perfecting, releasing, or satisfying, a retained title, lien, or other security interest created by a retail installment transaction. See Michigan Laws 445.852
  • Official fees: means the fees required by law to be paid to the appropriate public officer for obtaining any permit or filing or recording or releasing any judgment, mortgage, or other lien or perfecting any security interest taken or reserved as security in connection with a home improvement installment contract. See Michigan Laws 445.1102
  • Official league data: means statistics, results, outcomes, and other data relating to an athletic event obtained by a sports betting operator under an agreement with a sports governing body, or an entity expressly authorized by the sports governing body for determining the outcome of tier 2 sports bets. See Michigan Laws 432.403
  • On consignment: means that no title to or estate in the fine art or right to possession of the fine art superior to that of the consignor vests in the consignee, except that the consignee has the power or authority to transfer and convey, to a third person, all of the right, title, and interest of the consignor, in and to the fine art. See Michigan Laws 442.311
  • On-premises sign: means a sign advertising activities conducted or maintained on the property on which it is located. See Michigan Laws 252.302
  • Operator: means a person who controls the operation of a carnival or amusement ride. See Michigan Laws 408.652
  • Operator: means a person who owns or controls, or who has operational responsibility for, a ski area or ski lift. See Michigan Laws 408.322
  • Operator of a vending machine: means equally its owner, the person who refills it, and the owner or lessee of the property upon which it is located. See Michigan Laws 445.571
  • Oral argument: An opportunity for lawyers to summarize their position before the court and also to answer the judges' questions.
  • Ordinance: includes a temporary vessel speed limit established by a county emergency management coordinator or sheriff under section 80146 of the natural resources and environmental protection act, 1994 PA 451, MCL 324. See Michigan Laws 600.8701
  • Originate: means any of the following:
  •   (i) To negotiate, arrange, or offer to negotiate or arrange a mortgage loan between a mortgage lender and 1 or more individuals. See Michigan Laws 445.1651a
  • Outlays: Outlays are payments made (generally through the issuance of checks or disbursement of cash) to liquidate obligations. Outlays during a fiscal year may be for payment of obligations incurred in prior years or in the same year.
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Owner: means any person who owns or leases and controls or manages the operation of a carnival or amusement ride, and includes an individual, partnership, corporation, both profit and nonprofit, or the state and any of its political subdivisions and their departments or agencies. See Michigan Laws 408.652
  • Owner: means a person who has a right of property in an animal, a person who keeps or harbors an animal or has it in his or her care, or a person who permits an animal to remain on or about the premises occupied by him or her. See Michigan Laws 433.11
  • owner: shall include all individuals, incorporated companies, societies or associations having any title or interest in any properties, rights, easements or franchises to be acquired. See Michigan Laws 254.152
  • Owner: includes all individuals, copartnerships, associations, or corporations and also municipalities, political subdivisions, and all public agencies and instrumentalities having any title or interest in any property, rights, easements, and interests authorized to be acquired by this act. See Michigan Laws 254.221
  • Owner-builder: means an individual who is not a licensed residential builder and who builds, or acts as a general contractor for the construction of, a residential structure in which that individual or a member of that individual's family actually resides, or intends to occupy for his or her own use, upon the issuance of an occupancy permit. See Michigan Laws 445.883
  • Paid medical leave: means time off from work that is provided by an employer to an eligible employee that can be used for the purposes described in section 4(1). See Michigan Laws 408.962
  • panel: means a mediation panel selected pursuant to section 4905. See Michigan Laws 600.4901
  • Parking area: means an area used by the public as a means of access to and egress from, and for the free parking of motor vehicles by patrons of a shopping center, business, factory, hospital, institution, or similar building or location. See Michigan Laws 257.941
  • Participant: means an individual who is admitted into a drug treatment court. See Michigan Laws 600.1060
  • Participant: means an individual who is admitted into a mental health court. See Michigan Laws 600.1090
  • Participant: means a juvenile who is admitted into a juvenile mental health court. See Michigan Laws 600.1099b
  • Participant: means an individual who is admitted into a veterans treatment court. See Michigan Laws 600.1200
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Party: means the person or entity commencing a civil action. See Michigan Laws 600.1985
  • Payroll: means remuneration paid by a contributing employer for employment. See Michigan Laws 421.18
  • PEGSISF: means the fund created in subsection (4). See Michigan Laws 418.501
  • Penalty: includes fines, forfeitures, and forfeited recognizances. See Michigan Laws 600.4801
  • Performing group: means a vocal or instrumental group seeking to use the name of another group that has previously released a commercial sound recording under that name. See Michigan Laws 445.902
  • Period: means a day, week, 1 month, or other subdivision of a year. See Michigan Laws 445.952
  • Perishable property: means any property subject to quick deterioration or spoilage except when maintained under proper conditions. See Michigan Laws 434.21
  • Person: means an individual, partnership, corporation, association, or other legal entity. See Michigan Laws 445.571
  • Person: means an individual, partnership, corporation, association, limited liability company, federally recognized Indian tribe, or other legal entity. See Michigan Laws 432.303

  • Person: means a sole proprietorship, partnership, corporation, or any other form of business organization. See Michigan Laws 445.1452

  • Person holding a casino interest: includes all of the following:
  •   (i) A person who holds at least a 1% interest in a casino licensee or casino enterprise. See Michigan Laws 432.272
  • Personal identification cardholder list: means a compilation of names of individuals who are 18 years of age or older, addresses, zip codes, dates of birth, and sexes of Michigan residents who have received an official state personal identification card under Act No. See Michigan Laws 600.1300
  • Personal identifying information: means a name, number, or other information that is used for the purpose of identifying a specific person or providing access to a person's financial accounts, including, but not limited to, a person's name, address, telephone number, driver license or state personal identification card number, social security number, place of employment, employee identification number, employer or taxpayer identification number, government passport number, health insurance identification number, mother's maiden name, demand deposit account number, savings account number, financial transaction device account number or the person's account password, any other account password in combination with sufficient information to identify and access the account, automated or electronic signature, biometrics, stock or other security certificate or account number, credit card number, vital record, or medical records or information. See Michigan Laws 445.63
  • Personal information: means the first name or first initial and last name linked to 1 or more of the following data elements of a resident of this state:
  •   (i) Social security number. See Michigan Laws 445.63
  • Personal injury: includes a disease or disability that is due to causes and conditions that are characteristic of and peculiar to the business of the employer and that arises out of and in the course of the employment. See Michigan Laws 418.401
  • Personal injury: means bodily harm, sickness, disease, death, or emotional harm resulting from bodily harm. See Michigan Laws 600.6301
  • Personal property: All property that is not real property.
  • Personnel record: means a record kept by the employer that identifies the employee, to the extent that the record is used or has been used, or may affect or be used relative to that employee's qualifications for employment, promotion, transfer, additional compensation, or disciplinary action. See Michigan Laws 423.501
  • Plaintiff: means the person bringing the asbestos action, including a personal representative if the asbestos action is brought by an estate, or a conservator or next friend if the asbestos action is brought on behalf of a minor or legally incapacitated individual. See Michigan Laws 600.3011
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Plastic beverage container: means a beverage container composed primarily of plastic. See Michigan Laws 445.653
  • Platinum: means elemental platinum having an atomic weight of 195. See Michigan Laws 445.482
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
  • Poker: means the traditional game of poker, and any derivative of the game of poker as approved by the board, in which 2 or more authorized participants play against each other and wager on the value of the cards in the authorized participants' hands. See Michigan Laws 432.303
  • Political subdivision: means a village, city, township, county, or a university of this state. See Michigan Laws 257.1572
  • Post closing solvency covenant: means any provision of the loan documents for a nonrecourse loan, whether expressed as a covenant, representation, warranty, or default, that relates solely to the solvency of the borrower, including, without limitation, a provision requiring that the borrower maintain adequate capital or have the ability to pay its debts, with respect to any period of time after the date the loan is initially funded. See Michigan Laws 445.1592
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Practicum: means classroom and behind-the-wheel instruction in a driver education course under the direction of an instructor employed, enlisted, or appointed by a college or university or by a person approved by the secretary of state and a cooperating instructor, providing practical application of theory and experience for a student in an approved driver education instructor preparation program. See Michigan Laws 256.627
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Precious gem: means a diamond, alexandrite, ruby, sapphire, opal, amethyst, emerald, aquamarine, morganite, garnet, jadeite, topaz, tourmaline, turquoise, or pearl. See Michigan Laws 445.482
  • Precious item: means jewelry, a precious gem, or an item containing gold, silver, or platinum. See Michigan Laws 445.482
  • Premises: includes lands, tenements, condominium property, cooperative apartments, air rights and all manner of real property. See Michigan Laws 600.5701
  • Presentation: means delivery of a document to an issuer or nominated person for honor or giving of value under a letter of credit. See Michigan Laws 440.5102
  • Presentence report: A report prepared by a court's probation officer, after a person has been convicted of an offense, summarizing for the court the background information needed to determine the appropriate sentence. Source: U.S. Courts
  • Presenter: means a person making a presentation as or on behalf of a beneficiary or nominated person. See Michigan Laws 440.5102
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • Primary highway: means a state trunk line highway as designated, or as may hereafter be so designated, by the state highway department, and approved by the United States secretary of transportation, pursuant to the provisions of title 23 of the United States code. See Michigan Laws 252.201
  • Primary highway: means a highway other than an interstate highway or freeway that is a regulated route. See Michigan Laws 252.302
  • Primary obligor: means a person, other than a cosigner, who signs an obligation as a debtor. See Michigan Laws 445.271
  • principal: means a person that offers or extends credit creating a debt or a person to which a debt is owed or due or asserted to be owed or due. See Michigan Laws 445.251
  • Principal amount financed: means the cash price of the goods and services which are the subject matter of the home improvement installment sale minus the amount of the buyer's down payment, plus the amounts, if any, included for insurance and official fees. See Michigan Laws 445.1102
  • Principal balance: means the cash sale price of the goods or services covered by a retail installment contract plus the amounts, if any, included in the cash sale price if a separate identified charge is made and stated in the contract for insurance or official fees, less the amount of the buyer's down payment in money or goods, or both. See Michigan Laws 445.852
  • Principal officer: means the highest ranking officer of the qualified organization according to its written constitution, charter, articles of incorporation, or bylaws. See Michigan Laws 432.103a
  • Prison: means a facility that incarcerates or detains juveniles or adults accused of, convicted of, sentenced for, or adjudicated delinquent for, violations of state or local law. See Michigan Laws 600.5531
  • Prisoner: means a person subject to incarceration, detention, or admission to a prison who is accused of, convicted of, sentenced for, or adjudicated delinquent for violations of state or local law or the terms and conditions of parole, probation, pretrial release, or a diversionary program. See Michigan Laws 600.5531
  • Private nonprofit organization: means a private organization exempt from taxation under section 501(c)(3) of the internal revenue code, 26 USC 501(c)(3). See Michigan Laws 434.181a
  • Prize: means anything of value, including, but not limited to, money or merchandise that is given to a player for attending or winning a game at an event. See Michigan Laws 432.103a
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probate: Proving a will
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Proceeds of a crime: means any property obtained through the commission of a crime, including any appreciation in the value of the property. See Michigan Laws 600.4701
  • Processor: means the owner or operator of a dairy plant. See Michigan Laws 288.576
  • Producer: means a person who owns or operates a dairy farm and sells or distributes milk produced on that farm including a person who markets milk on behalf of a producer pursuant to a marketing agreement. See Michigan Laws 288.576
  • Professional development requirements: means training prescribed by the secretary of state to update the instructional knowledge and skill of a driver education instructor. See Michigan Laws 256.627
  • Program: means the Michigan business and industrial training program established pursuant to section 3. See Michigan Laws 421.222
  • Project: includes a bridge or tunnel, overpasses, underpasses, entrance plazas, toll houses, administration, storage and other buildings and facilities, and all equipment therefor, and may include buses and terminal facilities, the existing ferry system, and such approaches and approach highways as may be determined by the authority to be necessary to facilitate the flow of traffic or to connect the project with the existing highway systems, together with all property, rights, easements, and interests acquired by the authority for the construction or operation of the project. See Michigan Laws 254.221
  • Proofs: means multiples which depict the same image as, and which are produced from the same master used to produce, a limited edition, but which, whether or not designated as proofs, are set aside from and are in addition to the limited edition to which they relate. See Michigan Laws 442.351a
  • Property: means anything which is the subject of ownership and is corporeal, tangible, visible, or personal, or that has an exchange value. See Michigan Laws 434.21
  • Property of major value: means any property that is not collectible currency, contraband, currency, evidence, hazardous material, junk, perishable property, or property of minor value. See Michigan Laws 434.21
  • Property of minor value: means any property whose fair market value is less than the total cost of preparing a property report, plus the costs of storage and disposition, and which is not collectible currency, contraband, currency, evidence, hazardous material, junk, perishable property, or property of major value. See Michigan Laws 434.21
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Prosecutor: means the prosecuting attorney of the county, the city attorney, the village attorney, or the township attorney. See Michigan Laws 600.1060
  • Prosecutor: means the prosecuting attorney of the county, the city attorney, the village attorney, or the township attorney. See Michigan Laws 600.1200
  • Prospective employer: means a person to whom an employee or former employee has submitted an application for employment. See Michigan Laws 423.451
  • Prospective relief: means all relief other than monetary damages. See Michigan Laws 600.5531
  • Protected information: means information related to the playing of fantasy contests by fantasy contest players that is obtained by a fantasy contest operator. See Michigan Laws 432.502
  • provider: means a person that meets the requirements in subparagraph (i), if not excluded under subparagraph (ii), as follows:
  •   (i) Maintains or obtains the facilities and certified instructors to give instruction in the driving of a motor vehicle or maintains or obtains the facilities and certified instructors to prepare an applicant for an exam given by the secretary of state for a license as defined in section 25 of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 256.625
  • Public body: means that term as it is defined in section 2 of the freedom of information act, 1976 PA 442, MCL 15. See Michigan Laws 445.1032
  • Public employee: means an individual holding a position by appointment or employment in the government of this state, in the government of 1 or more of the political subdivisions of this state, in the public school service, in a public or special district, in the service of an authority, commission, or board, or in any other branch of the public service, subject to the following exceptions:
  •   (i) An individual employed by a private organization or entity who provides services under a time-limited contract with this state or a political subdivision of this state or who receives a direct or indirect government subsidy in his or her private employment is not an employee of this state or that political subdivision, and is not a public employee. See Michigan Laws 423.201
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Public playground equipment: means apparatus, including but not limited to slides, climbers, seesaws, and swings, designed for the recreational use of children and owned and operated by a local unit of government, school district, or any other governmental entity. See Michigan Laws 408.682
  • public police or fire department employee: means any employee of a city, county, village, or township, or of any authority, district, board, or any other entity created in whole or in part by the authorization of 1 or more cities, counties, villages, or townships, whether created by statute, ordinance, contract, resolution, delegation, or any other mechanism, who is engaged as a police officer, or in fire fighting or subject to the hazards thereof; emergency medical service personnel employed by a public police or fire department; or an emergency telephone operator, but only if directly employed by a public police or fire department. See Michigan Laws 423.232
  • Public school academy: means a public school academy or strict discipline academy organized under the revised school code, 1976 PA 451, MCL 380. See Michigan Laws 423.201
  • Public school administrator: means a superintendent, assistant superintendent, chief business official, principal, or assistant principal employed by a school district, intermediate school district, or public school academy. See Michigan Laws 423.201
  • Public school employer: means a public employer that is the board of a school district, intermediate school district, or public school academy; is the chief executive officer of a school district in which a school reform board is in place under part 5A of the revised school code, 1976 PA 451, MCL 380. See Michigan Laws 423.201
  • Public utility: means that term as defined in section 1 of 1972 PA 299, MCL 460. See Michigan Laws 445.63
  • Publicly display: means to exhibit, hold up, post, or make visible or set out for open view, including, but not limited to, open view on a computer device, computer network, website, or other electronic medium or device, to members of the public or in a public manner. See Michigan Laws 445.82
  • Purchase price: means the actual vehicle sales price listed on the buyer's order including any cash payment by the consumer and the sum equal to any allowance for any trade-in but excludes debt from any other transaction as well as any manufacturer to consumer discount, rebate, or incentive appearing in the agreement or contract that the consumer received or that was applied to reduce the purchase cost. See Michigan Laws 257.1401
  • Purchase transaction: means a purchase of scrap metal, or the purchase of property described in section 10 if the knowing purchase or offer to purchase that property is not prohibited by that section, by a scrap metal dealer. See Michigan Laws 445.423
  • Purse pool: means an amount of money allocated or apportioned to pay prizes for horse races and from which payments may be made to certified horsemen's organizations as provided in this act. See Michigan Laws 431.302
  • Qualified organization: means , subject to subdivision (e), either of the following:
  •   (i) A bona fide religious, educational, service, senior citizens, fraternal, or veterans' organization that operates without profit to its members and that either has been in existence continuously as an organization for a period of 5 years or is exempt from taxation under section 501(c) of the internal revenue code of 1986, 26 USC 501(c). See Michigan Laws 432.103a
  • Qualified vendor: means a private vendor selected by the state court administrative office by a competitive bidding process to effectuate the purpose of section 1991(3). See Michigan Laws 600.1985
  • Quarantine period: means the recommended number of days that an individual be in quarantine after the individual is in close contact as prescribed in the United States Centers for Disease Control and Prevention's guidelines regarding COVID-19. See Michigan Laws 419.401
  • Quorum: The number of legislators that must be present to do business.
  • racing commissioner: means the executive director of the Michigan gaming control board appointed under section 4 of the Michigan gaming control and revenue act, 1996 IL 1, MCL 432. See Michigan Laws 431.302
  • Racing event: means a motor vehicle race which is sanctioned by a nationally or internationally recognized racing organization, and includes preparations, practices, and qualifications for the race. See Michigan Laws 257.1702
  • Raffle: means an event for which raffle tickets are sold and at which a winner or winners are determined, either by randomly selecting stubs from all of the raffle tickets sold for an event or by an alternative method that is approved in writing by the bureau, and a preannounced prize is awarded. See Michigan Laws 432.103a
  • railroad company: as used in this act , shall be taken to embrace any company, association, corporation, or person managing, maintaining, operating, or in possession of a common carrier railroad in whole or in part within this state, whether as owner, contractor, lessee, mortgagee, trustee, assignee or receiver. See Michigan Laws 419.53
  • rating account: shall be construed to include reference to the employer's experience account. See Michigan Laws 421.3
  • Real estate broker: means a broker or associate broker licensed under article 25 of the occupational code, 1980 PA 299, MCL 339. See Michigan Laws 445.1651a
  • Real estate salesperson: means a salesperson licensed under article 25 of the occupational code, 1980 PA 299, MCL 339. See Michigan Laws 445.1651a
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Real property loan: means a loan, mortgage, advance, or credit sale secured by a lien on real property, on the stock allocated to a dwelling unit in a cooperative housing corporation, or on a residential manufactured home, whether real or personal property. See Michigan Laws 445.1621
  • Reasonable attempt to repair: means either or both of the following occurring within the term of an express warranty applicable to a new wheelchair or within 1 year after first delivery of the wheelchair to a consumer, whichever is sooner:
  •   (i) The same nonconformity is subject to repair at least 4 times by the manufacturer, wheelchair lessor, or any of the manufacturer's authorized wheelchair dealers. See Michigan Laws 445.1081
  • reasonable employment: means work that is within the employee's capacity to perform that poses no clear and proximate threat to that employee's health and safety, and that is within a reasonable distance from that employee's residence. See Michigan Laws 418.401
  • Receiving station: means any place, premise, or establishment where raw milk is received, collected, handled, stored, or cooled and is prepared for further transporting. See Michigan Laws 288.576
  • Recess: A temporary interruption of the legislative business.
  • Recipient: means a city, village, county, township, school district, intermediate school district, university, community college, private nonprofit organization, or governmental authority, or an agency or department of a city, village, county, township, school district, intermediate school district, or a private nonprofit organization. See Michigan Laws 409.222
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Michigan Laws 600.2182
  • Record: means information that is inscribed on a tangible medium, or that is stored in an electronic or other medium and is retrievable in perceivable form. See Michigan Laws 440.5102
  • Record: means a paper, electronic, or other generally accepted method of storing information in a retrievable form. See Michigan Laws 445.423
  • Recording group: means a vocal or instrumental group that meets both of the following:
  •   (i) At least 1 of the members of the group has previously released a commercial sound recording under the group's name. See Michigan Laws 445.902
  • Recourse: An arrangement in which a bank retains, in form or in substance, any credit risk directly or indirectly associated with an asset it has sold (in accordance with generally accepted accounting principles) that exceeds a pro rata share of the bank's claim on the asset. If a bank has no claim on an asset it has sold, then the retention of any credit risk is recourse. Source: FDIC
  • Recreational trailer: means a travel trailer, camper trailer, or other special purpose or utility trailer or semitrailer designed or intended to be drawn on the highway by an automobile or light truck that has a gross towing vehicle weight of less than 10,000 pounds. See Michigan Laws 257.1302a
  • Register: means filing a notice with the commissioner on a form prescribed by the commissioner that notifies the commissioner of the intent to engage in the activities of a mortgage broker, mortgage lender, or mortgage servicer in this state and the payment of any fees required under this act, along with the other documents, proofs, and fees required by the commissioner. See Michigan Laws 445.1651a
  • Registrant: means the person to whom the registration of a trademark or service mark under this act is issued, his or her legal representatives, successors, or assigns. See Michigan Laws 429.31
  • Registrant: means a person that is registered under section 6 or required to register under section 6. See Michigan Laws 445.1651a
  • Regulated person: means a person whose collection activities are confined and are directly related to the operation of a business other than that of a collection agency including any of the following:
  •   (i) A regular employee who collects accounts for 1 employer if the collection efforts are carried on in the name of the employer. See Michigan Laws 445.251
  • Regulated route: means an interstate highway, freeway, or primary highway required to be regulated under 23 USC 131 and any other route that is required to be regulated or may become required to be regulated by the department under this act or another state or federal statute or legal requirement. See Michigan Laws 252.302
  • Related entity: means a business entity other than a natural person whose members, owners, partners, or limited partners include a state or national chartered bank, a state or federal chartered savings bank, a state or federal chartered savings and loan association, a state or federal chartered credit union, an insurance carrier, or finance subsidiary of a manufacturing corporation. See Michigan Laws 438.61
  • Relevant market: means the geographical area of actual or potential competition in a line of trade or commerce, all or any part of which is within this state. See Michigan Laws 445.771
  • Relief: means all relief in any form that may be granted or approved by the court, and includes consent decrees but does not include private settlement agreements. See Michigan Laws 600.5531
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Remand: When an appellate court sends a case back to a lower court for further proceedings.
  • Remedy: means any remedial right to which an aggrieved party is entitled with or without resort to a tribunal. See Michigan Laws 440.1201
  • Removal sale: means any sale held in such a manner as to induce a belief that upon disposal of the stock of goods on hand, the business will cease and discontinue at the premises where the sale is conducted, and thereafter will be moved to and occupy another location. See Michigan Laws 442.211
  • Rental-purchase agreement: means an agreement for the use of personal property by a lessee primarily for personal, family, or household purposes, for an initial period of 4 months or less that is automatically renewable with each payment after the initial period and that permits the lessee to become the owner of the property. See Michigan Laws 445.952
  • Repair: means the reconditioning, adjustment, alteration, maintenance, or diagnosis of the operating condition of a motor vehicle, with or without the replacement of any component or subassembly of a motor vehicle, for compensation or under the terms of a warranty. See Michigan Laws 257.1302a
  • Repair category: means a category of motor vehicle repair work, listed in section 10b, that certification under this act is required to perform. See Michigan Laws 257.1302a
  • Repair facility: means any motor vehicle dealer, garage, body repair shop, or other commercial entity that undertakes the repair or replacement of parts that generally constitute the exterior of a motor vehicle. See Michigan Laws 257.1362
  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • Representative: means a person empowered to act for another, including an agent, an officer of a corporation or association, and a trustee, executor, or administrator of an estate. See Michigan Laws 440.1201
  • Rerun: means a frozen dessert that is not placed in its final container immediately after passing through the freezing process and is intended to be melted and reprocessed or refrozen. See Michigan Laws 288.576
  • Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
  • Resident: means an individual who has in this state the individual's true, fixed, and permanent home and principal establishment to which the individual intends to return whenever absent. See Michigan Laws 409.302
  • Resident: means an individual who has in this state the individual's true, fixed, and permanent home and principal establishment to which the individual intends to return whenever absent. See Michigan Laws 409.321
  • Resident of this state: means as follows:
  •   (i) For an individual, an individual who is a legal resident of this state. See Michigan Laws 257.1401
  • Residential builder: means a person engaged in the construction of a residential structure or a combination residential and commercial structure who, for a fixed sum, price, fee, percentage, valuable consideration, or other compensation, other than wages for personal labor only, undertakes with another or offers to undertake or purports to have the capacity to undertake with another for the erection, construction, replacement, repair, alteration, or an addition to, subtraction from, improvement, wrecking of, or demolition of, a residential structure or combination residential and commercial structure; a person who manufactures, assembles, constructs, deals in, or distributes a residential or combination residential and commercial structure which is prefabricated, preassembled, precut, packaged, or shell housing; or a person who erects a residential structure or combination residential and commercial structure except for the person's own use and occupancy on the person's property.   • Residential manufactured home: means a manufactured home as defined in section 603(6) of the national manufactured housing construction and safety standards act of 1974, 42 U. See Michigan Laws 445.1621
  • Residential structure: means a premises used or intended to be used for a residence purpose and related facilities appurtenant to the premises used or intended to be used as an adjunct of residential occupancy. See Michigan Laws 445.883
  • Residential window period loan: means a window period loan which is 1 of the following:
  •   (i) A loan secured by a lien on real property intended for occupancy by not more than 4 families. See Michigan Laws 445.1621
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Retail: means selling or offering for sale dairy products directly to a consumer. See Michigan Laws 288.576
  • Retail charge agreement: means an instrument prescribing the terms of a secured or unsecured retail installment transaction that may be made under the instrument from time to time and under the terms of which a time price differential is to be computed in relation to the buyer's unpaid balance from time to time. See Michigan Laws 445.852
  • Retail installment contract: means an instrument entered into in this state evidencing a secured or unsecured retail installment transaction, and includes a chattel mortgage, a security agreement, a conditional sale contract, or a bailment or lease contract if the bailment or lease contract requires the bailee or lessee to pay an amount equal to or greater than the value of the bailed or leased good, and additionally provides that the bailee or lessee shall become, for no additional consideration or for nominal consideration, the owner of the good on full compliance with the bailment or lease contract. See Michigan Laws 445.852
  • Retail installment transaction: means any transaction in which a retail buyer purchases goods or services from a retail seller pursuant to a retail installment contract or a retail charge agreement that provides for a time price differential and under which the buyer agrees to pay the unpaid balance in 1 or more installments. See Michigan Laws 445.852
  • Retrofit: means to install vision technology for designated metal, plastic, or glass beverage containers in an existing, new, or replacement reverse vending machine. See Michigan Laws 445.633
  • Returnable container: means a beverage container upon which a deposit of at least 10 cents has been paid, or is required to be paid upon the removal of the container from the sale or consumption area, and for which a refund of at least 10 cents in cash is payable by every dealer or distributor in this state of that beverage in beverage containers, as further provided in section 2. See Michigan Laws 445.571
  • Returnable container: means that term as defined in section 1 of the beverage container law, MCL 445. See Michigan Laws 445.653
  • revenue bonds: means revenue bonds of the authority issued under this act. See Michigan Laws 254.221
  • Reverse vending machine: means that term as defined in the reverse vending machine antifraud act. See Michigan Laws 445.633
  • Reverse vending machine: means a device designed to properly identify and process empty beverage containers and provide a means for a deposit refund on returnable containers. See Michigan Laws 445.653
  • Reverse vending machine manufacturer: means that term as defined in the reverse vending machine antifraud act. See Michigan Laws 445.633
  • Reverse vending machine manufacturer: means a person that engages in any of the following and the representatives of that person:
  •   (i) Designing or manufacturing a reverse vending machine. See Michigan Laws 445.653
  • Revocation: means the termination of a driver education provider's certification or a driver education instructor's certification. See Michigan Laws 256.627
  • rider of a carnival or amusement ride: means an individual who is waiting in the immediate vicinity of a carnival or amusement ride to get on the carnival or amusement ride, getting on a carnival or amusement ride, using a carnival or amusement ride, getting off a carnival or amusement ride, or leaving a carnival or amusement ride and is still in the immediate vicinity of the carnival or amusement ride. See Michigan Laws 408.652
  • Right: includes remedy. See Michigan Laws 440.1201
  • Right of rescission: Right to cancel, within three business days, a contract that uses the home of a person as collateral, except in the case of a first mortgage loan. There is no fee to the borrower, who receives a full refund of all fees paid. The right of rescission is guaranteed by the Truth in Lending Act (TILA). Source: OCC
  • Rule: means a rule promulgated pursuant to the administrative procedures act of 1969, Act No. See Michigan Laws 409.102
  • Rule: means a rule promulgated pursuant to the administrative procedures act of 1969, 1969 PA 306, MCL 24. See Michigan Laws 445.1032
  • sale: means the sale of goods and furnishing of services or the furnishing of services by a contractor to a retail buyer pursuant to a home improvement installment contract in which the cash price is stated to be in excess of $300. See Michigan Laws 445.1102
  • Sale: means sale or exchange. See Michigan Laws 442.351a
  • Sale at retail: means a transfer of an interest in a consumer item by a person that is regularly and principally engaged in the business of selling consumer items to a buyer for use or consumption and not for resale. See Michigan Laws 445.312
  • Sale or consumption area: means the premises within the property of the dealer or of the dealer's lessor where the sale is made, within which beverages in returnable containers may be consumed without payment of a deposit, and, upon removing a beverage container from which, the customer is required by the dealer to pay the deposit. See Michigan Laws 445.571
  • Sale or transfer: means the conveyance of property, or of any right, title, or interest in property, whether legal or equitable, whether voluntary or involuntary, by outright sale, deed, installment sale contract, land contract, contract for deed, leasehold interest with a term greater than 3 years, lease option contract, or any other method of conveyance of real property interest. See Michigan Laws 445.1621
  • Sanitary standards: means the dairy equipment construction standards or accepted dairy system operating practices formulated by 1 of the following:
  •   (i) 3-A sanitary standards committees representing the international association for food protection, the United States public health service, the United States department of agriculture, and the dairy industry committee. See Michigan Laws 288.577
  • Sanitizing: means the application of any effective method or sanitizing agent in compliance with the federal act to a clean surface for the destruction of pathogens and other organisms as far as is practicable. See Michigan Laws 288.577
  • Scale operator: means the employee of a scrap metal dealer who operates or attends a scale that is used to weigh the scrap metal in a purchase transaction. See Michigan Laws 445.423
  • Scenic byway: means a regulated route that is required to be regulated as a scenic byway under 23 USC 131. See Michigan Laws 252.302
  • Scheduled process: means the aseptic process selected by the processor as adequate under the conditions of manufacture for a given product to be free of viable microorganisms having a public health significance as well as microorganisms of nonhealth significance capable of reproducing in the food under normal nonrefrigerated conditions. See Michigan Laws 288.577
  • School district: means that term as defined in section 6 of the revised school code, 1976 PA 451, MCL 380. See Michigan Laws 423.201
  • Scrap metal: means ferrous or nonferrous metal, or items that contain ferrous or nonferrous metal, that are sold or offered for sale for the value of the ferrous or nonferrous metal they contain rather than their original intended use; ferrous or nonferrous metal removed from or obtained by cutting, demolishing, or disassembling a building, structure, or manufactured item; or other metal that cannot be used for its original intended purpose but can be processed for reuse in a mill, foundry, die caster, or other manufacturing facility. See Michigan Laws 445.423
  • Scrap metal dealer: means a person or governmental unit that buys scrap metal and is not a first purchaser. See Michigan Laws 445.423
  • Scrap metal recycler: means a person that purchases ferrous or nonferrous metal that is intended for recycling or reuse, whether regarded as a scrap processor, core buyer, or other similar business operation. See Michigan Laws 445.423
  • Scrap processor: means a person, utilizing machinery and equipment and operating from a fixed location, whose principal business is the processing and manufacturing of iron, steel, nonferrous metals, paper, plastic, or glass, into prepared grades of products suitable for consumption by recycling mills, foundries, and other scrap processors. See Michigan Laws 445.403
  • Scrap processor: means that term as defined in section 3 of 1917 PA 350, MCL 445. See Michigan Laws 445.423
  • Scrap tire hauler: means that term as defined in section 16901 of the natural resources and environmental protection act, 1994 PA 451, MCL 324. See Michigan Laws 257.1351
  • Scrap tire processor: means that term as defined in section 16901 of the natural resources and environmental protection act, 1994 PA 451, MCL 324. See Michigan Laws 257.1351
  • Script: means a list of commands that a fantasy-contest-related computer program can execute and that is created by a fantasy contest player, or by a third party for a fantasy contest player, to automate processes on a fantasy contest platform. See Michigan Laws 432.502
  • seal: shall be construed to include any of the following:
  •   (a) The impression of the seal on the paper alone. See Michigan Laws 8.3n
  • Secondary highway: means a state secondary road or county primary road. See Michigan Laws 252.201
  • Secondary mortgage loan act: means the secondary mortgage loan act, 1981 PA 125, MCL 493. See Michigan Laws 445.1651a
  • Secretary: means the secretary of state acting as director of the fund. See Michigan Laws 257.1102
  • Security: includes any share of stock, bond, debenture, note or other security issued by a corporation which is registered as to ownership on the books of the corporation. See Michigan Laws 441.101
  • security breach: means the unauthorized access and acquisition of data that compromises the security or confidentiality of personal information maintained by a person or agency as part of a database of personal information regarding multiple individuals. See Michigan Laws 445.63
  • Security interest: means an interest in personal property or fixtures which secures payment or performance of an obligation. See Michigan Laws 440.1201
  • Security interest: means any interest in real or personal property that secures payment or performance of an obligation. See Michigan Laws 600.4701
  • Self-insurer: means either of the following:
  •   (i) An individual employer authorized to carry its own risk. See Michigan Laws 418.601
  • sell: includes any sale, exchange, contract to sell, consignment for sale, shipment for sale, or other disposition. See Michigan Laws 445.102
  • seller: means a person regularly and principally engaged in the business of selling goods or services to retail buyers, but does not include the services of a professional person licensed by the state to perform legal or dental services or medical services as a medical doctor or a doctor of osteopathy. See Michigan Laws 445.852
  • Seller: means a person that either regularly, sporadically, or on a 1-time basis receives consideration from any other person from the purchase by a scrap metal dealer of scrap metal offered by that seller. See Michigan Laws 445.423
  • Sentencing guidelines: A set of rules and principles established by the United States Sentencing Commission that trial judges use to determine the sentence for a convicted defendant. Source: U.S. Courts
  • Sequester: To separate. Sometimes juries are sequestered from outside influences during their deliberations.
  • Serious emotional disturbance: means that term as defined in section 100d of the mental health code, 1974 PA 258, MCL 330. See Michigan Laws 600.1090

  • Service: means the collection or remittance, or the right or obligation to collect or remit, for a lender, noteowner, noteholder, mortgage servicer, or the licensee's or registrant's own account of 4 or more installment payments of the principal, interest, or an amount placed in escrow under a mortgage loan, mortgage servicing agreement, or an agreement with the mortgagor.   • Service dealer: means a person that, for compensation, engages or offers to engage in repairing, servicing, or maintaining an appliance. See Michigan Laws 445.832
  • Service mark: means any word, name, symbol, or device, or any combination thereof, other than a trade name in its entirety, adopted and used by a person in the sale or advertising of services to identify his or her services and distinguish them from the similar services of others. See Michigan Laws 429.31
  • Service member: means a member of the armed forces, a reserve branch of the armed forces, or the Michigan national guard. See Michigan Laws 445.1012
  • Service of process: The service of writs or summonses to the appropriate party.
  • Service provider: means a person, organization, or other entity that receives job training partnership act funds, either directly or indirectly from the governor, for the purpose of providing job training or other related services pursuant to the job training partnership act. See Michigan Laws 421.151
  • Services: means work, labor, advice, counseling, or instruction if purchased primarily for personal, family, or household use and not for commercial or business use. See Michigan Laws 445.852
  • Services: means work, labor, and services furnished in connection with the installation or application of goods. See Michigan Laws 445.1102
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • shall not apply: means that the pertinent provision is not operative as to certain persons or things or in conjunction with a particular date or dates. See Michigan Laws 8.4c
  • Shopping center: means a minimum area of 3 acres of land on which there is located 1 or more stores or business establishments, and where there is provided a parking area. See Michigan Laws 257.941
  • Sidewalk: means a paved public sidewalk intended for pedestrian use situated outside of and adjacent to the improved portion of a street or highway designed for vehicular travel. See Michigan Laws 257.1572
  • Sign: means any symbol or language that is reasonably calculated to communicate information to a rider or the rider's parent or guardian, including placards, prerecorded messages, live public address, stickers, pictures, pictograms, video, verbal information, and visual signals. See Michigan Laws 408.652
  • Sign: means any outdoor sign, display, device, figure, painting, drawing, message, placard, poster, billboard, or other thing, whether placed individually or on a T-type, V-type, back to back, or double-faced display, that is designed, intended, or used to advertise or inform. See Michigan Laws 252.302
  • Sign structure: means the assembled components that make up an outdoor advertising display, including, but not limited to, uprights, supports, facings, and trim. See Michigan Laws 252.302
  • Signed: includes any symbol executed or adopted by a party with present intention to adopt or accept a writing. See Michigan Laws 440.1201
  • Signed: means autographed by the artist's own hand, and not by means of mechanical or photographic reproduction, after the multiple was produced, whether or not the master was signed. See Michigan Laws 442.351a
  • Silver: means elemental silver having an atomic weight of 107. See Michigan Laws 445.482
  • Simulator device training: means that part of a driver education course where a driver education instructor uses interactive simulator units and programs to reproduce driving situations likely to occur in actual driving on a street and the student is required to evaluate risk, make decisions, and respond to the situations presented. See Michigan Laws 256.627
  • Ski area: means an area used for skiing and served by 1 or more ski lifts. See Michigan Laws 408.322
  • Ski lift: means a device for transporting persons uphill on skis, or in cars on tracks, or suspended in the air by the use of cables, chains, belts, or ropes, and usually supported by trestles or towers with 1 or more spans. See Michigan Laws 408.322
  • Skier: means a person wearing skis or utilizing a device that attaches to at least 1 foot or the lower torso for the purpose of sliding on a slope. See Michigan Laws 408.322
  • Small bingo: means a series of bingo occasions that occur on a regular basis during which the total value of all prizes awarded for bingo games at a single occasion does not exceed $300. See Michigan Laws 432.103a
  • Small raffle: means an event during which the total value of all prizes awarded through raffle drawings does not exceed $500. See Michigan Laws 432.103a
  • Sound recording: means a work that results from the fixation on a material object of a series of musical, spoken, or other sounds regardless of the nature of the material object, such as a disk, tape, or other phono-record, in which the sounds are embodied. See Michigan Laws 445.902
  • Special bingo: means a single or consecutive series of bingo occasions during which the total value of all prizes awarded for bingo games at a single occasion does not exceed $3,500. See Michigan Laws 432.103a
  • Specialty mechanic: means a motor vehicle mechanic who is certified by the department for a specific repair or service category or categories described in section 10(1). See Michigan Laws 257.1302a
  • Sports betting: means to operate, conduct, or offer for play wagering conducted under this act on athletic events and other events approved by the board. See Michigan Laws 432.403
  • sports betting equipment: means any mechanical, electronic, or other device, mechanism, or equipment used in the operation of internet sports betting that directly affects the wagering and results of internet sports betting offered under this act. See Michigan Laws 432.403
  • Sports betting operator: means a person that is issued a sports betting operator license. See Michigan Laws 432.403
  • Sports betting operator license: means a license issued by the board to a person to operate, conduct, or offer internet sports betting. See Michigan Laws 432.403
  • Sports betting supplier: means a person that the board has identified under rules promulgated by the board as requiring a license to provide a sports betting operator goods or services regarding the operation of internet sports betting. See Michigan Laws 432.403
  • Sports betting supplier license: means a license issued by the board to a sports betting supplier. See Michigan Laws 432.403
  • Sports betting wagering device: means a mechanical, electrical, or computerized terminal, device, apparatus, or piece of equipment used to place an internet sports betting wager. See Michigan Laws 432.403
  • Sports governing body: means an organization that prescribes final rules and enforces codes of conduct for an athletic event and the participants in the athletic event. See Michigan Laws 432.403
  • Standard methods: means the sixteenth edition of "Standard Methods for the Examination of Dairy Products" published by the American public health association, dated 1992, incorporated by reference. See Michigan Laws 288.577
  • Standardbred: means a horse registered with the United States Trotting Association that races on designated gaits of pace or trot. See Michigan Laws 431.302
  • State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States. See Michigan Laws 440.1201
  • State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States. See Michigan Laws 600.2182
  • State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, a federally recognized Indian tribe, or any territory or insular possession subject to the jurisdiction of the United States. See Michigan Laws 600.2202
  • State: means this state or an agency, department, division, bureau, board, commission, council, authority, or other body of this state. See Michigan Laws 423.321
  • state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories belonging to the United States; and the words "United States" shall be construed to include the district and territories. See Michigan Laws 8.3o
  • state: shall mean the state of Michigan. See Michigan Laws 254.301
  • state: means the state of Michigan. See Michigan Laws 254.311
  • State and federal laws: means , individually and collectively, 1 or more of the laws or regulations of this state or the federal government which regulate or are applicable to a mortgage loan or a person that is brokering, making, servicing, or collecting a mortgage loan, including, without limitation, the truth in lending act, 15 USC 1601 to 1667f, real estate settlement procedures act of 1974, Public Law 93-533, 88 Stat. See Michigan Laws 445.1632
  • State civil infraction: means a civil infraction involving either of the following:
  •   (i) A violation of state law that is designated by statute as a state civil infraction. See Michigan Laws 600.113
  • State civil infraction action: means a civil action in which the defendant is alleged to be responsible for a state civil infraction. See Michigan Laws 600.113
  • State department: means a department created in the executive branch of state government pursuant to section 2 of article V of the state constitution of 1963, or a board, commission, agency, or other unit of state government. See Michigan Laws 409.222
  • state lottery: means the lottery created pursuant to this act and operated exclusively by or under the exclusive control of the bureau of state lottery. See Michigan Laws 432.3
  • State project: means new construction, alteration, repair, installation, painting, decorating, completion, demolition, conditioning, reconditioning, or improvement of public buildings, schools, works, bridges, highways, or roads authorized by a contracting agent. See Michigan Laws 408.1101
  • State registrar: means that term as defined in section 2805 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 445.63
  • Statute: A law passed by a legislature.
  • Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
  • Strike: means the concerted failure to report for duty, the willful absence from one's position, the stoppage of work, or the abstinence in whole or in part from the full, faithful, and proper performance of the duties of employment for the purpose of inducing, influencing, or coercing a change in employment conditions, compensation, or the rights, privileges, or obligations of employment. See Michigan Laws 423.201
  • Subpoena: means a document, however denominated, issued under authority of a court of record requiring a person to do any of the following:
  •   (i) Attend and give testimony at a deposition. See Michigan Laws 600.2202
  • Subpoena: A command to a witness to appear and give testimony.
  • Subpoena duces tecum: A command to a witness to produce documents.
  • subscriber: means a person residing in this state who has residential telephone service. See Michigan Laws 445.111
  • Substituted proceeds of a crime: means any property obtained or any gain realized by the sale or exchange of proceeds of a crime. See Michigan Laws 600.4701
  • Successor of a beneficiary: means a person who succeeds to substantially all of the rights of a beneficiary by operation of law, including a corporation with or into which the beneficiary has been merged or consolidated, an administrator, executor, personal representative, trustee in bankruptcy, debtor in possession, liquidator, and receiver. See Michigan Laws 440.5102
  • Summary proceedings: means a civil action to recover possession of premises and to obtain certain ancillary relief as provided by this chapter and by court rules adopted in connection therewith. See Michigan Laws 600.5701
  • Summons: Another word for subpoena used by the criminal justice system.
  • Supplier: means a person licensed under this act to rent, sell, or lease equipment or to sell charity game or numeral game tickets to qualified organizations licensed under this act. See Michigan Laws 432.103a
  • supplier: means a brewer, micro brewer, an outstate seller of beer, a wine maker, a small wine maker, an outstate seller of wine, a manufacturer of mixed wine drink, an outstate seller of a mixed wine drink, a mixed spirit drink manufacturer, or an outstate seller of mixed spirit drink. See Michigan Laws 436.1105
  • Supplier: means a manufacturer, wholesaler, or distributor of farm and utility tractors and farm and utility equipment, or the attachments to or repair parts for that equipment. See Michigan Laws 445.1452
  • Supplier: means a person who the board has identified under rules promulgated by the board as requiring a license to provide casino licensees with goods or services regarding the business of a proposed or existing casino or casino enterprise on a regular or continuing basis. See Michigan Laws 432.202
  • Suspension: means the temporary withdrawal of a person's certification to engage or offer to engage in activities as a driver education provider or a driver education instructor during the period of suspension. See Michigan Laws 256.627
  • Sworn declaration: means a declaration in a signed record given under oath. See Michigan Laws 600.2182
  • Teen driver training: means driver training instruction provided through a segment 1 or segment 2 driver education course that allows an individual 17 years of age or less to apply for a level 1 or level 2 graduated driver license. See Michigan Laws 256.627
  • Telecommunication provider: means all of the following:
  •   (i) A provider as that term is defined in section 102 of the Michigan telecommunications act, 1991 PA 179, MCL 484. See Michigan Laws 445.65a
  • Telecommunication service: means all of the following:
  •   (i) A service as that term is defined in section 102 of the Michigan telecommunications act, 1991 PA 179, MCL 484. See Michigan Laws 445.65a
  • Telephone solicitation: means any voice communication over a telephone for the purpose of encouraging the recipient of the call to purchase, rent, or invest in goods or services during that telephone call. See Michigan Laws 445.111
  • Telephone solicitor: means any person doing business in this state who makes or causes to be made a telephone solicitation from within or outside of this state, including, but not limited to, calls made by use of automated dialing and announcing devices or by a live person. See Michigan Laws 445.111
  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
  • Tenancy by the entirety: A type of joint tenancy between husband and wife that is recognized in some States. Neither party can sever the joint tenancy relationship; when a spouse dies, the survivor acquires full title to the property.
  • Term: means a portion of an agreement that relates to a particular matter. See Michigan Laws 440.1201
  • Testator: A male person who leaves a will at death.
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Theory instruction: means that term as defined in 49 C. See Michigan Laws 256.627
  • Thoroughbred: means a thoroughbred, quarter, paint, Arabian, or other breed horse. See Michigan Laws 431.302
  • Time balance: means the sum of the principal amount financed and the finance charge. See Michigan Laws 445.1102
  • Time price differential: means the amount a buyer pays or is required to pay for the privilege of purchasing goods or services in installments over a period of time. See Michigan Laws 445.852
  • Time sale price: means the cash sale price of goods or services and the amount, if any, included for official fees, the time price differential, and, if a separate identified charge is made, for insurance. See Michigan Laws 445.852
  • Time sale price: means the total of the cash price of the goods and services or services, the finance charge, and the amounts, if any, included for insurance premiums and official fees. See Michigan Laws 445.1102
  • tire wheel or rim: includes a tire wheel or rim on which a tire is mounted. See Michigan Laws 257.1351
  • To construct: means to acquire through construction, purchase, gift, condemnation, or any combination thereof. See Michigan Laws 254.311
  • Tobacco product: means any tobacco product sold to the general public and includes, but is not limited to, cigarettes, tobacco snuff, and chewing tobacco. See Michigan Laws 252.302
  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • Total price: means the full purchase price of a consumer item, excluding sales tax and container deposit. See Michigan Laws 445.312
  • Trade name: means a word or group of words used by any person to identify a sole proprietorship, firm, partnership, corporation, association, union, or other organization. See Michigan Laws 429.31
  • Trade or commerce: means the conduct of a business for profit or not for profit producing or providing goods, commodities, property, or services and includes, without limitation, advertising, franchising, solicitation, offering for sale, lease, or distribution of a service or property, tangible or intangible, real, personal or mixed, or any other article of commerce. See Michigan Laws 445.771
  • Trade or commerce: means the conduct of a business providing goods, property, or service primarily for personal, family, or household purposes and includes the advertising, solicitation, offering for sale or rent, sale, lease, or distribution of a service or property, tangible or intangible, real, personal, or mixed, or any other article, or a business opportunity. See Michigan Laws 445.902
  • Trade or commerce: means trade or commerce as defined in section 2 of the consumer protection act. See Michigan Laws 445.52

  • Training: means custom-designed training given to prospective employees of new businesses and industries within this state; to employees, prospective employees, or both, of expanding businesses and industries within this state; and to employees, prospective employees, or both, of businesses and industries within this state that possibly would relocate without this training.   • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Transfer: means a change on the books of a corporation in the registered ownership of a security. See Michigan Laws 441.101
  • Transfer agent: means a person employed or authorized by a corporation to transfer securities issued by the corporation. See Michigan Laws 441.101
  • Transfer station: means any place, premises, or establishment where milk or dairy products are transferred directly from 1 milk tank truck to another. See Michigan Laws 288.577
  • Transient merchant: means any person, firm, association, or corporation engaging temporarily in a retail sale of goods, wares, or merchandise, in any place in this state and who, for the purpose of conducting business, occupies any lot, building, room, or structure of any kind. See Michigan Laws 445.371
  • Treasurer: means the state treasurer acting as the custodian of the fund. See Michigan Laws 257.1102
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Trial jury: A group of citizens who hear the evidence presented by both sides at trial and determine the facts in dispute. Federal criminal juries consist of 12 persons. Federal civil juries consist of six persons.
  • Tribal unit: includes any subdivision, subsidiary, or business enterprise, wholly owned by an Indian tribe. See Michigan Laws 421.13l
  • Trivision sign: means a sign or sign structure that uses mechanical means to display more than 1 message in sequence. See Michigan Laws 252.302
  • Trust account: A general term that covers all types of accounts in a trust department, such as estates, guardianships, and agencies. Source: OCC
  • Trust claims materials: means a final executed proof of claim and all other documents and information related to a claim against an asbestos trust, including claims forms and supplementary materials, affidavits, depositions and trial testimony, work history, and medical and health records, all documents that reflect the status of a claim against an asbestos trust, and, if the trust claim has settled, all documents that relate to the settlement of the trust claim.   • Trust governance documents: means all documents that relate to eligibility and payment levels, including claims payment matrices, trust distribution procedures, and plans for reorganization, for an asbestos trust. See Michigan Laws 600.3011
  • Trustee: A person or institution holding and administering property in trust.
  • Trustor: The person who makes or creates a trust. Also known as the grantor or settlor.
  • Truth in Lending Act: The Truth in Lending Act is a federal law that requires lenders to provide standardized information so that borrowers can compare loan terms. In general, lenders must provide information on Source: OCC
  • Underemployed: means the individual is working part time or full time, but is receiving wages less than 70% of the lower living standard income level as determined by the United States department of labor, bureau of labor statistics. See Michigan Laws 421.151
  • Unemployed: means an individual who is without a job and who wants and is available for work. See Michigan Laws 421.151
  • Uniform Commercial Code: A set of statutes enacted by the various states to provide consistency among the states' commercial laws. It includes negotiable instruments, sales, stock transfers, trust and warehouse receipts, and bills of lading. Source: OCC
  • Uninsured motor vehicle: means a motor vehicle as to which there is not in force a liability policy that meets the requirements of section 3009 of the insurance code of 1956, 1956 PA 218, MCL 500. See Michigan Laws 257.1102
  • Unit of government: means this state or an agency, instrumentality, political subdivision, or public corporation of this state, including but not limited to municipal corporations, quasi-municipal corporations, and authorities, and including their officials, employees, and agents when acting in their official capacity. See Michigan Laws 445.771
  • United States: shall be construed to include the district and territories. See Michigan Laws 8.3o
  • Unsubsidized employment: means employment in the private or public sector which does not result from a direct government payment for all or part of employee wages or benefits in an employment and training program. See Michigan Laws 408.902
  • Unsworn declaration: means a declaration or other affirmation of truth in a signed record that is not given under oath, but is given under penalty of perjury. See Michigan Laws 600.2182
  • Unzoned commercial or industrial area: means an area that is within an adjacent area, that is not zoned by state or local law, regulation, or ordinance, that contains 1 or more permanent structures devoted to the industrial or commercial purposes described in subdivision (e), and that extends along the highway a distance of 800 feet beyond each edge of the activity. See Michigan Laws 252.302
  • Update: means to install vision technology for designated metal, plastic, or glass beverage containers in an existing, new, or replacement reverse vending machine. See Michigan Laws 445.653
  • Uphold: The decision of an appellate court not to reverse a lower court decision.
  • Usage for demonstration: means usage, not prohibited by an agreement, to demonstrate the function of equipment or inventory to potential customers, but does not include use by a buyer who subsequently rescinds the purchase of the inventory or equipment. See Michigan Laws 445.1452
  • Usage for rental: means usage by a customer of the dealer, not prohibited by the agreement, under a rental contract or nonfinancing lease. See Michigan Laws 445.1452
  • used car lot: as used in this act shall be construed to mean any place where used motor vehicles are displayed and offered for sale in the open. See Michigan Laws 445.501
  • Used motor vehicle part: means any of the following:
  •   (i) A major component part, dashboard, radio, stereo, or seat of a late model motor vehicle for which a certificate of title and registration plate have been issued to a consumer or dealer. See Michigan Laws 257.1351
  • Usury: Charging an illegally high interest rate on a loan. Source: OCC
  • Variable Rate: Having a "variable" rate means that the APR changes from time to time based on fluctuations in an external rate, normally the Prime Rate. This external rate is known as the "index." If the index changes, the variable rate normally changes. Also see Fixed Rate.
  • Vehicle body work: means the business or activity of repairing physical damage to a motor vehicle by repairing, mending, straightening, or replacing a major component part, except for the engine or transmission. See Michigan Laws 257.1302a
  • Vehicle protection product: means a vehicle protection device, system, or service that is installed on or applied to a vehicle and is designed to prevent loss or damage to a vehicle from a specific cause. See Michigan Laws 257.1243
  • Vendor: means a person that is not licensed under this act that supplies any goods or services to an internet gaming operator or internet gaming supplier. See Michigan Laws 432.303
  • Vendor: means a person that is not licensed under this act that supplies any goods or services to a sports betting operator or sports betting supplier. See Michigan Laws 432.403
  • Vendor: means a person designated by the commission to maintain a do-not-call list under section 1a. See Michigan Laws 445.111
  • Vendor: means a person who is not licensed under this act who supplies any goods or services to a casino licensee or supplier licensee. See Michigan Laws 432.202
  • Venue: The geographical location in which a case is tried.
  • Verdict: The decision of a petit jury or a judge.
  • Veteran: means an individual who meets both of the following:
  •   (i) Is a veteran as defined in section 1 of 1965 PA 190, MCL 35. See Michigan Laws 600.1200
  • veterans court: means a court adopted or instituted under section 1201 that provides a supervised treatment program for individuals who are veterans and who abuse or are dependent upon any controlled substance or alcohol or suffer from a mental illness. See Michigan Laws 600.1200
  • Veterinarian: means an individual licensed to practice veterinary medicine under part 188 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 431.302
  • Veto: The procedure established under the Constitution by which the President/Governor refuses to approve a bill or joint resolution and thus prevents its enactment into law. A regular veto occurs when the President/Governor returns the legislation to the house in which it originated. The President/Governor usually returns a vetoed bill with a message indicating his reasons for rejecting the measure. In Congress, the veto can be overridden only by a two-thirds vote in both the Senate and the House.
  • Victim advocate: work with prosecutors and assist the victims of a crime.
  • Violent offender: means an individual who is currently charged with or has pled guilty to, or, if the individual is a juvenile, is currently alleged to have committed or has admitted responsibility for, an offense involving the death of or serious bodily injury to any individual, whether or not any of the circumstances are an element of the offense, or an offense that is criminal sexual conduct of any degree. See Michigan Laws 600.1060
  • Violent offender: means an individual who is currently charged with, or has been convicted of, an offense involving the death of, or a serious bodily injury to, any individual, whether or not any of these circumstances are an element of the offense, or with criminal sexual conduct in any degree. See Michigan Laws 600.1090
  • Violent offender: means a juvenile who is adjudicated on or has been, within the preceding 5 years, adjudicated on 1 or more of the following offenses:
  •   (i) First degree murder. See Michigan Laws 600.1099b
  • Violent offender: means an individual who is currently charged with or has pled guilty to an offense involving the death of, or a serious bodily injury to, any individual, whether or not any of these circumstances are an element of the offense, or an offense that is criminal sexual conduct in any degree.   • Visible: means a sign that has a message that is capable of being seen by an individual of normal visual acuity when traveling in a motor vehicle. See Michigan Laws 252.302
  • Vision technology: means that term as defined in the reverse vending machine antifraud act. See Michigan Laws 445.633
  • Vision technology: means a camera or other scanning device that allows a reverse vending machine to determine if beverage containers are returnable containers based on symbols, marks, or other distinguishing characteristics on the beverage containers. See Michigan Laws 445.653
  • Vital record: means that term as defined in section 2805 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 445.63

  • Vocationally disabled: means a person who has a medically certifiable impairment of the back or heart, or who is subject to epilepsy, or who has diabetes, and whose impairment is a substantial obstacle to employment, considering such factors as the person's age, education, training, experience, and employment rejection.   • Voir dire: The process by which judges and lawyers select a petit jury from among those eligible to serve, by questioning them to determine knowledge of the facts of the case and a willingness to decide the case only on the evidence presented in court. "Voir dire" is a phrase meaning "to speak the truth."
  • wage earning capacity: means the wages the employee earns or is capable of earning at a job reasonably available to that employee, whether or not wages are actually earned. See Michigan Laws 418.301

  • Warranted product: means a vehicle protection product covered by a written warranty. See Michigan Laws 257.1243
  • warrantor: means a person that is contractually obligated to a warranty holder under the terms of a vehicle protection product warranty agreement. See Michigan Laws 257.1243
  • warranty: means a written agreement by a warrantor that provides if a warranted product fails to prevent loss or damage to a vehicle from a specific cause covered by the warranty, the warrantor shall pay the warranty holder specified incidental costs that result from the failure of the warranted product to perform. See Michigan Laws 257.1243
  • Warranty: means a guarantee given by a motor vehicle repair facility, in writing or by implication, of the merchantability, of the integrity of the subject of a contract, or of the responsibility of the person that makes the warranty for the replacement or repair of defective parts or services, or both, assuring performance, product, or conditions as promised or declared by the person that makes the warranty. See Michigan Laws 257.1302a
  • Warranty holder: means a person who purchases a warranted product or who is a permitted transferee. See Michigan Laws 257.1243
  • Warranty reimbursement insurance policy: means a policy of insurance that is issued to a vehicle protection product warrantor to provide reimbursement to the warrantor or to pay on behalf of the warrantor all covered contractual obligations incurred by the warrantor under the terms and conditions of an insured vehicle protection product warranty sold by a warrantor. See Michigan Laws 257.1243
  • Webpage: means a location that has a uniform resource locator or URL with respect to the world wide web or another location that can be accessed on the internet. See Michigan Laws 445.63
  • Website: means a collection of pages of the world wide web or internet, usually in HTML format, with clickable or hypertext links to enable navigation from 1 page or section to another, that often uses associated graphics files to provide illustration and may contain other clickable or hypertext links. See Michigan Laws 445.82
  • Wheelchair: means a chair mounted on wheels used by a person with a disability to enhance mobility. See Michigan Laws 445.1081
  • Wheelchair dealer: means a person who is in the business of selling wheelchairs. See Michigan Laws 445.1081
  • Wheelchair lessor: means a person who leases a wheelchair to a consumer, or who holds the lessor's rights under a written lease. See Michigan Laws 445.1081
  • Willful blindness: means the intentional disregard of objective fact that would lead a reasonable person to conclude that the property was derived from unlawful activity or would be used for an unlawful purpose. See Michigan Laws 600.4701
  • Window period loan: means a real property loan which was made or assumed during a period beginning on January 5, 1977, and ending on October 15, 1982, other than a real property loan originated by a federal savings and loan association, a federal savings bank, a national bank, or a federally chartered credit union. See Michigan Laws 445.1621
  • Winnings: means the total cash value of all property or sums including currency or instruments of monetary value paid to an authorized participant by an internet gaming operator as a direct result of a winning internet wager. See Michigan Laws 432.303
  • Winnings: means the total cash value of all property or sums including currency or instruments of monetary value paid to an authorized participant by a sports betting operator as a direct result of a winning sports betting wager. See Michigan Laws 432.403

  • works: shall include all property, rights, easements and franchises relating thereto and deemed or convenient for their operation, and shall embrace an international bridge over, and ferries across the Saint Clair River at or near Port Huron. See Michigan Laws 254.152
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
  • Writ of certiorari: An order issued by the Supreme Court directing the lower court to transmit records for a case for which it will hear on appeal.
  • Written instrument: means a written or printed agreement, bill of sale, or any other written or printed note or memorandum of the sale or exchange of a work of fine art by an art merchant and includes a written or printed catalog or other prospectus of a forthcoming sale as well as any written or printed corrections or amendments thereof. See Michigan Laws 442.321
  • Written instrument: means a written agreement, bill of sale, invoice, certificate of authenticity, catalog, or other memorandum describing a multiple which is to be sold or consigned by an art merchant. See Michigan Laws 442.351a
  • Written solicitation: means a postcard or other written notice delivered to a buyer's residence that requests that the buyer contact the seller or seller's agent by telephone to inquire about a good or service, unless the postcard or other written notice concerns a previous purchase or order or specifies the price of the good or service and accurately describes the good or service. See Michigan Laws 445.111
