ยง 1213. Obstruction to driver's view or driving mechanism. (a) No person shall drive a motor vehicle when it is so loaded, or when there are in the front seat such number of persons as to obstruct the view of the driver to the front or sides of the vehicle or as to interfere with the driver's control over the driving mechanism of the vehicle. In no event shall there be more than three persons in the front seat of any vehicle, except where such seat has been constructed to accommodate more than three persons and there is eighteen inches of seating capacity for each passenger or occupant in said front seat.
(b) No passenger in a vehicle shall ride in such a position as to interfere with the driver's view ahead or to the sides, or to interfere with his control over the driving mechanism of the vehicle.
I was pulled over in between a 30mph and 55mph zone. There was no clear line as to where the 30mph zone ended. The officer was sitting right at the end of the town. He pulled me over and said I was speeding and that he got me on radar at 54. I asked how I was speeding if I was headed into a 55mph zone he then gave me a ticket for obstruction if view because I had my stethoscope hanging from the rear view mirror but wrote in the notes section that he got me going 54 in a30mph zone. I plead not guilty to the ticket grey a trial go in to talk to the DA and explain. She tells me obstruction of view is 2 points. I again say not guilty and she dismisses my ticket and has the officer write me a new one for speeding right then and there! Is that legal?

Yes it is legal. That officer has up to 1 year to write you that ticket. You were speeding because untill you pass the entry point of the new speed zone you have to remain at the current posted speed limit which you said was 30 mph. Should have taken the non moving violation ticket, what a dumb mistake on your part. It also states that no person shall have nothing hanging from their rear view mirror that can obstruct their view, which is pretty much anything. I can't believe you did not take the obstruction of view ticket after the officer did not write you the 24 mph over the speed limit ticket. That will be like 6 points and around $800 fine plus it goes to your insurance.

I was stopped by an officer and written a ticket for "Drivers View Obstructed". According to him my "GPS" was located in such a way that it obstructed my view of the road. This is my first traffic violation, thankfully, a non-moving one at that. Do you know how much the fine may be? Can I pay this online, or go to the court earlier than the date on the ticket. Lastly, my gps was at the bottom of the windshield near the middle, where can I place it next time so this does not happen again? Thank you very much. :)
