My mother (Glend Diane Bowman) was murdered in Lenoir,NC by Herbert Lawrence Peck Nov.14, 2009. They found him in the house with the murder weapon. Defense is using the defense of Automatism. DA looking to take from Murder 1 to manslaughter/time served. That or dismis the case. The accused has a laundry lsit of prior convictions from FL in the late 80's early 90's. Is there not a mandatory sentancing for manslaughter (voluntary or involuntary) for those with prior convictions? How can a DA's office dismiss a case when murder / manslaughter is the charge?
