North Carolina General Statutes > Chapter 25 > Article 2A > § 25-2A-104 - Leases subject to other law


Current as of: 2010

(1) A lease, although subject to this Article, is also subject to any applicable:

(a) certificate of title statute of this State (Gen. Stat. 20-50, Gen. Stat. 75A-32 et seq.);

(b) certificate of title statute of another jurisdiction (Gen. Stat. 25-2A-105); or

(c) consumer protection statute of this State, or final consumer protection decision of a court of this State existing on the effective date of this Article.

(2) In case of conflict between this Article, other than Gen. Stat. 2A-105, 2A-304(3), and 2A-305(3), and a statute or decision referred to in subsection (1) of this section, the statute or decision controls.

(3) Failure to comply with an applicable law has only the effect specified therein.

Gary, Any building would be considered a fixture. A tenant can in most cases remove a fixture they installed, as long as the land is restored to its original condition. Take a look...
if someone has a fence put in and cements the poles into the ground are they considered a fixture not to be removed?...
