§ 143-166.30 Retirement benefits for State law-enforcement officers

  • Administration: The provisions of the State Retirement System pertaining to administration and management of funds under N. See North Carolina General Statutes 143-166.30
  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Arrest: Taking physical custody of a person by lawful authority.
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Basic Retirement System: On and after January 1, 1985, law-enforcement officers employed by the State shall be members of the Teachers' and State Employees' Retirement System and beneficiaries who were last employed as officers by the State, or who are surviving beneficiaries of officers last employed by the State, shall be beneficiaries of the State Retirement System and paid in benefit amounts then in effect.   • Definitions: The following words and phrases as used in this Article, unless a different meaning is plainly required by the context, shall have the following meanings:

  • Employer: means the State of North Carolina and its departments, agencies and institutions. See North Carolina General Statutes 143-166.30
  • following: when used by way of reference to any section of a statute, shall be construed to mean the section next preceding or next following that in which such reference is made; unless when some other section is expressly designated in such reference. See North Carolina General Statutes 12-3
  • Forfeiture of Benefits for Certain Felonies: Participants in the Supplemental Retirement Income Plan for State Law-Enforcement Officers whose benefits are forfeited under N. See North Carolina General Statutes 143-166.30
  • Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
  • in writing: may be construed to include printing, engraving, lithographing, and any other mode of representing words and letters: Provided, that in all cases where a written signature is required by law, the same shall be in a proper handwriting, or in a proper mark. See North Carolina General Statutes 12-3
  • Law-enforcement officer: means a full-time paid employee of an employer who is actively serving in a position with assigned primary duties and responsibilities for prevention and detection of crime or the general enforcement of the criminal laws of the State or serving civil processes, and who possesses the power of arrest by virtue of an oath administered under the authority of the State. See North Carolina General Statutes 143-166.30
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Member: means an officer included in the membership of a retirement system including former officers no longer employed who also elected to leave their accumulated contributions on deposit with a Retirement System. See North Carolina General Statutes 143-166.30
  • Officer: means a "law-enforcement officer. See North Carolina General Statutes 143-166.30
  • Participant: means an officer with an individual account with the Supplemental Retirement Income Plan. See North Carolina General Statutes 143-166.30
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Regular accumulated contributions: means the sum of all contributions of a member made to the Retirement System, together with regular interest thereon, pursuant to N. See North Carolina General Statutes 143-166.30
  • Retirement allowance: means annual payments for life payable in monthly installments continuing until the death of a beneficiary. See North Carolina General Statutes 143-166.30
  • Rights of Participants under the Uniformed Services Employment and Reemployment Rights Act: A participant whose employment is interrupted by reason of service in the Uniformed Services, as that term is defined in section 4303(16) of the Uniformed Services Employment and Reemployment Rights Act, Public Law 103-353, hereafter referred to as "USERRA" shall be entitled to all rights and benefits that the participant would have been entitled to under this section had the participant's employment not been interrupted, provided that the participant returns to service as a law enforcement officer while the participant's reemployment rights are protected under the provisions of USERRA.   • Special annuity account accumulated contributions: means the sum of all contributions of a member or an employer made to the Special Annuity Accounts for Members of the Law-Enforcement Officers' Retirement System, together with regular interest thereon, pursuant to N. See North Carolina General Statutes 143-166.30
  • State: means the State of North Carolina. See North Carolina General Statutes 143-166.30
  • State Contributions to the Supplemental Retirement Income Plan: Under all other restrictions as are herein provided, the State shall contribute monthly to the individual accounts of participants who are employed by the State an amount equal to five percent (5%) of the compensation of each participant.   • State Retirement System: means the Teachers' and State Employees' Retirement System of North Carolina provided for under Article 1 of Chapter 135 of the N. See North Carolina General Statutes 143-166.30
  • Supplemental Retirement Income Plan: means a plan created in conformance with Section 401(a), 401(k), or any other section of the Internal Revenue Code of 1954 as amended. See North Carolina General Statutes 143-166.30
  • Supplemental Retirement Income Plan for State Law-Enforcement Officers: As of January 1, 1985, there shall be created a Supplemental Retirement Income Plan, hereinafter called the "Plan" established for the benefit of all law-enforcement officers employed by the State, who shall be participants.
