Could someone please help me. I am a resident of Petersburg, Va. I have just become the guardian of my 58 year old cousin born with intelluctial disabilities. He is in Oklahoma. I have been told that I cannot move him to Virginia until I get guardianship in Virginia. How do I go about this?

Both Oklahoma and Virginia have enacted the Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act. One of the purposes of this Act is to make it easier to transfer guardianship cases from one state to the other, saving considerable time and expense.

To transfer the case, the Oklahoma court must determine that adequate arrangements have been made for the individual or the individual’s property in Virgina, and that the case will be accepted by the court in the Virginia. The Oklahoma court will not dismiss the case until the order from the Virginia court accepting the case is filed with the Oklahoma court. The Virginia court must defer to the Oklahoma court’s finding of incapacity and selection of you as the guardian.

You should consult with local Oklahoma and Virginia attorneys to handle the court filings, but the cost should be reasonable given the relative simplicity of transfers under the Act. Good luck to you.
