    (1) Each nursing home not certified by the Medicare (Title XVIII) or Medicaid (Title XIX) program shall submit to the Board not more than 120 days after the end of its fiscal year, its audited financial statements for the fiscal year then ended. The auditor’s report shall be by a Florida licensed certified public accountant.

    (2) Each nursing home certified by the Medicaid program shall submit to the agency copies of the Medicaid audit report, desk audit or concurrence letter within 30 days from the provider’s receipt of the report or letter.

    (3) Each nursing home certified by the Medicare program but not by the Medicaid program shall submit to the Board copies of the Medicare “Notice of Program Reimbursement,” and supporting documentation within 30 days of the provider’s receipt of the notice from the Medicare fiscal intermediary. Supporting documentation shall be in sufficient detail to identify adjustments to reported revenues and expenditures.

    (4) In addition to the audit required above, each nursing home shall file financial reports as required in the Board publication entitled “Nursing Home Financial Reporting System”, which is incorporated by reference and which includes forms and instructions for the proper reporting of financial data.     (a) Nursing homes that change fiscal or Medicaid cost report years and do not notify the agency within 60 days of the change waive their right to a notice of violation as provided in Rule 59E-2.0021, F.A.C., in the event that a financial report is filed late.

    (b) If the financial reports for a nursing home or a group of nursing homes are prepared by a home office or management firm, the reports required by this rule shall be prepared for each nursing home separately. The entity filing the report(s) must notify the agency and sign an agreement assuming responsibility for response to all notices, documents or other correspondence from the agency concerning the financial reports. The agreement shall include a list of all the nursing homes covered by such agreement.
