  • Abandonment: Voluntary relinquishment by the borrower of control of security or EO property without providing for its care. See 25 CFR 213.22
  • Acceptable Quality Level: means the maximum percentage of failing vehicles that for purposes of sampling inspection, can be considered satisfactory as a process average. See 40 CFR 205.51
  • Access: means the physical ability of property owners and their successors in interest to have ingress to and egress from State or private inholdings, valid mining claims, or other valid occupancies. See 43 CFR 6301.5
  • Accessible route: means a continuous unobstructed path connecting accessible elements and spaces in a building or within a site that can be negotiated by a person with a severe disability using a wheelchair and that is also safe for and usable by people with other disabilities. See 24 CFR 100.201
  • Accidental release: means any sudden or nonsudden release of petroleum arising from operating an underground storage tank that results in a need for corrective action and/or compensation for bodily injury or property damage neither expected nor intended by the tank owner or operator. See 40 CFR 280.92
  • Account processing: includes charging, crediting, and settling of member or eligible institution accounts, excluding individual customer accounts. See 30 CFR 550.227
  • Accreditation: means a determination by a recognized accreditation body (or, in the case of direct accreditation, by FDA) that a third-party certification body meets the applicable requirements of this subpart. See 43 CFR 9180.1
  • Accreditation body: means an authority that performs accreditation of third-party certification bodies. See 43 CFR 9180.1
  • Accredited third-party certification body: means a third-party certification body that a recognized accreditation body (or, in the case of direct accreditation, FDA) has determined meets the applicable requirements of this subpart and is accredited to conduct food safety audits and to issue food or facility certifications to eligible entities. See 43 CFR 9180.1
  • ACFM: means actual cubic feet per minute. See 46 CFR 197.204
  • Acne: A disease involving the oil glands and hair follicles of the skin which is manifested by blackheads, whiteheads, acne pimples, and acne blemishes. See 46 CFR 169.553
  • Acne drug product: A drug product used to reduce the number of acne blemishes, acne pimples, blackheads, and whiteheads. See 46 CFR 169.553
  • Acquired lands: means lands which the United States obtained through purchase, gift, or condemnation, including mineral estates associated with lands previously disposed of under the public land laws, including the mining laws. See 43 CFR 3900.2
  • Acquisition: means the purchase by an eligible mortgagor of an existing hospital facility and ancillary property associated therewith. See 24 CFR 242.1
  • Acquisition: means acquiring ADP equipment or services from commercial sources or from State or local government resources. See 45 CFR 95.605
  • Acquisition Checklist: means the standard Department checklist that States can submit to meet prior written approval requirements instead of submitting the actual Request for Proposal (RFP), contracts or contract amendments. See 45 CFR 95.605
  • Acquisition cost: means the cost of the asset including the cost to ready the asset for its intended use. See 45 CFR 75.2
  • Act: means the Mineral Leasing Act of 1920, as amended and supplemented (30 U. See 43 CFR 3900.2

  • Active use: means that portion of the grazing preference that is:

    (1) Available for livestock grazing use under a permit or lease based on livestock carrying capacity and resource conditions in an allotment. See 43 CFR 4100.0-5

  • Activity plan: means a plan for managing a resource use or value to achieve specific objectives. See 43 CFR 4100.0-5
  • Actual use: means where, how many, what kind or class of livestock, and how long livestock graze on an allotment, or on a portion or pasture of an allotment. See 43 CFR 4100.0-5
  • Adequate housing: A housing unit of adequate size and design to meet the specific needs of low-income families and the requirements governing the particular housing program providing the services or financial assistance. See 25 CFR 166.218
  • Adjudication: means a formal proceeding employing procedures identical or similar to those required by the Administrative Procedure Act, as codified in 5 U. See 29 CFR 4211.1
  • Adjusted tangible net worth: Tangible balance sheet equity plus allowed tangible asset appreciation and subordinated owner debt. See 25 CFR 224.89
  • Administrative expenses: (1) Include general office and operating expenses such as telephone and photocopy charges, printing, legal, and professional fees, postage, courier services, and office supplies. See 30 CFR 550.251
  • Administrative wage garnishment: means the process by which a Federal agency orders a non-Federal employer to withhold amounts from a debtor's wages to satisfy a debt, as authorized by 31 U. See 29 CFR 4903.1
  • Administrator: means the Administrator of the Environmental Protection Agency or his authorized representative. See 40 CFR 204.2
  • Administrator: means the Administrator of the Economic Regulatory Administration. See 29 CFR 4211.1
  • Administrator: means the Administrator of the Environmental Protection Agency or his authorized representative. See 40 CFR 205.2
  • Administrator: means the Federal Energy Administrator of his delegate. See 29 CFR 4211.32

  • ADP: means data processing performed by a system of electronic or electrical machines so interconnected and interacting as to minimize the need for human assistance or intervention. See 45 CFR 95.605
  • Adult: means any individual 21 years of age or older. See 26 CFR 48.4101-1
  • Advance payment: means a payment that a Federal awarding agency or pass-through entity makes by any appropriate payment mechanism, including a predetermined payment schedule, before the non-Federal entity disburses the funds for program purposes. See 45 CFR 75.2
  • Advertised Engine Displacement: means the rounded off volumetric engine capacity used for marketing purposes by the motorcycle manufacturer. See 40 CFR 205.151
  • Affected Entity: is an entity that applies for and/or receives Federal financial assistance from EPA including but not limited to: State and local governments, Indian Tribes, Intertribal Consortia, Institutions of Higher Education, Hospitals, and other Non-profit Organizations, and Individuals. See 49 CFR 106.85
  • Affiliate: means a person or entity which, directly orindirectly, either controls or has the power to control or exert significant influence on the other, or a person and entity both controlled by a third person or entity, which may be a parent entity. See 24 CFR 242.1
  • Affiliate: means an entity or person that controls, is controlled by, or is under common control with, an applicant, permittee or lessee. See 43 CFR 4100.0-5
  • Agency: means the United States Environmental Protection Agency. See 40 CFR 204.2
  • Agency: means the United States Environmental Protection Agency. See 40 CFR 205.2
  • Agency: means any executive department, military department, Government corporation, Government controlled corporation, or other establishment in the executive branch of the government, or any independent regulatory agency, but does not include:

  • Agreement value of the donated commodity: means the price assigned by the Department to a donated food which reflects the Department's current acquisition price, transportation and, if applicable, processing costs related to the food. See 26 CFR 1.40-1
  • Allocation: means the process of assigning a cost, or a group of costs, to one or more cost objective(s), in reasonable proportion to the benefit provided or other equitable relationship. See 45 CFR 75.2
  • Allotment: means an area of land designated and managed for grazing of livestock. See 43 CFR 4100.0-5
  • Amendment: means a change you make to an EP, DPP, or DOCD that is pending before BOEM for a decision (see §§550. See 30 CFR 550.200
  • Amendment: means the act of making a change in a previously recorded mining claim or site as described in §3833. See 43 CFR 3830.5
  • Annual committed effective dose: means the committed effective dose resulting from one-year intake of radionuclides released plus the annual effective dose caused by direct radiation from facilities or activities subject to subparts B and C of this part. See 40 CFR 191.12
  • Annual rangelands: means those designated areas in which livestock forage production is primarily attributable to annual plants and varies greatly from year to year. See 43 CFR 4100.0-5
  • Annuitant: means a person receiving or who is entitled and has made application to receive retirement or survivor benefits under subchapter II, IV, or V of chapter 84 of title 5, United States Code. See 14 CFR 302.722
  • Annuity: means the gross monthly annuity rate payable before any authorized deductions (such as those for health benefits and life insurance premiums). See 14 CFR 302.722
  • Answering machine: means either a device or a voicemail system that allows a telephone caller to leave a recorded message to report an unsafe condition at a highway-rail or pathway grade crossing, as described in §234. See 49 CFR 234.301
  • Anthelmintic: An agent that is destructive to worms. See 46 CFR 197.322
  • Antifungal: A drug which inhibits the growth and reproduction of fungal cells and decreases the number of fungi present. See 46 CFR 169.541
  • API: means American Petroleum Institute. See 43 CFR 3170.3
  • Applicant: means the person in whose name a special permit, approval, registration, a renewed or modified special permit or approval, or party status to a special permit is requested to be issued. See 49 CFR 107.1
  • Application: means a request under subpart B of this part for a special permit, a renewal or modification of a special permit, party status to a special permit, or a request under subpart H of this part for an approval, or renewal or modification of an approval. See 49 CFR 107.1
  • Approval: means a written authorization, including a competent authority approval, issued by the Associate Administrator, the Associate Administrator's designee, or as otherwise prescribed in the HMR, to perform a function for which prior authorization by the Associate Administrator is required under subchapter C of this chapter (49 CFR parts 171 through 180). See 49 CFR 105.5
  • Approval: means a written authorization, including a competent authority approval, issued by the Associate Administrator, the Associate Administrator's designee, or as otherwise prescribed in the HMR, to perform a function for which prior authorization by the Associate Administrator is required under subchapter C of this chapter (49 CFR parts 171 through 180).   • Area of high unemployment: An area in which a B&I loan guarantee can be issued, consisting of a county or group of contiguous counties or equivalent subdivisions of a State which, on the basis of the most recent 12-month average or the most recent annual average data, has a rate of unemployment 150 percent or more of the national rate. See 25 CFR 224.89
  • Area ratio: means the smallest unrestricted area at the primary device divided by the cross-sectional area of the meter tube. See 43 CFR 3175.10
  • As-found: means the reading of a mechanical or electronic transducer when compared to a certified test device, prior to making any adjustments to the transducer. See 43 CFR 3175.10
  • As-left: means the reading of a mechanical or electronic transducer when compared to a certified test device, after making adjustments to the transducer, but prior to returning the transducer to service. See 43 CFR 3175.10
  • ASME Code: means the American Society of Mechanical Engineers "Boiler and Pressure Vessel Code. See 46 CFR 197.204
  • Assessment year: means a period of 12 consecutive months beginning at 12 noon on September 1 each year. See 43 CFR 3830.5
  • assets: means all existing and all probable future economic benefits obtained or controlled by a particular entity as a result of past transactions. See 40 CFR 280.92
  • Assets: includes furniture and equipment, leasehold improvements, and capitalized start-up costs. See 30 CFR 550.227
  • Assistance: Finance assistance in the form of a loan, grant, or subsidy received. See 25 CFR 170.440
  • Assistant Secretary: means the Assistant Secretary for Fair Housing and Equal Opportunity. See 24 CFR 115.100
  • Associate Administrator: means Associate Administrator for Hazardous Materials Safety, Pipeline and Hazardous Materials Safety Administration. See 49 CFR 105.5
  • Associate Administrator: means the Associate Administrator for Hazardous Materials Safety, Pipeline and Hazardous Materials Safety Administration. See 49 CFR 107.1
  • Associate Administrator: means the Associate Administrator for Pipeline Safety, or his or her delegate. See 49 CFR 190.3
  • Associate Administrator for Safety: means the Associate Administrator for Safety of the Federal Railroad Administration or that person's delegate as designated in writing. See 49 CFR 218.93

  • ATA: means a measure of pressure expressed in terms of atmosphere absolute (includes barometric pressure). See 46 CFR 197.204
  • Atmospheric pressure: means the pressure exerted by the weight of the atmosphere at a specific location. See 43 CFR 3175.10
  • Audit: means the systematic and functionally independent examination of an eligible entity under this subpart by an accredited third-party certification body or by FDA. See 43 CFR 9180.1
  • Audit agent: means an individual who is an employee or other agent of an accredited third-party certification body who, although not individually accredited, is qualified to conduct food safety audits on behalf of an accredited third-party certification body. See 43 CFR 9180.1
  • Audit finding: means deficiencies which the auditor is required by §75. See 45 CFR 75.2
  • Auditee: means any non-Federal entity that expends Federal awards which must be audited under subpart F-of this part. See 45 CFR 75.2
  • Auditor: means an auditor who is a public accountant, or a Federal, state, local government, or Indian Tribe audit organization, which meets the general standards specified for external auditors in generally accepted government auditing standards (GAGAS). See 45 CFR 75.2
  • Authorized FDA representative: means an FDA District Director in whose district the article of food involved is located or an FDA official senior to such director. See 21 CFR 1.377
  • Authorized officer: means any person authorized by the Secretary to administer regulations in this part. See 43 CFR 4100.0-5
  • Authorized officer: means any employee of the Bureau of Land Management to whom has been delegated the authority to perform the duties described herein. See 43 CFR 4700.0-5
  • Authorized representative: Any person who is authorized to act on behalf of the Secretary or a State lead agency for the purpose of surveying records required to be kept under this part and enforcing this part. See 26 CFR 31.3121(c)-1
  • Auto-IRA: means an individual retirement account for or opened on behalf of a participant in a state retirement savings program (whether or not the program provides for automatic enrollment). See 31 CFR 347.3
  • Auto-IRA custodian: means an entity designated by a state (including, for the purpose of these regulations, political subdivisions of states) to act as the trustee or custodian for Auto-IRAs, in the form of Roth IRAs or traditional IRAs, for or opened on behalf of participants in a state Auto-IRA program. See 31 CFR 347.3
  • Automated answering system: means a type of answering system that directs a telephone caller to a single menu of options, where the caller has the choice to select one of the available options to report an unsafe condition at a highway-rail or pathway grade crossing, as described in §234. See 49 CFR 234.301
  • Automatic ignition system: means an automatic ignitor and, where needed to ensure continuous combustion, a continuous pilot flame. See 43 CFR 3179.3
  • average VO concentration: means the mass-weighted average volatile organic concentration of a hazardous secondary material as determined in accordance with the requirements of §261. See 40 CFR 261.1081
  • average VO concentration: means the mass-weighted average volatile organic concentration of a hazardous waste as determined in accordance with the requirements of §265. See 40 CFR 265.1081
  • Bark: The tough outer covering of the woody stems of trees, shrubs, and other woody plants as distinguished from the cambium and inner wood. See 26 CFR 601.525
  • Bark products: Products containing pieces of bark including bark chips, bark nuggets, bark mulch, and bark compost. See 26 CFR 601.525
  • Base contract: means the initial contractual activity, including all option years, allowed during a defined unit of time, for example, 2 years. See 45 CFR 95.605
  • Basic employee death benefit: means the basic employee death benefit as defined in §843. See 14 CFR 302.714
  • Basic security: Consists of all equipment serving as security for Rural Development loans. See 25 CFR 213.22
  • Batch: means the collection of vehicles of the same category, configuration or subgroup thereof as designated by the Administrator in a test request, from which a batch sample is to be drawn, and inspected to determine conformance with the acceptability criteria. See 40 CFR 205.51
  • Batch sample: means the collection of vehicles of the same category, configuration or subgroup thereof which are drawn from a batch and from which test samples are drawn. See 40 CFR 205.51
  • Batch sample size: means the number of vehicles of the same category or configuration in a batch sample. See 40 CFR 205.51
  • Batch size: means the number as designated by the Administrator in the test request of vehicles of the same category or configuration in a batch. See 40 CFR 205.51
  • Bell: means a compartment either at ambient pressure (open bell) or pressurized (closed bell) that allows the diver to be transported to and from the underwater work site, allows the diver access to the surrounding environment, and is capable of being used as a refuge during diving operations. See 46 CFR 197.204
  • Beneficiary: refers to the second individual named in the registration of a security held in definitive form registered "John Doe SSN 123-45-6789 POD (payable on death to) Joseph Doe. See 31 CFR 351.3
  • Beta ratio: means the measured diameter of the orifice bore divided by the measured inside diameter of the meter tube. See 43 CFR 3175.10
  • Bias: means a systematic shift in the mean value of a set of measurements away from the true value of what is being measured. See 43 CFR 3175.10
  • Biogas: Biomass converted to gaseous fuel. See 25 CFR 224.89
  • Biomass: Any organic material that is available on a renewable or recurring basis including agricultural crops, trees grown for energy production, wood waste and wood residues, plants, including aquatic plants and grasses, fibers, animal waste and other waste materials, fats, oils, greases, including recycled fats, oils and greases. See 25 CFR 224.89
  • BLM: means the Bureau of Land Management and includes the individual employed by the Bureau of Land Management authorized to perform the duties set forth in this part and parts 3910 through 3930. See 43 CFR 3900.2
  • BLM: means the Bureau of Land Management. See 43 CFR 3170.3
  • BLM State Office: means the Bureau of Land Management State Office listed in §1821. See 43 CFR 3830.5
  • BOEM: means Bureau of Ocean Energy Management. See 30 CFR 550.200
  • Book-entry bond: means a Series EE savings bond maintained by Treasury solely as a computer record. See 31 CFR 351.3
  • Book-entry bond: means a savings bond maintained by Treasury in electronic or paperless form as a computer record. See 31 CFR 353.2
  • Borrower: When a loan is made to an individual, the individual is the borrower. See 25 CFR 213.22
  • Borrower: A borrower may be a cooperative organization, corporation, partnership, trust or other legal entity organized and operated on a profit or nonprofit basis. See 25 CFR 224.89

  • Building: means a structure, facility or portion thereof that contains or serves one or more dwelling units. See 24 CFR 100.201
  • Building entrance on an accessible route: means an accessible entrance to a building that is connected by an accessible route to public transportation stops, to accessible parking and passenger loading zones, or to public streets or sidewalks, if available. See 24 CFR 100.201
  • Bulk-power system: means the same as the definition of such term in paragraph (1) of section 215(a) of the Federal Power Act. See 10 CFR 205.380
  • Burden: means the total time, effort, or financial resources expended by persons to generate, maintain, retain, or disclose or provide information to or for a Federal agency, including:

    (i) Reviewing instructions. See 30 CFR 550.136

  • Bursting pressure: means the pressure at which a pressure containment device would fail structurally. See 46 CFR 197.204
  • By-pass: means any piping or other arrangement around or avoiding a meter or other measuring device or method (or component thereof) at an FMP that allows oil or gas to flow without measurement. See 43 CFR 3170.3
  • cab over engine: means the cab which contains the operator/passenger compartment is directly above the engine and front axle and the entire cab can be tilted forward to permit access to the engine compartment. See 40 CFR 205.51
  • Calendar day: means every day shown on the calendar. See 21 CFR 1.377
  • Capital assets: means tangible or intangible assets used in operations having a useful life of more than one year which are capitalized in accordance with GAAP. See 45 CFR 75.2
  • Capital debt: means the outstanding indebtedness used for the construction, rehabilitation, or acquisition of the physical property and equipment of a hospital, including those financing costs approved by HUD. See 24 CFR 242.1
  • Capital expenditures: means expenditures to acquire capital assets or expenditures to make additions, improvements, modifications, replacements, rearrangements, reinstallations, renovations, or alterations to capital assets that materially increase their value or useful life. See 45 CFR 75.2
  • Capture: means the physical containment of natural gas for transportation to market or productive use of natural gas, and includes injection and royalty-free on-site uses pursuant to subpart 3178 of this part. See 43 CFR 3179.3
  • Cargo transport unit: means a transport vehicle, a freight container, a portable tank or a multiple element gas container (MEGC). See 49 CFR 176.2
  • Case file: means a BOEM document file containing information and the record of evidence related to the alleged violation. See 30 CFR 550.1402
  • Categorically eligible: means considered income eligible for free meals or free milk, as applicable, based on documentation that a child is a member of a Family, as defined in this section, and one or more children in that family are receiving assistance under SNAP, FDPIR or the TANF program, as defined in this section. See 26 CFR 48.4101-1
  • Category: means a group of vehicle configurations which are identical in all material aspects with respect to the parameters listed in §205. See 40 CFR 205.51

  • Central service cost allocation plan: means the documentation identifying, accumulating, and allocating or developing billing rates based on the allowable costs of services provided by a state, local government, or Indian tribe on a centralized basis to its departments and agencies.   • centralized offset: refer to the process by which the Treasury Department's Financial Management Service offsets Federal payments through the Treasury Offset Program. See 29 CFR 4903.1
  • Certificate: A document issued or authorized to be issued under this subpart by an inspector to allow the interstate movement of regulated articles to any destination. See 24 CFR 203.22
  • Certificate: A document which is issued for a regulated article by an inspector or by a person operating under a compliance agreement, and which represents that the article is eligible for interstate movement in accordance with §301. See 24 CFR 203.35
  • Certificate: A document which is issued for a regulated article by an inspector or by a person operating under a compliance agreement, and which represents that such article is eligible for interstate movement in accordance with §301. See 24 CFR 203.43c
  • Certificate: A Plant Protection and Quarantine-approved form, stamp, or document issued and signed by an inspector, or by a qualified certified applicator or by any other person operating in accordance with a compliance agreement, affirming that a specified regulated article is eligible for interstate movement in accordance with this subpart. See 26 CFR 601.525

  • Certification number: A number issued by EPA or a State to an individual who is authorized by EPA or the State to use or supervise the use of any restricted use pesticide. See 26 CFR 31.3121(c)-1
  • Certified agency: is an agency that has been granted certification by the Assistant Secretary in accordance with the requirements of this part. See 24 CFR 115.100
  • Certified applicator: Any individual who is certified by EPA or the State to use or supervise the use of any restricted use pesticide covered by that individual's certification. See 26 CFR 31.3121(c)-1
  • Charge: means the statement of facts issued under 24 CFR 103. See 24 CFR 180.100
  • Chattel security: Chattel property which may consist of, but is not limited to, inventory. See 25 CFR 213.22
  • Chief Counsel: means the Chief Counsel of PHMSA. See 49 CFR 190.3
  • Chief Counsel: means the NHTSA Chief Counsel, or his or her designee. See 49 CFR 599.500
  • Child-resistant packaging: means packaging that is designed and constructed to be significantly difficult for children under 5 years of age to open or obtain a toxic or harmful amount of the substance contained therein within a reasonable time, and that is not difficult for normal adults to use properly. See 40 CFR 157.21
  • Cholecystokinetic drug product: A drug product that causes contraction of the gallbladder and is used during the course of diagnostic gallbladder studies (cholecystography). See 46 CFR 197.334
  • CID: means Conservation Information Document. See 30 CFR 550.200
  • Civil action: Court proceedings to protect Rural Development's financial interests such as obtaining possession of property from borrowers or third parties, judgments on indebtedness evidenced by notes or other contracts or judgments for the value of converted property, or judicial foreclosure. See 25 CFR 213.22
  • Civil penalty: means a fine. See 30 CFR 550.1402
  • Claimant: means the person under state or Federal law who is the owner of all or any part of an unpatented mining claim or site. See 43 CFR 3830.5
  • Class: means a group of vehicles which are identical in all material aspects with respect to the parameters listed in §205. See 40 CFR 205.151
  • Class I: has the meaning assigned by regulations of the Surface Transportation Board (49 CFR part 1201. See 49 CFR 234.401
  • Class of Federal awards: means a group of Federal awards either awarded under a specific program or group of programs or to a specific type of non-Federal entity or group of non-Federal entities to which specific provisions or exceptions may apply. See 45 CFR 75.2
  • Class of livestock: means ages and/or sex groups of a kind of livestock. See 43 CFR 4100.0-5
  • Clearance point: means the location near a turnout beyond which it is unsafe for passage on an adjacent track(s). See 49 CFR 218.93
  • closed cargo transport unit: means a cargo transport unit in which the contents are totally enclosed by permanent structures. See 49 CFR 176.2
  • Closed freight container: means a freight container which totally encloses its contents by permanent structures. See 49 CFR 176.2
  • Closed to mineral entry: means the land is not available for the location of mining claims or sites because Congress, BLM, or another surface managing agency has withdrawn or otherwise segregated the lands from the operation of the General Mining Law, often subject to valid existing rights. See 43 CFR 3830.5
  • Closed-vent system: means a system that is not open to the atmosphere and that is composed of piping, connections, and, if necessary, flow-inducing devices that transport gas or vapor from a piece or pieces of equipment to a control device. See 40 CFR 261.1031
  • Closed-vent system: means a system that is not open to the atmosphere and that is composed of piping, connections, and, if necessary, flow-inducing devices that transport gas or vapor from a piece or pieces of equipment to a control device. See 40 CFR 264.1031
  • Closeout: means the process by which the Federal awarding agency or pass-through entity determines that all applicable administrative actions and all required work of the Federal award have been completed and takes actions as described in §75. See 45 CFR 75.2
  • Closing agent: An attorney or title insurance company which is approved as a loan closing agent in accordance with subpart B of part 1927 of this chapter. See 25 CFR 170.512
  • Closing rpm: means the engine speed in Figure 2 of Appendix I. See 40 CFR 205.151
  • Closure device: means a cap, hatch, lid, plug, seal, valve, or other type of fitting that blocks an opening in a cover such that when the device is secured in the closed position it prevents or reduces air pollutant emissions to the atmosphere. See 40 CFR 261.1081

  • Cluster of programs: means a grouping of closely related programs that share common compliance requirements. See 45 CFR 75.2
  • Coal tar: The tar used for medicinal purposes that is obtained as a byproduct during the destructive distillation of bituminous coal at temperatures in the range of 900 °C to 1,100 °C. See 46 CFR 197.484
  • Cognizant agency for audit: means the Federal agency designated to carry out the responsibilities described in §75. See 45 CFR 75.2
  • Cognizant agency for indirect costs: means the Federal agency responsible for reviewing, negotiating, and approving cost allocation plans or indirect cost proposals developed under this part on behalf of all Federal agencies. See 45 CFR 75.2
  • COLA: means a cost-of-living adjustment. See 14 CFR 302.714
  • Collection of information: includes any requirement or request for persons to obtain, maintain, retain, report, or publicly disclose information. See 30 CFR 550.136
  • Collodion-like vehicle: A solution containing pyroxylin (nitrocellulose) in an appropriate nonaqueous solvent that leaves a transparent cohesive film when applied to the skin in a thin layer. See 46 CFR 197.404

  • Colostomy: An external operative opening of the colon. See 46 CFR 197.344
  • Comingle: refers to the act of creating systems, subsystems, or components where the systems, subsystems, or components are tightly coupled and with low cohesion. See 49 CFR 229.305
  • Commerce: means trade, traffic, commerce, or transportation:

    (i) Between a place in a State and any place outside thereof, or

    (ii) Which affects trade, traffic, commerce, or transportation described in paragraph (a)(17)(i) of this section. See 40 CFR 205.2

  • Commercial applicator: A certified applicator, whether or not the individual is a private applicator with respect to some uses, who uses or supervises the use of any restricted use pesticide for any purpose on any property other than as provided by the definition of private applicator. See 26 CFR 31.3121(c)-1
  • Commercial diving operation: means all activities in support of a commercial diver. See 46 CFR 197.204
  • Commercially available: Energy projects utilizing technology that has a proven operating history, and for which there is an established industry for the design, installation, and service (including spare parts) of the equipment. See 25 CFR 224.89
  • Commissioner: means the Assistant Secretary for Housing-Federal Housing Commissioner, or the Commissioner's delegates and designees. See 24 CFR 200.212
  • Commissioner: means the Federal Housing Commissioner or the Commissioner's authorized representative. See 24 CFR 206.3
  • Common areas and facilities: means those areas of the project and of the property upon which it is located that are for the use and enjoyment of the owners of family units located in the project. See 24 CFR 234.3
  • Common use areas: means rooms, spaces or elements inside or outside of a building that are made available for the use of residents of a building or the guests thereof. See 24 CFR 100.201
  • Communitized area: means the area committed to a BLM approved communitization agreement. See 43 CFR 3170.3
  • Community facilities: For the purposes of this subpart, community facilities are those facilities designed to aid in the development of private business and industry in rural areas. See 25 CFR 224.89
  • Comparable: With respect to the records required to be kept under this part, similar to those required under EPA-approved State certification programs. See 26 CFR 31.3121(c)-1
  • Compartment: means any space on a vessel that is enclosed by the vessel's decks and its sides or permanent steel bulkheads. See 49 CFR 176.2
  • Compensation: means any payment of money or the provision of any other thing of current or potential value in connection with service as a director. See 30 CFR 280.26
  • Competition motorcycle: means any motorcycle designed and marketed solely for use in closed course competition events. See 40 CFR 205.151
  • Complainant: The Administrator or an official of a cooperating State that deals with pesticide use or health or environmental issues related to the pesticide use, who institutes a proceeding pursuant to §110. See 26 CFR 31.3121(c)-1
  • Complainant: means the person (including the Assistant Secretary) who filed a complaint under the statutes covered by this part. See 24 CFR 180.100
  • Complaint: means a complaint filed under the statutes covered by this part. See 24 CFR 180.100
  • Compliance agreement: A written agreement between a person engaged in growing, handling, or moving regulated articles, and the Plant Protection and Quarantine Programs, wherein the former agrees to comply with the requirements of this subpart identified in the agreement by the inspector who executes the agreement on behalf of the Plant Protection and Quarantine Programs as applicable to the operations of such person. See 24 CFR 200.193
  • Compliance agreement: A written agreement between a person engaged in growing, handling, or moving regulated articles, and the Plant Protection and Quarantine Programs, wherein the former agrees to comply with the requirements of this subpart identified in the agreement by the inspector who executes the agreement on behalf of the Plant Protection and Quarantine Programs as applicable to the operations of such person.   • Compliance agreement: A written agreement between Plant Protection and Quarantine and a person engaged in the business of growing, handling, or moving regulated articles, in which the person agrees to comply with the provisions of this subpart and any conditions imposed pursuant to such provisions. See 24 CFR 203.35
  • Compliance agreement: A written agreement between Plant Protection and Quarantine and a person engaged in the business of growing, handling, or moving regulated articles, wherein the person agrees to comply with the provisions of this subpart and any conditions imposed pursuant thereto. See 24 CFR 203.43c
  • Compliance agreement: A written agreement between APHIS and a person engaged in growing, handling, or moving regulated articles, in which the person agrees to comply with the provisions of this subpart. See 26 CFR 601.525
  • Compliance supplement: means appendix XI to part 75 (previously known as the Circular A-133 Compliance Supplement). See 45 CFR 75.2
  • Component: means an electronic element, device, or appliance (including hardware or software) that is part of a system or subsystem. See 49 CFR 229.305
  • Component: means an element, device, or appliance (including those whose nature is electrical, mechanical, hardware, or software) that is part of a system or subsystem. See 49 CFR 236.903
  • Computing devices: means machines used to acquire, store, analyze, process, and publish data and other information electronically, including accessories (or "peripherals") for printing, transmitting and receiving, or storing electronic information. See 45 CFR 75.2
  • Condenser: means a heat-transfer device that reduces a thermodynamic fluid from its vapor phase to its liquid phase. See 40 CFR 261.1031

  • Conduct or Sponsor: A Federal agency is considered to "conduct or sponsor" a collection of information if the agency collects the information, causes another agency to collect the information, contracts or enters into a cooperative agreement with a person to collect the information, or requires a person to provide information to another person, or in similar ways causes another agency, contractor, partner in a cooperative agreement, or person to obtain, solicit, or require the disclosure to third parties or the public of information by or for an agency. See 30 CFR 550.136
  • Confidential regulatory information: means any record, data, or report, including but not limited to examination reports, or any part thereof, that is non-public, privileged or otherwise not intended for public disclosure which is in the possession or control of a financial regulatory agency and which contains information regarding members of a Bank or financial institutions with which a Bank has had or contemplates having transactions under the Bank Act. See 30 CFR 550.243
  • Configuration: means the basic classification unit of a manufacturer's product line and is comprised of all vehicle designs, models or series which are identical in material aspects with respect to the parameters listed in §205. See 40 CFR 205.51
  • Configuration: means the basic classification unit of a manufacturer's product line and is comprised of all vehicle designs, models or series which are identical in all material aspects with respect to the parameters listed in §205. See 40 CFR 205.151
  • Configuration log: means a list of all fixed or user-programmable parameters used by the flow computer that could affect the calculation or verification of flow rate, volume, or heating value. See 43 CFR 3175.10
  • Configuration management control plan: means a plan designed to ensure that the proper and intended product configuration, including the electronic hardware components and software version, is documented and maintained through the life-cycle of the products in use. See 49 CFR 229.305

  • Construction: means the creation of a new or replacement hospital facility, the substantial rehabilitation of an existing facility, or the limited rehabilitation of an existing facility. See 24 CFR 242.1
  • Consultative audit: means an audit of an eligible entity:

    (i) To determine whether such entity is in compliance with the applicable food safety requirements of the FD&C Act, FDA regulations, and industry standards and practices. See 43 CFR 9180.1

  • Containment and inactivation controls: means any combination of mechanical, procedural, or biological controls designed and operated to restrict environmental release of viable microorganisms from a facility. See 40 CFR 172.43
  • Contaminant: means any physical, chemical, biological, or radiological substance or matter in water. See 40 CFR 149.101
  • Continuous recorder: means a data-recording device recording an instantaneous data value at least once every 15 minutes. See 40 CFR 261.1031

  • Contractor: means an entity that receives a contract as defined in Contract. See 45 CFR 75.2
  • Contractor: means any individual, corporation, association, partnership, consortium or joint venture who has contracted to carry out activities under this part. See 43 CFR 3190.0-5
  • contributions: refers to contributions actually provided by the contributor from such individual's property, or the use thereof, or by the use of such individual's own credit. See 20 CFR 725.233
  • control: means having any relationship which gives an entity or person authority directly or indirectly to determine the manner in which an applicant, permittee or lessee conducts grazing operations. See 43 CFR 4100.0-5
  • Control device: means an enclosed combustion device, vapor recovery system, or flare. See 40 CFR 261.1031

  • Controlled substance: means any drug or other substance, or immediate precursor included in the definition in section 102 of the Controlled Substances Act (21 U. See 24 CFR 100.201
  • Controlling interest: means direct ownership of at least 50 percent of the voting stock of another entity. See 40 CFR 280.92
  • Controlling Participant: means an individual or entity serving in a capacity for a Covered Project that makes the individual or entity subject to Previous Participation review under this subpart, as further described in §200. See 24 CFR 200.212
  • Conversion: means the date on which all documents necessary to create a condominium under state law (and under local law, where applicable) have been recorded, except that in the case of the Commonwealth of Puerto Rico, conversion is defined as the date on which the legal documents (which must be in compliance with applicable law) to create a condominium are presented for inscription (i. See 24 CFR 234.3
  • Cooperative audit resolution: means the use of audit follow-up techniques which promote prompt corrective action by improving communication, fostering collaboration, promoting trust, and developing an understanding between the Federal agency and the non-Federal entity. See 45 CFR 75.2
  • Coowner: means either the first or the second individual named in the registration of a definitive Series EE savings bond registered "John Doe SSN 123-45-6789 or Joseph Doe. See 31 CFR 351.3
  • Corn and callus remover drug product: A topical agent used for the removal of corns and calluses. See 46 CFR 197.452
  • Corrective action: means action taken by the auditee that:

    (1) Corrects identified deficiencies. See 45 CFR 75.2

  • Cost allocation plan: means central service cost allocation plan or public assistance cost allocation plan. See 45 CFR 75.2
  • Cost objective: means a program, function, activity, award, organizational subdivision, contract, or work unit for which cost data are desired and for which provision is made to accumulate and measure the cost of processes, products, jobs, capital projects, etc. See 45 CFR 75.2
  • Cost sharing or matching: means the portion of project costs not paid by Federal funds (unless otherwise authorized by Federal statute). See 45 CFR 75.2
  • Country from which the article is shipped: means the country in which the article of food is loaded onto the conveyance that brings it to the United States or, in the case of food sent by international mail, the country from which the article is mailed. See 21 CFR 1.276
  • Cover: means a device that provides a continuous barrier over the hazardous secondary material managed in a unit to prevent or reduce air pollutant emissions to the atmosphere. See 40 CFR 261.1081
  • Cover: means a device that provides a continuous barrier over the hazardous waste managed in a unit to prevent or reduce air pollutant emissions to the atmosphere. See 40 CFR 265.1081
  • Covered multifamily dwellings: means buildings consisting of 4 or more dwelling units if such buildings have one or more elevators. See 24 CFR 100.201
  • Covered Project: means a project in which the participation of a Controlling Participant is conditioned on Previous Participation review under this subpart, as further described in §200. See 24 CFR 200.212
  • Creditor agency: means any Federal agency that is owed a debt. See 29 CFR 4903.1
  • Criminal action: Prosecution by the United States to exact punishment in the form of fines or imprisonment for alleged violations of criminal statutes. See 25 CFR 213.22
  • Critical electric infrastructure: means the same as the definition of such term in paragraph (2) of section 215A(a) of the Federal Power Act. See 10 CFR 205.380
  • Cross-cutting audit finding: means an audit finding where the same underlying condition or issue affects Federal awards of more than one Federal awarding agency or pass-through entity. See 45 CFR 75.2
  • Crossing Inventory: means the U. See 49 CFR 234.401
  • CSRS: means the Civil Service Retirement System as described in subchapter III of chapter 83 of title 5, United States Code. See 14 CFR 302.714
  • CSRS component: means the portion of a combined CSRS/FERS annuity that is computed under CSRS rules. See 14 CFR 302.714
  • Current income: means income, as defined in §245. See 26 CFR 48.4101-1
  • Current Treasury borrowing rate: means the prevailing market rate, as determined by Treasury, for a Treasury security with the specified period to maturity. See 31 CFR 344.1
  • Custodial property: Borrower-owned real property and improvements which serve as security for an Rural Development loan, have been abandoned by the borrower, and of which the respective Agency has taken possession. See 25 CFR 170.616
  • Custodian: means a trustee or custodian of a Roth IRA or traditional IRA. See 31 CFR 347.3
  • Cylinder: means a pressure vessel for the storage of gases under pressure. See 46 CFR 197.204
  • CZMA: means Coastal Zone Management Act. See 30 CFR 550.200
  • Dandruff: A condition involving an increased rate of shedding of dead epidermal cells of the scalp. See 46 CFR 197.484
  • Data communication: means transmitting and receiving of data to or from Banks, Federal Reserve offices, clearinghouse associations, depository institutions or their service bureaus, and other direct sending entities. See 30 CFR 550.227
  • Data processing: includes capture, storage, and assembling of, and computation of, data from payment instruments received from Federal Reserve offices, Banks, clearinghouse associations, depository institutions, and other direct lending entities. See 30 CFR 550.227
  • Data processing: means the preparation of source media containing data or basic elements of information and the use of such source media according to precise rules or procedures to accomplish such operations as classifying, sorting, calculating, summarizing, recording and transmitting. See 45 CFR 95.605
  • Day: means a 24-hour period ending at 11:59 p. See 49 CFR 190.3
  • Day: means calendar day, except where the term business day is used. See 24 CFR 206.3
  • Days: means consecutive calendar days, unless otherwise indicated. See 43 CFR 3170.3
  • Debt: means any amount of money, funds or property that has been determined by an appropriate official of the Federal Government to be owed to the United States government, including government-owned corporations, by a person. See 29 CFR 4903.1
  • Debt instrument: Used as a collective term to include promissory note, assumption agreement, grant agreement, or bond. See 25 CFR 170.440
  • Debtor: means a person who owes a debt to the United States. See 29 CFR 4903.1
  • Deceased beneficiary: In the event that a person, who is otherwise qualified to receive payments as the result of a deficit caused by an underpayment under the provisions of paragraph (c) of this section, dies before receiving payment or before negotiating the check or checks representing such payment, his or her share of the underpayment shall be divided among the remaining living person(s) in the same order or priority.   • Decompression chamber: means a pressure vessel for human occupancy such as a surface decompression chamber, closed bell, or deep diving system especially equipped to recompress, decompress, and treat divers. See 46 CFR 197.204
  • Decompression sickness: means a condition caused by the formation of gas or gas bubbles in the blood or body tissue as a result of pressure reduction. See 46 CFR 197.204
  • Decompression table: means a profile or set of profiles of ascent rates and breathing mixtures designed to reduce the pressure on a diver safely to atmospheric pressure after the diver has been exposed to a specific depth and bottom time. See 46 CFR 197.204
  • Default: Failure of the borrower to observe the agreements with Rural Development as contained in notes, security instruments, and similar or related instruments. See 25 CFR 213.22
  • Defense critical electric infrastructure: means the same as the definition of such term in paragraph (4) of section 215A(a) of the Federal Power Act. See 10 CFR 205.380

  • Deodorant for internal use: An ingredient taken internally to reduce odors arising from conditions such as colostomies, ileostomies, or fecal incontinence. See 46 CFR 197.344
  • Department: means the Department of the Interior. See 43 CFR 3900.2

  • Departure track: means a track located in a classification yard where rolling equipment is placed and made ready for an outgoing train movement. See 49 CFR 218.93

  • Development cost: These costs include, but are not limited to, those for acquisition, planning, construction, repair or enlargement of the proposed facility. See 25 CFR 224.89
  • Diligent development: means achieving or completing the prescribed milestones listed in §3930. See 43 CFR 3900.2
  • Direct accreditation: means accreditation of a third-party certification body by FDA. See 43 CFR 9180.1
  • Direct certification: means determining a child is eligible for free meals or free milk, as applicable, based on documentation obtained directly from the appropriate State or local agency or individuals authorized to certify that the child is a member of a household receiving assistance under SNAP, as defined in this section. See 26 CFR 48.4101-1
  • Direct loan accounts: For a borrower with a direct loan, the term "installation on note and other charges" as used in this Subpart, will be the sum of the following:

    (i) Annual installment for the year as provided in the promissory note(s). See 25 CFR 170.110

  • Direct sale: means a sale to a selected purchaser to the exclusion of all others without resorting to advertising for bids. See 24 CFR 291.5
  • Director: means the Director of OMB, or his or her designee. See 30 CFR 550.136
  • Director: means the Director of the Office of Government Ethics. See 20 CFR 10.508
  • Director of the Implementing Agency: means the EPA Regional Administrator, or, in the case of a state with a program approved under section 9004, the Director of the designated state or local agency responsible for carrying out an approved UST program. See 40 CFR 280.92
  • Directorate: means the board established under section 21(b) of the Bank Act (12 U. See 30 CFR 550.251
  • Disallowed costs: means those charges to a Federal award that the Federal awarding agency or pass-through entity determines to be unallowable, in accordance with the applicable Federal statutes, regulations, or the terms and conditions of the Federal award. See 45 CFR 75.2
  • Disaster Assistance for Rural Business Enterprises: Guaranteed loans authorized by section 401 of the Disaster Assistance Act of 1989 (Pub. See 25 CFR 224.89
  • Discharge coefficient: means an empirically derived correction factor that is applied to the theoretical differential flow equation in order to calculate a flow rate that is within stated uncertainty limits. See 43 CFR 3175.10
  • Disclosure: means reveal or use individual children's program eligibility information obtained through the free and reduced price meal or free milk eligibility process for a purpose other than for the purpose for which the information was obtained. See 26 CFR 48.4101-1
  • dispatches trains: means dispatches or otherwise provides the authority for the movement of the train or trains through a highway-rail or pathway grade crossing. See 49 CFR 234.301
  • Dispatching railroad: means a railroad that dispatches or otherwise provides the authority for the movement of one or more trains through a highway-rail or pathway grade crossing. See 49 CFR 234.301
  • Disposal system: means any combination of engineered and natural barriers that isolate spent nuclear fuel or radioactive waste after disposal. See 40 CFR 191.12
  • Dispute: is a disagreement by an Affected Entity with a specific Agency Decision regarding a pre-award or post-award action. See 49 CFR 106.85
  • Distributing agencies: means State, Federal or private agencies which enter into agreements with the Department for the distribution of donated food to eligible recipient agencies and recipients. See 26 CFR 1.40-1
  • Distribution site: means a location where the eligible recipient agency actually distributes commodities to needy persons for household consumption or serves prepared meals to needy persons under this part. See 26 CFR 1.36B-2
  • District: means the specific area of public lands administered by a District Manager or a Field Manager. See 43 CFR 4100.0-5
  • Dive location: means that portion of a vessel or facility from which a diving operation is conducted. See 46 CFR 197.204
  • Dive team: means the divers and diver support personnel involved in a diving operation, including the diving supervisor. See 46 CFR 197.204
  • Diver: means a person working beneath the surface, exposed to hyperbaric conditions, and using underwater breathing apparatus. See 46 CFR 197.204
  • Diver-carried reserve breathing gas: means a supply of air or mixed-gas, as appropriate, carried by the diver in addition to the primary or secondary breathing gas supplied to the diver. See 46 CFR 197.204
  • Diving installation: means all of the equipment used in support of a commercial diving operation. See 46 CFR 197.204
  • Diving mode: means a type of diving requiring SCUBA, surface-supplied air, or surface-supplied mixed-gas equipment, with related procedures and techniques. See 46 CFR 197.204
  • Diving stage: means a suspended platform constructed to carry one or more divers and used for putting divers into the water and bringing them to the surface when in-water decompression or a heavy-weight diving outfit is used. See 46 CFR 197.204
  • Diving supervisor: means the person having complete responsibility for the safety of a commercial diving operation including the responsibility for the safety and health of all diving personnel in accordance with this subpart. See 46 CFR 197.204
  • DOCD: means Development Operations Coordination Document. See 30 CFR 550.200
  • DOE: means the Department of Energy. See 29 CFR 4211.32
  • Domestic facility: means any facility located in any State or Territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico that manufactures/processes, packs, or holds food for consumption in the United States. See 21 CFR 1.227
  • DPP: means Development and Production Plan. See 30 CFR 550.200
  • Drought and Disaster Guaranteed Loans: Guaranteed loans authorized by section 331 of the Disaster Assistance Act of 1988 (Pub. See 25 CFR 224.89
  • dry air pollution control system: means an emission control system that utilizes filters to remove iron-bearing particles (fines) from blast furnace or sintering off-gases. See 40 CFR 420.21
  • Dwelling unit: means a single unit of residence for a family or one or more persons. See 24 CFR 100.201
  • DWOP: means Deepwater Operations Plan. See 30 CFR 550.200
  • Effective date: means the date annuities increased by a COLA begin to accrue at the higher rate. See 14 CFR 302.714
  • Effective dose: means the sum over specified tissues of the products of the dose equivalent received following an exposure of, or an intake of radionuclides into, specified tissues of the body, multiplied by appropriate weighting factors. See 40 CFR 191.12
  • Effectively diminishing: An eradication program is considered to be effectively diminishing the gypsy moth population of an area if the results of two successive annual Federal or State delimiting trapping surveys of the area conducted in accordance with Section II, "Survey Procedures--Gypsy Moth" of the Gypsy Moth Treatment Manual show that the average number of gypsy moths caught per trap in the second delimiting survey (when comparable geographical areas and trapping densities are used) is: (1) Less than 10, and (2) less than the average number of gypsy moths caught per trap in the first survey. See 26 CFR 601.525
  • EIA: means Environmental Impact Analysis. See 30 CFR 550.200
  • Electric Reliability Organization: means the same as the definition of such term in paragraph (2) of section 215(a) of the Federal Power Act. See 10 CFR 205.380
  • Electricity subsector: means both commercial and industrial actors who generate and deliver electric power. See 10 CFR 205.380
  • Element range: means the difference between the minimum and maximum value that the element (differential-pressure bellows, static-pressure element, and temperature element) of a mechanical recorder is designed to measure. See 43 CFR 3175.10
  • Eligible entity: means a foreign entity in the import supply chain of food for consumption in the United States that chooses to be subject to a food safety audit under this subpart conducted by an accredited third-party certification body. See 43 CFR 9180.1
  • Eligible Non-Borrowing Spouse: means a Non-Borrowing Spouse who meets all Qualifying Attributes for a Deferral Period. See 24 CFR 206.3
  • Eligible properties: means HUD-acquired properties designated by HUD for property disposition or other housing programs. See 24 CFR 291.5
  • Eligible recipient agency: means an organization which--

    (1) Is public, or

    (2) Is private, possessing tax exempt status pursuant to §251. See 26 CFR 1.36B-2

  • Emergency measures: means measures necessary in the judgment of the Secretary to protect or restore the reliability of critical electric infrastructure or of defense critical electric infrastructure during a grid security emergency as defined in section 215A(a) of the Federal Power Act. See 10 CFR 205.380
  • Emergency order: means an order for emergency measures under section 215A(b) of the Federal Power Act. See 10 CFR 205.380
  • Emergency order: means a written order imposing restrictions, prohibitions, or safety measures on affected entities. See 49 CFR 190.3
  • Employee: means an individual who is engaged or compensated by a railroad or by a contractor to a railroad to perform any of the duties defined in this subpart. See 49 CFR 218.93
  • Employee: includes a person who had applied for retirement under FERS but had not been separated from the service prior to his or her death even if the person's retirement would have been retroactively effective upon separation. See 14 CFR 302.24
  • Employee: means an officer or employee of the executive branch of the United States. See 20 CFR 10.508
  • Employer: means a railroad, or contractor to a railroad, that directly engages or compensates individuals to perform the duties specified in §236. See 49 CFR 236.903
  • Enclosure: means a structure that surrounds a tank or container, captures organic vapors emitted from the tank or container, and vents the captured vapors through a closed-vent system to a control device. See 40 CFR 261.1081
  • Enclosure: means a structure that surrounds a tank or container, captures organic vapors emitted from the tank or container, and vents the captured vapors through a closed-vent system to a control device. See 40 CFR 265.1081
  • Endowment: means the National Endowment for the Arts. See 45 CFR 1151.3
  • Energy information: includes all information in whatever form on (1) fuel reserves, exploration, extraction, and energy resources (including petrochemical feedstocks) wherever located. See 29 CFR 4211.32
  • Energy projects: Commercially available projects that produce or distribute energy or power and/or projects that produce biomass or biogas fuel. See 25 CFR 224.89
  • Enforcement: means action taken by an authorized representative of the Secretary in order to obtain compliance with applicable regulations, Onshore Oil and Gas Orders, Notices to Lessees and Operators, approvals, other written orders, the mineral leasing laws, and the Federal Oil and Gas Royalty Management Act. See 43 CFR 3190.0-5
  • Engine displacement: means volumetric engine capacity as defined in §205. See 40 CFR 205.151
  • Enhanced matching rate: means the higher than regular rate of FFP authorized by Title IV-D, IV-E, and XIX of the Social Security Act for acquisition of services and equipment that conform to specific requirements designed to improve administration of the Child Support Enforcement, Foster Care and Adoption Assistance, and Medicaid programs. See 45 CFR 95.605
  • ENS: means Emergency Notification System as defined in this section. See 49 CFR 234.301
  • Entity: means a person, association, or corporation, or any subsidiary, affiliate, corporation, or association controlled by or under common control with such person, association, or corporation. See 43 CFR 3900.2
  • Entrance: means any access point to a building or portion of a building used by residents for the purpose of entering. See 24 CFR 100.201
  • Entry: The point at which imported product offered for entry receives reinspection and is marked with the official mark of inspection in accordance with §557. See 37 CFR 2.171
  • EO property: Nonsecurity chattel property purchased, refinanced, or improved with EO loan funds. See 25 CFR 213.22
  • EPA: The United States Environmental Protection Agency. See 26 CFR 31.3121(c)-1
  • EPA registration number: The number assigned to a product registered with EPA in accordance with sections 3 or 24c of the Federal Insecticide, Fungicide, and Rodenticide Act and implementing regulations, and borne on the label of the product. See 26 CFR 31.3121(c)-1
  • EPAA: means the Emergency Petroleum Allocation Act of 1973 (Pub. See 29 CFR 4211.32
  • Ephemeral rangelands: means areas of the Hot Desert Biome (Region) that do not consistently produce enough forage to sustain a livestock operation, but from time to time produce sufficient forage to accommodate livestock grazing. See 43 CFR 4100.0-5
  • Equipment: means tangible personal property (including information technology systems) having a useful life of more than one year and a per-unit acquisition cost which equals or exceeds the lesser of the capitalization level established by the non-Federal entity for financial statement purposes, or $5,000. See 45 CFR 75.2
  • Equipment: means each valve, pump, compressor, pressure relief device, sampling connection system, open-ended valve or line, or flange or other connector, and any control devices or systems required by this subpart. See 40 CFR 261.1031
  • Equipment: means each valve, pump, compressor, pressure relief device, sampling connection system, open-ended valve or line, or flange or other connector, and any control devices or systems required by this subpart. See 40 CFR 264.1031
  • Eradication program: A program that uses pesticide application, biological controls, or other methods with the goal of eliminating gypsy moth from a particular area. See 26 CFR 601.525
  • ESECA: means the Energy Supply and Environmental Coordination Act of 1974 (Pub. See 29 CFR 4211.32
  • Essential nutrients: means compounds that are found in the tissues of untreated, healthy target animals and not produced in sufficient quantity to support the animal's growth, development, function, or reproduction, e. See 46 CFR 308.524
  • et seq:

    File or Filed means received by the appropriate PHMSA or other designated office within the time specified in a regulation or rulemaking document. See 49 CFR 105.5

  • European larch canker: The plant disease known as European larch canker, Lachnellula willkommi (Dasycypha), in any stage of development. See 24 CFR 203.43c
  • Event log: means an electronic record of all exceptions and changes to the flow parameters contained within the configuration log that occur and have an impact on a quantity transaction record. See 43 CFR 3175.10
  • Exhaust System: means the system comprised of a combination of components which provides for enclosed flow of exhaust gas from engine exhaust port to the atmosphere. See 40 CFR 205.51
  • Exhaust system: means the combination of components which provides for the enclosed flow of exhaust gas from the engine exhaust port to the atmosphere. See 40 CFR 205.151
  • Expenditures: means charges made by a non-Federal entity to a project or program for which a Federal award was received. See 45 CFR 75.2
  • Expenses: means necessary and reasonable travel, subsistence and other related expenses incurred in connection with the performance of official duties as are payable to senior officers of the Bank under the Bank's travel policy, except gift or entertainment expenses. See 30 CFR 280.26
  • Exploration: means drilling, excavating, and geological, geophysical or geochemical surveying operations designed to obtain detailed data on the physical and chemical characteristics of Federal oil shale and its environment including:

    (1) The strata below the Federal oil shale. See 43 CFR 3900.2

  • Exploration license: means a license issued by the BLM that allows the licensee to explore unleased oil shale deposits to obtain geologic, environmental, and other pertinent data concerning the deposits. See 43 CFR 3900.2
  • Exploration plan: means a plan prepared in sufficient detail to show the:

    (1) Location and type of exploration to be conducted. See 43 CFR 3900.2

  • Explosive substance: means a solid or liquid material, or a mixture of materials, which is in itself capable by chemical reaction of producing gas at such a temperature and pressure and at such a speed as to cause damage to its surroundings. See 49 CFR 176.2
  • Explosives anchorage: means an anchorage so designated under 33 CFR part 110, subpart B. See 49 CFR 176.2
  • Export exemption: means an exemption from the prohibitions of section 10 (a) (1), (2), (3), and (4) of the Act, granted by statute under section 10(b)(2) of the Act for the purpose of exporting regulated products. See 40 CFR 204.2
  • Export exemption: means an exemption from the prohibitions of section 10(a) (1), (2), (3), and (4) of the Act, granted by statute under section 10(b)(2) of the Act for the purpose of exporting regulated products. See 40 CFR 205.2
  • Export pesticide device: means a device, as defined in FIFRA section 2(h), that is intended solely for export from the United States to another country. See 40 CFR 168.67
  • Export pesticide product: means a pesticide product, as defined in §152. See 40 CFR 168.67
  • External floating roof: means a pontoon-type or double-deck type cover that rests on the surface of the material managed in a tank with no fixed roof. See 40 CFR 261.1081

  • Facility: means a deepwater port, or an artificial island, installation, or other device on the Outer Continental Shelf subject to Coast Guard jurisdiction. See 46 CFR 197.204
  • Facility: means any structure, or structures of an eligible entity under one ownership at one general physical location, or, in the case of a mobile facility, traveling to multiple locations, that manufactures/processes, packs, holds, grows, harvests, or raises animals for food for consumption in the United States. See 43 CFR 9180.1
  • Facility: means any establishment, structure, or structures under one ownership at one general physical location, or, in the case of a mobile facility, traveling to multiple locations, that manufactures/processes, packs, or holds food for consumption in the United States. See 21 CFR 1.227
  • Facility: means all or any portion of buildings, structures, equipment, roads, walks, parking lots, or other real or personal property or interest in such property. See 45 CFR 1151.3
  • Facility certification: means an attestation, issued for purposes of section 801(q) or 806 of the FD&C Act by an accredited third-party certification body, after conducting a regulatory audit and any other activities necessary to establish whether a facility complies with the applicable food safety requirements of the FD&C Act and FDA regulations. See 43 CFR 9180.1
  • Failing exhaust system: means that, when installed on any Federally regulated motorcycle for which it is designed and marketed, that motorcycle and exhaust system exceed the applicable standards. See 40 CFR 205.165
  • Failing vehicle: means that the measured emissions of the vehicle, when measured in accordance with the applicable procedure, exceeds the applicable standard. See 40 CFR 205.51
  • Failing vehicle: means a vehicle whose noise level is in excess of the applicable standard. See 40 CFR 205.151
  • Fair Housing Act matters: refers to proceedings under this part pursuant to the Fair Housing Act and the implementing regulations at 24 CFR parts 100 and 103. See 24 CFR 180.100
  • False information: Information, known to be incorrect, provided with the intent to obtain benefits which would not have been obtainable based on correct information. See 25 CFR 170.440
  • Family: means a group of related or nonrelated individuals, who are not residents of an institution or boarding house, but who are living as one economic unit. See 26 CFR 48.4101-1
  • Family unit: means a one-family unit including the undivided interest in the common areas and facilities, and such restricted common areas and facilities as may be designated. See 24 CFR 234.3
  • farm: as used in this subpart includes stock, dairy, poultry, fruit, fur-bearing animal, and truck farms, plantations, ranches, nurseries, ranges, orchards, and such greenhouses and other similar structures as are used primarily for the raising of agricultural or horticultural commodities. See 26 CFR 31.3306(k)-1
  • farm: includes operations that, in addition to these activities:

    (i) Pack or hold raw agricultural commodities;

    (ii) Pack or hold processed food, provided that all processed food used in such activities is either consumed on that farm or another farm under the same management, or is processed food identified in paragraph (1)(iii)(B)(1) of this definition; and

    (iii) Manufacture/process food, provided that:

    (A) All food used in such activities is consumed on that farm or another farm under the same management; or

    (B) Any manufacturing/processing of food that is not consumed on that farm or another farm under the same management consists only of:

    (1) Drying/dehydrating raw agricultural commodities to create a distinct commodity (such as drying/dehydrating grapes to produce raisins), and packaging and labeling such commodities, without additional manufacturing/processing (an example of additional manufacturing/processing is slicing);

    (2) Treatment to manipulate the ripening of raw agricultural commodities (such as by treating produce with ethylene gas), and packaging and labeling treated raw agricultural commodities, without additional manufacturing/processing; and

    (3) Packaging and labeling raw agricultural commodities, when these activities do not involve additional manufacturing/processing (an example of additional manufacturing/processing is irradiation); or

    (2) Secondary activities farm. See 21 CFR 1.227

  • Farm grade crossing: means a type of highway-rail grade crossing where a private roadway used for the movement of farm motor vehicles, farm machinery, or livestock in connection with agricultural pursuits, forestry, or other land-productive purposes crosses one or more railroad tracks at grade. See 49 CFR 234.301
  • Farmer program loans: This includes Farm Ownership (FO), Soil and Water (SW), Recreation (RL), Economic Opportunity (EO), Operating (OL), Emergency (EM), Economic Emergency (EE), Special Livestock (SL), Softwood Timber (ST) loans, and Rural Housing loans for farm service buildings (RHF). See 25 CFR 170.616
  • Farmer Programs loans: The term "Farmer Program loans" (FP) refers to the following types of loans: Farm Ownership (FO), Soil and Water (SW), Recreation (RL), Economic Opportunity (EO), Operating (OL), Emergency (EM), Economic Emergency (EE), Softwood Timber (ST), and Rural Housing Loans for farm service buildings (RHF). See 25 CFR 170.512
  • FCCS: means the Federal Claims Collection Standards, 31 CFR parts 900-904. See 29 CFR 4903.1
  • FDA: means the Food and Drug Administration. See 46 CFR 308.524
  • FDPIR: means the food distribution program for households on Indian reservations operated under part 253 of this title. See 26 CFR 48.4101-1
  • Feasibility study: means a preliminary study to determine whether it is sufficiently probable that effective and efficient use of ADP equipment or systems can be made to warrant a substantial investment of staff, time, and money being requested and whether the plan is capable of being accomplished successfully. See 45 CFR 95.605
  • Federal agency: means an "agency" as defined at 5 U. See 45 CFR 75.2
  • Federal award date: means the date when the Federal award is signed by the authorized official of the Federal awarding agency. See 45 CFR 75.2
  • Federal awarding agency: means the Federal agency that provides a Federal award directly to a non-Federal entity. See 45 CFR 75.2
  • Federal employee: means a current employee of PBGC or other Federal agency, including a current member of the uniformed services, including the Army, Navy, Air Force, Marine Corps, Coast Guard, Commissioned Corps of the National Oceanic and Atmospheric Administration, Commissioned Corps of the Public Health Service, the National Guard, and the reserve forces of the uniformed services. See 29 CFR 4903.1
  • Federal financial assistance: means any grant, loan, contract (other than a procurement contract or a contract of insurance or guaranty), or any other arrangement by which the Endowment provides or otherwise makes available assistance in the form of:

    (1) Funds. See 45 CFR 1151.3

  • Federal financial assistance: has the meaning provided in 24 CFR 1. See 24 CFR 180.100
  • Federal financial assistance: means any financial benefits provided directly as aid to a project by a department, agency, or instrumentality of the Federal government in any form including contracts, grants, and loan guarantees. See 40 CFR 149.101
  • Federal hazardous material transportation law: means 49 U. See 49 CFR 107.1
  • Federal lands: means any lands or interests in lands, including oil shale interests underlying non-Federal surface, owned by the United States, without reference to how the lands were acquired or what Federal agency administers the lands. See 43 CFR 3900.2
  • Federal lands: means any lands or interest in lands owned by the United States, subject to location under the General Mining Law, including, but not limited to, those lands within forest reservations in the National Forest System and wildlife refuges in the National Wildlife Refuge System. See 43 CFR 3830.5
  • Federal lease: A lease issued under the Act of February 25, 1920, as amended (30 U. See 43 CFR 3180.0-5
  • Federal payment agency: means any Federal agency that transmits payment requests in the form of certified payment vouchers, or other similar forms, to a disbursing official for disbursement. See 29 CFR 4903.1
  • Federal program office: means the Federal program office within the Department that is authorized to approve requests for the acquisition of ADP equipment or ADP services. See 45 CFR 95.605
  • Federal share: means the portion of total project costs that are paid by Federal funds. See 45 CFR 75.2
  • Federally registered: means currently registered under section 3 of the Act, after having been initially registered under the Federal Insecticide, Fungicide, and Rodenticide Act of 1947 by the Secretary of Agriculture or under FIFRA by the Administrator. See 40 CFR 162.151
  • FERS: means the Federal Employees Retirement System as described in chapter 84 of title 5, United States Code. See 14 CFR 302.24
  • FERS: means the Federal Employees Retirement System as defined in chapter 84 of title 5, United States Code. See 14 CFR 302.714
  • FERS component: means the portion of a combined CSRS/FERS annuity computed under FERS rules. See 14 CFR 302.714

  • Filed: means received by the appropriate PHMSA or other designated office within the time specified in a regulation or rulemaking document. See 49 CFR 107.1
  • Filed: means a document is--

    (a) Received by BLM on or before the due date. See 43 CFR 3830.5

  • Final administrative disposition: means an agency's completion of a case following a reasonable cause finding, including, but not limited to, an agency-approved settlement or a final, administrative decision issued by commissioners, hearing officers or administrative law judges. See 24 CFR 115.100
  • Final cost objective: means a cost objective which has allocated to it both direct and indirect costs and, in the non-Federal entity's accumulation system, is one of the final accumulation points, such as a particular award, internal project, or other direct activity of a non-Federal entity. See 45 CFR 75.2
  • Financial regulatory agency: means any of the following:

    (1) The Department of the Treasury, including the Comptroller of the Currency. See 30 CFR 550.243

  • Financial reporting year: means the latest consecutive twelve-month period for which any of the following reports used to support a financial test is prepared:

    (1) A 10-K report submitted to the SEC. See 40 CFR 280.92

  • First aid antibiotic: An antibiotic-containing drug product applied topically to the skin to help prevent infection in minor cuts, scrapes, and burns. See 46 CFR 169.525
  • First attempt at repair: means to take rapid action for the purpose of stopping or reducing leakage of organic material to the atmosphere using best practices. See 40 CFR 261.1031
  • First attempt at repair: means to take rapid action for the purpose of stopping or reducing leakage of organic material to the atmosphere using best practices. See 40 CFR 264.1031
  • First occupancy: means a building that has never before been used for any purpose. See 24 CFR 100.201
  • Fixed amount awards: means a type of grant agreement under which the Federal awarding agency or pass-through entity provides a specific level of support without regard to actual costs incurred under the Federal award. See 45 CFR 75.2
  • Fixed roof: means a cover that is mounted on a unit in a stationary position and does not move with fluctuations in the level of the material managed in the unit. See 40 CFR 261.1081

  • Foot-candle: means a one lumen of light density per square foot. See 49 CFR 228.307
  • Foreign cooperative: means an autonomous association of persons, identified as members, who are united through a jointly owned enterprise to aggregate food from member growers or processors that is intended for export to the United States. See 43 CFR 9180.1
  • Foreign facility: means a facility other than a domestic facility that manufactures/processes, packs, or holds food for consumption in the United States. See 21 CFR 1.227
  • forging: means the hot-working of heated steel shapes (e. See 40 CFR 420.131
  • Formula: means the formula used by the Department to allocate among States the commodities and funding available under this part. See 26 CFR 1.36B-2
  • Foster child: means a child who is formally placed by a court or an agency that administers a State plan under parts B or E of title IV of the Social Security Act (42 U. See 26 CFR 48.4101-1
  • FRA: means the Federal Railroad Administration. See 49 CFR 218.93

  • FRA Associate Administrator: means the FRA Associate Administrator for Railroad Safety/Chief Safety Officer. See 49 CFR 234.401
  • Free meal: means a meal for which neither the child nor any member of his family pays or is required to work in the school or in the school's food service. See 26 CFR 48.4101-1
  • Free milk: means milk served under the regulations governing the Special Milk Program and for which neither the child nor any member of his family pays or is required to work in the school or in the school's food service. See 26 CFR 48.4101-1
  • Fsw: means feet of seawater (or equivalent static pressure head). See 46 CFR 197.204
  • Full address: means the facility's street name and number. See 21 CFR 1.276
  • Full automatic operation: means that mode of an automatic train control system capable of operating without external human influence, in which the locomotive engineer/operator may act as a passive system monitor, in addition to an active system controller. See 49 CFR 236.903
  • Full-time equivalent employee: means all individuals employed by the person claiming the exemption. See 21 CFR 1.328
  • Fumigant: means any pesticide product that is a vapor or gas or forms a vapor or gas on application and whose method of pesticidal action is through the gaseous state. See 40 CFR 156.203
  • GARVS: means the BLM's Gas Analysis Reporting and Verification System. See 43 CFR 3175.10
  • Gas: means any fluid, either combustible or noncombustible, hydrocarbon or non-hydrocarbon, that has neither independent shape nor volume, but tends to expand indefinitely and exists in a gaseous state under metered temperature and pressure conditions. See 43 CFR 3170.3
  • Gas embolism: means a condition caused by expanding gases, which have been taken into and retained in the lungs while breathing under pressure, being forced into the bloodstream or other tissues during ascent or decompression. See 46 CFR 197.204
  • Gas well: means a well for which the energy equivalent of the gas produced, including its entrained liquefiable hydrocarbons, exceeds the energy equivalent of the oil produced, as determined at the time of well completion. See 43 CFR 3179.3
  • General: As used in this subpart, the term "overpayment" includes:

    (1) Payment where no amount is payable under this part. See 20 CFR 725.540

  • General infestation: (1) The detection of gypsy moth egg masses through visual inspection by an inspector during a 10-minute walk through the area. See 26 CFR 601.525

  • Generally infested area: Any part of a regulated area not designated as a suppressive area in accordance with §301. See 24 CFR 203.22

  • Golden nematode: The nematode known as the golden nematode (Globodera rostochiensis), in any stage of development. See 24 CFR 203.22
  • Government: The United States of America acting through the RBS, RHS, and RUS of the U. See 25 CFR 170.512
  • Government: The United States of America, acting through the respective agency, U. See 25 CFR 170.616
  • GPA: means the Gas Processors Association. See 43 CFR 3175.10
  • Grade: means a class or rank of quality. See 7 CFR 51.2
  • Grant agreement: The contract between Rural Development and the applicant which sets forth the terms and conditions under which TSA funds will be made available. See 25 CFR 166.218
  • Grant agreement: The contract between Agency and the grantee which sets forth the terms and conditions under which HPG funds will be made available. See 25 CFR 166.408
  • Grazing district: means the specific area within which the public lands are administered under section 3 of the Act. See 43 CFR 4100.0-5
  • Grazing lease: means a document that authorizes grazing use of the public lands under Section 15 of the Act. See 43 CFR 4100.0-5
  • Grazing permit: means a document that authorizes grazing use of the public lands under Section 3 of the Act. See 43 CFR 4100.0-5
  • Grid security emergency: means the same as the definition of such term in paragraph (7) of section 215A(a) of the Federal Power Act. See 10 CFR 205.380
  • Ground floor: means a floor of a building with a building entrance on an accessible route. See 24 CFR 100.201
  • Ground water: means water below the land surface in a zone of saturation. See 40 CFR 191.12
  • Grower: means a person who engages in growing and harvesting or collecting crops (including botanicals), raising animals (including fish, which includes seafood), or both. See 21 CFR 1.276
  • Gummosis disease: A dangerous plant disease of sugarcane which is caused by the highly infectious bacterium, Xanthomonas vasculorum (Cobb) Dowson, and which is not widely prevalent or distributed within and throughout the United States. See 24 CFR 203.35
  • Gypsy moth: The live insect known as the gypsy moth, Lymantria dispar (Linnaeus), in any life stage (egg, larva, pupa, adult). See 26 CFR 601.525
  • Hand-operated switch: means any type of switch when operated by manual manipulation. See 49 CFR 218.93
  • Handling: means the operation of loading and unloading a vessel. See 49 CFR 176.2
  • Hard costs: means the costs of the construction and equipment, including construction-related fees such as architect and construction manager fees. See 24 CFR 242.1
  • Hard-piping: means pipe or tubing that is manufactured and properly installed in accordance with relevant standards and good engineering practices. See 40 CFR 265.1081

  • Hardware: means automatic equipment that accepts and stores data, performs calculations and other processing steps, and produces information. See 45 CFR 95.605

  • Hazardous material: means a substance or material that the Secretary of Transportation has determined is capable of posing an unreasonable risk to health, safety, and property when transported in commerce, and has designated as hazardous under section 5103 of Federal hazardous materials transportation law (49 U.   • Head Start child: means a child enrolled as a participant in a Head Start program authorized under the Head Start Act (42 U. See 26 CFR 48.4101-1
  • Hearing: means an informal conference or a proceeding for oral presentation. See 49 CFR 190.3
  • Hearing: means a trial-type proceeding that involves the submission of evidence, either by oral presentation or written submission, and briefs and oral arguments on the evidence and applicable law. See 24 CFR 180.100
  • Hearing Officer: means a NHTSA employee who has been delegated the authority to assess civil penalties. See 49 CFR 599.500
  • Heating value: means the gross heat energy released by the complete combustion of one standard cubic foot of gas at 14. See 43 CFR 3175.10
  • Heating value variability: means the deviation of previous heating values over a given time period from the average heating value over that same time period, calculated at a 95 percent confidence level. See 43 CFR 3175.10
  • Heavy-weight diving outfit: means diver-worn surface-supplied deep-sea dress. See 46 CFR 197.204
  • HECM: means a Home Equity Conversion Mortgage. See 24 CFR 206.3
  • HECM counselor: means an independent third party who is currently active on FHA's HECM Counselor Roster and who is not, either directly or indirectly, associated with or compensated by, a party involved in originating, servicing, or funding the HECM, or the sale of annuities, investments, long-term care insurance, or any other type of financial or insurance product who provides statutorily required counseling to prospective borrowers who may be eligible for or interested in obtaining an FHA-insured HECM. See 24 CFR 206.3
  • HHS awarding agency: means any organization component of HHS that is authorized to make and administer awards. See 45 CFR 75.2
  • Highway-rail or pathway grade crossing: means either a highway-rail grade crossing or a pathway grade crossing. See 49 CFR 234.301
  • HMR: means the regulations at 49 CFR parts 171 through 180. See 49 CFR 105.5
  • Hold: means a compartment below deck that is used exclusively for the carriage of cargo. See 49 CFR 176.2
  • holder: is a person who, upon the effective date of this regulation or in the future, maintains indicia of ownership (as defined in §280. See 40 CFR 280.200
  • Holder: means the person in whose name a special permit or approval has been issued. See 49 CFR 107.1
  • Holding: means storage of food and also includes activities performed incidental to storage of a food (e. See 21 CFR 1.227

  • Homeowner: For the purposes of the HPG program, a homeowner is one who can meet the conditions of income and ownership under §1944. See 25 CFR 166.408
  • Hospital: means a facility that has been proposed for approval or has been approved by HUD under the provisions of this subpart, and:

    (1) That provides community services for inpatient medical care of the sick or injured (including obstetrical care). See 24 CFR 242.1

  • Hospital: means a facility licensed as a hospital under the law of any state or a facility operated as a hospital by the United States, a state, or a subdivision of a state. See 45 CFR 75.2
  • Household: For the purposes of the HPG program, a household is defined as all persons living all or part of the next 12 months in a unit or dwelling assisted with HPG funds. See 25 CFR 166.408
  • Household: means "family" as defined in this section. See 26 CFR 48.4101-1
  • Household application: means an application for free and reduced price meal or milk benefits, submitted by a household for a child or children who attend school(s) in the same local educational agency. See 26 CFR 48.4101-1
  • Housing preservation: The repair and rehabilitation activities that contribute to the health, safety, and well-being of the occupant, and contribute to the structural integrity or long-term preservation of the unit. See 25 CFR 166.408
  • HPG: Housing Preservation Grant. See 25 CFR 166.408
  • HUD: means the Department of Housing and Urban Development or its contractor, as appropriate. See 24 CFR 291.5
  • HUD:

    Applicant and Application have the meanings provided in 24 CFR 1. See 24 CFR 180.100

  • Human factors: refers to a body of knowledge about human limitations, human abilities, and other human characteristics, such as behavior and motivation, that must be considered in product design. See 49 CFR 236.903
  • Humane treatment: means handling compatible with animal husbandry practices accepted in the veterinary community, without causing unnecessary stress or suffering to a wild horse or burro. See 43 CFR 4700.0-5
  • HVAC: means heating, ventilation, and air conditioning. See 49 CFR 228.307
  • Hydrocarbon dew point: means the temperature at which hydrocarbon liquids begin to form within a gas mixture. See 43 CFR 3175.10
  • Hyperbaric conditions: means pressure conditions in excess of surface atmospheric pressure. See 46 CFR 197.204
  • Ileostomy: An external operative opening from the ileum. See 46 CFR 197.344
  • Imminent hazard: means the existence of a condition relating to a gas or hazardous liquid pipeline facility that presents a substantial likelihood that death, serious illness, severe personal injury, or a substantial endangerment to health, property, or the environment may occur before the reasonably foreseeable completion date of a formal administrative proceeding begun to lessen the risk of such death, illness, injury or endangerment. See 49 CFR 190.3
  • Implementation APD: means a recorded plan of action to request Federal Financial Participation (FFP) in the costs of designing, developing, and implementing the system. See 45 CFR 95.605
  • Import: To bring within the territorial limits of the United States whether that arrival is accomplished by land, air, or water. See 37 CFR 2.171
  • In containers or the like: means any clean, substantial, weatherproof box structure which can be secured to the vessel's structure, including a portable magazine or a closed cargo transport unit. See 49 CFR 176.2
  • In general: (1) Services performed by an employee for the person employing him which constitute "agricultural labor" as defined in section 3306(k) are excepted from employment by reason of section 3306(c)(1). See 26 CFR 31.3306(k)-1
  • In general: This subpart governs discovery in aid of administrative proceedings under this part. See 24 CFR 180.500

  • Incompetent: means an individual who is incapable of handling his or her business affairs because of a legal, mental or medical disability, except that a minor is not an incompetent solely because of age. See 31 CFR 353.2
  • Incontinence: An inability to retain urine or feces. See 46 CFR 197.344
  • Independent regulatory agency: means the Board of Governors of the Federal Reserve System, the Commodity Futures Trading Commission, the Consumer Product Safety Commission, the Federal Communications Commission, the Federal Deposit Insurance Corporation, the Federal Energy Regulatory Commission, the Federal Housing Finance Board, the Federal Maritime Commission, the Federal Trade Commission, the Interstate Commerce Commission, the Mine Enforcement Safety and Health Review Commission, the National Labor Relations Board, the Nuclear Regulatory Commission, the Occupational Safety and Health Review Commission, the Postal Rate Commission, the Securities and Exchange Commission, and any other similar agency designated by statute as a Federal independent regulatory agency or commission. See 30 CFR 550.136
  • Independent trustee: means a trustee who meets the requirements of §2634. See 20 CFR 10.508
  • Indian lands: means any lands or interests in lands of an Indian tribe or an Indian allottee held in trust by the United States or which is subject to Federal restriction against alienation, including mineral resources and mineral estates reserved to an Indian tribe or Indian allottee in the conveyance of a surface or nonmineral estate, except that such term does not include any lands subject to the provisions of section 3 of the Act of June 28, 1906 (34 Stat. See 43 CFR 3190.0-5
  • Indian reservation: All land located within the limits of any Indian reservation under the jurisdiction of the United States notwithstanding the issuance of any patent, and including rights-of-way running through the reservation. See 25 CFR 170.616
  • Indian tribe: means any Indian tribe, band, nation, or other organized group or community, including any Alaska Native village or regional or village corporation as defined in or established pursuant to the Alaska Native Claims Settlement Act (43 U. See 45 CFR 75.2
  • Indicia of ownership: means evidence of a secured interest, evidence of an interest in a security interest, or evidence of an interest in real or personal property securing a loan or other obligation, including any legal or equitable title or deed to real or personal property acquired through or incident to foreclosure. See 40 CFR 280.200
  • Indirect cost rate proposal: means the documentation prepared by a non-Federal entity to substantiate its request for the establishment of an indirect cost rate as described in appendix III through appendix VII, and appendix IX of this part. See 45 CFR 75.2
  • Individual: means a person eligible to have an IRA in Treasury's retirement savings program or in a state Auto-IRA program. See 31 CFR 347.3
  • Individual Employer Record: means a record of each employer's benefit ratio; reserve ratio; 1-year compensation base; 3-year compensation base; unallocated charge; reserve balance; net cumulative contribution balance; and cumulative benefit balance. See 43 CFR 3250.14
  • Industry track: means a switching track, or series of tracks, serving the needs of a commercial industry other than a railroad. See 49 CFR 218.93
  • Ineligible Non-Borrowing Spouse: means a Non-Borrowing Spouse who does not meet all Qualifying Attributes for a Deferral Period. See 24 CFR 206.3
  • Infestation: The presence of witchweed or the existence of circumstances that make it reasonable to believe that witchweed is present. See 24 CFR 200.193
  • Infestation: The presence of the golden nematode or the existence of circumstances that make it reasonable to believe that the golden nematode is present. See 24 CFR 203.22

  • Infrastructure: means all support structures necessary for the production or development of shale oil, including, but not limited to:

    (1) Offices. See 43 CFR 3900.2

  • Ingrown toenail relief drug product: A drug product applied to an ingrown toenail that relieves pain or discomfort either by softening the nail or by hardening the nail bed. See 46 CFR 197.432
  • Inholding: means State-owned or privately owned land that is completely surrounded by Congressionally designated wilderness. See 43 CFR 6301.5
  • Inhumane treatment: means any intentional or negligent action or failure to act that causes stress, injury, or undue suffering to a wild horse or burro and is not compatible with animal husbandry practices accepted in the veterinary community. See 43 CFR 4700.0-5
  • Initial monthly rate: means the monthly annuity rate that a retiree (other than a disability retiree) is entitled to receive at the time of retirement (as defined in §842. See 14 CFR 302.714
  • Injurious corrosion: means an advanced state of corrosion which may impair the structural integrity or safe operation of the equipment. See 46 CFR 197.204
  • Inspection: means the examination of oil and gas lease sites, records or motor vehicle documentation by an authorized representative of the Secretary of the Interior to determine if there is compliance with applicable regulations, Onshore Oil and Gas orders, approvals, Notices to Lessees and Operators, approvals, other written orders, the mineral leasing laws, and the Federal Oil and Gas Royalty Management Act.   • Inspector: Any employee of the Plant Protection and Quarantine Programs, Animal and Plant Health Inspection Service, U. See 24 CFR 200.193
  • Inspector: Any employee of the Plant Protection and Quarantine Programs, Animal and Plant Health Inspection Service, U. See 24 CFR 203.22

  • Integration: means a process by which the lines on a circular chart (differential pressure, static pressure, and flowing temperature) used in conjunction with a mechanical chart recorder are re-traced or interpreted in order to determine the volume that is represented by the area under the lines. See 43 CFR 3175.10
  • Interest credit: The terms "interest credit" and "interest credit assistance" as they relate to Single Family Housing (SFH) loans, are interchangeable with the term "payment assistance. See 25 CFR 170.512
  • Interested party: means the President, the Vice President, an employee, a nominee or candidate as described in §2634. See 20 CFR 10.508
  • Interested person: means a person outside the Department whose interest in the adjudication goes beyond the general interest of the public as a whole and includes applicants, intervenors, competitors of applicants, non-profit and public interest organizations, and other individuals and organizations, including state, local and other public officials, with a proprietary, financial or other special interest in the outcome of the adjudication. See 29 CFR 4211.1
  • Interested public: means an individual, group, or organization that has:

    (1)(i) Submitted a written request to BLM to be provided an opportunity to be involved in the decisionmaking process as to a specific allotment, and

    (ii) Followed up that request by submitting written comment as to management of a specific allotment, or otherwise participating in the decisionmaking process as to a specific allotment, if BLM has provided them an opportunity for comment or other participation. See 43 CFR 4100.0-5

  • Interim agency: is an agency that has been granted interim certification by the Assistant Secretary. See 24 CFR 115.100
  • Interior: means the spaces, parts, components or elements of an individual dwelling unit. See 24 CFR 100.201
  • Internal controls: means a process, implemented by a non-Federal entity, designed to provide reasonable assurance regarding the achievement of objectives in the following categories:

  • Lease: means a Federal lease issued under the mineral leasing laws, which grants the exclusive right to explore for and extract a designated mineral. See 43 CFR 3900.2
  • Lease bond: means the bond or equivalent security given to the Department to assure performance of all obligations associated with all lease terms and conditions. See 43 CFR 3900.2
  • Lender: means a person who engages in a residential real estate-related lending transaction. See 24 CFR 100.141
  • Licensed health care professional: A physician, nurse, emergency medical technician, or other qualified individual, licensed or certified by a State to provide medical treatment. See 26 CFR 31.3121(c)-1
  • Limited permit: A document issued or authorized to be issued by an inspector to allow the interstate movement of noncertifiable regulated articles to a specified destination for limited handling, utilization, or processing, or for treatment. See 24 CFR 200.193

  • Local educational agency: means a public board of education or other public or private nonprofit authority legally constituted within a State for either administrative control or direction of, or to perform a service function for, public or private nonprofit elementary schools or secondary schools in a city, county, township, school district, or other political subdivision of a State, or for a combination of school districts or counties that is recognized in a State as an administrative agency for its public or private nonprofit elementary schools or secondary schools.   • Local government: means any unit of government within a state, including a:

  • Location fee: means the one-time fee that 30 U. See 43 CFR 3830.5
  • Low income: An adjusted annual income that does not exceed the "lower" income limit according to size of household as established by the United States Department of Housing and Urban Development (HUD) for the county or Metropolitan Statistical Area (MSA) where the property is located.   • Magazine: means an enclosure designed to protect certain goods of Class 1 (explosive) materials from damage by other cargo and adverse weather conditions during loading, unloading, and when in transit. See 49 CFR 176.2

  • Maintenance fee: means the initial or annual fee that 30 U. See 43 CFR 3830.5
  • Major program: means a Federal program determined by the auditor to be a major program in accordance with §75. See 45 CFR 75.2
  • Malfunction: means any sudden, infrequent, and not reasonably preventable failure of air pollution control equipment, process equipment, or a process to operate in a normal or usual manner. See 40 CFR 265.1081
  • Malfunction: means any sudden failure of a control device or a hazardous secondary material management unit or failure of a hazardous secondary material management unit to operate in a normal or usual manner, so that organic emissions are increased. See 40 CFR 261.1031

  • Manufacturer: means any person engaged in the manufacturing or assembling of new products, or the importing of new products for resale, or who acts for and is controlled by any such person in connection with the distribution of such products. See 40 CFR 205.2
  • Manufacturer: means the last facility, as that word is defined in §1. See 21 CFR 1.276
  • Manufacturing-use product: means any pesticide product other than a product to be labeled with directions for end use. See 40 CFR 162.151
  • Marker residue: means the residue selected for assay whose concentration is in a known relationship to the concentration of the residue of carcinogenic concern in the last tissue to deplete to its S46 CFR 308.524
  • Market value: The most probable price which property should bring, as of a specific date, in a competitive and open market, assuming the buyer and seller are prudent and knowledgeable, and the price is not affected by undue stimulus such as forced sale or loan interest subsidy.   • Material determination: means performing all applicable procedures in accordance with the requirements of §261. See 40 CFR 261.1081

  • Medical emergency: A situation that requires immediate medical treatment or first aid to treat possible symptoms of pesticide poisoning or exposure. See 26 CFR 31.3121(c)-1
  • Metallic shoe seal: means a continuous seal that is constructed of metal sheets which are held vertically against the wall of the tank by springs, weighted levers, or other mechanisms and is connected to the floating roof by braces or other means. See 40 CFR 265.1081

  • Microburst wind: A violently descending column of air associated with a thunderstorm which causes straight-line wind damage. See 25 CFR 224.89
  • Microorganism: means a bacterium, fungus, alga, virus, or protozoan. See 40 CFR 172.43
  • Migrant child: means a child identified as meeting the definition of migrant in section 1309 of the Elementary and Secondary Education Act of 1965 (20 U. See 26 CFR 48.4101-1
  • Milk: means pasteurized fluid types of unflavored or flavored whole milk, lowfat milk, skim milk, or cultured buttermilk which meet State and local standards for such milk except that, in the meal pattern for infants (0 to 1 year of age) milk means unflavored types of whole fluid milk or an equivalent quantity of reconstituted evaporated milk which meet such standards.   • Mixed-type facility: means an establishment that engages in both activities that are exempt from registration under section 415 of the Federal Food, Drug, and Cosmetic Act and activities that require the establishment to be registered. See 21 CFR 1.227

  • Mobile home: Any vehicle, other than a recreational vehicle, designed to serve, when parked, as a dwelling or place of business. See 26 CFR 601.525

  • Nontransporter: means a person who owns food or who holds, manufactures, processes, packs, imports, receives, or distributes food for purposes other than transportation. See 21 CFR 1.328
  • Nontransporter immediate previous source: means a person that last had food before transferring it to another nontransporter. See 21 CFR 1.328

  • Offshore vehicle: means a vehicle that is capable of being driven on ice. See 30 CFR 550.200

  • OGOR: means Oil and Gas Operations Report (Form ONRR-4054 or any successor report). See 43 CFR 3170.3
  • OHA document: The self-inspection checklist portion of USDA-APHIS Program Aid Number 2065, "Don't Move Gypsy Moth" completed and signed by the owner of an outdoor household article (OHA) affirming that the owner has inspected the OHA for life stages of gypsy moth in accordance with the procedures in the program aid. See 26 CFR 601.525
  • Oil: means a mixture of hydrocarbons that exists in the liquid phase at the temperature and pressure at which it is measured. See 43 CFR 3170.3
  • Oil shale: means a fine-grained sedimentary rock containing:

    (1) Organic matter which was derived chiefly from aquatic organisms or waxy spores or pollen grains, which is only slightly soluble in ordinary petroleum solvents, and of which a large proportion is distillable into synthetic petroleum. See 43 CFR 3900.2

  • Oil well: means a well for which the energy equivalent of the oil produced exceeds the energy equivalent of the gas produced, as determined at the time of well completion. See 43 CFR 3179.3
  • OMB: refers to the Office of Management and Budget. See 30 CFR 550.136
  • ONRR: means the Office of Natural Resources Revenue, U. See 43 CFR 3170.3
  • Open to mineral entry: means that the land is open to the location of mining claims or sites under the General Mining Law. See 43 CFR 3830.5
  • Operating day: means a day that reimbursable meals are offered to eligible students under the National School Lunch Program or School Breakfast Program. See 26 CFR 48.4101-1
  • Operating railroad: means any railroad or urban rapid transit operator that operates one or more trains through a highway-rail or pathway crossing on, or connected to, the general railroad system of transportation. See 49 CFR 234.401
  • Operation: means the automated processing of data used in the administration of State plans for titles I, IV-A, IV-B, IV-D, IV-E, X, XIV, XVI(AABD), XIX, and XXI of the Social Security Act. See 45 CFR 95.605
  • Operator: means any owner or operator. See 49 CFR 190.3
  • OPS: means the Office of Pipeline Safety, which is part of the Pipeline and Hazardous Materials Safety Administration, U. See 49 CFR 190.3
  • Organization: (1) Public or private nonprofit corporations, agencies, institutions, Indian tribes, and other associations. See 25 CFR 166.218
  • Organization: An organization is defined as one of the following:

    (1) A State, commonwealth, trust territory, other political subdivision, or public nonprofit corporation authorized to receive and administer HPG funds. See 25 CFR 166.408

  • our: refers to the agency, the Bureau of the Fiscal Service. See 31 CFR 351.3
  • Outdoor household articles: Articles associated with a household that have been kept outside the home such as awnings, barbecue grills, bicycles, boats, dog houses, firewood, garden tools, hauling trailers, outdoor furniture and toys, recreational vehicles and associated equipment, and tents. See 26 CFR 601.525
  • Overcrowding: Guidance is provided at 7 CFR 3560. See 25 CFR 166.408
  • overpayment: includes :

    (1) Payment where no amount is payable under this part;

    (2) Payment in excess of the amount payable under this part;

  • Oversight agency for audit: means the Federal awarding agency that provides the predominant amount of funding directly to a non-Federal entity not assigned a cognizant agency for audit. See 45 CFR 75.2
  • Owner-occupant purchaser: means a purchaser who intends to use the property as his or her principal residence. See 24 CFR 291.5
  • packaging: means the immediate container or wrapping, including any attached closure(s), in which the pesticide is contained for distribution, sale, consumption, use or storage. See 40 CFR 157.21
  • Packing: means placing food into a container other than packaging the food and also includes re-packing and activities performed incidental to packing or re-packing a food (e. See 21 CFR 1.227

  • Participating agency: means all housing counseling and intermediary organizations participating in HUD's Housing Counseling program, including HUD-approved agencies, and affiliates and branches of HUD-approved intermediaries, HUD-approved multi-state organizations (MSOs), and state housing finance agencies.   • Participating area: That part of a unit area which is considered reasonably proven to be productive of unitized substances in paying quantities or which is necessary for unit operations and to which production is allocated in the manner prescribed in the unit agreement. See 43 CFR 3180.0-5
  • Participating area: means that part of the unit area that BLM deems to be productive from a horizon or deposit, and to which production would be allocated in the manner described in the unit agreement, assuming that all lands are committed to the unit agreement. See 43 CFR 3280.2

  • Plan of development: means the document a unit operator submits to BLM defining how the unit operator will diligently pursue unit exploration and development to meet both initial and subsequent unit development and public interest obligations. See 43 CFR 3280.2
  • Plant Protection and Quarantine: The organizational unit within the Animal and Plant Health Inspection Service, U. See 24 CFR 203.35

  • Point of royalty measurement: means a BLM-approved FMP at which the volume and quality of oil or gas which is subject to royalty is measured. See 43 CFR 3170.3
  • Point of waste origination: means as follows:

    (1) When the facility owner or operator is the generator of the hazardous waste, the point of waste origination means the point where a solid waste produced by a system, process, or waste management unit is determined to be a hazardous waste as defined in 40 CFR part 261. See 40 CFR 265.1081

  • Point of waste treatment: means the point where a hazardous waste to be treated in accordance with §265. See 40 CFR 265.1081
  • Port of arrival: means the water, air, or land port at which the article of food is imported or offered for import into the United States. See 21 CFR 1.276
  • Portable magazine: means a strong, closed, prefabricated, steel or wooden, closed box or container, other than a freight container, designed and used to handle Class 1 (explosive) materials either by hand or mechanical means. See 49 CFR 176.2
  • Potable water: means water that meets the quality standards prescribed in the U. See 49 CFR 228.307
  • Potable water system: means the containers, tanks, and associated plumbing lines and valves that hold, convey, and dispense potable water within a camp car. See 49 CFR 228.307
  • Ppm: means parts per million. See 49 CFR 228.307
  • practical utility: means that actual uses can be demonstrated. See 30 CFR 550.136
  • Predefined change: means any post-implementation modification to the use of a product that is provided for in the PSP (see §236. See 49 CFR 236.903
  • preference: means the total number of animal unit months on public lands apportioned and attached to base property owned or controlled by a permittee, lessee, or an applicant for a permit or lease. See 43 CFR 4100.0-5
  • Premises: means the interior or exterior spaces, parts, components or elements of a building, including individual dwelling units and the public and common use areas of a building. See 24 CFR 100.201
  • Presiding officer: Any individual designated in writing by the Administrator to preside at a proceeding conducted pursuant to §110. See 26 CFR 31.3121(c)-1
  • Presiding Official: means the person who conducts any hearing relating to civil penalty assessments, compliance orders, orders directing amendment, safety orders, or corrective action orders and who has the duties and powers set forth in §190. See 49 CFR 190.3
  • Pressure vessel: means a container capable of withstanding an internal maximum working pressure over 15 psig. See 46 CFR 197.204
  • Previous Condition: refers to the estimated risk inherent in the portion of the existing method of operation that is relevant to the change under analysis (including the elements of any existing signal or train control system relevant to the review of the product). See 49 CFR 236.903
  • Previous Participation: means a Controlling Participant's previous participation in Covered Projects, and, if applicable, other federal, state and local housing programs, in accordance with the definition of Risk. See 24 CFR 200.212
  • Primarily to protect a security interest: means that the holder's indicia of ownership are held primarily for the purpose of securing payment or performance of an obligation. See 40 CFR 280.200
  • Primary device: means the volume-measurement equipment installed in a pipeline that creates a measureable and predictable pressure drop in response to the flow rate of fluid through the pipeline. See 43 CFR 3175.10
  • Primary operating railroad: means the operating railroad that either owns or maintains the track through the highway-rail or pathway crossing, unless the crossing is located within a private company, port, or dock area. See 49 CFR 234.401
  • Principal amount: means the amount of the original investment. See 31 CFR 351.3
  • Principal limit: means the maximum amount calculated, taking into account the age of the youngest borrower or Eligible Non-Borrowing Spouse, the expected average mortgage interest rate, and the maximum claim amount. See 24 CFR 206.3
  • Principal residence: means the dwelling where the borrower and, if applicable, Non-Borrowing Spouse, maintain their permanent place of abode, and typically spend the majority of the calendar year. See 24 CFR 206.3
  • Prior approval: means written approval by an authorized HHS official evidencing prior consent before a recipient undertakes certain activities or incurs specific costs. See 45 CFR 75.2
  • Prior lien: A security instrument (such as a mortgage or deed of trust) or a judgment which was of public record before the Rural Development security instrument(s) as well as real estate taxes or assessments which are or will become a lien against the property which is superior to Rural Development's security instrument(s). See 25 CFR 170.512
  • Private maintenance: means the provision of proper care and humane treatment to excess wild horses and burros by qualified individuals under the terms and conditions specified in a Private Maintenance and Care Agreement. See 43 CFR 4700.0-5
  • Private nonprofit organization: means a secular or religious organization, no part of the net earnings of which may inure to the benefit of any member, founder, contributor, or individual. See 24 CFR 291.5
  • Problem loan: A loan which is not performing according to its original terms and conditions or which is not expected in the future to perform according to those terms and conditions. See 25 CFR 224.89
  • Process heater: means a device that transfers heat liberated by burning fuel to fluids contained in tubes, including all fluids except water that are heated to produce steam. See 40 CFR 261.1031

  • Product: means any safety critical electronic locomotive control system, subsystem, or component, not including safety critical processor based signal and train control systems, whose functions are directly related to safe movement and stopping of the train as well as the associated man-machine interfaces irrespective of the location of the control system, subsystem, or component.   • Product: means a processor-based signal or train control system, subsystem, or component. See 49 CFR 236.903
  • Production: means oil or gas removed from a well bore and any products derived therefrom. See 43 CFR 3170.3
  • Program income: means gross income earned by the non-Federal entity that is directly generated by a supported activity or earned as a result of the Federal award during the period of performance except as provided in §75. See 45 CFR 75.2
  • Program or activity: means all of the operations of any entity described in paragraphs (h)(1) through (4) of this section, any part of which is extended Federal financial assistance:

    (1)(i) A department, agency, special purpose district, or other instrumentality of a State or of a local government. See 45 CFR 1151.3

  • Program property: SFH and MFH inventory property that can be used to effectively carry out the objectives of their respective loan programs with financing through that program. See 25 CFR 170.616
  • Project: means a structure or structures containing four or more family units. See 24 CFR 234.3
  • Project: means a defined set of information technology related tasks, undertaken by the State to improve the efficiency, economy and effectiveness of administration and/or operation of one or more of its human services programs. See 45 CFR 95.605
  • Project: means a program or action for which an application for Federal financial assistance has been made. See 40 CFR 149.101
  • Project costs: means total allowable costs incurred under a Federal award and all required cost sharing and voluntary committed cost sharing, including third-party contributions. See 45 CFR 75.2
  • Project mortgage: means a mortgage which is or has been insured under any of the FHA multifamily housing programs, other than sections 213(a)(1) and 213(a)(2) of the Act (12 U. See 24 CFR 234.3

  • Psoriasis: A condition of the scalp or body characterized by irritation, itching, redness, and extreme excess shedding of dead epidermal cells. See 46 CFR 197.484
  • Public body: A municipality, political subdivision, public authority, district, or similar organization. See 25 CFR 224.89
  • Public interest: means operations within a geothermal unit resulting in:

    (1) Diligent development. See 43 CFR 3280.2

  • Public lands: means lands, i. See 43 CFR 3900.2
  • Public lands: means any land and interest in land outside of Alaska owned by the United States and administered by the Secretary of the Interior through the Bureau of Land Management, except lands held for the benefit of Indians. See 43 CFR 4100.0-5
  • Public lands: means any lands or interests in lands administered by the Secretary of the Interior through the Bureau of Land Management. See 43 CFR 4700.0-5
  • Public lands: means any lands and interests in lands owned by the United States and administered by the Secretary of the Interior through BLM without regard to how the United States acquired ownership. See 43 CFR 6301.5
  • public report of warning system malfunction at a highway-rail grade crossing: means a report that contains specific information regarding a warning system malfunction at a highway-rail grade crossing that is supplied to a railroad via the ENS by a member of the public who does not belong to one of the categories of individuals listed in the definition of Credible report of warning system malfunction or credible report of warning system malfunction at a highway-rail grade crossing in §234. See 49 CFR 234.301
  • Purchaser: means any person or entity who legally takes ownership of oil or gas in exchange for financial or other consideration. See 43 CFR 3170.3
  • PVHO: means pressure vessel for human occupancy but does not include pressure vessels for human occupancy that may be subjected to external pressures in excess of 15 psig but can only be subjected to maximum internal pressures of 15 psig or less (i. See 46 CFR 197.204
  • Qualified: means that a person has successfully completed all instruction, training, and examination programs required by the railroad and this subpart and that the person, therefore, has actual knowledge or may reasonably be expected to have knowledge of the subject on which the person is expected to be competent.   • Qualified blind trust: means a trust in which the interested party has a beneficial interest and which:

  • Qualified diversified trust: means a trust in which the interested party has a beneficial interest and which:

    (1) Is certified pursuant to §2634. See 20 CFR 10.508

  • Qualified test facility: means a facility with currently certified measurement systems for mass, length, time, temperature, and pressure traceable to the NIST primary standards or applicable international standards approved by the BLM. See 43 CFR 3175.10
  • Qualified trust: means a trust described in the Ethics in Government Act of 1978 and this part and certified by the Director under this subpart. See 20 CFR 10.508
  • Qualifying court order: means a court order acceptable for processing as defined in §838. See 14 CFR 302.722
  • Radioactive material: means matter composed of or containing radionuclides, with radiological half-lives greater than 20 years, subject to the Atomic Energy Act of 1954, as amended. See 40 CFR 191.12
  • Range improvement: means an authorized physical modification or treatment which is designed to improve production of forage. See 43 CFR 4100.0-5
  • Real property: means land, including land improvements, structures and appurtenances thereto, but excludes moveable machinery and equipment. See 45 CFR 75.2
  • Reasonable assistance: means providing timely and unobstructed access to test products or products and records required by this part and opportunity for copying such records or testing such test products. See 40 CFR 204.2

  • Recipient: means an entity, usually but not limited to non-Federal entities, that receives a Federal award directly from a Federal awarding agency to carry out an activity under a Federal program. See 45 CFR 75.2
  • Recipient: means any state or its political subdivision, any instrumentality of a state or its political subdivision, any public or private agency, institution, organization, or other entity, or any person to which federal financial assistance is extended directly or through another recipient, including any successor, assignee, or transferee of a recipient, but excluding the ultimate beneficiary of the assistance.   • Recipient: has the meaning provided in 24 CFR 1. See 24 CFR 180.100
  • Recipient agency: means disaster organizations, charitable institutions, nonprofit summer camps for children, school food service authorities, schools, service institutions, welfare agencies, nutrition programs for the elderly, nonresidential child care institutions and emergency feeding organizations.   • Reclamation: means the measures undertaken to bring about the necessary reconditioning of lands or waters affected by exploration, mining, in situ operations, onsite processing operations or waste disposal in a manner which will meet the requirements imposed by the BLM under applicable law. See 43 CFR 3900.2
  • Reclamation bond: means the bond or equivalent security given to the BLM to assure performance of all obligations relating to reclamation of disturbed areas under an exploration license or lease. See 43 CFR 3900.2
  • Recognized accreditation body: means an accreditation body that FDA has determined meets the applicable requirements of this subpart and is authorized to accredit third-party certification bodies under this subpart. See 43 CFR 9180.1
  • Record: The legible recording of all required elements under section 110. See 26 CFR 31.3121(c)-1
  • Recording: means the act of filing a notice or certificate of location with the local recording office and BLM, as required by FLPMA. See 43 CFR 3830.5
  • Recordkeeping: The recording by the certified applicator, or the agent of the certified applicator, of the information required by §110. See 26 CFR 31.3121(c)-1
  • Recoverable cost: is a contractual or noncontractual program loan cost expense chargeable to a borrower, property account, or part of the loan subsidy. See 25 CFR 170.512
  • Recoverable cost: is a contractual or noncontractual program loan expense chargeable to a borrower, property account, or part of the loan subsidy. See 25 CFR 170.616
  • Redemption value: means principal plus accrued interest of a Series EE savings bond, as of the date of potential or actual redemption. See 31 CFR 351.3
  • Reduced price meal: means a meal which meets all of the following criteria: (1) The price shall be less than the full price of the meal. See 26 CFR 48.4101-1
  • Redundancy verification: means a process of verifying the accuracy of an EGM system by comparing the readings of two sets of transducers placed on the same primary device. See 43 CFR 3175.10
  • Refinancing: means the discharging of the existing capital debt of a hospital through entering into new debt. See 24 CFR 242.1
  • Refinancing loan: A loan, all of the proceeds of which are applied to extinguish the entire balance of an outstanding debt. See 25 CFR 224.89
  • Refund: means (1) a credit or check issued to a distributor in an amount equal to the NCP contract value of donated foods contained in an end product sold by the distributor to a recipient agency at a discounted price or (2) a check issued to a recipient agency in an amount equal to the NCP contract value of donated foods contained in an end product sold to the recipient agency under a refund system. See 26 CFR 1.40-1
  • Regional Director: means the head of any one of the Regional Offices of the Office of Pipeline Safety, or a designee appointed by the Regional Director. See 49 CFR 190.3
  • Regional entity: means an entity having enforcement authority under section 215(e)(4) of the Federal Power Act, 16 U. See 10 CFR 205.380
  • Registration: means that the names of all persons named on the bond and the taxpayer identification number (TIN) of the owner, first-named coowner, or purchaser of a gift bond are maintained on our records. See 31 CFR 351.3

  • Regulatory method: means the aggregate of all experimental procedures for measuring and confirming the presence of the marker residue of the sponsored compound in the target tissue of the target animal. See 46 CFR 308.524
  • Reissue: means the cancellation and retirement of a bond and the issuance of a new bond or bonds of the same series, same issue date, and same total face amount. See 31 CFR 353.2
  • Rejection of a batch: means the number of noncomplying vehicles in the batch sample is greater than or equal to the rejection number as determined by the appropriate sampling plan. See 40 CFR 205.51
  • Rejection of a Batch sequence: means that the number of rejected batches in a sequence is equal to or greater than the rejection number as determined by the appropriate sampling plan. See 40 CFR 205.51
  • Remote control operator: means a locomotive engineer, as defined in §240. See 49 CFR 218.93
  • Remote control zone: means one or more tracks within defined limits designated in the timetable special instructions, or other railroad publication, within which remote control locomotives, under certain circumstances specified in this part, may be operated without an employee assigned to protect the pull-out end of the remote control movement, i.   • Rental properties: Rental properties are defined as single-unit or multi-unit dwellings used for occupancy by tenants, owners, or members of an owner's immediate family. See 25 CFR 166.408
  • Repaired: means that equipment is adjusted, or otherwise altered, to eliminate a leak. See 40 CFR 261.1031
  • Repaired: means that equipment is adjusted, or otherwise altered, to eliminate a leak. See 40 CFR 264.1031
  • Replacement housing: The replacement of existing, individual owner occupied housing where repair and rehabilitation assistance is not economically feasible or practical. See 25 CFR 166.408

  • Repossessed property: Security or EO property in Rural Development's custody, but still owned by the borrower. See 25 CFR 213.22
  • Requirements Analysis: means determining and documenting the information needs and the functional and technical requirements the proposed computerized system must meet. See 45 CFR 95.605
  • Residential real estate-related lending transaction: means the making of a loan:

    (1) For purchasing, constructing, improving, repairing, or maintaining a dwelling. See 24 CFR 100.141

  • Residential use: means use of a pesticide or device:

    (1) Directly on humans or pets. See 40 CFR 157.21

  • Residue: means any compound present in edible tissues of the target animal which results from the use of the sponsored compound, including the sponsored compound, its metabolites, and any other substances formed in or on food because of the sponsored compound's use. See 46 CFR 308.524
  • Residue of carcinogenic concern: means all compounds in the total residue of a demonstrated carcinogen excluding any compounds judged by FDA not to present a carcinogenic risk. See 46 CFR 308.524
  • Respondent: means a person upon whom the PHMSA has served a notice of probable violation. See 49 CFR 107.1
  • Respondent: The party proceeded against pursuant to §110. See 26 CFR 31.3121(c)-1
  • Respondent: means a person upon whom OPS has served an enforcement action described in this part. See 49 CFR 190.3
  • Respondent: means the person accused of violating one of the statutes covered by this part, including a recipient. See 24 CFR 180.100
  • Responsible person: means a person empowered by the master of the vessel to make all decisions relating to his or her specific task, and having the necessary knowledge and experience for that purpose. See 49 CFR 176.2

  • Restricted common areas and facilities: means those areas and facilities restricted to a particular family unit or number of family units. See 24 CFR 234.3
  • Restricted destination permit: A document issued or authorized to be issued by an inspector to allow the interstate movement of regulated articles not certifiable under all applicable Federal domestic plant quarantines to a specified destination for other than scientific purposes.   • Revision control: means a chain of custody regimen designed to positively identify safety-critical components and spare equipment availability, including repair/replacement tracking. See 49 CFR 229.305

  • RHS: RHS means the Rural Housing Service, or a successor agency. See 25 CFR 166.408
  • Ringworm: A skin infection caused by certain dermatophytic fungi. See 46 CFR 169.541
  • Risk: means the expected probability of occurrence for an individual accident event (probability) multiplied by the severity of the expected consequences associated with the accident (severity). See 49 CFR 236.903
  • Risk: In order to determine whether a Controlling Participant's participation in a project would constitute an unacceptable risk, the Commissioner must determine whether the Controlling Participant could be expected to participate in the Covered Project in a manner consistent with furthering the Department's purposes. See 24 CFR 200.212
  • Risk assessment: means the process of determining, either quantitatively or qualitatively, the measure of risk associated with use of the product under all intended operating conditions or the previous condition. See 49 CFR 236.903
  • Roadway maintenance activity: means any work limited to the duties prescribed for a roadway worker by definition in this section, including movement of on-track maintenance-of-way equipment other than locomotives. See 49 CFR 218.93
  • Roadway worker: means any employee of a railroad, or of a contractor to a railroad, whose duties include inspection, construction, maintenance or repair of railroad track, bridges, roadway, signal and communication systems, electric traction systems, roadway facilities or roadway maintenance machinery on or near track or with the potential of fouling a track, and flagmen and watchmen/lookouts as defined in §214.   • Roadway worker in charge: means a roadway worker who is qualified in accordance with §214. See 49 CFR 218.93
  • Roth IRA: means an individual retirement account defined under 26 U. See 31 CFR 347.3
  • Runaway child: means a child identified as a runaway receiving assistance under a program under the Runaway and Homeless Youth Act (42 U. See 26 CFR 48.4101-1
  • Rural area: The definition in 7 CFR part 3550 applies. See 25 CFR 166.408
  • Rural Development: A mission area within the U. See 25 CFR 170.440
  • Safe working load: means the maximum gross weight that cargo handling equipment is approved to lift. See 49 CFR 176.2
  • Safety Analysis: refers to a formal set of documentation which describes in detail all of the safety aspects of the product, including but not limited to procedures for its development, installation, implementation, operation, maintenance, repair, inspection, testing, and modification, as well as analyses supporting its safety claims. See 49 CFR 229.305
  • Safety device: means a closure device such as a pressure relief valve, frangible disc, fusible plug, or any other type of device which functions exclusively to prevent physical damage or permanent deformation to a unit or its air emission control equipment by venting gases or vapors directly to the atmosphere during unsafe conditions resulting from an unplanned, accidental, or emergency event. See 40 CFR 265.1081
  • Safety device: means a closure device such as a pressure relief valve, frangible disc, fusible plug, or any other type of device which functions exclusively to prevent physical damage or permanent deformation to a unit or its air emission control equipment by venting gases or vapors directly to the atmosphere during unsafe conditions resulting from an unplanned, accidental, or emergency event. See 40 CFR 261.1081
  • Salary offset: means a type of administrative offset to collect a debt under Section 5514 of Title 5 of the United States Code and 5 CFR part 550, subpart K by deduction(s) at one or more officially established pay intervals from the current pay account of an employee with or without his or her consent. See 29 CFR 4903.1
  • Sample: means any number of sample units to be used for inspection. See 7 CFR 51.2
  • Saturation diving: means saturating a diver's tissues with the inert gas in the breathing mixture to allow an extension of bottom time without additional decompression. See 46 CFR 197.204
  • Schedule status: For direct and insured loans, a borrower will be on schedule when the sum of regular payments through the last preceding due date of the note equals the sum of installments on the note and other charges due through the same date. See 25 CFR 170.110
  • Scope: The parties are encouraged to engage in voluntary discovery procedures. See 24 CFR 180.500
  • SCUBA diving: means a diving mode in which the diver is supplied with a compressed breathing mixture from diver carried equipment. See 46 CFR 197.204
  • Seborrheic dermatitis: A condition of the scalp or body characterized by irritation, itching, redness, and excess shedding of dead epidermal cells. See 46 CFR 197.484
  • Secondary device: means the differential-pressure, static-pressure, and temperature transducers in an EGM system, or a mechanical recorder, including the differential pressure, static pressure, and temperature elements, and the clock, pens, pen linkages, and circular chart. See 43 CFR 3175.10
  • Secretary: means the Secretary of the Interior. See 43 CFR 3900.2
  • Secretary: means the Secretary of Housing and Urban Development or his or her authorized representatives. See 24 CFR 242.1
  • Secretary: means the Secretary of the Interior or his authorized officer. See 43 CFR 4100.0-5
  • Secretary: means the Secretary of Energy. See 10 CFR 205.380
  • Secretary: means the Secretary of the Treasury. See 31 CFR 347.3

  • Self-assessment: means an evaluation conducted by a recognized accreditation body or by an accredited third-party certification body of its competency and capacity under the applicable requirements of this subpart for the defined scope of recognition or accreditation. See 43 CFR 9180.1
  • Self-test: means any program, practice or study a lender voluntarily conducts or authorizes which is designed and used specifically to determine the extent or effectiveness of compliance with the Fair Housing Act. See 24 CFR 100.141
  • Sensor: means a device that measures a physical quantity or the change in a physical quantity, such as temperature, pressure, flow rate, pH, or liquid level. See 40 CFR 261.1031
  • Sensor: means a device that measures a physical quantity or the change in a physical quantity, such as temperature, pressure, flow rate, pH, or liquid level. See 40 CFR 264.1031
  • Separated employee: means a former employee or Member who has been separated from the service but who has not met all the requirements for retirement under FERS or who has not filed an application for retirement under FERS. See 14 CFR 302.24
  • Serial number: means the identification number assigned by the manufacturer to a specific production unit. See 40 CFR 205.151
  • Series EE savings bond: is an accrual-type savings bond, offered at a discount, either in definitive (paper) form or in book-entry form, that pays interest on the principal based on rates determined by Treasury. See 31 CFR 351.3
  • Service agreement: means the document signed by the State or local agency and the State or local Central Data Processing facility whenever the latter provides data processing services to the former and:

    (a) Identifies those ADP services the Central Data Processing facility will provide. See 45 CFR 95.605

  • Service area: means the area that can be properly grazed by livestock watering at a certain water. See 43 CFR 4100.0-5
  • Service charge: means an administrative fee that BLM assesses under this part to cover the cost of processing documents. See 43 CFR 3830.5
  • Servicing official: For loans to individuals as defined in paragraph (d) of this section, the servicing official is the County Supervisor. See 25 CFR 170.512

  • Shale oil: means synthetic petroleum derived from the destructive distillation of oil shale. See 43 CFR 3900.2
  • Shipper: means the owner or exporter of the article of food who consigns and ships the article from a foreign country or the person who sends an article of food by international mail or express consignment operators or carriers or other private delivery service to the United States. See 21 CFR 1.276
  • Siding: means an auxiliary track, adjacent and connected to a main track, used for meeting or passing trains. See 49 CFR 218.93
  • Signaled siding: means a siding within traffic control system (TCS) territory or within interlocking limits where a signal indication authorizes the siding's use. See 49 CFR 218.93
  • Significant hazard to public health: means any level of contaminant which causes or may cause the aquifer to exceed any maximum contaminant level set forth in any promulgated National Primary Drinking Water Standard at any point where the water may be used for drinking purposes or which may otherwise adversely affect the health of persons, or which may require a public water system to install additional treatment to prevent such adverse effect. See 40 CFR 149.101
  • Similar composition: means a pesticide product which contains only the same active ingredient(s), or combinations of active ingredients, and which is in the same toxicity category, as defined in §156. See 40 CFR 162.151
  • Similar product: means a pesticide product which, when compared to a federally registered product, has a similar composition and a similar use pattern. See 40 CFR 162.151
  • Similar use pattern: means a use of a pesticide product which, when compared to a federally registered use of a product with a similar composition, does not require a change in precautionary labeling under part 156 of this chapter, and which is substantially the same as the federally registered use. See 40 CFR 162.151
  • Simplified acquisition threshold: means the dollar amount below which a non-Federal entity may purchase property or services using small purchase methods. See 45 CFR 75.2
  • Single genome: means the sum total of chromosomal and extrachromosomal genetic material of an isolate and any descendants derived under axenic culture conditions from that isolate. See 40 CFR 172.43
  • sintering: means a process for agglomerating iron-bearing materials into small pellets (sinter) that can be charged to a blast furnace. See 40 CFR 420.21
  • Site: means a parcel of land bounded by a property line or a designated portion of a public right or way. See 24 CFR 100.201
  • Site: means either an unpatented mill site authorized under 30 U. See 43 CFR 3830.5
  • Skilled person: means a person having the knowledge and experience to perform a certain duty. See 49 CFR 176.2
  • SLGS rate: means the current Treasury borrowing rate, less one basis point, as released daily by Treasury in a SLGS rate table. See 31 CFR 344.1
  • SLGS rate table: means a compilation of SLGS rates available for a given day. See 31 CFR 344.1
  • Small miner: means a claimant who, along with all related parties, holds no more than 10 mining claims or sites on Federal lands on the date annual maintenance fees are due, and meets the additional requirements of part 3835 of this chapter. See 43 CFR 3830.5
  • Small-scale test: means the experimental use of a microbial pesticide in a facility such as a laboratory or greenhouse, or use in limited replicated field trials or other tests as described in §172. See 40 CFR 172.43
  • SNAP: means the Supplemental Nutrition Assistance Program established under the Food and Nutrition Act of 2008 (7 U. See 26 CFR 48.4101-1
  • Software: means a set of computer programs, procedures, and associated documentation used to operate the hardware. See 45 CFR 95.605
  • Software maintenance: means routine support activities that normally include corrective, adaptive, and perfective changes, without introducing additional functional capabilities. See 45 CFR 95.605
  • Soil: That part of the upper layer of earth in which plants can grow. See 24 CFR 200.193

  • Special Assistance Certification and Reimbursement Alternatives: means the three optional alternatives for free and reduced price meal application and claiming procedures in the National School Lunch Program and School Breakfast Program which are available to those School Food Authorities with schools in which at least 80 percent of the enrolled children are eligible for free or reduced price meals, or schools which are currently, or who will be serving all children free meals. See 26 CFR 48.4101-1
  • Special local need: means an existing or imminent pest problem within a State for which the State lead agency, based upon satisfactory supporting information, has determined that an appropriate federally registered pesticide product is not sufficiently available. See 40 CFR 162.151
  • Special permit: means a document issued by the Associate Administrator, the Associate Administrator's designee, or as otherwise prescribed in the HMR, under the authority of 49 U. See 49 CFR 105.5

  • Standard deviation: means a measure of the variation in a distribution, and is equal to the square root of the arithmetic mean of the squares of the deviations of each value in the distribution from the arithmetic mean of the distribution. See 43 CFR 3175.10
  • Standby diver: means a diver at the dive location available to assist a diver in the water. See 46 CFR 197.204
  • Startup: means the setting in operation of a hazardous secondary material management unit or control device for any purpose. See 40 CFR 261.1031

  • State Auto-IRA program: means a state Auto-IRA retirement savings program. See 31 CFR 347.3
  • State Director: means an employee of the Bureau of Land Management designated as the chief administrative officer of one of the BLM's 12 administrative areas administered by a state office. See 43 CFR 3900.2
  • State Director: means the State Director, Bureau of Land Management, or his or her authorized representative. See 43 CFR 4100.0-5
  • State lead agency: The agency designated by a State to have access to the records required to be maintained under this part. See 26 CFR 31.3121(c)-1
  • Statement packaging: includes receiving statement information from members or eligible institutions or their service bureaus on respective customer cycle dates. See 30 CFR 550.227
  • Steam stripping operation: means a distillation operation in which vaporization of the volatile constituents of a liquid mixture takes place by the introduction of steam directly into the charge. See 40 CFR 261.1031

  • Stock configuration: means that no modifications have been made to the orginal equipment motorcycle that would affect the noise emissions of the vehicle when measured according to the acceleration test procedure. See 40 CFR 205.165
  • Storage services: includes filing, storage, and truncation of items. See 30 CFR 550.227
  • Streamflow source zone: means the upstream headwaters area which drains into the recharge zone as defined in the December 16, 1975, Notice of Determination. See 40 CFR 149.101
  • Subaward: means an award provided by a pass-through entity to a subrecipient for the subrecipient to carry out part of a Federal award received by the pass-through entity. See 45 CFR 75.2
  • Subordinated owner debt: Debt owed by the borrower to one or more of the owner(s) that is subordinated to debt owed by the borrower to the Agency or guaranteed by the Agency (aggregate B&I loan exposure) pursuant to a subordination agreement satisfactory to the Agency. See 25 CFR 224.89
  • Subpart A: Subpart A of this part describes the purpose and scope of the provisions in this part and defined terms used in this part. See 29 CFR 4219.1
  • Subpart C: Subpart C establishes the interest rate to be charged on overdue, defaulted and overpaid withdrawal liability under section 4219(c)(6) of ERISA, and authorizes multiemployer plans to adopt alternative rules concerning assessment of interest and related matters. See 29 CFR 4219.1
  • Subrecipient: means a non-Federal entity that receives a subaward from a pass-through entity to carry out part of a Federal program. See 45 CFR 75.2
  • Substantial business relationship: means the extent of a business relationship necessary under applicable state law to make a guarantee contract issued incident to that relationship valid and enforceable. See 40 CFR 280.92
  • Substantial governmental relationship: means the extent of a governmental relationship necessary under applicable state law to make an added guarantee contract issued incident to that relationship valid and enforceable. See 40 CFR 280.92
  • Substantial rehabilitation: means additions, expansion, remodeling, renovation, modernization, repair, and alteration of existing buildings, including acquisition of new or replacement equipment, in cases where the hard costs of construction and equipment are equal to or greater than 20 percent of the mortgage amount. See 24 CFR 242.1
  • Substitute bond: means a bond or book-entry bond issued as a result of a claim or application for relief under subpart F of this part. See 31 CFR 353.2
  • Substitution: means (1) the replacement of donated food with like quantities of domestically produced commercial food of the same generic identity and of equal or better quality (i. See 26 CFR 1.40-1
  • Subsystem: means a defined portion of a system. See 49 CFR 229.305
  • Subsystem: means a defined portion of a system. See 49 CFR 236.903
  • Sugarcane disease: This means leaf scald disease with respect to activities in Hawaii, and means gummosis disease or leaf scald disease with respect to activities in Puerto Rico. See 24 CFR 203.35
  • Suitable property: For FSA inventory property, real property that can be used for agricultural purposes, including those farm properties that may be used as a start up or add-on parcel of farmland. See 25 CFR 170.616
  • Supervisory assistance: Any type of assistance to low-income families which will assist those families in meeting the eligibility requirements for, or the financial and managerial responsibilities of, homeownership or tenancy in an adequate housing unit. See 25 CFR 166.218
  • Supplemental feed: means a feed which supplements the forage available from the public lands and is provided to improve livestock nutrition or rangeland management. See 43 CFR 4100.0-5
  • Supplies: means all tangible personal property other than those described in Equipment. See 45 CFR 75.2
  • support: includes food, shelter, clothing, ordinary medical expenses, and other ordinary and customary items for the maintenance of the person supported. See 20 CFR 725.233
  • Suppressive area: That portion of a regulated area where eradication of infestation is undertaken as an objective, as designated under §301. See 24 CFR 203.22
  • Surface management agency: means the Federal agency with jurisdiction over the surface of federally-owned lands containing oil shale deposits. See 43 CFR 3900.2
  • Surface Resources Act: means the Act of July 23, 1955 (30 U. See 43 CFR 3830.5
  • Surface-supplied air diving: means a diving mode in which the diver is supplied from the dive location or bell with compressed breathing air including oxygen or oxygen enriched air if supplied for treatment. See 46 CFR 197.204
  • Surplus property: For FSA inventory property, real property that cannot be used for agricultural purposes including nonfarm properties. See 25 CFR 170.616
  • Surrender: means the actual receipt of a bond with an appropriate request for payment or reissue by either a Federal Reserve Bank or Branch, the Bureau of the Fiscal Service, or, if a paying agent is authorized to handle the transaction, the actual receipt of the bond and the request for payment by the paying agent. See 31 CFR 353.2
  • Survivor: means a person entitled to benefits under part 843 or 846 of this chapter based on the death of an employee, separated employee, retiree, or survivor. See 14 CFR 302.24
  • Survivor: means a person receiving a current spouse annuity or a former spouse annuity, or the beneficiary of an insurable interest annuity. See 14 CFR 302.714
  • Suspension: means the withholding from active use, through a decision issued by the authorized officer or by agreement, of part or all of the grazing preference specified in a grazing permit or lease. See 43 CFR 4100.0-5
  • Suspension of award activities: means an action by the HHS awarding agency requiring the recipient to cease all activities on the award pending corrective action by the recipient. See 45 CFR 75.2
  • Switching or humping operations: includes the classification of placarded railroad cars according to commodity or destination, assembling of placarded cars for train movements, changing the position of placarded cars for purposes of loading, unloading, or weighing, and the placing of placarded cars for repair. See 49 CFR 228.101
  • Switchtender: means a qualified employee assigned to handle switches at a specific location. See 49 CFR 218.93
  • System: refers to any electronic locomotive control system and includes all subsystems and components thereof, as the context requires. See 49 CFR 229.305
  • System: refers to a signal or train control system and includes all subsystems and components thereof, as the context requires. See 49 CFR 236.903
  • system design: means a combination of narrative and diagrams describing the structure of a new or more efficient automatic data processing system. See 45 CFR 95.605
  • System Safety Precedence: means the order of precedence in which methods used to eliminate or control identified hazards within a system are implemented. See 49 CFR 236.903
  • Tampering: means those acts prohibited by section 10(a)(2) of the Act. See 40 CFR 205.51
  • Tampering: means the removal or rendering inoperative by any person, other than for purposes of maintenance, repair, or replacement, of any device or element of design incorporated into any product in compliance with regulations under section 6, prior to its sale or delivery to the ultimate purchaser or while it is in use. See 40 CFR 205.151
  • TANF: means the State funded program under part A of title IV of the Social Security Act that the Secretary determines complies with standards established by the Secretary that ensure that the standards under the State program are comparable to or more restrictive than those in effect on June 1, 1995. See 26 CFR 48.4101-1
  • Tangible balance sheet equity: Total equity less the value of intangible assets recorded on the financial statements, as determined from balance sheets prepared in accordance with generally accepted accounting principles (GAAP), plus qualified intellectual property. See 25 CFR 224.89
  • Tangible net worth: means the tangible assets that remain after deducting liabilities. See 40 CFR 280.92
  • Target tissue: means the edible tissue selected to monitor for residues in the target animals, including, where appropriate, milk or eggs. See 46 CFR 308.524
  • Tax refund offset: means the reduction by the IRS of a tax overpayment payable to a taxpayer by the amount of past-due, legally enforceable debt owed by that taxpayer to a Federal agency pursuant to Treasury regulations. See 29 CFR 4903.1
  • Taxpayer identifying number: means a social security account number or an employer identification number. See 31 CFR 353.2
  • Technical assistance: Any specific expertise necessary to carry out housing efforts by or for low-income families to improve the quantity and/or quality of housing available to meet their needs. See 25 CFR 166.218
  • Temporary crossing: means a highway-rail or pathway crossing created to serve a specific activity for a temporary time period not to exceed six months. See 49 CFR 234.401
  • Temporary nonuse: means that portion of active use that the authorized officer authorizes not to be used, in response to an application made by the permittee or lessee. See 43 CFR 4100.0-5
  • tenant: as used in this subpart shall include a member of a cooperative, and the term rental payment shall include the carrying charges under the occupancy agreement between the members of the cooperative and the cooperative housing owner. See 24 CFR 236.720
  • Tenant: means the occupant(s) named in the lease or rental agreement of a housing unit in a project as of the date the condominium conversion documents are properly filed for the project, or as of the date on which the occupants are notified by management of intent to convert the project to a condominium, whichever is earlier. See 24 CFR 234.3
  • Tenant: Any person who resides in a single- or multi-unit rental property. See 25 CFR 166.408
  • Termination: means the ending of a Federal award, in whole or in part at any time prior to the planned end of period of performance. See 45 CFR 75.2
  • Test animals: means the species selected for use in the toxicity tests. See 46 CFR 308.524
  • Test exhaust system: means an exhaust system in Selective Enforcement Audit test sample. See 40 CFR 205.165
  • Test facility: means a track that is not part of the general railroad system of transportation and is being used exclusively for the purpose of testing equipment and has all of its public grade crossings protected. See 49 CFR 229.305
  • Test product: means any product that is required to be tested pursuant to this part. See 40 CFR 204.2
  • Test product: means any product that is required to be tested pursuant to this part. See 40 CFR 205.2
  • Test sample: means the collection of vehicles from the same category, configuration or subgroup thereof which is drawn from the batch sample and which will receive noise emissions tests. See 40 CFR 205.51
  • Test sample size: means the number of vehicles of the same category or configuration in a test sample. See 40 CFR 205.51
  • Test vehicle: means a vehicle selected and used to demonstrate compliance with the applicable noise emission standards. See 40 CFR 205.51
  • Test vehicle: means a vehicle in a Selective Enforcement Audit test sample. See 40 CFR 205.151
  • testing: means any use of a microbial pesticide consistent with section 5 of the Act, including limited replicated field trials and associated activities. See 40 CFR 172.43
  • Testing: refers to the use of an individual or individuals ("testers") who, without a bona fide intent to rent or purchase a house, apartment, or other dwelling, pose as prospective renters or purchasers for the purpose of gathering information that may indicate whether a housing provider is complying with fair housing laws. See 24 CFR 115.100
  • Testing exemption: means an exemption from the prohibitions of section 10(a) (1), (2), (3), and (5) of the Act, which may be granted under section 10(b)(1) of the Act for the purpose of research, investigations, studies, demonstrations, or training, but not including national security where lease or sale of the exempted product is involved. See 40 CFR 204.2
  • Testing exemption: means an exemption from the prohibitions of section 10(a) (1), (2), (3), and (5) of the Act, which may be granted under section 10(b)(1) of the Act for the purpose of research, investigations, studies, demonstrations, or training, but not including national security. See 40 CFR 205.2
  • Third party: means any person or entity except a director, officer, employee or agent of either:

    (1) A Bank in possession of any particular confidential regulatory information. See 30 CFR 550.243

  • Third-party in-kind contributions: means the value of non-cash contributions (i. See 45 CFR 75.2
  • Third-party telephone service: means a service that receives telephonic reports of unsafe conditions at highway-rail and pathway grade crossings on behalf of a railroad. See 49 CFR 234.301
  • Threshold assessment: means FDA's review of data and information about a sponsored compound to determine whether chronic bioassays in test animals are necessary to resolve questions concerning the carcinogenicity of the compound. See 46 CFR 308.524
  • Timekeeping device: means a device for measuring the time of a dive in minutes. See 46 CFR 197.204
  • Toilet: means a chemical toilet, a recirculating toilet, a combustion toilet, or a toilet that is flushed with water. See 49 CFR 228.307
  • Toilet room: means a room containing a toilet. See 49 CFR 228.307
  • Toxic material: means a material in concentration or amount of such toxicity as to constitute a recognized hazard that is causing or is likely to cause death or serious physical harm. See 49 CFR 228.307
  • Trade name: means the name or names under which the facility conducts business, or additional names by which the facility is known. See 21 CFR 1.227
  • Transducer: means an electronic device that converts a physical property such as pressure, temperature, or electrical resistance into an electrical output signal that varies proportionally with the magnitude of the physical property. See 43 CFR 3175.10
  • Transportation: means the movement of property and loading, unloading, or storage incidental to the movement. See 49 CFR 105.5

  • Transportation of items: includes transporting items from Federal Reserve offices, other Banks' clearinghouse associations, depository institutions, and other direct sending entities to a Bank. See 30 CFR 550.227

  • Transporter: means a person who has possession, custody, or control of an article of food in the United States for the sole purpose of transporting the food, whether by road, rail, water, or air. See 21 CFR 1.328
  • Treasury: means the United States Department of the Treasury. See 31 CFR 347.3
  • Treatment Manual: The provisions currently contained in the "Manual of Administratively Authorized Procedures to be Used Under the Witchweed Quarantine" and the "Fumigation Procedures Manual" and any amendments thereto. See 24 CFR 200.193
  • Treatment manual: The provisions currently contained in the Gypsy Moth Program Manual. See 26 CFR 601.525
  • Tribe: has the meaning provided for the term "Indian tribe" in section 102 of the Housing and Community Development Act of 1974 (42 U. See 24 CFR 291.5
  • Triggering Event: means an occurrence in connection with a Covered Project that subjects a Controlling Participant to Previous Participation review under this subpart, as further described in §200. See 24 CFR 200.212
  • Turndown: means a reduction of the measurement range of a transducer in order to improve measurement accuracy at the lower end of its scale. See 43 CFR 3175.10
  • Typhoon Omar: A typhoon that caused damage in Guam on August 28, 1992. See 25 CFR 224.89
  • Ultimate recipient: The entity receiving financial assistance from the intermediary. See 25 CFR 170.452
  • Umbilical: means the hose bundle between a dive location and a diver or bell, or between a diver and a bell, that supplies the diver or bell with a life-line, breathing gas, communications, power, and heat as appropriate to the diving mode or conditions. See 46 CFR 197.204
  • Unauthorized assistance: Any loan, interest subsidy, grant, or portion thereof received by a recipient for which there was no regulatory authorization or for which the recipient was not eligible. See 25 CFR 170.440
  • Uncertainty: means the range of error that could occur between a measured value and the true value being measured, calculated at a 95 percent confidence level. See 43 CFR 3175.10
  • Under the direction of: Monitoring treatments to assure compliance with the requirements in this subpart. See 26 CFR 601.525
  • underpayment: includes a payment in an amount less than the amount of the benefit due for such month, and nonpayment where some amount of such benefits is payable. See 20 CFR 725.545
  • Undisturbed performance: means the predicted behavior of a disposal system, including consideration of the uncertainties in predicted behavior, if the disposal system is not disrupted by human intrusion or the occurrence of unlikely natural events. See 40 CFR 191.12
  • Unit: means the land within a unit area as defined in 43 CFR 3180. See 43 CFR 3170.3
  • Unit agreement: means an agreement for the exploration, development, production, and utilization of separately owned interests in the geothermal resources made subject thereto as a single consolidated unit without regard to separate ownerships, which provides for the allocation of costs and benefits on a basis defined in the agreement or plan. See 43 CFR 3280.2
  • Unit area: The area described in an agreement as constituting the land logically subject to exploration and/or development under such agreement. See 43 CFR 3180.0-5
  • Unit area: means the area described in a unit agreement as constituting the land logically subject to development under such agreement. See 43 CFR 3280.2
  • Unit contraction provision: means a term of a unit agreement providing that the boundaries of the unit area will contract to the size of the participating area, by having those lands outside of the participating area removed. See 43 CFR 3280.2
  • Unit operator: means the person, association, partnership, corporation, or other business entity designated under a unit agreement to conduct operations on unitized land as specified in such agreement. See 43 CFR 3280.2
  • Unit PA: means the unit participating area, if one is in effect, the exploratory unit if there is no associated participating area, or an enhanced recovery unit. See 43 CFR 3170.3
  • Unit well: means a well that is:

    (1) Designed to produce or utilize geothermal resources in commercial quantities. See 43 CFR 3280.2

  • United States: means the Customs territory of the United States (i. See 21 CFR 1.276
  • Unitized land: Those lands and formations within a unit area which are committed to an approved agreement or plan. See 43 CFR 3180.0-5
  • Unitized substances: Deposits of oil and gas contained in the unitized land which are recoverable in paying quantities by operation under and pursuant to an agreement. See 43 CFR 3180.0-5
  • Unitized substances: means deposits of geothermal resources recovered from unitized land by operation under and pursuant to a unit agreement. See 43 CFR 3280.2
  • Upper calibrated limit: means the maximum engineering value for which a transducer was calibrated by certified equipment, either in the factory or in the field. See 43 CFR 3175.10
  • Utilization: means the portion of forage that has been consumed by livestock, wild horses and burros, wildlife and insects during a specified period. See 43 CFR 4100.0-5
  • Valid occupancy: means an occupancy under a current permit, lease, or other written authorization from BLM to occupy public lands. See 43 CFR 6301.5
  • Validation: means the process of determining whether a product's design requirements fulfill its intended design objectives during its development and life-cycle. See 49 CFR 236.903
  • Vapor incinerator: means any enclosed combustion device that is used for destroying organic compounds and does not extract energy in the form of steam or process heat. See 40 CFR 261.1031
  • Vapor incinerator: means any enclosed combustion device that is used for destroying organic compounds and does not extract energy in the form of steam or process heat. See 40 CFR 264.1031
  • Vapor-mounted seal: means a continuous seal that is mounted such that there is a vapor space between the hazardous waste in the unit and the bottom of the seal. See 40 CFR 265.1081
  • Vapor-mounted seal: means a continuous seal that is mounted such that there is a vapor space between the hazardous secondary material in the unit and the bottom of the seal. See 40 CFR 261.1081
  • Variance: means an approved alternative to a provision or standard of a regulation, Onshore Oil and Gas Order, or NTL. See 43 CFR 3170.3
  • Vehicle: means any motor vehicle, machine or tractor, which is propelled by mechanical power and capable of transportation of property on a street or highway and which has a gross vehicle weight rating in excess of 10,000 pounds and a partially or fully enclosed operator's compartment. See 40 CFR 205.51
  • Vehicle: means any motorcycle regulated pursuant to this subpart. See 40 CFR 205.151
  • Vented: means discharged through an opening, typically an open-ended pipe or stack, allowing the passage of a stream of liquids, gases, or fumes into the atmosphere. See 40 CFR 261.1031

  • Verification: means the process of determining the amount of error in a differential pressure, static pressure, or temperature transducer or element by comparing the readings of the transducer or element with the readings from a certified test device with known accuracy. See 43 CFR 3175.10
  • Verification: means the process of determining whether the results of a given phase of the development cycle fulfill the validated requirements established at the start of that phase. See 49 CFR 236.903
  • Verification: means confirmation of eligibility for free or reduced price benefits under the National School Lunch Program or School Breakfast Program. See 26 CFR 48.4101-1
  • Very low-income: An adjusted annual income that does not exceed the very low-income limit according to size of household as established by HUD for the county of MSA where the property is located. See 25 CFR 166.408
  • Vessel: means any waterborne craft including mobile offshore drilling units required to have a Certificate of Inspection issued by the Coast Guard or any waterborne craft connected with a deepwater port or within the deepwater port safety zone, or any waterborne craft engaged in activities related to the Outer Continental Shelf. See 46 CFR 197.204
  • Violation: means failure to comply with the Outer Continental Shelf Lands Act (OCSLA) or any other applicable laws, with any regulations issued under the OCSLA, or with the terms or provisions of leases, licenses, permits, rights-of-way, or other approvals issued under the OCSLA. See 30 CFR 550.1402
  • Violation: means any non-conformance with the CARS Act or the regulations in this part except §599. See 49 CFR 599.500
  • Violator: means a person responsible for a violation. See 30 CFR 550.1402
  • VO concentration: means the fraction by weight of the volatile organic compounds contained in a hazardous waste expressed in terms of parts per million (ppmw) as determined by direct measurement or by knowledge of the waste in accordance with the requirements of §265. See 40 CFR 265.1081
  • VO concentration: means the fraction by weight of the volatile organic compounds contained in a hazardous secondary material expressed in terms of parts per million (ppmw) as determined by direct measurement or by knowledge of the material in accordance with the requirements of §261. See 40 CFR 261.1081
  • Volume tank: means a pressure vessel connected to the outlet of a compressor and used as an air reservoir. See 46 CFR 197.204
  • Voluntary committed cost sharing: means cost sharing specifically pledged on a voluntary basis in the proposal's budget or the Federal award on the part of the non-Federal entity and that becomes a binding requirement of Federal award. See 45 CFR 75.2
  • Voluntary guardian: means an individual who is recognized as authorized to act for an incompetent, as provided by §353. See 31 CFR 353.2
  • Voluntary representative: means the person qualified by the Department of the Treasury to request payment or distribution of a decedent's savings bonds pursuant to §353. See 31 CFR 353.2
  • Waiver: means an annuitant's written request to forfeit a specified amount of annuity as described in this subpart. See 14 CFR 302.722
  • Waiver of Preemption: means a decision by the Associate Administrator to forego preemption of a non-Federal requirement--that is, to allow a State, political subdivision or Indian tribe requirement to remain in effect. See 49 CFR 105.5
  • Warning system failure at a pathway grade crossing: means failure of an active pathway grade crossing warning system to perform as intended. See 49 CFR 234.301
  • Warranty: means the warranty required by section 6(d)(1) of the Act. See 40 CFR 205.151
  • Wart remover drug product: A topical agent used for the removal of common or plantar warts. See 46 CFR 197.404
  • Waste determination: means performing all applicable procedures in accordance with the requirements of §265. See 40 CFR 265.1081
  • Waste stabilization process: means any physical or chemical process used to either reduce the mobility of hazardous constituents in a hazardous waste or eliminate free liquids as determined by Test Method 9095B (Paint Filter Liquids Test) in "Test Methods for Evaluating Solid Waste, Physical/Chemical Methods" EPA Publication SW-846, as incorporated by reference in §260. See 40 CFR 265.1081
  • Watering: means the act of filling potable water systems. See 49 CFR 228.307
  • wet air pollution control system: means an emission control system that utilizes water to clean process or furnace off-gases. See 40 CFR 420.21
  • Wheelchair: means a device that is designed solely for use by a mobility-impaired person for locomotion, and that is suitable for use in an indoor pedestrian area. See 43 CFR 6301.5
  • Wild horses and burros: means all unbranded and unclaimed horses and burros that use public lands as all or part of their habitat, that have been removed from these lands by the authorized officer, or that have been born of wild horses or burros in authorized BLM facilities, but have not lost their status under section 3 of the Act. See 43 CFR 4700.0-5
  • Witchweed: Parasitic plants of the genus Striga and reproductive parts thereof, including seeds. See 24 CFR 200.193
  • Working capital: The excess of current assets over current liabilities. See 25 CFR 170.452
  • Working capital: The excess of current assets over current liabilities. See 25 CFR 224.89
  • Working capital advance: means a procedure whereby funds are advanced to the recipient to cover its estimated disbursement needs for a given initial period. See 45 CFR 75.2
