Terms Used In CFR > Title 7 > Chapter XV

  • Access: means the physical ability of property owners and their successors in interest to have ingress to and egress from State or private inholdings, valid mining claims, or other valid occupancies. See 43 CFR 6301.5
  • Accounting firm: means a corporation, proprietorship, partnership, or other business firm providing audit services. See 32 CFR 21.215
  • Act: means the Act of December 15, 1971, as amended (16 U. See 43 CFR 4700.0-5
  • Act: means Title VIII of the National Energy Conservation Policy Act. See 30 CFR 56.19120
  • Act: means the Energy Conservation in Existing Buildings Act of 1976, as amended, 42 U. See 41 CFR 101-26.507-4
  • Act: means Chapter 537 of Title 46 of the U. See 50 CFR 253.10
  • Act: means the Interjurisdictional Fisheries Act of 1986, Public Law 99-659 (Title III). See 50 CFR 253.50
  • Actual cost: means the sum of all amounts for a project paid by an obligor (or related person), as well as all amounts that the Program determines the obligor will become obligated to pay, as such amounts are calculated by §253. See 50 CFR 253.10
  • Air carrier: means a citizen of the United States who undertakes directly to engage in or provide air transportation. See 49 CFR 1510.3
  • Air transportation: means continental interstate air transportation, continental intrastate air transportation, foreign air transportation, non-continental interstate air transportation, or non-continental intrastate air transportation. See 49 CFR 1510.3
  • Aircraft: means a device that is used or intended to be used for flight in the air. See 49 CFR 1510.3
  • Airport: means any landing area used regularly by aircraft for receiving or discharging passengers or cargo. See 49 CFR 1510.3
  • Amendment: means any data and information that you submit regarding a filed GRAS notice before we respond to your notice by letter in accordance with §570. See 47 CFR 1.749
  • Annual energy audit: means a procedure including, but not limited to, verification of the achievement of energy cost savings and energy unit savings guaranteed resulting from implementation of energy conservation measures and determination of whether an adjustment to the energy baseline is justified by conditions beyond the contractor's control. See 30 CFR 56.19120
  • Applicant: Any individual or business with financial interest in QSVP services who has applied for service under this part. See 7 CFR 97.150
  • Applicant: means the individual or entity applying for a loan (the prospective obligor). See 50 CFR 253.10
  • Application: means the documents provided to or requested by NMFS from an applicant to apply for a loan. See 50 CFR 253.10
  • Application fee: means 0. See 50 CFR 253.10
  • Assessment: A systematic review of the adequacy of program or system documentation, or the review of the completeness of implementation of a documented program or system. See 7 CFR 97.150
  • Assistant Secretary: means the Assistant Secretary for Conservation and Renewable Energy or official to whom the Assistant Secretary's functions may be redelegated by the Secretary. See 41 CFR 101-26.507-4
  • Audit services: means any service required to be performed by an independent public accountant by section 36 of the FDIA and 12 CFR part 363, including attestation services. See 32 CFR 21.215
  • Authorized officer: means any employee of the Bureau of Land Management to whom has been delegated the authority to perform the duties described herein. See 43 CFR 4700.0-5
  • Authorized officer: means any employee of the Bureau of Land Management designated to perform the duties described in this subpart:

    (b) Fossil means the remains or trace(s) of an organism or assemblage of organisms which have been preserved by natural processes in the earth's crust. See 43 CFR 8224.0-5

  • Banking organization: means an insured state member bank, bank holding company, or savings and loan holding company that obtains audit services that are used to satisfy requirements imposed by section 36 or part 363 on an insured subsidiary bank or insured savings association of that holding company. See 32 CFR 21.215
  • Base Allocation: means the fixed amount of funds for each State as set forth in §440. See 41 CFR 101-26.507-4
  • Base temperature: means the temperature used to compute heating and cooling degree days. See 41 CFR 101-26.507-4
  • Base Year: means the fiscal year in which a life cycle cost analysis is conducted. See 30 CFR 56.19094
  • Beginning of amortization: means the date one month prior to the date of the first monthly payment to principal and interest. See 24 CFR 203.251
  • Biomass: means biologically generated energy sources such as heat derived from combustion of plant matter, or from combustion of gases or liquids derived from plant matter, animal wastes, or sewage, or from combustion of gases derived from landfills, or hydrogen derived from these same sources. See 41 CFR 101-26.607
  • Board decisional employee: means a Board Member, law judge or other employee who is, or who may reasonably be expected to be, involved in the decisional process of the proceeding. See 49 CFR 821.60
  • Btu: means British thermal unit. See 30 CFR 57.3202
  • Building: means any closed structure primarily intended for human occupancy in which energy is consumed, produced, or distributed. See 30 CFR 56.19120
  • Building energy system: means an energy conservation measure or any portion of the structure of a building or any mechanical, electrical, or other functional system supporting the building, the nature or selection of which for a new building influences significantly the cost of energy consumed. See 30 CFR 56.19094
  • Building water system: means a water conservation measure or any portion of the structure of a building or any mechanical, electrical, or other functional system supporting the building, the nature or selection of which for a new building influences significantly the cost of water consumed. See 30 CFR 56.19094
  • Bureau: means the Bureau of Land Management. See 43 CFR 8340.0-5
  • CAA: means a Community Action Agency. See 41 CFR 101-26.507-4
  • Captain: means a vessel operator or a vessel master. See 50 CFR 253.10
  • Cellulosic biofuel: means any liquid fuel produced from cellulosic feedstocks. See 41 CFR 101-26.801
  • Certification: means a written debt claim, as prescribed by §179. See 10 CFR 431.20
  • Children: means dependents not exceeding 19 years or a lesser age set forth in the State plan. See 41 CFR 101-26.507-4
  • Citizen: means a "citizen of the United States" as described in 46 U. See 50 CFR 253.10
  • Closed-loop biomass: means any organic material from a plant which is planted exclusively for purposes of being used at a qualified renewable energy facility to generate electricity. See 41 CFR 101-26.607
  • collection procedures: as used in this subpart , includes that series of more intensive efforts, including litigation as described in §674. See 34 CFR 674.45
  • Commercial fishery failure: means a serious disruption of a fishery resource affecting present or future productivity due to natural or undetermined causes. See 50 CFR 253.50
  • Commercial prerinse spray valve: means a handheld device that has a release-to-close valve and is suitable for removing food residue from food service items before cleaning them in commercial dishwashing or ware washing equipment. See 30 CFR 56.9330
  • Compensation: The compensation of employees as defined in the rules in this part is to be stated in such manner and detail as the forms adopted for periodical returns require. See 49 CFR 1245.3
  • consent order: is a formal decree accepting an agreement between a party to an adjudicatory hearing proceeding held to determine whether that party has violated statutes or Commission rules or policies and the appropriate operating Bureau, with regard to such party's future compliance with such statutes, rules or policies, and disposing of all issues on which the proceeding was designated for hearing. See 47 CFR 1.93
  • Contract of Insurance: means the agreement evidenced by the issuance of a Mortgage Insurance Certificate or by the endorsement of the Commissioner upon the credit instrument given in connection with an insured mortgage, incorporating by reference the regulations in this subpart and the applicable provisions of the Act. See 24 CFR 203.251
  • Contractor: means any individual, corporation, association, partnership, consortium or joint venture who has contracted to carry out activities under this part. See 43 CFR 3190.0-5
  • Cooling Degree Days: means a population-weighted annual average of the climatological cooling degree days for each weather station within a State, as determined by DOE. See 41 CFR 101-26.507-4
  • creditor agency: includes OPM, unless otherwise noted. See 10 CFR 431.20
  • Debt: means money owed by an employee of the Federal Government to an agency of the Federal Government, from sources which include loans insured or guaranteed by the United States and all other amounts due the Government from fees, leases, rents, royalties, services, sales of real or personal property, overpayments, penalties, damages, interests, fines and forfeitures (except those arising under the Uniform Code of Military Justice) and all other similar sources. See 10 CFR 431.20
  • Deciding Official: means the Manager of the Golden Field Office of the Department of Energy (or any DOE official to whom the authority of the Manager of the Golden Field Office may be redelegated by the Secretary of Energy). See 41 CFR 101-26.607
  • Delinquent: means the failure to pay an obligation or debt by the date specified in the initial notification or applicable contractual agreement, unless other payment arrangements have been agreed to by OPM and the debtor by that date, or if, at any time thereafter, the debtor fails to satisfy the obligations under a payment agreement with the creditor agency. See 10 CFR 431.20
  • Demand: means a noteholder's request that a debtor or guarantor pay a note's full principal and interest balance. See 50 CFR 253.10
  • Deputy Assistant Secretary: means the Deputy Assistant Secretary for Technical and Financial Assistance or any official to whom the Deputy Assistant Secretary's functions may be redelegated by the Assistant Secretary. See 41 CFR 101-26.507-4
  • Detailed energy survey: means a procedure which may include, but is not limited to, a detailed analysis of energy cost savings and energy unit savings potential, building conditions, energy consuming equipment, and hours of use or occupancy for the purpose of confirming or revising technical and price proposals based on the preliminary energy survey. See 30 CFR 56.19120
  • Detection agent: means any one of the substances specified in this paragraph when introduced into a plastic explosive or formulated in such explosive as a part of the manufacturing process in such a manner as to achieve homogeneous distribution in the finished explosive, including--

    (i) Ethylene glycol dinitrate (EGDN), C27 CFR 555.180

  • Direct air carrier and foreign air carrier: means a selling carrier. See 49 CFR 1510.3
  • Director: means the Director of OPM or his or her designee. See 10 CFR 431.20
  • Director: means the Director of the Office of Government Ethics. See 20 CFR 10.508
  • Disbursement: The entire principal amount of the mortgage must have been disbursed to the mortgagor or to his or her creditors for his or her account and with his or her consent. See 24 CFR 203.17
  • Disposable pay: means that part of current basic pay, special pay, incentive pay, retired pay, retainer pay, or, in the case of an employee not entitled to basic pay, other authorized pay remaining after the deduction of any amount required by law to be withheld. See 10 CFR 431.20
  • disposal agency: as used in this part refers to GSA. See 41 CFR 102-75.5
  • Disqualification: The removal of a lender's eligibility for an indefinite period of time by the Secretary on review of limitation, suspension, or termination action taken against the lender by a guaranty agency. See 34 CFR 682.701

  • Employee: means a current employee of OPM or other agency, including a current member of the Armed Forces or Reserve of the Armed Forces of the United States. See 10 CFR 431.20
  • Employee: means an officer or employee of the executive branch of the United States. See 20 CFR 10.508
  • Energy baseline: means the amount of energy that would be consumed annually without implementation of energy conservation measures based on historical metered data, engineering calculations, submetering of buildings or energy consuming systems, building load simulation models, statistical regression analysis, or some combination of these methods. See 30 CFR 56.19120
  • Energy conservation measures: means measures that are applied to an existing Federal building that improve energy efficiency and are life cycle cost effective and that involve energy conservation, cogeneration facilities, renewable energy sources, improvements in operation and maintenance efficiencies, or retrofit activities. See 30 CFR 56.19094
  • Energy conservation measures: means measures that are applied to an existing Federally owned building or facility that improves energy efficiency, are life-cycle cost-effective under subpart A of this part, and involve energy conservation, cogeneration facilities, renewable energy sources, improvements in operation and maintenance efficiencies, or retrofit activities. See 30 CFR 56.19120
  • Energy cost savings: means a reduction in the cost of energy and related operation and maintenance expenses, from a base cost established through a methodology set forth in an energy savings performance contract, utilized in an existing federally owned building or buildings or other federally owned facilities as a result of--

    (1) The lease or purchase of operating equipment, improvements, altered operation and maintenance, or technical services. See 30 CFR 56.19120

  • Energy efficiency goal: means the ratio of production achieved to energy used. See 30 CFR 57.3202
  • Energy savings performance contract: means a contract which provides for the performance of services for the design, acquisition, installation, testing, operation, and, where appropriate, maintenance and repair of an identified energy conservation measure or series of measures at one or more locations. See 30 CFR 56.19120
  • Energy unit savings: means the determination, in electrical or thermal units (e. See 30 CFR 56.19120
  • Energy use avoidance: means the amount of energy resources, e. See 30 CFR 57.3202
  • Enforcement agreement: means a written agreement, signed and dated, between a state agency and either the Secretary of the Interior or Secretary of Commerce, or both, to enforce Federal and state laws pertaining to the protection of interjurisdictional fishery resources. See 50 CFR 253.50
  • ex parte communication: means an oral or written communication not on the public record with respect to which reasonable prior notice to all parties is not given, subject however, to the provisions of §§2414. See 30 CFR 585.501
  • Ex parte communication: means an oral or written communication not on the public record with respect to which reasonable prior notice to all parties is not given, but does not include requests for status reports on any matter or proceeding covered by this part. See 49 CFR 821.60
  • exceptions: means the document consolidating the exceptions and supporting brief. See 47 CFR 1.276
  • Facility: means any structure not primarily intended for human occupancy, or any contiguous group of structures and related systems, either of which produces, distributes, or consumes energy. See 30 CFR 56.19120
  • Facility: means a fishery or an aquaculture facility. See 50 CFR 253.10
  • Family Unit: means all persons living together in a dwelling unit. See 41 CFR 101-26.507-4

  • Federal building: means an energy or water conservation measure or any building, structure, or facility, or part thereof, including the associated energy and water consuming support systems, which is constructed, renovated, leased, or purchased in whole or in part for use by the Federal government.   • Federal fishery management plan: means a plan developed and approved under the Magnuson Fishery Conservation and Management Act (16 U. See 50 CFR 253.50
  • FHA: means the Federal Housing Administration. See 24 CFR 203.251
  • Finance Office: means the DOE Office of the Chief Financial Officer (or any office to which that Office's authority may be redelegated by the Secretary of Energy). See 41 CFR 101-26.607
  • Fiscal year: means the Federal fiscal year beginning October 1 and ending on September 30 of the following calendar year. See 41 CFR 101-26.607
  • Fish: means finfish, mollusks, crustaceans and all other forms of aquatic animal and plant life, other than marine mammals and birds. See 50 CFR 253.10
  • Fisheries management: means all activities concerned with conservation, restoration, enhancement, or utilization of fisheries resources, including research, data collection and analysis, monitoring, assessment, information dissemination, regulation, and enforcement. See 50 CFR 253.50
  • Fishery facility: means land, land structures, water craft that do not engage in fishing, and equipment used for transporting, unloading, receiving, holding, processing, preserving, or distributing fish for commercial purposes (including any water craft used for charter fishing). See 50 CFR 253.10
  • Fishery resource: means finfish, mollusks, and crustaceans, and any form of marine or Great Lakes animal or plant life, including habitat, other than marine mammals and birds. See 50 CFR 253.50
  • Foreign air carrier: means any person other than a citizen of the United States who undertakes directly to engage in or provide air transportation. See 49 CFR 1510.3
  • Foreign air transportation: means the carriage by aircraft of persons for compensation or hire between a place in the United States and any place outside of the United States. See 49 CFR 1510.3
  • Formula Share: means the percentage of the total formula allocation provided to each State as calculated in §440. See 41 CFR 101-26.507-4
  • Frequent flyer award: means a zero-fare award of air transportation that a domestic air carrier or foreign air carrier provides to a passenger in exchange for accumulated travel mileage credits in a customer loyalty program, whether or not the term frequent flyer is used in the definition of that program. See 49 CFR 1510.3
  • General operations: means world-wide Federal agency operations, other than building operations, and includes services. See 30 CFR 57.3202
  • General transportation: means the use of vehicles for over-the-road driving as opposed to vehicles designed for off-road conditions, and the use of aircraft and vessels. See 30 CFR 57.3202
  • Goal: means a specific statement of an intended energy conservation result which will occur within a prescribed time period. See 30 CFR 57.3202
  • Governor: means the chief executive officer of a State, including the Mayor of the District of Columbia. See 41 CFR 101-26.507-4
  • Grantee: means the State or other entity named in the Notification of Grant Award as the recipient. See 41 CFR 101-26.507-4
  • GRAS: means generally recognized as safe. See 47 CFR 1.749
  • GRAS notice: means a submission that informs us of your view that a substance is not subject to the premarket approval requirements of the Federal Food, Drug, and Cosmetic Act based on your conclusion that the substance is GRAS under the conditions of its intended use in accordance with §570. See 47 CFR 1.749
  • Guarantee: means a guarantor's contractual promise to repay indebtedness if an obligor fails to repay as agreed. See 50 CFR 253.10
  • Guarantee fee: means one percent of a guaranteed note's average annual unpaid principal balance. See 50 CFR 253.10
  • Guaranteed note: means a promissory note from an obligor to a noteholder, the repayment of which the United States guarantees. See 50 CFR 253.10
  • Guidelines: means a set of instructions designed to prescribe, direct and regulate a course of action. See 30 CFR 57.3202
  • Hearing official: means an individual (including an administrative law judge) responsible for conducting any hearing with respect to the existence or amount of a debt claimed, and rendering a decision on the basis of such hearing. See 10 CFR 431.20
  • Heating Degree Days: means a population-weighted seasonal average of the climatological heating degree days for each weather station within a State, as determined by DOE. See 41 CFR 101-26.507-4
  • IFQ: means Individual Fishing Quota, which is a Federal permit under a limited access system to harvest a quantity of fish, expressed by a unit or units representing a percentage of the total allowable catch of a fishery that may be received or held for exclusive use by a person. See 50 CFR 253.10
  • Incidental Repairs: means those repairs necessary for the effective performance or preservation of weatherization materials. See 41 CFR 101-26.507-4
  • Independent trustee: means a trustee who meets the requirements of §2634. See 20 CFR 10.508
  • Indian tribal government: means the governing body of an Indian tribe as defined in section 4 of the Indian Self-Determination and Education Assistance Act (25 U. See 41 CFR 101-26.607
  • Indian Tribe: means any tribe, band, nation, or other organized group or community of Native Americans, including any Alaskan native village, or regional or village corporation as defined in or established pursuant to the Alaska Native Claims Settlement Act, Pub. See 41 CFR 101-26.507-4
  • Industrial or production: means the operation of facilities including buildings and plants which normally use large amounts of capital equipment, e. See 30 CFR 57.3202
  • Inholding: means State-owned or privately owned land that is completely surrounded by Congressionally designated wilderness. See 43 CFR 6301.5
  • Interested party: means the President, the Vice President, an employee, a nominee or candidate as described in §2634. See 20 CFR 10.508
  • Interstate Commission: means a commission or other administrative body established by an interstate compact. See 50 CFR 253.50
  • Interstate Fisheries Research Program: means research conducted by two or more state agencies under a formal interstate agreement. See 50 CFR 253.50
  • Interstate fishery management plan: means a plan for managing a fishery resource developed and adopted by the member states of an Interstate Marine Fisheries Commission, and contains information regarding the status of the fishery resource and fisheries, and recommends actions to be taken by the States to conserve and manage the fishery resource. See 50 CFR 253.50
  • Investment costs: means the initial costs of design, engineering, purchase, construction, and installation exclusive of sunk costs. See 30 CFR 56.19094
  • Landed: means the first point of offloading fishery resources. See 50 CFR 253.50
  • Life cycle cost: means the total cost of owning, operating and maintaining a building over its useful life (including its fuel and water, energy, labor, and replacement components), determined on the basis of a systematic evaluation and comparison of alternative building systems, except that in the case of leased buildings, the life cycle cost shall be calculated over the effective remaining term of the lease. See 30 CFR 56.19094
  • Limitation: The continuation of a lender's or third-party servicer's eligibility subject to compliance with special conditions established by agreement with the Secretary or a guaranty agency, as applicable, or imposed as the result of a limitation or termination proceeding. See 34 CFR 682.701
  • Local Applicant: means a CAA or other public or non profit entity unit of general purpose local government. See 41 CFR 101-26.507-4
  • Low income: means that income in relation to family size which:

    (1) At or below 200 percent of the poverty level determined in accordance with criteria established by the Director of the Office of Management and Budget, except that the Secretary may establish a higher level if the Secretary, after consulting with the Secretary of Agriculture and the Secretary of Health and Human Services, determines that such a higher level is necessary to carry out the purposes of this part and is consistent with the eligibility criteria established for the weatherization program under Section 222(a)(12) of the Economic Opportunity Act of 1964. See 41 CFR 101-26.507-4

  • Maturity: means the date on which the mortgage indebtedness would be extinguished if paid in accordance with periodic payments provided for in the mortgage. See 24 CFR 203.251
  • Maturity: The mortgage shall have a term of not more than 30 years from the date of the beginning of amortization. See 24 CFR 203.17
  • Measures: means actions, procedures, devices or other means for effecting energy efficient changes in general operations which can be applied by Federal agencies. See 30 CFR 57.3202
  • Mechanical transport: means any vehicle, device, or contrivance for moving people or material in or over land, water, snow, or air that has moving parts. See 43 CFR 6301.5
  • Minimum initial unit obligation: means the requirement to complete at least one unit well within the timeframe specified in the unit agreement. See 43 CFR 3280.2
  • Motorized equipment: means any machine that uses or is activated by a motor, engine, or other power source. See 43 CFR 6301.5
  • Native corporation: has the meaning set forth in the Alaska Native Claims Settlement Act (25 U. See 41 CFR 101-26.607
  • Net electric energy: means the metered kilowatt-hours (kWh) generated and sold, and excludes electric energy used within the renewable energy facility to power equipment such as pumps, motors, controls, lighting, heating, cooling, and other systems needed to operate the facility. See 41 CFR 101-26.607
  • NMFS Regional Director: means the Director of any one of the five National Marine Fisheries Service regions. See 50 CFR 253.50
  • Non-fuel operation and maintenance costs: means material and labor cost for routine upkeep, repair and operation exclusive of energy cost. See 30 CFR 56.19094
  • Non-recurring costs: means costs that are not uniformly incurred annually over the study period. See 30 CFR 56.19094
  • Not-for-profit electrical cooperative: means a cooperative association that is legally obligated to operate on a not-for-profit basis and is organized under the laws of any State for the purpose of providing electric service to its members. See 41 CFR 101-26.607
  • Noteholder: means a guaranteed note payee. See 50 CFR 253.10
  • notice of intent: means a written notice from a creditor agency to an employee that states the creditor agency's determination that the employee owes a debt to the creditor agency and apprises the employee of certain administrative rights. See 10 CFR 431.20
  • Notice of salary offset: means a written notice from the paying agency to an employee after a certification has been issued by the creditor agency, informing the employee that salary offset will begin at the next officially established pay interval. See 10 CFR 431.20
  • Notified substance: means the substance that is the subject of your GRAS notice. See 47 CFR 1.749
  • Obligor: means a party primarily liable for payment of the principal of or interest on an obligation, used interchangeably with the terms "note payor" or "notemaker. See 50 CFR 253.10
  • Ocean: means the waters of the Atlantic Ocean (including the Gulf of Mexico) and the Pacific Ocean within the jurisdiction of the United States from which energy may be derived through application of tides, waves, currents, thermal differences, or other means. See 41 CFR 101-26.607
  • Off-road vehicle: means any motorized vehicle capable of, or designed for, travel on or immediately over land, water, or other natural terrain, excluding:

    (1) Any nonamphibious registered motorboat. See 43 CFR 8340.0-5

  • Office: means the central and regional offices of the Office of Personnel Management. See 10 CFR 431.20
  • One-way trip: means continuous air transportation, during which a stopover does not occur. See 49 CFR 1510.3
  • Open window: means the period during each reverse auction, as specified in an associated solicitation, during which DOE accepts bids for production incentives under this part. See 41 CFR 101-26.801
  • Open-end advance: means an insured advance made by an approved mortgagee in connection with a previously insured mortgage, pursuant to an open-end provision in the mortgage. See 24 CFR 203.251
  • Operational training and readiness: means those activities which are necessary to establish or maintain an agency's capability to perform its primary mission. See 30 CFR 57.3202
  • Origination year: means the year in which an application for a loan is accepted for processing. See 50 CFR 253.10
  • Participating area: means that part of the unit area that BLM deems to be productive from a horizon or deposit, and to which production would be allocated in the manner described in the unit agreement, assuming that all lands are committed to the unit agreement. See 43 CFR 3280.2
  • party: refers to any person who participates in a proceeding by the timely filing of a petition for rule making, comments on a notice of proposed rule making, a petition for reconsideration, or responsive pleadings in the manner prescribed by this subpart. See 47 CFR 1.400
  • Paying agency: means the agency of the Federal Government which employs the individual who owes a debt to an agency of the Federal Government. See 10 CFR 431.20
  • Payroll office: means the payroll office in the paying agency which is primarily responsible for the payroll records and the coordination of pay matters with the appropriate personnel office with respect to an employee. See 10 CFR 431.20
  • Persons with Disabilities: means any individual (1) who is a handicapped individual as defined in section 7(6) of the Rehabilitation Act of 1973, (2) who is under a disability as defined in section 1614(a)(3)(A) or 223(d)(1) of the Social Security Act or in section 102(7) of the Developmental Disabilities Services and Facilities Construction Act, or (3) who is receiving benefits under chapter 11 or 15 of title 38, U. See 41 CFR 101-26.507-4
  • Plan: means those actions which an agency envisions it must undertake to assure attainment of energy consumption and efficiency goals without an unacceptably adverse impact on primary missions. See 30 CFR 57.3202
  • Plan of development: means the document a unit operator submits to BLM defining how the unit operator will diligently pursue unit exploration and development to meet both initial and subsequent unit development and public interest obligations. See 43 CFR 3280.2
  • Plastic explosive: means an explosive material in flexible or elastic sheet form formulated with one or more high explosives which in their pure form has a vapor pressure less than 1027 CFR 555.180
  • pleading: means any written notice, motion, petition, request, opposition, reply, brief, proposed findings, exceptions, memorandum of law, or other paper filed with the Commission in a hearing proceeding. See 47 CFR 1.204
  • Preliminary energy survey: means a procedure which may include, but is not limited to, an evaluation of energy cost savings and energy unit savings potential, building conditions, energy consuming equipment, and hours of use or occupancy, for the purpose of developing technical and price proposals prior to selection. See 30 CFR 56.19120
  • Principal: means the aggregate amount of all passenger security services fees due to be remitted to the Transportation Security Administration by an air carrier as required by this part. See 49 CFR 1510.3
  • Private maintenance: means the provision of proper care and humane treatment to excess wild horses and burros by qualified individuals under the terms and conditions specified in a Private Maintenance and Care Agreement. See 43 CFR 4700.0-5
  • Program: means the organized set of activities and allocation of resources directed toward a common purpose, objective, or goal undertaken or proposed by an agency in order to carry out the responsibilities assigned to it. See 30 CFR 57.3202
  • Program: means the Fisheries Finance Program, Financial Services Division, National Marine Fisheries Service, National Oceanic and Atmospheric Administration, U. See 50 CFR 253.10
  • Program Allocation: means the base allocation plus formula allocation for each State. See 41 CFR 101-26.507-4
  • Project: means an undertaking or a proposal for research in support of management of an interjurisdictional fishery resource or an interstate fishery management plan. See 50 CFR 253.50
  • Public interest: means operations within a geothermal unit resulting in:

    (1) Diligent development. See 43 CFR 3280.2

  • Public lands: means any lands or interests in lands administered by the Secretary of the Interior through the Bureau of Land Management. See 43 CFR 4700.0-5
  • Public lands: means any lands and interests in lands owned by the United States and administered by the Secretary of the Interior through BLM without regard to how the United States acquired ownership. See 43 CFR 6301.5
  • Public lands: means any lands the surface of which is administered by the Bureau of Land Management. See 43 CFR 8340.0-5
  • QSVP Procedures: Audit rules and guidelines set forth by the Agricultural Marketing Service regarding the development, documentation, and implementation of QSVP. See 7 CFR 97.150
  • Qualified blind trust: means a trust in which the interested party has a beneficial interest and which:

    (1) Is certified pursuant to §2634. See 20 CFR 10.508

  • Qualified diversified trust: means a trust in which the interested party has a beneficial interest and which:

    (1) Is certified pursuant to §2634. See 20 CFR 10.508

  • Qualified trust: means a trust described in the Ethics in Government Act of 1978 and this part and certified by the Director under this subpart. See 20 CFR 10.508
  • RAM: means the Restricted Access Management division in the Alaska Regional Office of NMFS or the office that undertakes the duties of this division to issue or manage quota shares. See 50 CFR 253.10
  • Reasonably proven to produce: means a sufficient demonstration, based on scientific and technical information, that lands are contributing to unit production in commercial quantities or are providing reservoir pressure support for unit production. See 43 CFR 3280.2
  • Recurring costs: means future costs that are incurred uniformly and annually over the study period. See 30 CFR 56.19094
  • Refinancing: means newer debt that either replaces older debt or reimburses applicants for previous expenditures. See 50 CFR 253.10
  • Refurbishing: means any reconstruction, reconditioning, or other improvement of existing vessels or facilities, but does not include routine repairs or activities characterized as maintenance. See 50 CFR 253.10
  • Regulations: means the regulations in this subpart. See 7 CFR 51.2
  • Renewable energy facility: means a single module or unit, or an aggregation of such units, that generates electric energy which is independently metered and which results from the utilization of a renewable energy source. See 41 CFR 101-26.607
  • Renewable energy source: means solar heat, solar light, wind, ocean, geothermal heat, and biomass, except for--

    (1) Heat from the burning of municipal solid waste. See 41 CFR 101-26.607

  • Renewable energy sources: means sunlight, wind, geothermal, biomass, solid wastes, or other such sources of energy. See 30 CFR 57.3202
  • Renewable energy system: means a system which when installed in connection with a dwelling--

    (1) Transmits or uses solar energy, energy derived from geothermal deposits, energy derived from biomass (or any other form of renewable energy which DOE subsequently specifies through an amendment of this part) for the purpose of heating or cooling such dwelling or providing hot water or electricity for use within such dwelling. See 41 CFR 101-26.507-4

  • Research: means work or investigative study, designed to acquire knowledge of fisheries resources and their habitat. See 50 CFR 253.50
  • Residential Energy Expenditures: means the average annual cost of purchased residential energy, including the cost of renewable energy resources. See 41 CFR 101-26.507-4
  • Retrofit: means installation of a building energy system or building water system alternative in an existing Federal building. See 30 CFR 56.19094
  • return to work: as used in this subpart is not limited to returning to work at the employee's normal worksite or usual position, but may include returning to work at other locations and in other positions. See 20 CFR 10.505
  • Round trip: means a trip on an air travel itinerary that terminates or has a stopover at the origin point (or co-terminal). See 49 CFR 1510.3
  • Salary offset: means an administrative offset to collect a debt under 5 U. See 10 CFR 431.20
  • Salary Offset Coordinator: means an official, designated by the Director of OPM, who is responsible for coordinating debt collection activities for OPM. See 10 CFR 431.20
  • Salvage value: means the value of any building energy system or building water system removed or replaced during the study period, or recovered through resale or remaining at the end of the study period. See 30 CFR 56.19094
  • Secretary: means the Secretary of Commerce or his/her designee. See 50 CFR 253.50
  • Secretary: means the Secretary of the Department of Energy. See 30 CFR 57.3202
  • Secretary: means the Secretary of the Department of Energy. See 41 CFR 101-26.507-4
  • Services: means the provision of administrative assistance or something of benefit to the public. See 30 CFR 57.3202
  • Shelter: means a dwelling unit or units whose principal purpose is to house on a temporary basis individuals who may or may not be related to one another and who are not living in nursing homes, prisons, or similar institutional care facilities. See 41 CFR 101-26.507-4
  • Spray force: means the amount of force exerted onto the spray disc, measured in ounce-force (ozf). See 30 CFR 56.9330
  • State: means each of the several states, the District of Columbia, the Commonwealth of Puerto Rico, American Samoa, the Virgin Islands, Guam, or the Commonwealth of the Northern Mariana Islands. See 50 CFR 253.50
  • State: means each of the States, the District of Columbia, American Samoa, Guam, Commonwealth of the Northern Mariana Islands, Commonwealth of Puerto Rico, and the Virgin Islands. See 41 CFR 101-26.507-4
  • State: means the District of Columbia, Puerto Rico, and any of the States, Commonwealths, territories, and possessions of the United States. See 41 CFR 101-26.607
  • State agency: means any department, agency, commission, or official of a state authorized under the laws of the State to regulate commercial fisheries or enforce laws relating to commercial fisheries. See 50 CFR 253.50
  • Study period: means the time period covered by a life cycle cost analysis. See 30 CFR 56.19094
  • Subgrantee: means an entity managing a weatherization project which receives a grant of funds awarded under this part from a grantee. See 41 CFR 101-26.507-4
  • Sunk costs: means costs incurred prior to the time at which the life cycle cost analysis occurs. See 30 CFR 56.19094
  • Supplement: means any data and information that you submit regarding a filed GRAS notice after we respond to your notice by letter in accordance with §570. See 47 CFR 1.749
  • Support Office Director: means the Director of the DOE Field Support Office with the responsibility for grant administration or any official to whom that function may be redelegated by the Assistant Secretary. See 41 CFR 101-26.507-4
  • Suspension: The removal of a lender's eligibility, or a third-party servicer's eligibility to contract with a lender or guaranty agency, for a specified period of time or until the lender or servicer fulfills certain requirements. See 34 CFR 682.701
  • Termination: (1) The removal of a lender's eligibility for an indefinite period of time--

    (i) By a guaranty agency. See 34 CFR 682.701

  • TOTAL: is an acronym that stands for "Technology Open to Approved Lenders. See 24 CFR 203.251
  • Total Program Allocations: means the annual appropriation less funds reserved for training and technical assistance. See 41 CFR 101-26.507-4
  • Tribal Organization: means the recognized governing body of any Indian tribe or any legally established organization of Native Americans which is controlled, sanctioned, or chartered by such governing body. See 41 CFR 101-26.507-4
  • Under Secretary: means the Under Secretary of the Department of Energy. See 30 CFR 57.3202
  • Unit agreement: means an agreement for the exploration, development, production, and utilization of separately owned interests in the geothermal resources made subject thereto as a single consolidated unit without regard to separate ownerships, which provides for the allocation of costs and benefits on a basis defined in the agreement or plan. See 43 CFR 3280.2
  • Unit area: means the area described in a unit agreement as constituting the land logically subject to development under such agreement. See 43 CFR 3280.2
  • Unit contraction provision: means a term of a unit agreement providing that the boundaries of the unit area will contract to the size of the participating area, by having those lands outside of the participating area removed. See 43 CFR 3280.2
  • Unit of General Purpose Local Government: means any city, county, town, parish, village, or other general purpose political subdivision of a State. See 41 CFR 101-26.507-4
  • Unit operator: means the person, association, partnership, corporation, or other business entity designated under a unit agreement to conduct operations on unitized land as specified in such agreement. See 43 CFR 3280.2
  • Unit well: means a well that is:

    (1) Designed to produce or utilize geothermal resources in commercial quantities. See 43 CFR 3280.2

  • United States: means the States, the District of Columbia, Guam, Puerto Rico, and the Virgin Islands of the United States. See 24 CFR 203.315
  • Unitized land: means the part of a unit area committed to a unit agreement. See 43 CFR 3280.2
  • Unitized substances: means deposits of geothermal resources recovered from unitized land by operation under and pursuant to a unit agreement. See 43 CFR 3280.2
  • USDA: The U. See 7 CFR 97.150
  • Useful life: means the period during which project property will, as determined by the Program, remain economically productive. See 50 CFR 253.10
  • Valid occupancy: means an occupancy under a current permit, lease, or other written authorization from BLM to occupy public lands. See 43 CFR 6301.5
  • Value: means the monetary worth of fishery resources used in developing the apportionment formula, which is equal to the price paid at the first point of landing. See 50 CFR 253.50
  • Variance: means the difference between actual consumption and goal. See 30 CFR 57.3202
  • Vessel: means any vessel documented under U. See 50 CFR 253.10
  • Volume: means the weight of the fishery resource as landed, at the first point of landing. See 50 CFR 253.50
  • Waiver: means the cancellation, remission, forgiveness, or non-recovery of a debt allegedly owed by an employee to OPM or another agency as permitted or required by 5 U. See 10 CFR 431.20
  • Weatherization Project: means a project conducted in a single geographical area which undertakes to weatherize dwelling units that are energy inefficient. See 41 CFR 101-26.507-4
  • Wheelchair: means a device that is designed solely for use by a mobility-impaired person for locomotion, and that is suitable for use in an indoor pedestrian area. See 43 CFR 6301.5
  • Wild horses and burros: means all unbranded and unclaimed horses and burros that use public lands as all or part of their habitat, that have been removed from these lands by the authorized officer, or that have been born of wild horses or burros in authorized BLM facilities, but have not lost their status under section 3 of the Act. See 43 CFR 4700.0-5
  • Working interest: means the interest held in geothermal resources or in lands containing the same by virtue of a lease, operating agreement, fee title, or otherwise, under which, except as otherwise provided in a unit agreement, the owner of such interest is vested with the right to explore for, develop, produce, and utilize such resources. See 43 CFR 3280.2
