Terms Used In California Codes > Government Code > Title 2 > Division 5 > Part 2

  • Access: means a personal inspection and review of a record or an accurate copy of a record, or an oral description or communication of a record or an accurate copy of a record, and a request to release a copy of any record. See California Education Code 76210
  • Access: means the ability to receive, use, select, and manipulate data and operate controls included in voting technology and systems. See California Government Code 19780
  • Accessible: means that the information provided on the paper cast vote record from the voter verified paper audit trail mechanism is provided or conveyed to voters via both a visual and a nonvisual method, such as through an audio component. See California Government Code 18674
  • Acquisition: means the acquisition of a fee interest or any other interest in real property including easements, leases and development rights. See California Government Code 18654.5
  • Administrative officer: means the chief administrative officer, county administrator, county executive, county manager, or other officials employed in the several counties under various titles whose duties and responsibilities are comparable to the officials named herein. See California Government Code 18672.1
  • Adopted budget: means the budget document formally approved by the board of supervisors after the required public hearings and deliberations on the recommended budget. See California Government Code 18672.1
  • adverse action: means dismissal, demotion, suspension, or other disciplinary action. See California Government Code 19570
  • ammunition: includes , but is not limited to, any bullet, cartridge, magazine, clip, speed loader, autoloader, or projectile capable of being fired from a firearm with a deadly consequence. See California Revenue and Taxation Code 30176.1
  • Application for stay and early evaluation conference: means an application to be filed with the court that meets the requirements of subdivision (c) of Section 55. See California Education Code 74012
  • Auditor: means the county auditor or that officer whose responsibilities include those designated in Chapter 4 (commencing with Section 26900) of Division 2. See California Government Code 18672.1
  • BB device: means any instrument that expels a projectile, such as a BB or a pellet, through the force of air pressure, gas pressure, or spring action, or any spot marker gun. See California Revenue and Taxation Code 30180
  • Best interests of the city: means a procurement process that is determined by the city to provide the best value and an expedited delivery schedule while maintaining a high level of quality workmanship and materials. See California Insurance Code 1396
  • Best value: means a value determined by objective criteria that shall include a combination of price, financing costs, features, functions, performance, life-cycle maintenance costs and abatement offsets, and development experience. See California Insurance Code 1396
  • Board: means the State Board of Forestry and Fire Protection. See California Government Code 19062.5
  • Board: means the Wildlife Conservation Board. See California Government Code 18654.5
  • Board: means the State Allocation Board. See California Education Code 17087
  • Board: means the Board of Registered Nursing. See California Education Code 81146
  • Board: means the board of supervisors of the county, or the same body acting as the governing board of a special district whose affairs and finances are under its supervision and control. See California Government Code 18672.1
  • board: as used in this chapter means the Medical Board of California. See California Education Code 66261
  • Board: means the Speech-Language Pathology and Audiology and Hearing Aid Dispensers Board. See California Education Code 72104
  • Board: means the Voting Modernization Board, established pursuant to Section 19256. See California Government Code 18652
  • Bond: means a state general obligation bond issued pursuant to this article adopting the provisions of the State General Obligation Bond Law. See California Government Code 18652
  • Bond act: means this article authorizing the issuance of state general obligation bonds and adopting the State General Obligation Bond Law by reference. See California Government Code 18652
  • Bonds: means any bonds, notes, certificates of indebtedness or other evidences of indebtedness issued after January 1, 1989, by a public body which is authorized to issue bonds, notes, certificates of indebtedness or other evidence of indebtedness. See California Insurance Code 1300
  • Bonds: means bonds, notes, warrants, bond anticipation notes, commercial paper, or other evidences of indebtedness, or lease, installment purchase, or other agreements or certificates of participation therein. See California Insurance Code 1311
  • Budget year: means the fiscal year (July 1 through June 30) for which the budget is being prepared. See California Government Code 18672.1
  • Business entity: means a partnership, corporation, or other legal entity that is able to provide appropriately licensed contracting, architectural, engineering, financial, operations, management, facilities maintenance, and other services for development of a new Long Beach Civic Center. See California Insurance Code 1396
  • business opportunity: shall include the sale or lease of the business and goodwill of an existing business enterprise or opportunity. See California Government Code 53098.1
  • Buyer: means a person who buys or contracts to buy goods. See California Education Code 79227
  • California Water Plan: means the California Water Plan Update Bulletin 160-05 and subsequent revisions and amendments. See California Government Code 18654.5
  • CalWORKs recipient: means a recipient of aid under Chapter 2 (commencing with Section 11200) of Part 3 of Division 9 of the Welfare and Institutions Code or any successor program. See California Education Code 79200
  • CASp: means any person who has been certified pursuant to Section 4459. See California Education Code 74012
  • certificate: as used in this chapter are deemed to be synonomous. See California Education Code 69960
  • City: means the City of Long Beach and its departments, including the City of Long Beach Harbor Department. See California Insurance Code 1396
  • commission: means the Student Aid Commission. See California Education Code 70100
  • Committee: means an intervention evaluation committee created by this article. See California Education Code 81146
  • committee: means the chief administrative officer, auditor, and treasurer, or any other county employee appointed by the board of supervisors. See California Government Code 19815.3
  • Committee: means the Voting Modernization Finance Committee, established pursuant to Section 19253. See California Government Code 18652
  • Conduit financing: means the issuance of conduit revenue bonds. See California Insurance Code 1307
  • Conduit financing provider: means any county, city, city and county, public district, public authority, public corporation, nonprofit corporation, joint powers authority, or other statutorily constituted public entity that issues one or more conduit revenue bonds. See California Insurance Code 1307
  • Construction: includes acquisition by purchase. See California Education Code 17110
  • Construction or alteration: as used in this article , includes any construction, reconstruction, or alteration of, or addition to, any school building. See California Education Code 81130.5
  • Construction-related accessibility claim: means any civil claim in a civil action with respect to a place of public accommodation, including, but not limited to, a claim brought under Section 51, 54, 54. See California Education Code 74012
  • Construction-related accessibility standard: means a provision, standard, or regulation under state or federal law requiring compliance with standards for making new construction and existing facilities accessible to persons with disabilities, including, but not limited to, any provision, standard, or regulation set forth in Section 51, 54, 54. See California Education Code 74012
  • Consumer lease: means a lease that a lessor regularly engaged in the business of leasing or selling makes to a lessee who is an individual and who takes under the lease primarily for a personal, family, or household purpose. See California Education Code 78018
  • Contract for sale: includes both a present sale of goods and a contract to sell goods at a future time. See California Education Code 79420
  • Controller: means the State Controller. See California Government Code 18672.1
  • costs incurred by the county: means all costs, except normal salaries and expenses, incurred by the county in bringing to trial or trials, including the trial or trials of, a person or persons for the offense of homicide, including costs, except normal salaries and expenses, incurred by the district attorney in investigation and prosecution, by the sheriff in investigation, by the public defender or court-appointed attorney or attorneys in investigation and defense, and all other costs, except normal salaries and expenses, incurred by the county in connection with bringing the person or persons to trial including the trial itself, which include extraordinary expenses for such services as witness fees and expenses, court-appointed expert witness fees and expenses, reporter fees, and costs in preparing transcripts.   • Credit disability insurance: means insurance on a debtor to provide indemnity for payments becoming due on a specific loan or other credit transaction while the debtor is disabled, as defined in the policy, exclusive of any insurance procured at no expense to the debtor. See California Insurance Code 1758.992
  • Credit insurance: includes credit life insurance, credit disability insurance, credit involuntary unemployment insurance, credit loss-of-income insurance, credit property insurance, or guaranteed asset protection (GAP) insurance. See California Insurance Code 1758.992
  • Credit insurance agent license: means an agent license issued to an individual or organization for the enrollment and sale of credit insurance. See California Insurance Code 1758.992
  • Credit life insurance: means insurance on the life of a debtor pursuant to or in connection with a specific loan or other credit transaction, exclusive of any insurance procured at no expense to the debtor. See California Insurance Code 1758.992
  • credit loss-of-income insurance: means insurance issued to provide indemnity for payments becoming due on a specific loan or other credit transaction while the debtor is involuntarily unemployed, as defined in the policy. See California Insurance Code 1758.992
  • Credit property insurance: means insurance that provides coverage (1) on personal property pledged or offered as collateral for securing a personal or consumer loan, or (2) on personal property purchased under an installment sales agreement or through a consumer credit transaction, but does not include any insurance that provides theft, collision, liability, property damage, or comprehensive insurance coverage in any automobile or any other self-propelled vehicle that is designed primarily for operation in the air or on the highways, waterways, or sea, and its operating equipment, or that is necessitated by reason of the liability imposed by law for damages arising out of the ownership, operation, maintenance, or use of those vehicles.   • Dealer: means a person who is a grantee of a dealership situated in this state. See California Education Code 74108
  • Dealership: means a contract or agreement, either express or implied, whether oral or written, between two or more persons, by which a person is granted the right to sell or distribute goods or services, or to use a trade name, trademark, service mark, logotype, or advertising or other commercial symbol, in which there is a community of interest in the business of offering, selling, or distributing goods or services at wholesale, or at retail, by lease, agreement, or otherwise. See California Education Code 74108
  • Defect: means any flaw in the hardware or documentation of a voting system that could result in a state of unfitness for use or nonconformance to the manufacturer's specifications or applicable law. See California Government Code 19771.5
  • Delta: means the Sacramento-San Joaquin River Delta. See California Government Code 18654.5
  • Department: means the Department of Parks and Recreation. See California Government Code 19173
  • Department: means the Department of Water Resources. See California Government Code 18654.5
  • Department: means the Department of Parks and Recreation. See California Government Code 19050
  • Development: includes , but is not limited to the physical improvement of real property including the construction of facilities or structures. See California Government Code 18654.5
  • Direct recording electronic voting system: means a voting system that records a vote electronically and does not require or permit the voter to record his or her vote directly onto a tangible ballot. See California Government Code 18674
  • Director: means the Director of Fish and Game. See California Government Code 19062.5
  • Director: means the Director of Parks and Recreation. See California Government Code 19173
  • directors: means natural persons, designated in the articles or bylaws or elected by the incorporators, and their successors and natural persons designated, elected, or appointed by any other name or title to act as members of the governing body of the corporation. See California Government Code 31781.11
  • Directory information: means one or more of the following items: a student's name, address, telephone number, date and place of birth, major field of study, participation in officially recognized activities and sports, weight and height of members of athletic teams, dates of attendance, degrees and awards received, the most recent previous public or private school attended by the student, and any other information authorized in writing by the student. See California Education Code 76210
  • Disadvantaged community: means a community with a median household income less than 80% of the statewide average. See California Government Code 18654.5
  • Division: means the Public Safety Communications Division established by this part. See California Government Code 18525.1
  • Division of Licensing: shall be deemed to refer to the board. See California Education Code 66261
  • Elections official: means the county elections official, registrar of voters, or city clerk. See California Government Code 18535
  • Employee: means any firefighter or law enforcement officer represented by an employee organization, as defined in subdivision (b). See California Education Code 71024
  • Employee organization: means any organization recognized by the employer for the purpose of representing firefighters or law enforcement officers in matters relating to wages, hours, and other terms and conditions of employment within the scope of arbitration. See California Education Code 71024
  • Employer: means any local agency employing employees, as defined in subdivision (a), or any entity, except the State of California, acting as an agent of any local agency, either directly or indirectly. See California Education Code 71024
  • Facility: includes a place for organized team sports, outdoor recreation, permanent play structures, and multipurpose structures designed to meet the special recreational, educational, vocational, and social needs of youth. See California Government Code 19173
  • Failure: means a discrepancy between the external results of the operation of any software or firmware in a voting system and the manufacturer's product requirements for that software or firmware or applicable law. See California Government Code 19771.5
  • Fault: means a step, process, or data definition in any software or firmware in a voting system that is incorrect under the manufacturer's program specification or applicable law. See California Government Code 19771.5
  • Fault: means wrongful act, omission, breach, or default. See California Education Code 78018
  • Final budget: means the adopted budget adjusted by all revisions throughout the fiscal year as of June 30. See California Government Code 18672.1
  • Finance lease: means a lease with respect to which (A) the lessor does not select, manufacture, or supply the goods, (B) the lessor acquires the goods or the right to possession and use of the goods in connection with the lease, and (C) one of the following occurs:

  • Firefighter: means any person who is employed to perform firefighting, fire prevention, fire training, hazardous materials response, emergency medical services, fire or arson investigation, or any related duties, without respect to the rank, job title, or job assignment of that person.   • Fiscal year: means the current 12-month period to which the annual operating budget applies and at the end of which a government determines its financial position and the results of its operations. See California Government Code 18672.1
  • Foreign money: means money other than money of the United States of America. See California Education Code 69652
  • Foreign-money claim: means a claim upon an obligation to pay, or a claim for recovery of a loss, expressed in or measured by a foreign money. See California Education Code 69652
  • Free-flowing: means existing or flowing without artificial impoundment, diversion, or other modification of the river. See California Government Code 19062.5
  • Fund: means the State Urban Parks and Healthy Communities Fund. See California Government Code 19173
  • fund: means the State Parks and Recreation Fund. See California Government Code 19583.1
  • Fund: means the Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Fund of 2006. See California Government Code 18654.5
  • Fund: means the Voting Modernization Fund, created pursuant to subdivision (b) of Section 19254. See California Government Code 18652
  • Fund: means the Heritage Network Decal Fund created pursuant to Section 5066 of the Vehicle Code. See California Government Code 19050
  • good cause: includes , but is not limited to, the following offenses, occurring while enrolled as a student:

  • Goods: means all things that are movable at the time of identification to the lease contract, or are fixtures (Section 10309), but the term does not include money, documents, instruments, accounts, chattel paper, general intangibles, or minerals or the like, including oil and gas, before extraction.   • Governing body: means the governing board, commission, city council, board of supervisors, board of directors or similar multimember body which exercises authority over a public body. See California Insurance Code 1300
  • Grant: means a sale, lease, or transfer of any kind. See California Education Code 74108
  • Grantor: means a person who sells, leases, or otherwise transfers a dealership. See California Education Code 74108
  • Green Party: means the Green Party of California. See California Government Code 19582.51
  • handgun: means any pistol, revolver, or firearm capable of being concealed upon the person. See California Revenue and Taxation Code 30266
  • Hearing aid dispenser: as used in this article , means a person engaged in the practice of fitting or selling hearing aids to an individual with impaired hearing. See California Education Code 74102
  • Immediate environments: means the land immediately adjacent to the segments of the rivers designated in Section 5093. See California Government Code 19062.5
  • Immediate vicinity: means the area within a distance of 100 feet from the room or rooms in which the voters are signing the roster and casting ballots. See California Government Code 18535
  • In this state: has the meaning specified in Section 25008 of the Corporations Code. See California Insurance Code 1330
  • individual with a disability: means any individual who has a physical or mental disability as defined in Section 12926. See California Government Code 19231
  • Inspected by a CASp: means the site was inspected by a CASp and is pending a determination by the CASp that the site meets applicable construction-related accessibility standards pursuant to paragraph (2) of subdivision (a) of Section 55. See California Education Code 74012
  • Installment lease contract: means a lease contract that authorizes or requires the delivery of goods in separate lots to be separately accepted, even though the lease contract contains a clause "each delivery is a separate lease" or its equivalent. See California Education Code 78018
  • insurance agent: as used in this chapter does not include a life agent as defined in this article. See California Insurance Code 1621
  • Interpretation: includes , but is not limited to, a visitor serving amenity that educates and communicates the significance and value of natural, historical, and cultural resources in a way that increases the understanding and enjoyment of these resources and that may utilize the expertise of a naturalist or other specialist skilled at educational interpretation. See California Government Code 18654.5
  • Issuer: has the meaning specified in Section 25010 of the Corporations Code. See California Insurance Code 1330
  • Issuer transaction: means any transaction directly or indirectly for the benefit of the issuer. See California Insurance Code 1330
  • Knowingly: means that a person, with respect to an offer or sale of a security constituting a fractional interest in a lease, installment sale, or other obligation of a local agency, does any of the following:

  • Land use regulation: means the regulation by any state or local governmental entity, agency, or official of any activities that take place other than directly on the waters of the segments of the rivers designated in Section 5093. See California Government Code 19062.5
  • Law enforcement officer: means any person who is a peace officer, as defined in Section 830. See California Education Code 71024
  • Lease: means a transfer of the right to possession and use of goods for a term in return for consideration, but a sale, including a sale on approval or a sale or return, or retention or creation of a security interest is not a lease. See California Education Code 78018
  • Lease agreement: means the bargain, with respect to the lease, of the lessor and the lessee in fact as found in their language or by implication from other circumstances including course of dealing or usage of trade or course of performance as provided in this division. See California Education Code 78018
  • Lease contract: means the total legal obligation that results from the lease agreement as affected by this division and any other applicable rules of law. See California Education Code 78018
  • Leasehold interest: means the interest of the lessor or the lessee under a lease contract. See California Education Code 78018
  • Legislative body: means the governing body or board of the state or local government. See California Insurance Code 1311
  • Lessee: means a school district or county superintendent of schools to whom the board has leased a portable classroom pursuant to this chapter. See California Education Code 17087
  • Lessee: means a person who acquires the right to possession and use of goods under a lease. See California Education Code 78018
  • Lessor: means a person who transfers the right to possession and use of goods under a lease. See California Education Code 78018
  • license: includes certificate, registration, or any other authorization to engage in practice regulated by this chapter. See California Education Code 81133.1
  • license: includes a certificate of convenience and a permanent license, and the term "persons who are licensed" includes the holders of any such certificate or the license, but these definitions and the use of those terms in this chapter shall not confer upon a certificate of convenience or any holder thereof any property right in or to the certificate, the certificate being and remaining only a temporary permit, issued as a matter of convenience, allowing the transaction of insurance without a permanent license, but within the limits, and subject to the conditions of the certificate of convenience issued and the laws applicable thereto.   • License term: as used in this chapter means all of that two-year period beginning as described in subdivision (a) or (b) of Section 1629, as applicable, and ending the second succeeding year on the last calendar day of the month in which the initial license was issued. See California Insurance Code 1630
  • License year: as used in this chapter shall be determined for each entity as follows:

  • licensee: as used in this chapter means the holder of a physician's and surgeon's certificate or doctor of podiatric medicine's certificate, as the case may be, who is engaged in the professional practice authorized by the certificate under the jurisdiction of the appropriate board. See California Education Code 69962
  • Lien: means a charge against or interest in goods to secure payment of a debt or performance of an obligation, but the term does not include a security interest. See California Education Code 78018
  • listing: as used in this part includes, but is not limited to:

    California Government Code 53097.3

  • Local agency: means a city, county, city and county, school district, special district, public corporation, or other public entity of this state. See California Insurance Code 1330
  • Local conservation corps: means a program operated by a public agency or nonprofit organization that meets the requirements of Section 14406. See California Government Code 18654.5
  • Local government: means any city, city and county, county, public district, public corporation, authority, agency, board, commission, or other public entity. See California Insurance Code 1325
  • Long Beach Civic Center: means the area bounded by Broadway, Pacific Avenue, Ocean Boulevard, and Magnolia Avenue, containing approximately 14. See California Insurance Code 1396
  • Meets applicable standards: means the site was inspected by a CASp and determined to meet all applicable construction-related accessibility standards pursuant to paragraph (1) of subdivision (a) of Section 55. See California Education Code 74012
  • Minimum management requirements: means the minimum wilderness management actions that are necessary to administer a wilderness area for the purpose of this chapter. See California Government Code 19054
  • Minimum tool: means the least intrusive tool, equipment, device, regulation, action, or practice that will achieve the minimum management requirements. See California Government Code 19054
  • Money: means a medium of exchange for the payment of obligations or a store of value authorized or adopted by a government or by intergovernmental agreement. See California Education Code 69652
  • National emergency: as used in this part means any period in which the United States is at war prior to the declaration by the Governor of a state military emergency. See California Government Code 18540.1
  • negotiable paper: means bank checks and drafts and express and post-office money orders. See California Insurance Code 1633.5
  • Nonprofit organization: means any nonprofit corporation qualified to do business in California, and qualified under Section 501?(c)(3) of the Internal Revenue Code. See California Government Code 18654.5
  • Nonvisual: means synthesized speech, braille, and other output methods that do not require sight. See California Government Code 19780
  • Notice: includes all papers and orders required to be served in any proceedings before any court, board, or officer, or when required by law to be served independently of such proceeding. See California Government Code 26660
  • Office: means the Office of Emergency Services. See California Government Code 18525.1
  • officer of the county: includes any elective or appointive officer of a county and any person in charge of any office, department, service, or institution of the county, or a division or branch thereof. See California Government Code 19050.7
  • offsite building: is a building that is situated on land which is neither owned by a community college district nor leased by a community college district under a lease containing an option to purchase the land. See California Education Code 81130.5
  • organization: means any legal entity other than a natural person. See California Insurance Code 1628
  • Parallel monitoring: means the testing of a randomly selected sampling of voting equipment on election day designed to simulate actual election conditions to confirm that the system is registering votes accurately. See California Government Code 18674
  • Person: has the meaning specified in Section 25013 of the Corporations Code. See California Insurance Code 1330
  • Person: means any broker, dealer, municipal securities dealer, investment advisor, or investment firm. See California Insurance Code 1394
  • Person: means any individual, partnership, corporation, limited liability company, or other organization or combination thereof, except that only individuals can be licensed under this chapter. See California Education Code 72104
  • Person: means an individual, a corporation, government or governmental subdivision or agency, business trust, estate, trust, joint venture, partnership, association, two or more persons having a joint or common interest, or any other legal or commercial entity. See California Education Code 69652
  • person: includes a firm, association, corporation, campaign committee or organization. See California Government Code 19240
  • Person: means a natural person, partnership, joint venture, corporation, limited liability company, or other entity. See California Education Code 74108
  • physical therapy: as used in this chapter , and a license issued pursuant to this chapter does not authorize the diagnosis of disease. See California Education Code 76370
  • Practice of fitting or selling hearing aids: as used in this article , means those practices used for the purpose of selection and adaptation of hearing aids, including direct observation of the ear, testing of hearing in connection with the fitting and selling of hearing aids, taking of ear mold impressions, fitting or sale of hearing aids, and any necessary postfitting counseling. See California Education Code 74015
  • present sale: means a sale which is accomplished by the making of the contract. See California Education Code 79420
  • Preservation: means rehabilitation, stabilization, restoration, development, and reconstruction, or any combination of those activities. See California Government Code 18654.5
  • presidential elector: as used in this chapter means an elector of President and Vice President of the United States, and not an elector as defined in Section 321. See California Government Code 19253
  • Private entity: means an individual, business entity, or combination of individuals and business entities. See California Insurance Code 1396
  • Private portion of the project: means those parcels of land within the Long Beach Civic Center to be conveyed to a private entity and developed as residential, retail, hospitality, institutional, or industrial facilities. See California Insurance Code 1396
  • Program: means the State Heritage Network Plan and Grants Program. See California Government Code 19050
  • Program manager: means the staff manager of the intervention program, as designated by the executive officer of the board. See California Education Code 81146
  • prohibited area: means any place where it is unlawful to discharge a weapon. See California Revenue and Taxation Code 30367
  • Project: means the revitalization and redevelopment of the Long Beach Civic Center with a new city hall, port headquarters, public library, and public park, and residential, retail, hospitality, institutional, and industrial facilities. See California Insurance Code 1396
  • Protection: means those actions necessary to prevent harm or damage to persons, property or natural resources or those actions necessary to allow the continued use and enjoyment of property or natural resources and includes acquisition, development, restoration, preservation and interpretation. See California Government Code 18654.5
  • Public body: means the county, city, city and county, public district, public authority, public corporation, nonprofit corporation or other statutorily constituted public entity which is authorized to issue bonds. See California Insurance Code 1300
  • Public portion of the project: means those parcels of land within the Long Beach Civic Center to be developed as a city hall, port headquarters, public park, public library, or other government facilities. See California Insurance Code 1396
  • Public-private partnership: means a cooperative arrangement between the public and private sectors, built on the expertise of each partner, that best meets the city's needs through the appropriate allocation of resources, risks, and rewards for the purposes of, and, including, but not limited to, studying, planning, designing, constructing, developing, financing, operating, maintaining, or any combination thereof, the project. See California Insurance Code 1396
  • Purchase: includes taking by sale, lease, mortgage, security interest, pledge, gift, or any other voluntary transaction creating an interest in goods. See California Education Code 78018
  • Qualified defendant: means a defendant in an action that includes a construction-related accessibility claim that is asserted against a place of public accommodation that met the requirements of "meets applicable standards" or "inspected by a CASp" prior to the date the defendant was served with the summons and complaint in that action. See California Education Code 74012
  • Recommended budget: means the budget document recommended to the board of supervisors by the designated county official. See California Government Code 18672.1
  • Regulatory agency: means the Department of Business Oversight, the securities administrators or other similar regulatory authority in any other state, the Securities and Exchange Commission, the Financial Industry Regulatory Authority, the Municipal Securities Rulemaking Board, the Commodity Futures Trading Commission, or any other self-regulatory organization. See California Insurance Code 1394
  • Residents: means any person defined in Section 19 who is resident within the meaning of Section 30. See California Insurance Code 1620.2
  • Resources Agency: means the Secretary of the Resources Agency and any constituent units of the Resources Agency that the secretary determines to be necessary to accomplish the purposes of this chapter. See California Government Code 19062.5
  • Restoration: means the improvement of physical structures or facilities and, in the case of natural systems and landscape features includes, but is not limited to, projects for the control of erosion, the control and elimination of exotic species, prescribed burning, fuel hazard reduction, fencing out threats to existing or restored natural resources, road elimination, and other plant and wildlife habitat improvement to increase the natural system value of the property. See California Government Code 18654.5
  • River: means the water, bed, and shoreline of rivers, streams, channels, lakes, bays, estuaries, marshes, wetlands, and lagoons, up to the first line of permanently established riparian vegetation. See California Government Code 19062.5
  • safety: is a utomatically applied by the pistol, this feature shall not be defeated. See California Penal Code 31900
  • Salesperson: when used without modification, means a person licensed as a salesperson under any of the provisions of this part. See California Government Code 53090
  • School building: as used in this article , means any building used, or designed to be used, for community college purposes and constructed by the state, by any city, county, or city and county, by any district of any kind within the state, by any regional occupational center or program created by or authorized to act by an agreement under joint exercise of power, or by the United States government, or any agency thereof. See California Education Code 81050
  • School building: as used in this article , means and includes any building used, or designed to be used, for community college purposes and constructed, reconstructed, altered, or added to, by the state or by any city or city and county, by any political subdivision, by any district of any kind within the state, by any regional occupational center or program created by or authorized to act by an agreement under joint exercise of power, or by the United States government, or any agency thereof. See California Education Code 81130.5
  • School building: as used in this article excludes any building which is used for community college district administrative buildings located on a site separate from the community college campuses of the district, and into which students are not required to enter. See California Education Code 81160
  • Scope of arbitration: means economic issues, including salaries, wages and overtime pay, health and pension benefits, vacation and other leave, reimbursements, incentives, differentials, and all other forms of remuneration. See California Education Code 71024
  • Secretary: means the Secretary of the Resources Agency. See California Government Code 19054
  • Secretary: means the Secretary of the Resources Agency. See California Government Code 19062.5
  • Secretary: means the Secretary of the Resources Agency. See California Government Code 18654.5
  • secretary: refer to the Labor and Workforce Development Agency and the Secretary of Labor and Workforce Development, respectively, unless the context otherwise requires. See California Government Code 18570
  • Security: has the meaning specified in Section 25019 of the Corporations Code. See California Insurance Code 1330
  • Seller: means a person who sells or contracts to sell goods. See California Education Code 79227
  • Site: means a place of public accommodation. See California Education Code 74012
  • Special treatment areas: means , for purposes of this chapter, those areas defined as special treatment areas in Section 895. See California Government Code 19062.5
  • speech-language pathologist: is a person who practices speech-language pathology. See California Education Code 72104
  • Speech-language pathology aide: means any person meeting the minimum requirements established by the board, who works directly under the supervision of a speech-language pathologist. See California Education Code 72104
  • Speech-language pathology assistant: means a person who meets the academic and supervised training requirements set forth by the board and who is approved by the board to assist in the provision of speech-language pathology under the direction and supervision of a speech-language pathologist who shall be responsible for the extent, kind, and quality of the services provided by the speech-language pathology assistant. See California Education Code 72104
  • State: means the state or any department, agency, board, commission, or authority of the state. See California Insurance Code 1325
  • State Board: means the State Water Resources Control Board. See California Government Code 18654.5
  • state lands: means lands owned by, or under the jurisdiction of, the state or any state agency. See California Government Code 19405
  • State military emergency: as used in this part , means an emergency declared and terminable by the Governor by proclamation during, but not limited to, such times as the United States is conscripting personnel for service in the armed forces. See California Government Code 18540.2
  • State or local government: means the state, any department, agency, board, commission, or authority of the state, or any city, city and county, county, public district, public corporation, authority, agency, board, commission, or other public entity. See California Insurance Code 1311
  • State School Building Aid Fund: means that fund established pursuant to Section 16096. See California Education Code 17087
  • Student record: means any item of information directly related to an identifiable student, other than directory information, which is maintained by a community college or required to be maintained by any employee in the performance of his or her duties, whether recorded by handwriting, print, tapes, film, microfilm or other means. See California Education Code 76210
  • Sublease: means a lease of goods the right to possession and use of which was acquired by the lessor as a lessee under an existing lease. See California Education Code 78018
  • Supplier: means a person from whom a lessor buys or leases goods to be leased under a finance lease. See California Education Code 78018
  • Supply contract: means a contract under which a lessor buys or leases goods to be leased. See California Education Code 78018
  • Surplus deposits of subscribers: as used in this chapter , means amounts, over and above any premium charges, which are contributed by subscribers and which are used for the purpose of funding the surplus of a reciprocal or interinsurance exchange. See California Insurance Code 1374.1
  • System: means the California wilderness preservation system. See California Government Code 19054
  • System: means the California Wild and Scenic Rivers System. See California Government Code 19062.5
  • Trust: means a State Heritage Network Trust organized pursuant to subdivision (c) of Section 5078. See California Government Code 19050
  • Underutilization: means having a statistically significant, smaller percentage of persons of a group in an occupation or at a level in a state agency than would reasonably be expected by their percentage representation in the relevant labor force. See California Penal Code 26040
  • Urbanized or heavily urbanized local agencies: include cities, counties, or a city and county, or special districts as determined by the Department of Finance according to the latest verifiable census data pursuant to subdivisions (c) and (d) of Section 5621. See California Government Code 19173
  • visually impaired: means a person having central visual acuity not to exceed 20-200 in the better eye, with corrected lenses, or visual acuity greater than 20-200, but with a limitation in the field of vision such that the widest diameter of the visual field subtends at an angle of not greater than 20 degrees. See California Government Code 18932
  • visually impaired: includes blindness and means having central visual acuity not to exceed 20/200 in the better eye, with corrected lenses, as measured by the Snellen test, or visual acuity greater than 20/200, but with a limitation in the field of vision such that the widest diameter of the visual field subtends an angle not greater than 20 degrees.   • Voter verified paper audit trail: means a paper cast vote record containing a copy of each of the voter's selections that allows each voter to confirm his or her selections before the voter casts his or her ballot for systems that do not contain a paper ballot.   • Voting system: means any voting machine, voting device, or vote tabulating device that does not use prescored punch card ballots. See California Government Code 18652
  • Wilderness areas: means component areas of the system as described in Section 5093. See California Government Code 19054
