Terms Used In Delaware Code > Title 31 > Chapter 23

  • Agency: means any agency, board, department, bureau or commission of this State which receives an appropriation under the general appropriation act of the General Assembly. See Delaware Code Title 29 Sec. 5901
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Applicant: means a person who has applied for assistance under this chapter. See Delaware Code Title 29 Sec. 5918
  • Assistance: means money payments to persons who are blind in need. See Delaware Code Title 29 Sec. 5918
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Board: means the Merit Employee Relations Board created by this chapter. See Delaware Code Title 29 Sec. 5901
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Fraud: Intentional deception resulting in injury to another.
  • Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
  • Month: means a calendar month, unless otherwise expressed. See Delaware Code Title 6 Sec. 4307
  • Ophthalmologist: means a physician licensed to practice medicine in this State and who is actively engaged in the treatment of diseases of the human eye. See Delaware Code Title 29 Sec. 5918
  • Person who is blind: means one who is totally blind or has visual acuity of not more than 20/200 in the better eye with correction or whose vision is limited in field so that the widest diameter subtends an angle no greater than 20 degrees. See Delaware Code Title 29 Sec. 5918
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Publicly soliciting: means the wearing, carrying or exhibiting of signs denoting blindness or the carrying of receptacles for the reception of alms or the doing of the same by proxy or by begging from house to house. See Delaware Code Title 29 Sec. 5918
  • Recipient: means a person who has received assistance under the terms of this chapter. See Delaware Code Title 29 Sec. 5918
  • Rules: means those rules adopted by the Board pursuant to this chapter. See Delaware Code Title 29 Sec. 5901
  • Secretary: means the Secretary of the Department of Human Resources. See Delaware Code Title 29 Sec. 5901
  • State: means the State of Delaware; and when applied to different parts of the United States, it includes the District of Columbia and the several territories and possessions of the United States. See Delaware Code Title 6 Sec. 4307
  • state service: means all positions of state employment other than the following positions, which are excluded:

    (1) Members of the General Assembly and others elected by popular vote and persons appointed to fill vacancies in elective offices. See Delaware Code Title 29 Sec. 5903

  • Supplementary services: means services other than money payments to persons who are blind in need. See Delaware Code Title 29 Sec. 5918
  • United States: includes its territories and possessions and the District of Columbia. See Delaware Code Title 6 Sec. 4307
  • Year: means a calendar year, and is equivalent to the words "year of our Lord. See Delaware Code Title 6 Sec. 4307
