Terms Used In Illinois Compiled Statutes > Chapter 410

  • act of terrorism: means : (1) any act that is intended to cause or create a risk and does cause or create a risk of death or great bodily harm to one or more persons; (2) any act that disables or destroys the usefulness or operation of any communications system; (3) any act or any series of 2 or more acts committed in furtherance of a single intention, scheme, or design that disables or destroys the usefulness or operation of a computer network, computers, computer programs, or data used by any industry, by any class of business, or by 5 or more businesses or by the federal government, State government, any unit of local government, a public utility, a manufacturer of pharmaceuticals, a national defense contractor, or a manufacturer of chemical or biological products used in or in connection with agricultural production; (4) any act that disables or causes substantial damage to or destruction of any structure or facility used in or used in connection with ground, air, or water transportation; the production or distribution of electricity, gas, oil, or other fuel (except for acts that occur inadvertently and as the result of operation of the facility that produces or distributes electricity, gas, oil, or other fuel); the treatment of sewage or the treatment or distribution of water; or controlling the flow of any body of water; (5) any act that causes substantial damage to or destruction of livestock or to crops or a series of 2 or more acts committed in furtherance of a single intention, scheme, or design which, in the aggregate, causes substantial damage to or destruction of livestock or crops; (6) any act that causes substantial damage to or destruction of any hospital or any building or facility used by the federal government, State government, any unit of local government or by a national defense contractor or by a public utility, a manufacturer of pharmaceuticals, a manufacturer of chemical or biological products used in or in connection with agricultural production or the storage or processing of agricultural products or the preparation of agricultural products for food or food products intended for resale or for feed for livestock; (7) any act that causes substantial damage to any building containing 5 or more businesses of any type or to any building in which 10 or more people reside; (8) endangering the food supply; or (9) endangering the water supply.   • Aftercare release: means the conditional and
    
revocable release of an adjudicated delinquent juvenile committed to the Department of Juvenile Justice under the supervision of the Department of Juvenile Justice. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Air rifle: means and includes any air gun, air pistol, spring gun, spring pistol, B-B gun, paint ball gun, pellet gun or any implement that is not a firearm which impels a breakable paint ball containing washable marking colors or, a pellet constructed of hard plastic, steel, lead or other hard materials with a force that reasonably is expected to cause bodily harm. See Illinois Compiled Statutes 720 ILCS 5/24.8-0.1
  • Approved electronic monitoring device: means a device approved by the supervising authority that is primarily intended to record or transmit information as to the minor's presence or nonpresence in the home. See Illinois Compiled Statutes 705 ILCS 405/5-7A-105
  • Approved electronic monitoring device: means a device approved by the supervising authority which is primarily intended to record or transmit information as to the defendant's presence or nonpresence in the home, consumption of alcohol, consumption of drugs, location as determined through GPS, cellular triangulation, Wi-Fi, or other electronic means. See Illinois Compiled Statutes 730 ILCS 5/5-8A-2
  • artificially made or reclaimed land: as used in this Division 123, includes all land which formerly was submerged under the public waters of the state, the title to which is in the state, and which has been artificially made or reclaimed in whole or in part contrary to law. See Illinois Compiled Statutes 720 ILCS 5/29A-2
  • Ashes: means residue from fires used for cooking and for heating buildings. See Illinois Compiled Statutes 65 ILCS 5/11-19-2
  • Authority: means a School Finance Authority created under this Article. See Illinois Compiled Statutes 105 ILCS 5/1E-10
  • Authority: means a School Finance Authority created under this Article. See Illinois Compiled Statutes 105 ILCS 5/1F-10
  • Authority: means any Municipal Zoo Authority, as provided in this Division. See Illinois Compiled Statutes 65 ILCS 5/11-48.3-2
  • Board: includes a board, commission, authority, task force, or other similar body to which one or more members are appointed by the Governor with the advice and consent of the Senate, but does not include any subcommittee thereof, and where the member receives any form of compensation on a per meeting basis; this does not include reimbursement for actual travel or other expenses necessarily incurred in discharging the duties of the office. See Illinois Compiled Statutes 720 ILCS 5/21.2-1
  • Board: means the Weatherization Initiative Board. See Illinois Compiled Statutes 30 ILCS 738/40-5
  • Board: means the governing and administrative body of any Municipal Zoo Authority, as provided in this Division. See Illinois Compiled Statutes 65 ILCS 5/11-48.3-2
  • Bonds: means bonds authorized to be issued by the Authority under Section 1E-65 of this Code. See Illinois Compiled Statutes 105 ILCS 5/1E-10
  • Bonds: means bonds authorized to be issued by the Authority under Section 1F-65 of this Code. See Illinois Compiled Statutes 105 ILCS 5/1F-10
  • Budget: means the annual budget of the district required under Section 17-1 of this Code, as in effect from time to time. See Illinois Compiled Statutes 105 ILCS 5/1E-10
  • Budget: means the annual budget of the district required under Section 17-1 of this Code, as in effect from time to time. See Illinois Compiled Statutes 105 ILCS 5/1F-10
  • Buyer: means a person who buys or contracts to
  •     
    buy goods. See Illinois Compiled Statutes 810 ILCS 5/2-103
  • Certification program: means an instructional curriculum, examination, and process for certification, recertification, and revocation of certification of certified public accountants that is administered by the Illinois CPA Society and that is officially approved by the Department to ensure that a certified public accountant possesses the necessary skills and abilities to successfully perform an attestation engagement for tax compliance review in a certified audit project. See Illinois Compiled Statutes 720 ILCS 5/2-5
  • Chairperson: means the Chairperson of the Authority. See Illinois Compiled Statutes 105 ILCS 5/1E-10
  • Chairperson: means the Chairperson of the Authority. See Illinois Compiled Statutes 105 ILCS 5/1F-10
  • Chairperson: means the Chairperson of the Panel. See Illinois Compiled Statutes 105 ILCS 5/1H-10
  • Circuit clerk: means clerk of the circuit court. See Illinois Compiled Statutes 5 ILCS 70/1.26
  • Code: means any municipal ordinance that pertains to or regulates: sanitation practices; forestry practices; the attachment of bills or notices to public property; the definition, identification and abatement of public nuisances; and the accumulation, disposal and transportation of garbage, refuse and other forms of solid waste in a municipality. See Illinois Compiled Statutes 65 ILCS 5/11-19.2-1
  • Community service: means uncompensated labor for
  •     
    a community service agency as hereinafter defined. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Conservation management plan: means a plan approved by the Department of Natural Resources that specifies conservation and management practices, including uses that will be conducted to preserve and restore unimproved land. See Illinois Compiled Statutes 720 ILCS 5/12-6.4
  • Consumer lease: means a lease that a lessor
  •     
    regularly engaged in the business of leasing or selling makes to a lessee who is an individual and who takes under the lease primarily for a personal, family, or household purpose, if the total payments to be made under the lease contract, excluding payments for options to renew or buy, do not exceed $40,000. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Court: means the circuit court in a session or
  •     
    division assigned to hear proceedings under this Act, and includes the term Juvenile Court. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Dealer: means any person, copartnership, association or corporation engaged in the business of selling at retail or renting any of the articles included in the definition of "air rifle". See Illinois Compiled Statutes 720 ILCS 5/24.8-0.1
  • deception: means knowingly to:
         (a) Create or confirm another's impression which is false and which the offender does not believe to be true; or
         (b) Fail to correct a false impression which the offender previously has created or confirmed; or
         (c) Prevent another from acquiring information pertinent to the disposition of the property involved; or
         (d) Sell or otherwise transfer or encumber property, failing to disclose a lien, adverse claim, or other legal impediment to the enjoyment of the property, whether such impediment is or is not valid, or is or is not a matter of official record; or
         (e) Promise performance which the offender does not intend to perform or knows will not be performed. See Illinois Compiled Statutes 720 ILCS 5/15-4
  • decree: is synonymous with the word "judgment". See Illinois Compiled Statutes 5 ILCS 70/1.24
  • Delinquent minor: means any minor who prior to
  •     
    his or her 18th birthday has violated or attempted to violate, regardless of where the act occurred, any federal, State, county or municipal law or ordinance. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Department: means the Department of Human
  •     
    Services unless specifically referenced as another department. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Department: means the Illinois Department of Revenue. See Illinois Compiled Statutes 720 ILCS 5/2-5
  • Department: means the Department of Transportation. See Illinois Compiled Statutes 725 ILCS 5/124B-1020
  • Department: means the Department of Commerce and Economic Opportunity. See Illinois Compiled Statutes 30 ILCS 738/40-5
  • Department: means the Department of Juvenile Justice. See Illinois Compiled Statutes 730 ILCS 5/3-2.5-10
  • Department: means the Department of Corrections or the Department of Juvenile Justice. See Illinois Compiled Statutes 730 ILCS 5/5-8A-2
  • Departments: means for the purposes of this Act, the Department of Human Services, the Department on Aging, Department of Healthcare and Family Services and Department of Public Health, unless otherwise noted. See Illinois Compiled Statutes 705 ILCS 405/5-130
  • detention: includes the court ordered care of an alleged or adjudicated delinquent minor who requires secure custody pursuant to Section 5-125 of this Act. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Director: means the Director of Juvenile Justice. See Illinois Compiled Statutes 730 ILCS 5/3-2.5-10
  • District: means any school district having a population of not more than 500,000 that prior to the effective date of this amendatory Act of the 92nd General Assembly has had a Financial Oversight Panel established for the district under Section 1B-4 of this Code following the district's petitioning of the State Board of Education for the creation of the Financial Oversight Panel and for which the Financial Oversight Panel has been in existence for at least one year. See Illinois Compiled Statutes 105 ILCS 5/1E-10
  • District: means any elementary school district having a population of not more than 500,000 that prior to December 1, 2002 has had a Financial Oversight Panel established for the district under Section 1B-4 of this Code following the district's petitioning of the State Board of Education for the creation of the Financial Oversight Panel. See Illinois Compiled Statutes 105 ILCS 5/1F-10
  • District: means any school district having a population of not more than 500,000 that has had a Financial Oversight Panel established under this Article. See Illinois Compiled Statutes 105 ILCS 5/1H-10
  • district: means a public water district organized under "An Act in relation to public water districts" approved July 25, 1945, as amended. See Illinois Compiled Statutes 65 ILCS 5/11-151-1
  • Diversion: means the referral of a juvenile,
  •     
    without court intervention, into a program that provides services designed to educate the juvenile and develop a productive and responsible approach to living in the community. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • electrical equipment: as used in this Division 37 means conductors and other equipment installed for the utilization of electricity for light, heat, or power. See Illinois Compiled Statutes 65 ILCS 5/11-37-1
  • Electronic communication: includes transmissions through an electronic device including, but not limited to, a telephone, cellular phone, computer, or pager, which communication includes, but is not limited to, e-mail, instant message, text message, or voice mail. See Illinois Compiled Statutes 720 ILCS 5/26.5-0.1
  • Electronic monitoring: means the monitoring of an inmate, person, or offender with an electronic device both within and outside of their home under the terms and conditions established by the supervising authority. See Illinois Compiled Statutes 730 ILCS 5/5-8A-2
  • English learners: means (1) all children in grades pre-K through 12 who were not born in the United States, whose native tongue is a language other than English, and who are incapable of performing ordinary classwork in English; and (2) all children in grades pre-K through 12 who were born in the United States of parents possessing no or limited English-speaking ability and who are incapable of performing ordinary classwork in English. See Illinois Compiled Statutes 105 ILCS 5/14C-2
  • Enterprise: includes :
             (1) any partnership, corporation, association,
  •     
    business or charitable trust, or other legal entity; and
            (2) any group of individuals or other legal entities,
        
    or any combination thereof, associated in fact although not itself a legal entity. See Illinois Compiled Statutes 720 ILCS 5/33G-3
  • Family or household member: includes spouses, former spouses, parents, children, stepchildren and other persons related by blood or by present or prior marriage, persons who share or formerly shared a common dwelling, persons who have or allegedly share a blood relationship through a child, persons who have or have had a dating or engagement relationship, and persons with disabilities and their personal assistants. See Illinois Compiled Statutes 720 ILCS 5/26.5-0.1
  • Fault: means wrongful act, omission, breach, or
  •     
    default. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Finance lease: means a lease with respect to
  •     
    which:
                (i) the lessor does not select, manufacture, or
            
    supply the goods;
                (ii) the lessor acquires the goods or the right
            
    to possession and use of the goods in connection with the lease; and
                (iii) one of the following occurs:
                     (A) the lessee receives a copy of the
                
    contract by which the lessor acquired the goods or the right to possession and use of the goods before signing the lease contract;
                    (B) the lessee's approval of the contract by
                
    which the lessor acquired the goods or the right to possession and use of the goods is a condition to effectiveness of the lease contract;
                    (C) the lessee, before signing the lease
                
    contract, receives an accurate and complete statement designating the promises and warranties, and any disclaimers of warranties, limitations or modifications of remedies, or liquidated damages, including those of a third party, such as the manufacturer of the goods, provided to the lessor by the person supplying the goods in connection with or as part of the contract by which the lessor acquired the goods or the right to possession and use of the goods; or
                    (D) if the lease is not a consumer lease, the
                
    lessor, before the lessee signs the lease contract, informs the lessee in writing (a) of the identity of the person supplying the goods to the lessor, unless the lessee has selected that person and directed the lessor to acquire the goods or the right to possession and use of the goods from that person, (b) that the lessee is entitled under this Article to the promises and warranties, including those of any third party, provided to the lessor by the person supplying the goods in connection with or as part of the contract by which the lessor acquired the goods or the right to possession and use of the goods, and (c) that the lessee may communicate with the person supplying the goods to the lessor and receive an accurate and complete statement of those promises and warranties, including any disclaimers and limitations of them or of remedies. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Financial plan: means the financial plan of the district to be developed pursuant to this Article, as in effect from time to time. See Illinois Compiled Statutes 105 ILCS 5/1E-10
  • Financial plan: means the financial plan of the district to be developed pursuant to this Article, as in effect from time to time. See Illinois Compiled Statutes 105 ILCS 5/1F-10
  • Financial plan: means the financial plan of the district to be developed pursuant to this Article, as in effect from time to time. See Illinois Compiled Statutes 105 ILCS 5/1H-10
  • Fiscal year: means the fiscal year of the district. See Illinois Compiled Statutes 105 ILCS 5/1F-10
  • Future damages: includes all damages which the trier of fact finds will accrue after the damages findings are made, including, without limitation, damages for future medical or health treatment, care or custody, loss of future earnings, loss of bodily function, future pain and suffering, and future physical impairment and inconvenience. See Illinois Compiled Statutes 735 ILCS 5/2-1703
  • Garbage: means wastes resulting from the handling, preparation, cooking and consumption of food; wastes from the handling, storage and sale of produce. See Illinois Compiled Statutes 65 ILCS 5/11-19-2
  • General construction or demolition debris: has the meaning given to that term in Section 3. See Illinois Compiled Statutes 65 ILCS 5/11-19-2
  • General Revenue Law of Illinois: or any equivalent expression, when used with reference to revenue, shall be deemed to refer to the Property Tax Code and all existing and future amendments thereto and modifications thereof, and all rules now or hereafter adopted pursuant thereto. See Illinois Compiled Statutes 5 ILCS 70/1.23
  • Goods: means all things that are movable at the
  •     
    time of identification to the lease contract, or are fixtures (Section 2A-309), but the term does not include money, documents, instruments, accounts, chattel paper, general intangibles, or minerals or the like, including oil and gas, before extraction. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • governmental property: means funds or other property owned by the State, a unit of local government, or a school district. See Illinois Compiled Statutes 720 ILCS 5/15-10
  • harassing: means knowing conduct which is not necessary to accomplish a purpose that is reasonable under the circumstances, that would cause a reasonable person emotional distress and does cause emotional distress to another. See Illinois Compiled Statutes 720 ILCS 5/26.5-0.1
  • Hearing officer: means a person other than a sanitation inspector or law enforcement officer having the following powers and duties:
            (1) to preside at an administrative hearing called to
  •     
    determine whether or not a code violation exists;
            (2) to hear testimony and accept evidence from the
        
    sanitation inspector, the respondent and all interested parties relevant to the existence of a code violation;
            (3) to preserve and authenticate the record of the
        
    hearing and all exhibits and evidence introduced at the hearing;
            (4) to issue and sign a written finding, decision and
        
    order stating whether a code violation exists; and
            (5) to impose penalties consistent with applicable
        
    code provisions and to assess costs reasonably related to instituting the proceeding upon finding the respondent liable for the charged violation, provided, however, that in no event shall the hearing officer have the authority to impose a penalty of incarceration. See Illinois Compiled Statutes 65 ILCS 5/11-19.2-1
  • Heretofore: means any time previous to the day on which the statute takes effect; and the word "hereafter" at any time after such day. See Illinois Compiled Statutes 5 ILCS 70/1.17
  • home and community-based long-term care services: means , with respect to the State Medicaid program, a service aid, or benefit, home and community-based services, including, but not limited to, home health and personal care services, that are provided to a person with a disability, and are voluntarily accepted, as part of his or her long-term care that: (i) is provided under the State's qualified home and community-based program or that could be provided under such a program but is otherwise provided under the Medicaid program; (ii) is delivered in a qualified residence; and (iii) is necessary for the person with a disability to live in the community. See Illinois Compiled Statutes 705 ILCS 405/5-130
  • Home detention: means the confinement of a minor adjudicated delinquent or subject to an adjudicatory hearing under Article V for an act that if committed by an adult would be an offense to his or her place of residence under the terms and conditions established by the supervising authority. See Illinois Compiled Statutes 705 ILCS 405/5-7A-105
  • Home detention: means the confinement of a person convicted or charged with an offense to his or her place of residence under the terms and conditions established by the supervising authority. See Illinois Compiled Statutes 730 ILCS 5/5-8A-2
  • Industrial project: means any (a) capital project, including one or more buildings and other structures, improvements, machinery and equipment whether or not on the same site or sites now existing or hereafter acquired, suitable for use by any manufacturing, industrial, research, transportation or commercial enterprise, including but not limited to use as a factory, mill, processing plant, assembly plant, packaging plant, fabricating plant, office building, industrial distribution center, warehouse, repair, overhaul or service facility, freight terminal, research facility, test facility, railroad facility, or commercial facility, and including also the sites thereof and other rights in land therefor whether improved or unimproved, site preparation and landscaping, and all appurtenances and facilities incidental thereto such as utilities, access roads, railroad sidings, truck docking and similar facilities, parking facilities, dockage, wharfage, and other improvements necessary or convenient thereto; or (b) land, buildings, machinery or equipment comprising an addition to or renovation, rehabilitation or improvement of any existing capital project; (c) construction, remodeling or conversion of a structure to be leased to the Illinois Department of Corrections for the purposes of its serving as a correctional institution or facility pursuant to paragraph (c) of Section 3-2-2 of the Unified Code of Corrections; or (d) construction, remodeling or conversion of a structure to be leased to the Department of Central Management Services for the purpose of serving as a State facility pursuant to Section 405-320 of the Department of Central Management Services Law (20 ILCS 405/405-320).   • Initiative: means the Urban Weatherization Initiative. See Illinois Compiled Statutes 30 ILCS 738/40-5
  • Juvenile detention home: means a public facility
  •     
    with specially trained staff that conforms to the county juvenile detention standards adopted by the Department of Juvenile Justice. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Juvenile police officer: means a sworn police
  •     
    officer who has completed a Basic Recruit Training Course, has been assigned to the position of juvenile police officer by his or her chief law enforcement officer and has completed the necessary juvenile officers training as prescribed by the Illinois Law Enforcement Training Standards Board, or in the case of a State police officer, juvenile officer training approved by the Director of State Police. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Labor organization: includes any organization, labor union, craft union, or any voluntary unincorporated association designed to further the cause of the rights of union labor that is constituted for the purpose, in whole or in part, of collective bargaining or of dealing with employers concerning grievances, terms or conditions of employment, or apprenticeships or applications for apprenticeships, or of other mutual aid or protection in connection with employment, including apprenticeships or applications for apprenticeships. See Illinois Compiled Statutes 720 ILCS 5/33G-3
  • Late term appointee: means a person who is appointed to an office by a Governor who does not succeed himself or herself as Governor, whose appointment requires the advice and consent of the Senate, and whose appointment is confirmed by the Senate 90 or fewer days before the end of the appointing Governor's term. See Illinois Compiled Statutes 720 ILCS 5/19-4
  • Lease: means a transfer of the right to
  •     
    possession and use of goods for a term in return for consideration, but a sale, including a sale on approval or a sale or return, or retention or creation of a security interest is not a lease. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Lease agreement: means the bargain, with respect
  •     
    to the lease, of the lessor and the lessee in fact as found in their language or by implication from other circumstances including course of dealing or usage of trade or course of performance as provided in this Article. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Lease contract: means the total legal obligation
  •     
    that results from the lease agreement as affected by this Article and any other applicable rules of law. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Leasehold interest: means the interest of the
  •     
    lessor or the lessee under a lease contract. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Lessee: means a person who acquires the right to
  •     
    possession and use of goods under a lease. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Lessor: means a person who transfers the right
  •     
    to possession and use of goods under a lease. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Lien: means a charge against or interest in
  •     
    goods to secure payment of a debt or performance of an obligation, but the term does not include a security interest. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Managed land: means unimproved land of 5 contiguous acres or more that is subject to a conservation management plan. See Illinois Compiled Statutes 720 ILCS 5/12-6.4
  • Material support or resources: means currency or other financial securities, financial services, lodging, training, safe houses, false documentation or identification, communications equipment, facilities, weapons, lethal substances, explosives, personnel, transportation, any other kind of physical assets or intangible property, and expert services or expert assistance. See Illinois Compiled Statutes 720 ILCS 5/29D-10
  • medical malpractice action: means any action, whether in tort, contract or otherwise, in which the plaintiff seeks damages for injuries or death by reason of medical, hospital, or other healing art malpractice. See Illinois Compiled Statutes 735 ILCS 5/2-1704
  • Metropolitan Area: means all that territory in the State of Illinois lying within the corporate boundaries of the municipality or municipalities establishing an authority as provided in this Division. See Illinois Compiled Statutes 65 ILCS 5/11-48.3-2
  • Minor: means a person under the age of 21 years
  •     
    subject to this Act. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Municipality: includes any city, village or incorporated town in this State. See Illinois Compiled Statutes 65 ILCS 5/11-74-2
  • New property: means (i) the assessed value, after final board of review or board of appeals action, of new improvements or additions to existing improvements on any parcel of real property that increase the assessed value of that real property during the levy year multiplied by the equalization factor issued by the Department under Section 17-30 and (ii) the assessed value, after final board of review or board of appeals action, of real property not exempt from real estate taxation, which real property was exempt from real estate taxation for any portion of the immediately preceding levy year, multiplied by the equalization factor issued by the Department under Section 17-30.   • Non-secure custody: means confinement where the
  •     
    minor is not physically restricted by being placed in a locked cell or room, by being handcuffed to a rail or other stationary object, or by other means. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Obligations: means bonds and notes of the Authority. See Illinois Compiled Statutes 105 ILCS 5/1E-10

  • obtain: means :
         (a) In relation to property, to bring about a transfer of interest or possession, whether to the offender or to another, and
         (b) In relation to labor or services, to secure the performance thereof. See Illinois Compiled Statutes 720 ILCS 5/15-7
  • officer: means an elected or appointed official; regardless of whether the official is compensated, and (ii) an "employee" means a full-time, part-time, or contractual employee. See Illinois Compiled Statutes 720 ILCS 5/29D-10
  • Operation or management: means directing or carrying out the enterprise's affairs and is limited to any person who knowingly serves as a leader, organizer, operator, manager, director, supervisor, financier, advisor, recruiter, supplier, or enforcer of an enterprise in violation of this Article. See Illinois Compiled Statutes 720 ILCS 5/33G-3
  • owner: means a person, other than the offender, who has possession of or any other interest in the property involved, even though such interest or possession is unlawful, and without whose consent the offender has no authority to exert control over the property. See Illinois Compiled Statutes 720 ILCS 5/15-2
  • Panel: means the Financial Oversight Panel created under Section 1B-4;
         (b) "Board" means a local board of education;
         (c) "Budget" means the annual budget of the board required under Section 17-1 and is subject to the authority of the Panel as provided in this Article;
         (d) "Chairman" means the chairman of the Panel appointed pursuant to Section 1B-5 of this Article;
         (e) "District" means any school district of this State not subject to the provisions of Article 34;
         (f) "Financial plan" means the financial plan of the board required to be developed pursuant to this Article;
         (g) "Fiscal year" means the fiscal year of the board;
         (h) "School year" means the school year of the board;
         (i) "State Board" means the Illinois State Board of Education;
         (j) "State Superintendent" means the State Superintendent of Education. See Illinois Compiled Statutes 105 ILCS 5/1B-3
  • Panel: means a Financial Oversight Panel created under this Article. See Illinois Compiled Statutes 105 ILCS 5/1H-10
  • Participant: means a minor placed into an electronic monitoring program. See Illinois Compiled Statutes 705 ILCS 405/5-7A-105
  • Participant: means an inmate or offender placed into an electronic monitoring program. See Illinois Compiled Statutes 730 ILCS 5/5-8A-2
  • Participating taxpayer: means any person subject to the revenue laws administered by the Department who enters into an engagement with a qualified practitioner for tax compliance review and who is approved by the Department under the certified audit project. See Illinois Compiled Statutes 720 ILCS 5/2-5
  • Passenger rail systems: includes all passenger rail systems maintained by the National Passenger Railroad Corporation in Illinois and those passenger rail systems under the jurisdiction of the Commuter Rail Board as established in Section 3B. See Illinois Compiled Statutes 725 ILCS 5/124B-1020
  • Past damages: means damages that have accrued when the damages findings are made. See Illinois Compiled Statutes 735 ILCS 5/2-1703
  • Pattern of predicate activity: means :
             (1) at least 3 occurrences of predicate activity that
  •     
    are in some way related to each other and that have continuity between them, and that are separate acts. See Illinois Compiled Statutes 720 ILCS 5/33G-3
  • Person: means any individual, firm, partnership, corporation, both domestic and foreign, company, association or joint stock association; and includes any trustee, receiver, assignee or personal representative thereof. See Illinois Compiled Statutes 65 ILCS 5/11-48.3-2
  • Person: has the meaning given in Section 2-15 of this Code and, in addition to that meaning, includes, without limitation, any charitable organization, whether incorporated or unincorporated, any professional fund raiser, professional solicitor, limited liability company, association, joint stock company, association, trust, trustee, or any group of people formally or informally affiliated or associated for a common purpose, and any officer, director, partner, member, or agent of any person. See Illinois Compiled Statutes 720 ILCS 5/29D-10
  • Person under legal disability: means a person 18 years or older who (a) because of mental deterioration or physical incapacity is not fully able to manage his or her person or estate, or (b) is a person with mental illness or is a person with developmental disabilities and who because of his or her mental illness or developmental disability is not fully able to manage his or her person or estate, or (c) because of gambling, idleness, debauchery or excessive use of intoxicants or drugs, so spends or wastes his or her estate as to expose himself or herself or his or her family to want or suffering. See Illinois Compiled Statutes 5 ILCS 70/1.06
  • police force: shall be construed to include such persons in the employ of a municipality as members of the department of police, who are or shall hereafter be appointed and sworn as policemen. See Illinois Compiled Statutes 5 ILCS 70/1.20
  • Predicate activity: means any act that is a Class 2 felony or higher and constitutes a violation or violations of any of the following provisions of the laws of the State of Illinois (as amended or revised as of the date the activity occurred or, in the instance of a continuing offense, the date that charges under this Article are filed in a particular matter in the State of Illinois) or any act under the law of another jurisdiction for an offense that could be charged as a Class 2 felony or higher in this State:
             (1) under the Criminal Code of 1961 or the Criminal
  •     
    Code of 2012: 8-1. See Illinois Compiled Statutes 720 ILCS 5/33G-3
  • Program in transitional bilingual education: means a full-time program of instruction (1) in all those courses or subjects which a child is required by law to receive and which are required by the child's school district, which shall be given in the native language of English learners who are enrolled in the program and also in English, (2) in the reading and writing of the native language of English learners who are enrolled in the program and in the oral language (listening and speaking), reading, and writing of English, and (3) in the history and culture of the country, territory, or geographic area which is the native land of the parents of English learners who are enrolled in the program and in the history and culture of the United States; or a part-time program of instruction based on the educational needs of those English learners who do not need a full-time program of instruction. See Illinois Compiled Statutes 105 ILCS 5/14C-2
  • property: means anything of value. See Illinois Compiled Statutes 720 ILCS 5/15-1
  • Property owner: means the legal or beneficial owner of an improved or unimproved parcel of real estate. See Illinois Compiled Statutes 65 ILCS 5/11-19.2-1
  • Public or community service: means
  •     
    uncompensated labor for a not-for-profit organization or public body whose purpose is to enhance physical or mental stability of the offender, environmental quality or the social welfare and which agrees to accept public or community service from offenders and to report on the progress of the offender and the public or community service to the court or to the authorized diversion program that has referred the offender for public or community service. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • public utility: when used in this Division 117, means and includes any plant, equipment, or property, and any franchise, license, or permit, used or to be used (1) for or in connection with the transportation of persons or property, or the conveyance of telegraph or telephone messages; or (2) for the production, storage, transmission, sale, delivery, or furnishing of cold, heat, light, power, water, or for the conveyance of oil or gas by pipe lines; or (3) for the storage or warehousing of goods; or (4) for the conduct of the business of a wharfinger. See Illinois Compiled Statutes 720 ILCS 5/18-2
  • Purchase: includes taking by sale, lease,
  •     
    mortgage, security interest, pledge, gift, or any other voluntary transaction creating an interest in goods. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Qualified practitioner: means a certified public accountant who is licensed to practice in Illinois and who has completed the certification program. See Illinois Compiled Statutes 720 ILCS 5/2-5
  • Real and present threat to the physical safety of any person or persons: as used in this Article , includes a threat to the community, person, persons or class of persons. See Illinois Compiled Statutes 725 ILCS 5/110-1
  • Refuse: means combustible trash, including, but not limited to, paper, cartons, boxes, barrels, wood, excelsior, tree branches, yard trimmings, wood furniture, bedding; noncombustible trash, including, but not limited to, metals, tin cans, metal furniture, dirt, small quantities of rock and pieces of concrete, glass, crockery, other mineral waste; street rubbish, including, but not limited to, street sweepings, dirt, leaves, catch-basin dirt, contents of litter receptacles, but refuse does not mean earth and wastes from building operations, nor shall it include solid wastes resulting from industrial processes and manufacturing operations such as food processing wastes, boiler-house cinders, lumber, scraps and shavings. See Illinois Compiled Statutes 65 ILCS 5/11-19-2
  • Respondent: means a property owner, waste hauler or other person charged with liability for an alleged code violation and the person to whom the notice of violation is directed. See Illinois Compiled Statutes 65 ILCS 5/11-19.2-1
  • Sanitation inspector: means a municipal employee authorized to issue citations for code violations and to conduct inspections of public or private real property in a municipality to determine if code violations exist. See Illinois Compiled Statutes 65 ILCS 5/11-19.2-1
  • School District: means any school district established under this Code. See Illinois Compiled Statutes 105 ILCS 5/14C-2
  • Seller: means a person who sells or contracts to
  •     
    sell goods. See Illinois Compiled Statutes 810 ILCS 5/2-103
  • Sentencing hearing: means a hearing to
  •     
    determine whether a minor should be adjudged a ward of the court, and to determine what sentence should be imposed on the minor. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Shelter: means the temporary care of a minor in
  •     
    physically unrestricting facilities pending court disposition or execution of court order for placement. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Site: means a not-for-profit organization,
  •     
    public body, church, charitable organization, or individual agreeing to accept community service from offenders and to report on the progress of ordered or required public or community service to the court or to the authorized diversion program that has referred the offender for public or community service. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Special Service Area: means a contiguous area within a municipality or county in which special governmental services are provided in addition to those services provided generally throughout the municipality or county, the cost of the special services to be paid from revenues collected from taxes levied or imposed upon property within that area. See Illinois Compiled Statutes 35 ILCS 200/20-120
  • Special Services: means all forms of services pertaining to the government and affairs of the municipality or county, including but not limited to weather modification and improvements permissible under Article 9 of the Illinois Municipal Code, and contracts for the supply of water as described in Section 11-124-1 of the Illinois Municipal Code which may be entered into by the municipality or by the county on behalf of a county service area. See Illinois Compiled Statutes 35 ILCS 200/20-120
  • State Board: means the State Board of Education. See Illinois Compiled Statutes 105 ILCS 5/14C-2

  • Station adjustment: means the informal or

  • stolen property: means property over which control has been obtained by theft. See Illinois Compiled Statutes 720 ILCS 5/15-6
  • Sublease: means a lease of goods the right to
  •     
    possession and use of which was acquired by the lessor as a lessee under an existing lease. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Substantial damage: means monetary damage greater than $100,000. See Illinois Compiled Statutes 720 ILCS 5/29D-10
  • subways: as used in this Division 121, includes all tunnels, entrances, exits, passageways, connections, approaches, inclines, elevators, stations, and other structures, equipment, appliances, or appurtenant property, appropriate to a system of such subways. See Illinois Compiled Statutes 720 ILCS 5/26-4
  • Succeeding Governor: means the Governor in office immediately after a Governor who appoints a late term appointee. See Illinois Compiled Statutes 720 ILCS 5/19-4
  • Supervising authority: means the Department of Juvenile Justice, probation supervisory authority, sheriff, superintendent of a juvenile detention center, or any other officer or agency charged with authorizing and supervising home detention. See Illinois Compiled Statutes 705 ILCS 405/5-7A-105
  • Supervising authority: means the Department of Corrections, the Department of Juvenile Justice, probation department, sheriff, superintendent of municipal house of corrections or any other officer or agency charged with authorizing and supervising electronic monitoring and home detention. See Illinois Compiled Statutes 730 ILCS 5/5-8A-2
  • Supplier: means a person from whom a lessor buys
  •     
    or leases goods to be leased under a finance lease. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Supply contract: means a contract under which a

    lessor buys or leases goods to be leased. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Surviving spouse: means "widow" or "widower" as the case may be. See Illinois Compiled Statutes 5 ILCS 70/1.32
  • sworn: shall be construed to include the word "affirmed. See Illinois Compiled Statutes 5 ILCS 70/1.12
  • Teacher of transitional bilingual education: means a teacher with a speaking and reading ability in a language other than English in which transitional bilingual education is offered and with communicative skills in English. See Illinois Compiled Statutes 105 ILCS 5/14C-2
  • threat: means a menace, however communicated, to:
         (a) Inflict physical harm on the person threatened or any other person or on property; or
         (b) Subject any person to physical confinement or restraint; or
         (c) Commit any criminal offense; or
         (d) Accuse any person of a criminal offense; or
         (e) Expose any person to hatred, contempt or ridicule; or
         (f) Harm the credit or business repute of any person; or
         (g) Reveal any information sought to be concealed by the person threatened; or
         (h) Take action as an official against anyone or anything, or withhold official action, or cause such action or withholding; or
         (i) Bring about or continue a strike, boycott or other similar collective action if the property is not demanded or received for the benefit of the group which he purports to represent; or
         (j) Testify or provide information or withhold testimony or information with respect to another's legal claim or defense; or
         (k) Inflict any other harm which would not benefit the offender. See Illinois Compiled Statutes 720 ILCS 5/15-5
  • Trial: means a hearing to determine whether the
  •     
    allegations of a petition under Section 5-520 that a minor is delinquent are proved beyond a reasonable doubt. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Unimproved land: means woodlands, prairie, wetlands, or other vacant and undeveloped land that is not used for any residential or commercial purpose that materially disturbs the land. See Illinois Compiled Statutes 720 ILCS 5/12-6.4
  • Unlawful death: includes the following offenses: under the Code of 1961 or the Criminal Code of 2012: Sections 9-1 (first degree murder) or 9-2 (second degree murder). See Illinois Compiled Statutes 720 ILCS 5/33G-3
  • utility: as used in this Division 123 means and includes: (1) harbors, canals, slips, wharves, docks, levees, piers, quay walls, breakwaters, and all appropriate harbor structures, facilities, connections, and improvements; and (2) such elevators, vaults, warehouses, including cold storage warehouses which may be acquired, owned, maintained, or operated in connection therewith, as necessary adjuncts or incidental to transportation or railroad terminals; and (3) all other necessary or appropriate terminal facilities. See Illinois Compiled Statutes 720 ILCS 5/29A-2
  • Waste hauler: means any person owning or controlling any vehicle used to carry or transport garbage, refuse or other forms of solid waste. See Illinois Compiled Statutes 65 ILCS 5/11-19.2-1
  • waterworks: as used in this Division 130, means and includes a waterworks system in its entirety or any integral part thereof, including mains, hydrants, meters, valves, standpipes, storage tanks, pumping tanks, intakes, wells, impounding reservoirs, or purification plants. See Illinois Compiled Statutes 720 ILCS 5/33F-2
