Terms Used In Kansas Statutes 47-1014

  • Commissioner: means the animal health commissioner of the Kansas department of agriculture. See Kansas Statutes 47-1001
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Person: means and includes any individual, partnership, corporation or association. See Kansas Statutes 47-1001

In addition to the remedies provided under Kan. Stat. Ann. § 47-1001 et seq., and amendments thereto, the commissioner is hereby authorized to apply to the district court for an injunction restraining any person from violating any provision of Kan. Stat. Ann. § 47-1001 et seq., and amendments thereto. Such court, upon a showing of cause therefore, shall have jurisdiction to grant such injunction irrespective of whether or not there exists an adequate remedy at law.
