Terms Used In Kansas Statutes 65-34,111
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Secretary: means the secretary of health and environment. See Kansas Statutes 65-3402
The secretary may deny any license applied for, or suspend or revoke any license issued, pursuant to Kan. Stat. Ann. § 65-34,110 if the secretary finds, after notice and the opportunity for a hearing conducted in accordance with the provisions of the Kansas administrative procedure act, that the applicant or licensee, whichever is applicable, has:
(a) Fraudulently or deceptively obtained or attempted to obtain a license;
(b) failed at any time to meet the qualifications for a license or to comply with any provision or requirement of this act or of any rule and regulation adopted thereunder; or
(c) failed to comply with local requirements of any jurisdiction within which the licensee has installed, repaired or removed an underground storage tank.
