Terms Used In Louisiana Revised Statutes 30:2287

  • Discharge: means discharge as defined in Louisiana Revised Statutes 30:2272
  • Disposal: means disposal as defined in Louisiana Revised Statutes 30:2272
  • Person: means any individual, municipality, public or private corporation, partnership, firm, the United States Government, and any agent or subdivision thereof or any other juridical person, which shall include, but not be limited to, trusts, joint stock companies, associations, the state of Louisiana, political subdivisions of the state of Louisiana, commissions, and interstate bodies. See Louisiana Revised Statutes 30:2004
  • Secretary: means the secretary of the Department of Environmental Quality. See Louisiana Revised Statutes 30:2004

Persons specified in La. Rev. Stat. 30:2288 or La. Rev. Stat. 30:2288.1(C) shall not be liable for aggravating or contributing to any discharge or disposal or threatened discharge or disposal identified in an approved voluntary remedial action plan for the purpose of La. Rev. Stat. 30:2289(1) as a result of their performance of the remedial actions required in accordance with the plan and the direction of the secretary.  Nothing in this Part relieves a person of any liability for failure to perform the work required by the voluntary remedial action plan in a workman-like manner and in accordance with generally accepted standards of performance and operation applicable to such remedial work.
