Terms Used In Louisiana Revised Statutes 32:412.2

  • Department: means the Department of Public Safety and Corrections. See Louisiana Revised Statutes 32:401
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.

A.  A veteran of service in the United States Armed Forces shall be exempt from the payment of fees under this Chapter for the issuance of a driver’s license or a special identification card, issued pursuant to La. Rev. Stat. 40:1321, if the veteran meets all of the following qualifications:

(1)  Was honorably discharged.

(2)  Has a service-related disability of at least fifty percent.

(3)  Receives compensation from the United States government because of such disability.

(4)  Is not subject to the registration requirements of Chapter 3-B of Title 15 of the Louisiana Revised Statutes of 1950.

B.  The provisions of this Section shall not apply to the fee imposed by La. Rev. Stat. 32:668(B)(1)(a)(i).

C.  The department shall adopt rules relative to the proof of entitlement to such exemption and any other rules as may be necessary to implement the provisions of this Section.
