Terms Used In Louisiana Revised Statutes 47:463.161

  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Department: means the Louisiana Department of Transportation and Development, acting directly through its duly authorized officers and agents, or whatever state board, official, or body may hereafter be authorized by law to exercise the functions now devolving upon it under the law.   • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Motor vehicle: means every vehicle, as herein defined, which is self propelled. See Louisiana Revised Statutes 47:451
  • Vehicle: means every device in, upon, or by which any person, property, or thing is or may be transported or drawn upon a public highway excepting devices moved by human power or used exclusively upon stationary rails or tracks; provided, that for the purpose of this Chapter, a bicycle or a ridden animal shall not be deemed a vehicle, and provided further that a trailer or semitrailer shall be held and deemed each to be and constitute a separate vehicle. A.  The secretary of the Department of Public Safety and Corrections shall establish a special prestige motor vehicle license plate to be known as the “Louisiana Cultural Economy Foundation” plate, provided there is a minimum of one thousand applicants for such plate.  These license plates shall be restricted to use on passenger cars, pickup trucks, recreational vehicles, and vans.

B.  The license plate color and design shall be selected by the Board of Directors of the Louisiana Cultural Economy Foundation, a nonprofit corporation qualified as tax exempt pursuant to Section 501(c)(3) of the Internal Revenue Code, provided it is in compliance with La. Rev. Stat. 47:463(A)(3) and shall bear the words “Louisiana Cultural Economy Foundation”.

C.  The prestige license plate shall be issued, upon application, to any citizen of Louisiana in the same manner as any other motor vehicle license plate.

D.  The department shall collect an annual royalty fee of twenty-five dollars, which shall be disbursed in accordance with Subsection E of this Section.  This fee shall be in addition to the standard motor vehicle license tax imposed by La. Const. Art. VII, § 5 , and a handling fee of three dollars and fifty cents for each plate to be retained by the department to offset a portion of administrative costs.

E.  The annual royalty fee shall be collected by the department and forwarded to the Louisiana Cultural Economy Foundation, to be used solely for administrative and operational purposes, including but not limited to the lease or purchase of supplies and equipment for programming, production, and the marketing needs of the foundation.

F.  The secretary shall adopt rules and regulations as are necessary to implement the provisions of this Section.
