  • Arrest: Taking physical custody of a person by lawful authority.
  • Autocycle: means a 3-wheeled motorcycle that has a steering wheel or handlebars, floor pedals for automotive-style controls and seating that does not require the operator to straddle or sit astride a seat and that:

  • Automobile: means a motor vehicle designed for the conveyance of passengers that has a seating capacity of not more than 15 persons, including the operator. See Maine Revised Statutes Title 29-A Sec. 101
  • Bicycle: means a device primarily propelled by human power, operated by a person usually seated on a seat and driven on the ground on wheels by the operator. See Maine Revised Statutes Title 29-A Sec. 101
  • Bureau: means the Bureau of Motor Vehicles. See Maine Revised Statutes Title 29-A Sec. 101
  • Bus: means a motor vehicle designed for carrying more than 15 persons, including the operator. See Maine Revised Statutes Title 29-A Sec. 101
  • Business or residential district: means the part of a municipality, contiguous to a way, that is built up with structures that are situated less than 150 feet apart for a distance of at least 1/4 of a mile. See Maine Revised Statutes Title 29-A Sec. 101
  • Camp trailer: includes a manufactured or homemade tent trailer, so called, that consists of a platform, shelf or box with means of permanently or temporarily attaching a tent. See Maine Revised Statutes Title 29-A Sec. 101
  • Combination vehicle: means a motor vehicle consisting of a truck or truck tractor in combination with one or more trailers or semitrailers. See Maine Revised Statutes Title 29-A Sec. 101
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Crosswalk: means the portion of a way:

  • Curb: means the edge of a sidewalk nearest to a way or either edge of the wrought or usually traveled part of a way. See Maine Revised Statutes Title 29-A Sec. 101
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Department: means the Department of Transportation. See Maine Revised Statutes Title 29-A Sec. 101
  • Electric bicycle: means a 2-wheel or 3-wheel bicycle with fully operable pedals and an electric motor of less than 750 watts that is a Class 1 electric bicycle, a Class 2 electric bicycle or a Class 3 electric bicycle as defined in this subsection. See Maine Revised Statutes Title 29-A Sec. 101
  • Electric personal assistive mobility device: means a self-balancing, 2-nontandem-wheeled device, designed to transport only one person, with an electric propulsion system that limits the maximum speed of the device to 15 miles per hour or less. See Maine Revised Statutes Title 29-A Sec. 101
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Farming: means engaging in farming in all its branches and the cultivation and tillage of the soil as a livelihood and includes dairying; raising livestock, equines not raised for racing at a commercial track, freshwater fish, fur-bearing animals or poultry; producing, cultivating, growing and harvesting fruit, produce or floricultural or horticultural commodities; or any practices on a farm that are incident to or in conjunction with these farming operations.   • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Hazardous material: means any material that has been designated as hazardous under 49 United States Code §§ 5101 to 5127 (2003) and is required to be placarded under Title 49 of the Code of Federal Regulations, Part 172, Subpart F or any quantity of material listed as a select agent or toxin in Title 42 of the Code of Federal Regulations, Part 73.   • highway: means a public way. See Maine Revised Statutes Title 29-A Sec. 101
  • in writing: include printing and other modes of making legible words. See Maine Revised Statutes Title 1 Sec. 72
  • Intersection: means :

  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Law enforcement officer: means a person who by virtue of public employment is vested by law with a duty to maintain public order or to make arrests for crimes, whether that duty extends to all crimes or is limited to specific crimes. See Maine Revised Statutes Title 29-A Sec. 101
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • License: includes , but is not limited to, a nonresident operating privilege and the privilege of a person to apply for or obtain a license or permit to operate a motor vehicle. See Maine Revised Statutes Title 29-A Sec. 101
  • Limousine: means a vehicle for hire, with a driver, that is used for the transportation of passengers and that has a seating capacity of at least 5 and no more than 14 persons behind the driver. See Maine Revised Statutes Title 29-A Sec. 101
  • Low-speed vehicle: means a 4-wheeled motor vehicle that is able to attain a speed of at least 20 miles per hour but not more than 25 miles per hour and is less than 3,000 pounds in unloaded weight. See Maine Revised Statutes Title 29-A Sec. 101
  • Moped: means a motorized device designed to travel with only 2 or 3 10-inch or larger diameter wheels in contact with the ground and that:

  • Motor carrier: means a contract carrier, a common carrier or a private carrier of property or passengers by motor vehicle. See Maine Revised Statutes Title 29-A Sec. 101
  • Motor vehicle: means a self-propelled vehicle not operated exclusively on railroad tracks, but does not include:

  • Motorcycle: means a motor vehicle that has a seat or a saddle for the use of the rider and is designed to travel with only 2 or 3 10-inch or larger diameter wheels in ground contact and has a motor with a cylinder capacity of more than 50 cubic centimeters or an electric motor with a capacity of not less than 1,500 watts.   • Motorized bicycle or tricycle: means a bicycle or tricycle that:

  • Motorized scooter: means a scooter that has 2 or 3 wheels less than 10 inches in diameter in ground contact or is powered by a motor having a maximum piston displacement of less than 25 cubic centimeters or an electric motor with a capacity not exceeding 750 watts.   • Motorized wheelchair: means a battery-powered device used exclusively for the transportation of an individual with a physical disability. See Maine Revised Statutes Title 29-A Sec. 101
  • Municipal officers: means the mayor and municipal officers or councilors of a city, the members of the select board or councilors of a town and the assessors of a plantation. See Maine Revised Statutes Title 1 Sec. 72
  • Municipality: includes cities, towns and plantations, except that "municipality" does not include plantations in Title 10, chapter 110, subchapter IV; or Title 30?A, Part 2. See Maine Revised Statutes Title 1 Sec. 72
  • Nighttime: means a time other than daytime. See Maine Revised Statutes Title 29-A Sec. 101
  • Off-road vehicle: means a motor vehicle that, because of the vehicle's design, configuration, original manufacture or original intended use, does not meet the inspection standards of chapter 15, the Federal Motor Vehicle Safety Standards, the United States Environmental Protection Agency's pollutant requirements or the National Highway Traffic and Safety Administration's crash testing standards and that is not a moped or motorcycle.   • Operator: means an individual who drives or is in control of a vehicle or who is exercising control over or steering a towed vehicle. See Maine Revised Statutes Title 29-A Sec. 101
  • Owner: means a person holding title to a vehicle or having exclusive right to the use of the vehicle for a period of 30 days or more. See Maine Revised Statutes Title 29-A Sec. 101
  • Parking area: means an area designed for use as access or parking for patrons and customers of establishments to which the public is invited. See Maine Revised Statutes Title 29-A Sec. 101
  • Pedestrian: means a person on foot or an operator of a wheelchair or a 4-wheeled or 3-wheeled motorized wheelchair. See Maine Revised Statutes Title 29-A Sec. 101
  • Person: means an individual, corporation, firm, partnership, joint venture, association, fiduciary, trust, estate or any other legal or commercial entity. See Maine Revised Statutes Title 29-A Sec. 101
  • Pickup truck: means a truck with a registered gross vehicle weight of 10,000 pounds or less. See Maine Revised Statutes Title 29-A Sec. 101
  • Private way: means a way privately owned and maintained over which the owner may restrict use or passage and includes a discontinued way even if a public recreation easement has been reserved. See Maine Revised Statutes Title 29-A Sec. 101
  • Public way: means a way, owned and maintained by the State, a county or a municipality, over which the general public has a right to pass. See Maine Revised Statutes Title 29-A Sec. 101
  • Recess: A temporary interruption of the legislative business.
  • Registered weight: means the gross vehicle weight specified on the vehicle's registration certificate. See Maine Revised Statutes Title 29-A Sec. 101
  • Registration: means the registration certificate, plates and renewal devices pertaining to the registration of a vehicle, including temporary registered gross weight increases. See Maine Revised Statutes Title 29-A Sec. 101
  • Rotary: means a type of circular intersection with a large diameter and straight entries in which traffic circulates counterclockwise around a center traffic island. See Maine Revised Statutes Title 29-A Sec. 101
  • Roundabout: includes a mini-roundabout with a traversable island. See Maine Revised Statutes Title 29-A Sec. 101
  • School zone: means the portion of the public highway abutting improved school property or 300 feet on either side of a school entrance, whichever is greater, or as designated under section 2075, subsection 3, paragraph F. See Maine Revised Statutes Title 29-A Sec. 101
  • Scooter: means a device upon which a person may ride, consisting of a footboard between 2 end wheels, controlled by an upright steering handle attached to the front wheel and propelled by human power. See Maine Revised Statutes Title 29-A Sec. 101
  • Semitrailer: includes , but is not limited to, so-called pole dollies and pole dickeys and wheels commonly used as a support for the ends of logs or other long articles. See Maine Revised Statutes Title 29-A Sec. 101
  • Summons: Another word for subpoena used by the criminal justice system.
  • Tank vehicle: means a commercial motor vehicle that is designed to transport liquid or gaseous materials within a tank or tanks having an individual rated capacity of more than 119 gallons and an aggregated rated capacity of 1,000 gallons or more that is either permanently or temporarily attached to the vehicle or the chassis.   • Taxicab: means a sedan, station wagon or minivan used for hire, with a driver, that has a seating capacity of fewer than 5 persons behind the driver. See Maine Revised Statutes Title 29-A Sec. 101
  • Tiny home: means a living space permanently constructed on a frame or chassis and designed for use as permanent living quarters that:

  • Town: includes cities and plantations, unless otherwise expressed or implied. See Maine Revised Statutes Title 1 Sec. 72
  • Traffic: means pedestrians, ridden or herded animals, vehicles, bicycles and other conveyances either singly or together using public way for travel. See Maine Revised Statutes Title 29-A Sec. 101
  • Traffic control device: means a sign, a signal, a marking or a device placed or erected by a public body or official to regulate, warn or guide traffic. See Maine Revised Statutes Title 29-A Sec. 101
  • Traffic infraction: means any violation of any provision of this Title, or of any rules established under this Title, not expressly defined as a crime or as a civil violation and otherwise not punishable by incarceration. See Maine Revised Statutes Title 29-A Sec. 101
  • Trailer: means a vehicle without motive power, designed to carry persons or property and to be drawn by a motor vehicle, not operated on railroad tracks, and so constructed that no part of its weight rests upon the towing vehicle. See Maine Revised Statutes Title 29-A Sec. 101
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Trolley trailer: means a trailer equipped with permanent seats that face forward, are parallel to each other and have devices at each end to prevent a passenger from falling from the trailer when it is in motion. See Maine Revised Statutes Title 29-A Sec. 101
  • Truck: means a motor vehicle designed and used primarily to carry property. See Maine Revised Statutes Title 29-A Sec. 101
  • United States: includes territories and the District of Columbia. See Maine Revised Statutes Title 1 Sec. 72
  • Vehicle: means a device for conveyance of persons or property on a way. See Maine Revised Statutes Title 29-A Sec. 101
  • Way: means the entire width between boundary lines of a road, highway, parkway, street or bridge used for vehicular traffic, whether public or private. See Maine Revised Statutes Title 29-A Sec. 101
  • Wrecker: means a motor vehicle with hoisting apparatus and special equipment designed and used for towing or carrying wrecked or disabled vehicles or freeing vehicles stalled or stuck in snow, mud or sand, when such a motor vehicle in fact is being used for one of those purposes.   • Year: means a calendar year, unless otherwise expressed. See Maine Revised Statutes Title 1 Sec. 72
