  • Abuse: means the occurrence of the following acts:

  • Adult: means a person who is 18 years of age or older. See Maine Revised Statutes Title 19-A Sec. 101
  • Adult: means a person 18 years of age or older or a person under 18 years of age who is emancipated pursuant to Title 15, section 3506?A. See Maine Revised Statutes Title 19-A Sec. 4102
  • Adult education: means education programs primarily operated for individuals beyond the compulsory school ages and administered by school administrative units. See Maine Revised Statutes Title 20-A Sec. 1
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • Agent: means an individual appointed to serve in the capacity of a superintendent. See Maine Revised Statutes Title 20-A Sec. 1
  • Allegation: something that someone says happened.
  • Allocated parental rights and responsibilities: means that responsibilities for the various aspects of a child's welfare are divided between the parents, with the parent allocated a particular responsibility having the right to control that aspect of the child's welfare. See Maine Revised Statutes Title 19-A Sec. 1501
  • Allocation year: means the year that subsidy is distributed to school administrative units. See Maine Revised Statutes Title 20-A Sec. 15672
  • Alternative education program: means a program in which the primary purpose is to provide at-risk students with curricula and assessment in a setting designed to effectively meet the student's academic, social and relational needs. See Maine Revised Statutes Title 20-A Sec. 1
  • Alternative learning: means an educational option that a public school or publicly supported program offers at-risk students by offering some combination of the following: alternative education programs; small class size; flexible scheduling; relevant alternative curricula and assessment; mentoring adults; skilled teachers; a focus on social, emotional and relationship skills; collaboration among home, school and social service agencies; and any other measures designed to accommodate the needs of at-risk students.   • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Approved private school: means a private school approved for attendance purposes under chapter 117. See Maine Revised Statutes Title 20-A Sec. 1
  • Arrest: Taking physical custody of a person by lawful authority.
  • Associated equipment: means any mechanical, electromechanical or electronic component part or machine that is used, or intended for use, in a slot machine or table game and that affects the outcome of the game or that is involved in the handling of money, tokens, credits or similar objects or things of value used to play a slot machine or table game or the calculation of or distribution of payoffs of the slot machine or table game.   • At-risk student: means a student who:

  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • Base year: means the 2nd year prior to the allocation year. See Maine Revised Statutes Title 20-A Sec. 15672
  • Basic support entitlement: means the sum derived from the child support table appropriate for each child and the parties' gross income. See Maine Revised Statutes Title 19-A Sec. 2001
  • Board: means a bureau, board or commission listed in Title 10, section 8001 or 8001?A, other licensor that is affiliated with or is a part of the Department of Professional and Financial Regulation, the Board of Overseers of the Bar or any other state agency or municipality that issues a license authorizing a person to engage in a business, occupation, profession or industry and any state agency, bureau, board, commission or municipality that issues a license or permit to hunt, fish, operate a boat, operate a snowmobile, operate an ATV or engage in any other sporting or recreational activity.   • Board: means the Gambling Control Board established under section 1002. See Maine Revised Statutes Title 8 Sec. 1001
  • Board of directors: means the governing body with statutory powers and duties for a school administrative district. See Maine Revised Statutes Title 20-A Sec. 1
  • Budget authority: Authority provided by law to enter into obligations that will result in outlays of Federal funds. Budget authority may be classified by the period of availability (one-year, multiyear, no-year), by the timing of congressional action (current or permanent), or by the manner of determining the amount available (definite or indefinite).
  • Bus purchase costs: includes expenditures for bus purchase payments approved by the commissioner and made during the year prior to the allocation year. See Maine Revised Statutes Title 20-A Sec. 15672
  • Casino: means a facility licensed in accordance with this chapter, where gambling activities occur, including, but not limited to, the operation of slot machines and table games. See Maine Revised Statutes Title 8 Sec. 1001
  • Casino operator: means a person who is licensed under this chapter to operate a casino. See Maine Revised Statutes Title 8 Sec. 1001
  • Child: means a son or daughter under 21 years of age or a son or daughter who is incapable of earning a living and without sufficient means. See Maine Revised Statutes Title 19-A Sec. 3501
  • Child care costs: means the actual child care costs incurred by the parties for each child for whom support is being established that are related to that party's employment, education or training and are reasonable or customary in the area in which that party resides. See Maine Revised Statutes Title 19-A Sec. 2001
  • Child or children: means a person who has not attained the age of 18 years. See Maine Revised Statutes Title 1 Sec. 72
  • Child support: means money paid directly to a parent, to another person or agency awarded parental rights and responsibilities with respect to a child or to the department on behalf of a child receiving public assistance and medical or dental insurance coverage provided on behalf of a child pursuant to court order. See Maine Revised Statutes Title 19-A Sec. 1501
  • Child support table: means the schedule that has been adopted by the department under section 2011. See Maine Revised Statutes Title 19-A Sec. 2001
  • Clerical staff: means full-time equivalent public school secretaries, as documented in the department's database. See Maine Revised Statutes Title 20-A Sec. 15672
  • Commissioner: means the Commissioner of Health and Human Services, a designee or an authorized representative. See Maine Revised Statutes Title 19-A Sec. 101
  • Commissioner: means the Commissioner of Education or the commissioner's designee. See Maine Revised Statutes Title 20-A Sec. 1
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Community school district: means a state-approved unit of school administration composed of more than one municipality or school administrative district which may provide public education for any combination of kindergarten through grade 12. See Maine Revised Statutes Title 20-A Sec. 1
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contract: A legal written agreement that becomes binding when signed.
  • Control: means the power to exercise authority over or direct the management or policies of a person. See Maine Revised Statutes Title 8 Sec. 1001
  • Conviction: A judgement of guilt against a criminal defendant.
  • Cooperative board: means the governing body with statutory powers and duties for a career and technical education region. See Maine Revised Statutes Title 20-A Sec. 1
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Cost of private health insurance: means the cost of adding the child to existing coverage or the difference between self-only and family coverage, unless that cost is determined to be unjust by a court or the Department of Health and Human Services.   • Counterclaim: A claim that a defendant makes against a plaintiff.
  • Courses of study: means the courses of study for the elementary and secondary schools that are in alignment with the system of learning results as established in section 6209 and consistent with the requirements of this Title. See Maine Revised Statutes Title 20-A Sec. 1
  • Court: means a District Court and, with regard to section 4113, the tribal court of the Passamaquoddy Tribe or the Penobscot Nation. See Maine Revised Statutes Title 19-A Sec. 4102
  • Dam: means any human-made artificial barrier, including appurtenant works, the site on which it is located and appurtenant rights of flowage and access, that impounds or diverts a river, stream or great pond and that is 2 feet or more in height and has an impounding capacity at maximum water storage elevation of 15 acre-feet or more. See Maine Revised Statutes Title 38 Sec. 817
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Dating partners: means individuals currently or formerly involved in dating each other, whether or not the individuals are or were sexual partners. See Maine Revised Statutes Title 19-A Sec. 4102
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Department: means the Department of Health and Human Services and its agents and authorized representatives. See Maine Revised Statutes Title 19-A Sec. 101
  • Department: means the Department of Public Safety. See Maine Revised Statutes Title 8 Sec. 1001
  • Dependent: A person dependent for support upon another.
  • Dependent child: means any minor child who is not emancipated. See Maine Revised Statutes Title 19-A Sec. 2101
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • Distribute: means to sell, lease, license, place or otherwise make available for use in the State or to transport into the State for the purpose of selling, leasing, licensing, placing or otherwise making available for use in the State. See Maine Revised Statutes Title 8 Sec. 1001
  • District board of trustees: means a body with statutory powers and duties for a community school district. See Maine Revised Statutes Title 20-A Sec. 1
  • District school committee: means the governing body with statutory powers and duties for a community school district. See Maine Revised Statutes Title 20-A Sec. 1
  • Domestic abuse: means abuse as defined in section 4002. See Maine Revised Statutes Title 19-A Sec. 1501
  • domestic partners: means 2 unmarried adults who are domiciled together under long-term arrangements that evidence a commitment to remain responsible indefinitely for each other's welfare. See Maine Revised Statutes Title 19-A Sec. 4102
  • Earnings: means compensation paid or payable for personal services, whether denominated as wages, salary, commission, bonus or otherwise, and specifically includes periodic payments pursuant to pension or retirement programs, or insurance policies of any type, and all gain derived from capital, from labor or from both combined, including profit gained through sale or conversion of capital assets, and unemployment compensation benefits and workers' compensation benefits.   • Economic abuse: means causing or attempting to cause an individual to be financially dependent by maintaining control over the individual's financial resources, including, but not limited to, unauthorized or coerced use of credit or property, withholding access to money or credit cards, forbidding attendance at school or employment, stealing from or defrauding an individual of money or assets, exploiting the individual's resources for personal gain of the defendant or withholding physical resources such as food, clothing, necessary medications or shelter.   • Economically disadvantaged students: means students who are included in the department's count of students who are eligible for free or reduced-price meals or free milk or both. See Maine Revised Statutes Title 20-A Sec. 15672
  • Education technician: means a full-time equivalent public teacher aide or education technician I, associate teacher or education technician II or assistant teacher or education technician III but not a special education technician I, II or III, as documented in the department's database.   • Elementary free or reduced-price meals percentage: means the percentage, as determined by the commissioner, that reflects either:

  • Elementary grades: means public preschool programs to grade 8. See Maine Revised Statutes Title 20-A Sec. 15672
  • Elementary school: means that portion of a school that provides instruction in any combination of kindergarten through grade 8. See Maine Revised Statutes Title 20-A Sec. 1
  • Elementary school level: means the grades from public preschool programs to grade 5. See Maine Revised Statutes Title 20-A Sec. 15672
  • Elementary student: means a student enrolled in an elementary school. See Maine Revised Statutes Title 20-A Sec. 1
  • English learner: means a student who has a primary or home language other than English, as determined by a language use survey developed by the department; who is not yet proficient in English, as determined by a state-approved English language proficiency assessment; and who satisfies the definition of an English learner under the federal Elementary and Secondary Education Act of 1965, as amended, 20 United States Code, Chapter 70.   • Enhanced support entitlement: means the basic support entitlement multiplied by a factor of 1. See Maine Revised Statutes Title 19-A Sec. 2001
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • EPS per-pupil rate: means the rate calculated under section 15676 or 15676?A, as applicable. See Maine Revised Statutes Title 20-A Sec. 15672
  • Essential programs and services: means those educational resources that are identified in this chapter that enable all students to meet the standards in the 8 content standard subject areas and goals of the system of learning results established in chapter 222. See Maine Revised Statutes Title 20-A Sec. 15672
  • Ex officio: Literally, by virtue of one's office.
  • Extraordinary medical expenses: means recurring, uninsured medical expenses in excess of $250 per child or group of children per calendar year that can reasonably be predicted by the court or hearing officer at the time of establishment or modification of a support order.   • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • Family or household members: means :

  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Gifted and talented costs: means the cost of programs for gifted and talented students that have been approved by the commissioner. See Maine Revised Statutes Title 20-A Sec. 15672
  • Grandparent: includes a parent of a child's parent whose parental rights have been terminated pursuant to Title 18?C, section 9?204 or Title 22, chapter 1071, subchapter 6, but only until the child's adoption. See Maine Revised Statutes Title 19-A Sec. 1802
  • Gross income: means gross income of a party as follows. See Maine Revised Statutes Title 19-A Sec. 2001
  • Gross slot machine income: means the total value of money, tokens, credits or similar objects or things of value used to actually play a slot machine before payback is distributed to a player. See Maine Revised Statutes Title 8 Sec. 1001
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Guidance staff: means full-time equivalent public guidance counselors, directors of guidance or school social workers, as documented in the department's database. See Maine Revised Statutes Title 20-A Sec. 15672
  • Health staff: means full-time equivalent public school nurses, as documented in the department's database. See Maine Revised Statutes Title 20-A Sec. 15672
  • Height: means , in reference to a dam, the vertical distance in feet from the natural bed of the stream or watercourse measured at the downstream toe of the barrier, or from the lowest elevation of the outside limit of the barrier, if it is not across a stream channel or watercourse, to the maximum capable water storage elevation.   • High school level: means grade 9 to grade 12. See Maine Revised Statutes Title 20-A Sec. 15672
  • Homeless student: means a person eligible to attend elementary or secondary school pursuant to section 5201 who:

  • In forma pauperis: In the manner of a pauper. Permission given to a person to sue without payment of court fees on claim of indigence or poverty.
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Institutional resident: means a person between 5 years of age and 20 years of age who is attending a public school of the school administrative unit and who is committed or otherwise legally admitted to and residing at a state-operated institution.   • Kindergarten: means a one-year or 2-year childhood education program, for children at least 5 years of age, immediately prior to grade one. See Maine Revised Statutes Title 20-A Sec. 1
  • Kindergarten: means kindergarten or a prekindergarten early education program for students who are at least 4 years of age on October 15th of the school year. See Maine Revised Statutes Title 20-A Sec. 15672
  • lands: includes lands and all tenements and hereditaments connected therewith, and all rights thereto and interests therein. See Maine Revised Statutes Title 1 Sec. 72
  • Law enforcement agency: means a state, county, tribal, municipal or University of Maine System law enforcement agency. See Maine Revised Statutes Title 19-A Sec. 4102
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Librarian: means a full-time equivalent public librarian or media specialist, as documented in the department's database. See Maine Revised Statutes Title 20-A Sec. 15672
  • License: means a license issued by the board under this chapter. See Maine Revised Statutes Title 8 Sec. 1001
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Littoral proprietor: means an owner or lessee of property on the shore of a lake impounded by a particular dam. See Maine Revised Statutes Title 38 Sec. 817
  • Major capital costs: means costs relating to school construction projects, as defined in section 15901. See Maine Revised Statutes Title 20-A Sec. 15672
  • Media assistant: means a full-time equivalent public librarian aide or library technician I, librarian assistant or library technician II or librarian associate or library technician III, as documented in the department's database. See Maine Revised Statutes Title 20-A Sec. 15672
  • Medical support: means an amount ordered to be paid toward the cost of health insurance provided by a public entity or by another parent through employment or otherwise or for other medical costs not covered by insurance. See Maine Revised Statutes Title 19-A Sec. 1501
  • Membership: means active participation in the program of a school from the date of enrollment to the time the student withdraws or is absent from the school for 10 consecutive days for reasons other than illness. See Maine Revised Statutes Title 20-A Sec. 15001
  • Middle school level: means grade 6 to grade 8. See Maine Revised Statutes Title 20-A Sec. 15672
  • Minor capital costs: means costs relating to plant maintenance, minor remodeling, site development or the purchase of land not in conjunction with a construction project. See Maine Revised Statutes Title 20-A Sec. 15672
  • minor child: means a person who has not attained the age of 18 years. See Maine Revised Statutes Title 19-A Sec. 101
  • Month: means a calendar month. See Maine Revised Statutes Title 1 Sec. 72
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Mortgagee: The person to whom property is mortgaged and who has loaned the money.
  • Mortgagor: The person who pledges property to a creditor as collateral for a loan and who receives the money.
  • Municipal officers: means the mayor and municipal officers or councilors of a city, the members of the select board or councilors of a town and the assessors of a plantation. See Maine Revised Statutes Title 1 Sec. 72
  • Municipal school unit: means a state-approved unit of school administration composed of a single municipality. See Maine Revised Statutes Title 20-A Sec. 1
  • Municipality: includes cities, towns and plantations, except that "municipality" does not include plantations in Title 10, chapter 110, subchapter IV; or Title 30?A, Part 2. See Maine Revised Statutes Title 1 Sec. 72
  • Municipality: means a city, town or organized plantation. See Maine Revised Statutes Title 20-A Sec. 15672
  • mutual order of protection or restraint: means an order that is granted to the defendant under this chapter or the inclusion of language in an order granted to a plaintiff in an action under this chapter that restricts or limits the plaintiff's conduct with regard to the defendant absent the filing of a separate complaint by the defendant, service of the summons and complaint on the plaintiff and a finding by the court that the plaintiff committed the abuse alleged in the complaint.   • Net slot machine income: means money, tokens, credits or similar objects or things of value used to play a slot machine minus money, credits or prizes paid out to winners and amounts paid pursuant to section 1036, subsection 1. See Maine Revised Statutes Title 8 Sec. 1001
  • Net table game income: means money, tokens, credits or similar objects or things of value used to play a table game minus money, credits or prizes paid out to winners. See Maine Revised Statutes Title 8 Sec. 1001
  • Newly incurred capital outlay and debt service: means capital outlay and debt service costs for a school construction project approved for funding by the voters on or after June 1, 1998. See Maine Revised Statutes Title 20-A Sec. 1
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Obligee: means any person to whom a duty of support is owed. See Maine Revised Statutes Title 19-A Sec. 101
  • Obligor: means any person owing a duty of support. See Maine Revised Statutes Title 19-A Sec. 101
  • Operate: means to offer for use. See Maine Revised Statutes Title 8 Sec. 1001
  • Order: means :

  • Other subsidizable costs: means those costs identified in section 15681?A. See Maine Revised Statutes Title 20-A Sec. 15672
  • Parent: means the legal parent or the legal guardian when no legal parent exists. See Maine Revised Statutes Title 19-A Sec. 101
  • Parent: means a parent, guardian or legal guardian. See Maine Revised Statutes Title 20-A Sec. 1
  • Parent: includes either a biological parent or an adoptive parent. See Maine Revised Statutes Title 19-A Sec. 3501
  • Parental support obligation: means the portion of total basic or enhanced support obligation a party is ordered to pay in money as child support. See Maine Revised Statutes Title 19-A Sec. 2001
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: means an individual, trust, estate, partnership, association, company, corporation, political subdivision of the State, instrumentality of the State or other entity. See Maine Revised Statutes Title 19-A Sec. 101
  • Person: means any individual, firm, association, partnership, corporation, trust, municipality, quasi-municipal corporation, state agency, federal agency or other legal entity. See Maine Revised Statutes Title 38 Sec. 817
  • Personal property: All property that is not real property.
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Predicted per-pupil transportation costs: means the greater of:

  • Previous education unit: means a state-approved unit of school administration that was responsible for operating or constructing public schools prior to the reorganization of school administrative units pursuant to chapter 103?A. See Maine Revised Statutes Title 20-A Sec. 1
  • Primary residence: means the residence of a child where that child receives residential care for more than 50% of the time on an annual basis if the parents do not provide substantially equal care as defined in subsection 8?A. See Maine Revised Statutes Title 19-A Sec. 2001
  • Primary residential care provider: means the party who provides residential care for a child for more than 50% of the time on an annual basis if the parents do not provide substantially equal care as defined in subsection 8?A. See Maine Revised Statutes Title 19-A Sec. 2001
  • Private health insurance: means fee-for-service, health maintenance organization, preferred provider organization and other types of coverage available to either parent under which medical services could be provided to a child. See Maine Revised Statutes Title 19-A Sec. 1501
  • Private school: means an academy, seminary, institute or other private corporation or body formed for educational purposes covering kindergarten through grade 12 or any portion thereof. See Maine Revised Statutes Title 20-A Sec. 1
  • Private school approved for tuition purposes: means a private school approved for the receipt of public funds under sections 2951 to 2955. See Maine Revised Statutes Title 20-A Sec. 1
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Property fiscal capacity: means the average of the certified state valuations for the 3 most recent years prior to the most recently certified state valuation or the certified state valuation for the most recent prior year, whichever is lower. See Maine Revised Statutes Title 20-A Sec. 15672
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Public assistance: means money payments and medical care furnished to or on behalf of dependent children by the State. See Maine Revised Statutes Title 19-A Sec. 2101
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Public preschool program: means a program offered by a public elementary school pursuant to chapter 203 that provides instruction to children who are 4 years of age, including but not limited to a Head Start program that is approved as a component of the public preschool program.   • Public school: means a school that is governed by a school board of a school administrative unit and funded primarily with public funds. See Maine Revised Statutes Title 20-A Sec. 1
  • Publicly supported secondary school: means :

  • Pupil: means elementary or secondary school student. See Maine Revised Statutes Title 20-A Sec. 15001
  • Real estate: includes lands and all tenements and hereditaments connected therewith, and all rights thereto and interests therein. See Maine Revised Statutes Title 1 Sec. 72
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Reasonable cost: means the cost of private health insurance to the parent responsible for providing medical support that does not exceed amounts adopted by the Department of Health and Human Services in a rule implementing a cost-reasonableness standard. See Maine Revised Statutes Title 19-A Sec. 1501
  • Regional school unit: means the state-approved unit of school administration as established pursuant to chapter 103?A. See Maine Revised Statutes Title 20-A Sec. 1
  • Regional school unit board: means the board of directors that is the governing body with statutory powers and duties of a regional school unit. See Maine Revised Statutes Title 20-A Sec. 1
  • Responsible parent: means the parent of a dependent child. See Maine Revised Statutes Title 19-A Sec. 2101
  • Riparian proprietor: means an owner or lessee of property on the bank of a river or stream or shore of a pond or other small body of water impounded by a particular dam. See Maine Revised Statutes Title 38 Sec. 817
  • School administrative district: means a state-approved unit of school administration, composed of one or more municipalities which must provide public education to all public school students in the district. See Maine Revised Statutes Title 20-A Sec. 1
  • School administrative staff: means full-time equivalent public school principals and assistant principals, as documented in the department's database. See Maine Revised Statutes Title 20-A Sec. 15672
  • School administrative unit: means the state-approved unit of school administration and includes a municipal school unit, school administrative district, community school district, regional school unit or any other municipal or quasi-municipal corporation responsible for operating or constructing public schools, except that it does not include a career and technical education region. See Maine Revised Statutes Title 20-A Sec. 1
  • School administrative unit: means a school administrative unit as defined by section 1, subsection 26, paragraphs A to G. See Maine Revised Statutes Title 20-A Sec. 15672
  • School board: means the governing body with statutory powers and duties for a school administrative unit. See Maine Revised Statutes Title 20-A Sec. 1
  • School committee: means the governing body with statutory powers and duties for a municipal school unit. See Maine Revised Statutes Title 20-A Sec. 1
  • School level: means elementary level, middle school level and high school level. See Maine Revised Statutes Title 20-A Sec. 15672
  • School level teaching staff: means full-time equivalent public classroom teachers, itinerant classroom teachers and special teachers of reading or literacy specialists excluding special education teachers and career and technical education teachers, as documented in the department's database. See Maine Revised Statutes Title 20-A Sec. 15672
  • School union: means a union composed of school administrative units joined for the purpose of providing joint administrative services, including a joint superintendent. See Maine Revised Statutes Title 20-A Sec. 1
  • Secondary grades: means grade 9 to grade 12. See Maine Revised Statutes Title 20-A Sec. 15672
  • Secondary school: means that portion of a school that provides instruction in any combination of grades 9 through 12. See Maine Revised Statutes Title 20-A Sec. 1
  • Secondary student: means a student enrolled in a secondary school. See Maine Revised Statutes Title 20-A Sec. 1
  • Service of process: The service of writs or summonses to the appropriate party.
  • Shared parental rights and responsibilities: means that most or all aspects of a child's welfare remain the joint responsibility and right of both parents, so that both parents retain equal parental rights and responsibilities, and both parents confer and make joint decisions regarding the child's welfare. See Maine Revised Statutes Title 19-A Sec. 1501
  • Slot machine: means any mechanical, electrical or electronic device, contrivance or machine or other device, contrivance or machine that is available to play upon insertion of money or a token, credit or similar object or thing of value, the play of which by the element of chance may deliver or entitle the person playing the device, contrivance or machine to receive cash, tokens or credits to be exchanged for cash, merchandise or anything of value, whether the payoff is made automatically from the device, contrivance or machine or in any other manner, and includes progressive electronic gaming devices with a payoff that increases as the electronic gaming device is played.   • Slot machine facility: means a facility, not including a casino, at which a slot machine operator operates slot machines. See Maine Revised Statutes Title 8 Sec. 1001
  • Slot machine operator: means a person, not including a casino operator, who is licensed under this chapter to operate slot machines and associated equipment in the State. See Maine Revised Statutes Title 8 Sec. 1001
  • Social media: means an electronic medium or service through which users create, share and view user-generated content, including, but not limited to, videos, still photographs, blogs, video blogs, podcasts, instant and text messages, e-mail, online service accounts and Internet website profiles and locations. See Maine Revised Statutes Title 19-A Sec. 4102
  • Sole parental rights and responsibilities: means that one parent is granted exclusive parental rights and responsibilities with respect to all aspects of a child's welfare, with the possible exception of the right and responsibility for support. See Maine Revised Statutes Title 19-A Sec. 1501
  • special education tuition and board: means :
    (1) Tuition and board for pupils placed directly by the State in accordance with rules adopted or amended by the commissioner; and
    (2) Special education tuition and other tuition for institutional residents of state-operated institutions attending programs in school administrative units or private schools in accordance with rules adopted or amended by the commissioner. See Maine Revised Statutes Title 20-A Sec. 15672
  • Special school district: means a school district created by private and special law for the purpose of constructing or adding to school buildings, but which does not have the authority or responsibility for operating public schools. See Maine Revised Statutes Title 20-A Sec. 1
  • state: means any state, territory or possession of the United States, the Commonwealth of Puerto Rico and the District of Columbia. See Maine Revised Statutes Title 19-A Sec. 101
  • State agency client: means a child with a disability who is 3 years of age or older and under 22 years of age who requires an individualized education program in order to access a free, appropriate public education and who is:

  • State board: means the State Board of Education. See Maine Revised Statutes Title 20-A Sec. 1
  • State share percentage: means the percentage of the state contribution determined under section 15688, subsection 3?A, paragraph D divided by the total cost determined in section 15688, subsection 1. See Maine Revised Statutes Title 20-A Sec. 15672
  • State subsidy: means the total of the state contribution determined under section 15688, subsection 3?A, paragraph D and any applicable adjustment under section 15689. See Maine Revised Statutes Title 20-A Sec. 15672
  • State valuation: means the value certified to the Secretary of State as provided in Title 36, section 305, subsection 1. See Maine Revised Statutes Title 20-A Sec. 1
  • State-operated institution: means any residential facility or institution that is operated by the Department of Health and Human Services or a school operated by the Department of Education. See Maine Revised Statutes Title 20-A Sec. 15672
  • Statute: A law passed by a legislature.
  • Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
  • Subdistrict: means a geographic area which is a subdivision of a school administrative district for election purposes. See Maine Revised Statutes Title 20-A Sec. 1
  • Subpoena: A command to a witness to appear and give testimony.
  • Subsidizable costs: includes the costs described in paragraphs A to C and used to calculate the total allocation amount:

  • Subsidizable pupils: means all school level pupils who reside in a school administrative unit and who are educated at public expense at a public school or at a private school approved for tuition purposes. See Maine Revised Statutes Title 20-A Sec. 15672
  • Substantially equal care: means that both parents participate substantially equally in the child's total care, which may include, but is not limited to, the child's residential, educational, recreational, child care and medical, dental and mental health care needs. See Maine Revised Statutes Title 19-A Sec. 2001
  • Sufficient existing relationship: means a relationship involving extraordinary contact between a grandparent and a child, including but not limited to circumstances in which the grandparent has been a primary caregiver and custodian of the child for a significant period of time. See Maine Revised Statutes Title 19-A Sec. 1802
  • Summons: Another word for subpoena used by the criminal justice system.
  • Superintendent: means the person in a school administrative unit or school union appointed and having the authority and responsibility under this Title and other applicable statutes. See Maine Revised Statutes Title 20-A Sec. 1
  • Support guidelines: means the child support table and the criteria for application of the table set forth in section 2006. See Maine Revised Statutes Title 19-A Sec. 2001
  • Support order: means a judgment, decree or order, whether temporary, final or subject to modification, issued by a court or an administrative agency of competent jurisdiction for the support and maintenance of a child, including a child who has attained the age of majority under the law of the issuing state, or a child and the parent with whom the child is living, that provides for monetary support, health care, arrearages or reimbursement and may include related costs and fees, interest and penalties, income withholding, attorney's fees and other relief. See Maine Revised Statutes Title 19-A Sec. 2101
  • Table game: means a card game, dice game or other game of chance, including, but not limited to, blackjack, poker, dice, craps, roulette, baccarat, money wheels, wheel of fortune or an electronic table game located in a casino. See Maine Revised Statutes Title 8 Sec. 1001
  • Testify: Answer questions in court.
  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • Total allocation: means the total of the operating allocation as described in section 15683 and the debt service allocation as described in section 15683?A. See Maine Revised Statutes Title 20-A Sec. 15672
  • Total basic support obligation: means the sum of money determined by adding the basic support entitlement, child care costs, extraordinary medical expenses and health insurance premiums. See Maine Revised Statutes Title 19-A Sec. 2001
  • Total cost of the components of essential programs and services: means the total of the following components:

  • Total enhanced support obligation: means the sum of money determined by calculating the enhanced support entitlement. See Maine Revised Statutes Title 19-A Sec. 2001
  • Town: includes cities and plantations, unless otherwise expressed or implied. See Maine Revised Statutes Title 1 Sec. 72
  • Transportation operating costs: means all costs incurred in the transportation of pupils in kindergarten to grade 12, including lease costs for bus garage and maintenance facilities and lease-purchase costs that the school administrative unit may apply to the purchase of bus garage and maintenance facilities, when the leases and lease-purchase agreements have been approved by the commissioner, but excluding the costs of bus purchases and excluding all costs not associated with transporting students from home to school and back home each day.   • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Trustee: A person or institution holding and administering property in trust.
  • Union committee: means the governing body with statutory powers and duties for a school union. See Maine Revised Statutes Title 20-A Sec. 1
  • Venue: The geographical location in which a case is tried.
  • Verdict: The decision of a petit jury or a judge.
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
  • Year: means a fiscal year starting July 1st and ending June 30th of the succeeding year. See Maine Revised Statutes Title 20-A Sec. 15672
  • Year of funding: means the fiscal year during which state subsidies are disbursed to school administrative units, except as specified in section 15005, subsection 1. See Maine Revised Statutes Title 20-A Sec. 15672
