Terms Used In Maine Revised Statutes > Title 7 > Part 2 > Chapter 105 - Payment of Dues

  • Adjudication: means a finding by a court that a person has committed a traffic infraction and includes the acceptance by the clerk of the violations bureau or any judicial division of an answer of not contested. See Maine Revised Statutes Title 29-A Sec. 101
  • Affordable housing: means decent, safe and sanitary dwellings, apartments or other living accommodations for low-income and moderate-income households. See Maine Revised Statutes Title 30-A Sec. 5002
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Antique auto: means an automobile or truck manufactured in or after model year 1916 that is:

  • Antique motorcycle: means a motorcycle or a motor-driven cycle that is:

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Authority: means the Maine State Housing Authority. See Maine Revised Statutes Title 30-A Sec. 4991
  • Automobile: means a motor vehicle designed for the conveyance of passengers that has a seating capacity of not more than 15 persons, including the operator. See Maine Revised Statutes Title 29-A Sec. 101
  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Bicycle: means a device primarily propelled by human power, operated by a person usually seated on a seat and driven on the ground on wheels by the operator. See Maine Revised Statutes Title 29-A Sec. 101
  • Bureau: means the Bureau of Motor Vehicles. See Maine Revised Statutes Title 29-A Sec. 101
  • Camp trailer: includes a manufactured or homemade tent trailer, so called, that consists of a platform, shelf or box with means of permanently or temporarily attaching a tent. See Maine Revised Statutes Title 29-A Sec. 101
  • Catalytic converter: means a device installed in the exhaust system of a motor vehicle that uses a catalyst to convert pollutant gases into less harmful gases. See Maine Revised Statutes Title 29-A Sec. 101
  • Certificate: means the certificate of an insurance company or a surety company authorized to transact business in this State under Title 24-A that certifies that the company has issued a motor vehicle liability policy covering the vehicle involved in the accident.   • Commercial motor vehicle: means a motor vehicle or combination of motor vehicles used in commerce to transport passengers or property if the motor vehicle:

  • Conviction: A judgement of guilt against a criminal defendant.
  • Conviction: means conviction, adjudication or judgment, and includes but is not limited to a forfeiture of bail or collateral deposited to secure a defendant's appearance in court, on a charge of violating a motor vehicle law that has not been vacated. See Maine Revised Statutes Title 29-A Sec. 1551
  • Council: means the Statewide Homeless Council. See Maine Revised Statutes Title 30-A Sec. 5002
  • Customer: means a person, including, but not limited to, an agent, who contracts with a repair facility for repair of a motor vehicle. See Maine Revised Statutes Title 29-A Sec. 1801
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Department: means the Department of Transportation. See Maine Revised Statutes Title 29-A Sec. 101
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • Elderly: means a person or family as defined in the United States Housing Act of 1937, Public Law 75-412, 50 Stat. See Maine Revised Statutes Title 30-A Sec. 4702
  • Executor: A male person named in a will to carry out the decedent
  • Fair share fee: means a fee deducted by a dealer or processor from a producer who is not an association member. See Maine Revised Statutes Title 7 Sec. 1091-A
  • Federal Government: means the United States of America or any agency or instrumentality, corporate or otherwise, of the United States of America. See Maine Revised Statutes Title 30-A Sec. 2001
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Fish truck: means a 2-axle or 3-axle motor truck used primarily to harvest and transport fish or marine animals, including use in aquaculture. See Maine Revised Statutes Title 29-A Sec. 101
  • Flat rate: means a method of calculating charges for labor that is based on the specific repair done and not on the amount of time actually spent on that repair. See Maine Revised Statutes Title 29-A Sec. 1801
  • For-hire transportation: means the transportation for compensation of passengers, freight or merchandise not owned by the carrier. See Maine Revised Statutes Title 29-A Sec. 101
  • Fuel assistance: means assistance paid to eligible households or to fuel vendors on behalf of an eligible household or directly to eligible tenants who pay heating costs as an undesignated portion of rent. See Maine Revised Statutes Title 30-A Sec. 4991
  • Grantee: means the person to whom a freehold estate or interest in land is conveyed. See Maine Revised Statutes Title 1 Sec. 72
  • Grantor: The person who establishes a trust and places property into it.
  • Grantor: means the person who conveys a freehold estate or interest in land. See Maine Revised Statutes Title 1 Sec. 72
  • Gross weight: means the weight in pounds of an empty vehicle or axle plus the weight of the maximum load to be carried by the vehicle or axle. See Maine Revised Statutes Title 29-A Sec. 101

  • Insurance identification card: means an identification of insurance in paper or electronic form issued to an insured by an insurer pursuant to Title 24-A, section 2412, subsection 7; or an identification of proof of financial responsibility in paper or electronic form issued by the Secretary of State to a person who elects to provide proof of financial responsibility in accordance with section 1605.   • Judgment: means a judgment that has become final without appeal by expiration of the time within which appeal might have been perfected, or by final affirmance on appeal, rendered by a court of competent jurisdiction of any state or of the United States.   • Law enforcement officer: means a person who by virtue of public employment is vested by law with a duty to maintain public order or to make arrests for crimes, whether that duty extends to all crimes or is limited to specific crimes. See Maine Revised Statutes Title 29-A Sec. 101
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • License: includes , but is not limited to, a nonresident operating privilege and the privilege of a person to apply for or obtain a license or permit to operate a motor vehicle. See Maine Revised Statutes Title 29-A Sec. 101
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Limousine: means a vehicle for hire, with a driver, that is used for the transportation of passengers and that has a seating capacity of at least 5 and no more than 14 persons behind the driver. See Maine Revised Statutes Title 29-A Sec. 101
  • Low-speed vehicle: means a 4-wheeled motor vehicle that is able to attain a speed of at least 20 miles per hour but not more than 25 miles per hour and is less than 3,000 pounds in unloaded weight. See Maine Revised Statutes Title 29-A Sec. 101
  • Lower income households: means low-income and very low-income households as defined by the United States Department of Housing and Urban Development under the United States Housing Act of 1937, Public Law 75-412, 50 Stat. See Maine Revised Statutes Title 30-A Sec. 5002
  • Minor: means a person who has not attained 18 years of age. See Maine Revised Statutes Title 29-A Sec. 101
  • Mobile telephone: means a device used to access a wireless telephone service. See Maine Revised Statutes Title 29-A Sec. 101
  • Moderate income households: means households in which gross income does not exceed 150% of the median income of the county or metropolitan statistical area in which the household is located. See Maine Revised Statutes Title 30-A Sec. 5002
  • Moped: means a motorized device designed to travel with only 2 or 3 10-inch or larger diameter wheels in contact with the ground and that:

  • Mortgagor: The person who pledges property to a creditor as collateral for a loan and who receives the money.

  • Motor vehicle: means a self-propelled vehicle not operated exclusively on railroad tracks, but does not include:

  • Motorcycle: means a motor vehicle that has a seat or a saddle for the use of the rider and is designed to travel with only 2 or 3 10-inch or larger diameter wheels in ground contact and has a motor with a cylinder capacity of more than 50 cubic centimeters or an electric motor with a capacity of not less than 1,500 watts.   • Motorized bicycle or tricycle: means a bicycle or tricycle that:

  • Operator: means an individual who drives or is in control of a vehicle or who is exercising control over or steering a towed vehicle. See Maine Revised Statutes Title 29-A Sec. 101
  • OUI: means operating under the influence of intoxicants or with an excessive alcohol level. See Maine Revised Statutes Title 29-A Sec. 1551
  • Owner: means a person holding title to a vehicle or having exclusive right to the use of the vehicle for a period of 30 days or more. See Maine Revised Statutes Title 29-A Sec. 101

  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Policy: means a motor vehicle liability insurance policy or motor vehicle liability bond. See Maine Revised Statutes Title 29-A Sec. 1551
  • Portable electronic device: means an electronic device that is portable in nature, including but not limited to a device for sending or receiving e-mail, a text messaging device, a mobile telephone and a computer. See Maine Revised Statutes Title 29-A Sec. 1551
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Public way: means a way, owned and maintained by the State, a county or a municipality, over which the general public has a right to pass. See Maine Revised Statutes Title 29-A Sec. 101
  • Registration: means the registration certificate, plates and renewal devices pertaining to the registration of a vehicle, including temporary registered gross weight increases. See Maine Revised Statutes Title 29-A Sec. 101
  • Repair: means the examination, maintenance, servicing, adjustment, improvement, replacement, removal or installation of a part of a motor vehicle, including, but not limited to, body work, painting and incidental services such as storage and towing, and excluding the sale of motor fuel. See Maine Revised Statutes Title 29-A Sec. 1801
  • Repair facility: means a motor vehicle repair facility offering services to the general public for compensation. See Maine Revised Statutes Title 29-A Sec. 1801
  • residence: refer to an individual's place of domicile. See Maine Revised Statutes Title 30-A Sec. 2001
  • Resident: means a person who has declared or established residency in this State or has been domiciled in this State for a period of at least 30 days, except for persons in compliance with section 109, subsection 1. See Maine Revised Statutes Title 29-A Sec. 101
  • Secretary of State: means the Secretary of State or the Secretary of State's deputy. See Maine Revised Statutes Title 29-A Sec. 1551
  • Sell: means to sell, offer, negotiate or advertise to sell, display for sale, exchange or otherwise transfer for value. See Maine Revised Statutes Title 29-A Sec. 101
  • Semitrailer: includes , but is not limited to, so-called pole dollies and pole dickeys and wheels commonly used as a support for the ends of logs or other long articles. See Maine Revised Statutes Title 29-A Sec. 101
  • Service of process: The service of writs or summonses to the appropriate party.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Shop supplies: means small parts and materials used or consumed in the process of repair, including, but not limited to, nuts and bolts, electrical wire, rags, tape, brake cleaners and other items maintained as inventory. See Maine Revised Statutes Title 29-A Sec. 1801
  • Special mobile equipment: includes , but is not limited to, road construction or maintenance machinery, ditch-digging apparatus, stone crushers, air compressors, power shovels, cranes, graders, rollers, trucks used only to plow snow and for other duties pertaining to winter maintenance, including sanding and salting, well drillers and wood-sawing equipment or similar types of equipment.   • State: means a state of the United States, the District of Columbia or a province of the Dominion of Canada. See Maine Revised Statutes Title 29-A Sec. 1551
  • state authority: means the Maine State Housing Authority. See Maine Revised Statutes Title 30-A Sec. 5002
  • Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
  • Street rod: means a replica of or a modified antique auto manufactured prior to 1949 that complies with standards adopted by the Chief of the State Police. See Maine Revised Statutes Title 29-A Sec. 101
  • Summons: Another word for subpoena used by the criminal justice system.
  • Taxicab: means a sedan, station wagon or minivan used for hire, with a driver, that has a seating capacity of fewer than 5 persons behind the driver. See Maine Revised Statutes Title 29-A Sec. 101
  • Text messaging: means reading or manually composing electronic communications, including text messages, instant messages and electronic mail, using a handheld electronic device. See Maine Revised Statutes Title 29-A Sec. 101
  • Tractor: means a motor vehicle used primarily off the highway for farming, forestry or other similar types of activities. See Maine Revised Statutes Title 29-A Sec. 101
  • Traffic: means pedestrians, ridden or herded animals, vehicles, bicycles and other conveyances either singly or together using public way for travel. See Maine Revised Statutes Title 29-A Sec. 101
  • Traffic infraction: means any violation of any provision of this Title, or of any rules established under this Title, not expressly defined as a crime or as a civil violation and otherwise not punishable by incarceration. See Maine Revised Statutes Title 29-A Sec. 101
  • Trailer: means a vehicle without motive power, designed to carry persons or property and to be drawn by a motor vehicle, not operated on railroad tracks, and so constructed that no part of its weight rests upon the towing vehicle. See Maine Revised Statutes Title 29-A Sec. 101
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Truck: means a motor vehicle designed and used primarily to carry property. See Maine Revised Statutes Title 29-A Sec. 101
  • Vehicle: means a device for conveyance of persons or property on a way. See Maine Revised Statutes Title 29-A Sec. 101
  • Way: means the entire width between boundary lines of a road, highway, parkway, street or bridge used for vehicular traffic, whether public or private. See Maine Revised Statutes Title 29-A Sec. 101
