  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Trustee: A person or institution holding and administering property in trust.
Within 30 days of the filing of the trustee disclosure with the court, the plaintiff or defendant shall be entitled to take trustee’s deposition on the issue of trustee’s chargeability upon such notice to the trustee as is required in taking depositions under court rules and upon the payment to the trustee of fees for travel and attendance.
