Terms Used In New Hampshire Revised Statutes > Chapter 176 - The Liquor Commission

  • Alcohol: means that substance known as ethyl alcohol or hydrated oxide of ethyl alcohol which is commonly produced by the fermentation or distillation of grain, starch, molasses, sugar, potatoes or other substances, including all solids, powders, crystals, dilutions and mixtures of these substances. See New Hampshire Revised Statutes 175:1
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Armed forces: means the United States Army, Army Reserve, Navy, Naval Reserve, Marine Corps, Marine Corps Reserve, Air Force, Air Force Reserve, Space Force, Coast Guard, Coast Guard Reserve, Army National Guard, and the Air National Guard. See New Hampshire Revised Statutes 21:50
  • Commission: means the state liquor commission. See New Hampshire Revised Statutes 175:1
  • Dependent: A person dependent for support upon another.
  • Designee: means a person designated in writing by the owner or operator of a business to hold the liquor license for that particular business. See New Hampshire Revised Statutes 175:1
  • Direct shipper: means any licensee outside the state of New Hampshire who accepts orders placed from New Hampshire, by mail, telephone, Internet, or any electronic or other means, for liquor or beverages and who ships, packages for shipment, or facilitates in any way shipment of said liquor or beverages by a licensed carrier to a New Hampshire location. See New Hampshire Revised Statutes 175:1
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • following: when used by way of reference to any section of these laws, shall mean the section next preceding or following that in which such reference is made, unless some other is expressly designated. See New Hampshire Revised Statutes 21:13
  • governor and council: shall mean the governor with the advice and consent of the council. See New Hampshire Revised Statutes 21:31-a
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • justice: when applied to a magistrate, shall mean a justice of a municipal court, or a justice of the peace having jurisdiction over the subject-matter. See New Hampshire Revised Statutes 21:12
  • License: means the authority granted by the commission to engage in the sale of liquor, wine, beverages, tobacco products, or e-cigarettes otherwise unlawful unless evidenced by such document. See New Hampshire Revised Statutes 175:1
  • Licensee: means the person to whom a license of any kind is issued by the commission. See New Hampshire Revised Statutes 175:1
  • Liquor: means all distilled and rectified spirits, alcohol, wines, fermented and malt liquors and cider, of over 6 percent alcoholic content by volume at 60 degrees Fahrenheit. See New Hampshire Revised Statutes 175:1
  • Liquor and wine representative: means a person who offers for sale or solicits orders for the sale of any liquor or wine or both. See New Hampshire Revised Statutes 175:1
  • Person: means an individual, partnership, limited liability company or corporation. See New Hampshire Revised Statutes 175:1
  • Quorum: The number of legislators that must be present to do business.
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Safekeeping: means a temporary voluntary surrender of the license privileges granted to a licensee, which provides for a moratorium on all licensing requirements under this title for that license type during the period of time the license is placed in safekeeping. See New Hampshire Revised Statutes 175:1
  • Sampling: means distributing free tobacco products to consumers for promotional purposes. See New Hampshire Revised Statutes 175:1
  • seal: shall include an impression of the official seal made upon the paper alone, as well as an impression thereof made by means of wax, or a wafer, affixed thereto. See New Hampshire Revised Statutes 21:11
  • state: when applied to different parts of the United States, may extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall include said district and territories. See New Hampshire Revised Statutes 21:4
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Tobacco products: means cigarettes, loose tobacco, and smokeless tobacco. See New Hampshire Revised Statutes 175:1
  • United States: shall include said district and territories. See New Hampshire Revised Statutes 21:4
  • Wine vendor: means an individual, partnership, limited liability company, or corporation, which sells table wine to the state, containing more than 6 percent but not more than 24 percent alcoholic content by volume at 60 degrees Fahrenheit. See New Hampshire Revised Statutes 175:1
