Terms Used In New Hampshire Revised Statutes > Chapter 357-E - Regulation of Manufacturers, Distributors and Dealers of New Trucks

  • Contract: A legal written agreement that becomes binding when signed.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Distributor: means any person who sells or distributes new trucks to truck dealers. See New Hampshire Revised Statutes 357-E:1
  • following: when used by way of reference to any section of these laws, shall mean the section next preceding or following that in which such reference is made, unless some other is expressly designated. See New Hampshire Revised Statutes 21:13
  • Manufacturer: means any person who manufactures or assembles new trucks or any partnership, firm, association, joint venture, corporation or trust, which is controlled by the manufacturer. See New Hampshire Revised Statutes 357-E:1
  • Motor vehicle: means any motor vehicle as defined by N. See New Hampshire Revised Statutes 357-E:1
  • New truck: means any truck which has been sold only to a truck dealer by a manufacturer or distributor for the sale of that make of truck, which is in fact new, and on which the original title has not been issued from such dealer. See New Hampshire Revised Statutes 357-E:1
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • person: may extend and be applied to bodies corporate and politic as well as to individuals. See New Hampshire Revised Statutes 21:9
  • Truck: means any motor vehicle with not more than 6 wheels which is intended, designed or constructed to carry not more than 2,000 pounds of freight or merchandise. See New Hampshire Revised Statutes 357-E:1
  • Truck dealer: means any person who:
    (a) Is in the business of selling, offering to sell, soliciting or advertising the sale of new trucks, either as his primary business or incidental thereto; and
    (b) Holds a valid sales and service agreement, franchise or contract, granted by the manufacturer or distributor for the sale of its new trucks. See New Hampshire Revised Statutes 357-E:1
