Terms Used In Rhode Island General Laws > Chapter 2-23.1 - Notification to Farmers

  • Acquittal:
    1. Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
    2. A verdict of "not guilty."
     
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Arrest: Taking physical custody of a person by lawful authority.
  • Bailee: means a person that by a warehouse receipt, bill of lading, or other document of title acknowledges possession of goods and contracts to deliver them. See Rhode Island General Laws 6A-7-102
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Court: means any appropriate district court of the state of Rhode Island. See Rhode Island General Laws 11-9-13.4
  • Dealer: is synonymous with the term "retail tobacco products dealer. See Rhode Island General Laws 11-9-13.4
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Department of taxation: means the state of Rhode Island taxation division, its employees, agents, or assigns. See Rhode Island General Laws 11-9-13.4
  • Dependent: A person dependent for support upon another.
  • Destructive or incendiary device or substance: means an explosive, article or device designed or adapted to cause physical harm to persons or property by means of fire, explosion, deflagration, or detonation and consisting of any substance capable of being ignited, whether or not contrived to ignite or explode automatically. See Rhode Island General Laws 11-13-10
  • e-liquid products: means any liquid or substance placed in or sold for use in an electronic nicotine-delivery system that generally utilizes a heating element that aerosolizes, vaporizes, or combusts a liquid or other substance containing nicotine or nicotine derivative:

    (i)  Whether the liquid or substance contains nicotine or a nicotine derivative; or

    (ii)  Whether sold separately or sold in combination with a personal vaporizer, electronic nicotine-delivery system, or an electronic inhaler. See Rhode Island General Laws 11-9-13.4

  • Electronic nicotine-delivery system: means an electronic device that may be used to simulate smoking in the delivery of nicotine or other substance to a person inhaling from the device, and includes, but is not limited to, an electronic cigarette, electronic cigar, electronic cigarillo, electronic little cigars, electronic pipe, or electronic hookah, "heat not burn products" e-liquids, e-liquid products, or any related device and any cartridge or other component of such device. See Rhode Island General Laws 11-9-13.4
  • Electronic nicotine-delivery system product: means any combination of electronic nicotine-delivery system and/or e-liquid and/or any derivative thereof, and/or any e-liquid container. See Rhode Island General Laws 11-9-13.4
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Explosive: means any chemical compound, mechanical mixture, or device that contains any oxidizing and combustible units, or other ingredients, in such proportions, quantities, or packing that ignition by fire, by friction, by concussion, by percussion, or by detonation of the compound, mixture, or device, or any part thereof, may cause an explosion; any chemical compound, mixture, or device, the primary or common purpose of which is to function by explosion; the term includes, but is not limited to, high and low explosives, black powder, smokeless powder, pellet powder, initiating explosives, detonators, safety fuses, squibs, detonating cord, igniter cord, igniters; and other materials that are classified as Division 1. See Rhode Island General Laws 11-13-10
  • Fiduciary: A trustee, executor, or administrator.
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Good faith: means honesty in fact and the observance of reasonable commercial standards of fair dealing. See Rhode Island General Laws 6A-7-102
  • Goods: means all things that are treated as movable for the purposes of a contract for storage or transportation. See Rhode Island General Laws 6A-7-102
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • in writing: include printing, engraving, lithographing, and photo-lithographing, and all other representations of words in letters of the usual form. See Rhode Island General Laws 43-3-16
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Juror: A person who is on the jury.
  • justice of the peace: include warden of the peace and the words "district court" include warden's court. See Rhode Island General Laws 43-3-14
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • License: is synonymous with the term "retail tobacco products dealer license" or "electronic nicotine-delivery system license" or any license issued under chapter 20 of Title 44 or chapter 1 of Title 23. See Rhode Island General Laws 11-9-13.4
  • License holder: is synonymous with the term "retail tobacco products dealer" or "electronic nicotine-delivery system license" or any licenses issued under chapter 20 of Title 44 or chapter 1 of Title 23. See Rhode Island General Laws 11-9-13.4
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Little cigars: means and includes any roll, made wholly or in part of tobacco, irrespective of size or shape, and irrespective of whether the tobacco is flavored, adulterated, or mixed with any other ingredient, where such roll has a wrapper or cover made of tobacco wrapped in leaf tobacco or any substance containing tobacco paper or any other material and where such roll has an integrated filter, except where such wrapper is wholly or in greater part made of tobacco and where such roll has an integrated filter and weighs over four (4) pounds per thousand (1,000).   • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Original bill: A bill which is drafted by a committee. It is introduced by the committee or subcommittee chairman after the committee votes to report it.
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: means any individual person, firm, fiduciary, partnership, trust, association, or corporation licensed as a retail dealer to sell tobacco products within the state. See Rhode Island General Laws 11-9-13.4
  • person: may be construed to extend to and include co-partnerships and bodies corporate and politic. See Rhode Island General Laws 43-3-6
  • Personal property: All property that is not real property.
  • Places: means to set or put in a particular space. See Rhode Island General Laws 11-13-10
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Pyrotechnic: means any commercially manufactured combustible or explosive composition or manufactured article designed and prepared for the purpose of producing an audible effect or a visible display including, but not limited to: (i) Fireworks, firecrackers; and (ii) Flares, fuses and torpedoes, so-called, and similar signaling devices. See Rhode Island General Laws 11-13-10
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • seal: shall be construed to include an impression of the seal made with or without the use of wax or wafer on the paper. See Rhode Island General Laws 43-3-15
  • Small-arms ammunition: means any shotgun, rifle, pistol, or revolver cartridge and cartridges for propellant-actuated power devices and industrial guns. See Rhode Island General Laws 11-13-10
  • Statute: A law passed by a legislature.
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • town: may be construed to include city; the words "town council" include city council; the words "town clerk" include city clerk; the words "ward clerk" include clerk of election district; the words "town treasurer" include city treasurer; and the words "town sergeant" include city sergeant. See Rhode Island General Laws 43-3-9

  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • underage individuals: means any individual under the age of twenty-one (21). See Rhode Island General Laws 11-9-13.4
  • United States: include the several states and the territories of the United States. See Rhode Island General Laws 43-3-8
  • Verdict: The decision of a petit jury or a judge.
