Terms Used In Rhode Island General Laws > Chapter 5-44 - Psychologists

  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Allegation: something that someone says happened.
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Associate director: means the associate director of the department of administration for planning. See Rhode Island General Laws 42-128.2-3
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Board: means the governing body of the corporation. See Rhode Island General Laws 42-133-3
  • Board: means the board of psychology established by § 5-44-3. See Rhode Island General Laws 5-44-1
  • Bonds: means bonds, notes (but only as provided in § 42-133-8(6)(e)), or other evidences of indebtedness of the corporation, all of which shall be in all events payable solely from and secured solely by such portion of the state's tobacco receipts as are sold to the corporation and pledged to secure the bonds, and issued pursuant to the authorizations contained in this chapter, all of which shall be issued under the name of or known as obligations of the corporation.   • Chairperson: means the chairperson of the housing resources commission. See Rhode Island General Laws 42-128.2-3
  • Commission: means the Persian Gulf War information and relief commission;

    (2)  "Director" means the director of the department of human services;

    (3)  "Department" means the department of human services;

    (4)  "Veteran" means a person who (i) was a resident of the state at the time of his or her induction into the armed forces of the United States or is currently a resident of the state, and (ii) served during the Persian Gulf War during Operation Desert Shield or Operation Desert Storm, as defined by the U.   • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Comprehensive plan: means a comprehensive plan adopted and approved by a city or town pursuant to chapters 22. See Rhode Island General Laws 42-128.2-3
  • Contract: A legal written agreement that becomes binding when signed.
  • Coordinating committee: means the Rhode Island housing resources coordinating committee established pursuant to § 42-128-2(2). See Rhode Island General Laws 42-128.3-4
  • Corporation: means the corporation authorized, created, and established pursuant to this chapter. See Rhode Island General Laws 42-133-3
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Council: means the state greenways council. See Rhode Island General Laws 42-125-3
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Department: means the Rhode Island department of health. See Rhode Island General Laws 5-44-1
  • Determination of probable consistency: means a determination by the associate director that an eligible affordable housing project appears to be consistent with applicable provisions of state plans pertaining to affordable housing development; a determination of probable consistency shall not be deemed to be a conclusive, final, or biding determination of conformity with such plans or with any specific requirements adopted pursuant to such plans.   • Direct light: means light emitting generally in a downward direction by a lamp, off a reflector or through a refractor of a lighting unit. See Rhode Island General Laws 42-136-3
  • Director: means the director of the secretary of state's first stop business information center;

    (2)  "Department" means the secretary of state's office;

    (3)  "License" means any certificate, permit or other evidence, by whatever name called, of a right or privilege to engage in any business activity, except occupational licenses;

    (4)  "Occupational license" means any certificate, permit or other evidence, by whatever name called, of a right or privilege to engage in a profession, occupation, or field of endeavor that is issued by an occupational licensing agency;

    (5)  "Occupational licensing agency" means any board, commission, committee, or other agency of this state that is established for the primary purpose of regulating the admission or conduct of persons in a particular profession, occupation, or field of endeavor, and is authorized to issue and revoke licenses.   • Director: means the director of the Rhode Island department of health. See Rhode Island General Laws 5-44-1
  • East Bay: means Bristol County, Newport County, and the city of East Providence. See Rhode Island General Laws 42-126-3
  • Education: means the academic program pursued by a person in obtaining a doctoral degree, that program to include formal course work, seminars, and practica. See Rhode Island General Laws 5-44-1
  • Eligible affordable housing project: means low or moderate income housing or housing development in which at least twenty-five percent (25%) of the dwelling units are low or moderate income housing whether built or operated by any public agency or any nonprofit organization or by any limited equity housing cooperative or any private developer, that is subsidized by a federal, state, or municipal government subsidy under any program to assist the construction or rehabilitation of housing affordable to low or moderate income households, as defined in the applicable federal or state statute, or local ordinance and that will remain affordable through a land lease and/or deed restriction for ninety-nine (99) years or such other period that is either agreed to by the applicant and town or prescribed by the federal, state, or municipal government subsidy program but that is not less than thirty (30) years from initial occupancy.   • Energy crisis: means a condition of danger to the health, safety, welfare, or economic well being of the citizens of this state due to existing or impending abnormal market disruptions as they relate to energy resources. See Rhode Island General Laws 42-60-3
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Escrow: means the escrow as that term is defined in the master settlement agreement. See Rhode Island General Laws 42-133-3
  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Escrow agent: means the escrow agent as that term is defined in the master settlement agreement. See Rhode Island General Laws 42-133-3
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Ex officio: Literally, by virtue of one's office.
  • Executor: A male person named in a will to carry out the decedent
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Forbearance: A means of handling a delinquent loan. A
  • Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
  • Fraud: Intentional deception resulting in injury to another.
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Glare: means direct light emitted by a lighting unit that causes reduced visibility of objects or momentary blindness. See Rhode Island General Laws 42-136-3
  • Grace period: The number of days you'll have to pay your bill for purchases in full without triggering a finance charge. Source: Federal Reserve
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Gulf War-related risk substance: means any environmental or chemical substance or condition which was present in the Persian Gulf region during and following the Persian Gulf War or which was present during hostilities in Southwest Asia subsequent to September 11, 2001, including, but not limited to, pesticides, chemical or biological warfare agents, vaccines, pyridostigmine bromide, infectious diseases, depleted uranium, oil well fires and smoke and petroleum products.   • Housing incentive district: means an overlay district adopted by a city or town pursuant to this chapter. See Rhode Island General Laws 42-128.3-4
  • Housing project of critical concern: means an eligible affordable housing project designated by the housing resources commission to be significant, in its operational stage, by its ability to advance affordable goals set forth in duly approved plans for affordable housing and to help alleviate affordable housing shortages in Rhode Island. See Rhode Island General Laws 42-128.2-3
  • Housing resources commission: means the housing resources commission established by chapter 128 of this title. See Rhode Island General Laws 42-128.2-3
  • in writing: include printing, engraving, lithographing, and photo-lithographing, and all other representations of words in letters of the usual form. See Rhode Island General Laws 43-3-16
  • Independent auditor: means the independent auditor as that term is defined in the master settlement agreement. See Rhode Island General Laws 42-133-3
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Joint committee: Committees including membership from both houses of teh legislature. Joint committees are usually established with narrow jurisdictions and normally lack authority to report legislation.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Lamp: means the component of a lighting unit that produces light. See Rhode Island General Laws 42-136-3
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Licensed psychologist: means a person who has been licensed for the practice of psychology under this chapter. See Rhode Island General Laws 5-44-1
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Light pollution: means a general sky glow caused by the scattering of artificial light in the atmosphere. See Rhode Island General Laws 42-136-3
  • Lighting unit: means a complete lighting unit, including a lamp or lamps together with the parts designed to distribute the light, to position and protect the lamps and to connect the lamps to the power supply. See Rhode Island General Laws 42-136-3
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Lumen: means a specific standard unit of measurement of luminous flux. See Rhode Island General Laws 42-136-3
  • Majority leader: see Floor Leaders
  • Master settlement agreement: means the settlement agreement and related documents entered into on November 23, 1998, by the state and the four (4) principal United States tobacco product manufacturers, as amended and supplemented. See Rhode Island General Laws 42-133-3
  • Minority leader: See Floor Leaders
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Mortgagee: The person to whom property is mortgaged and who has loaned the money.
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Office: means the first stop business information center. See Rhode Island General Laws 42-132-2
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Participating manufacturers: means the participating manufacturers as that term is defined in the master settlement agreement. See Rhode Island General Laws 42-133-3
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Permanent outdoor lighting unit: means any fixed lighting unit or system of lighting units that is outdoors and that is intended to be used for seven (7) days or longer. See Rhode Island General Laws 42-136-3
  • Person: means any natural person, company, corporation, partnership, or any type of business entity. See Rhode Island General Laws 42-128.2-3
  • person: may be construed to extend to and include co-partnerships and bodies corporate and politic. See Rhode Island General Laws 43-3-6
  • Personal property: All property that is not real property.
  • Practice of psychology: means the rendering of professional psychological services to individuals, groups, families, or any public or private organization for remuneration. See Rhode Island General Laws 5-44-1
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Psychologist: as used in this chapter means a licensed psychologist as defined in this section. See Rhode Island General Laws 5-44-1
  • Quorum: The number of legislators that must be present to do business.
  • real estate: may be construed to include lands, tenements, and hereditaments and rights thereto and interests therein. See Rhode Island General Laws 43-3-10
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Roadway lighting: means permanent outdoor lighting units that are specifically intended to illuminate roadways for automotive vehicles. See Rhode Island General Laws 42-136-3
  • School impact offset payments: means a payment to a city or town to help offset increased municipal costs of educating eligible students. See Rhode Island General Laws 42-128.3-4
  • seal: shall be construed to include an impression of the seal made with or without the use of wax or wafer on the paper. See Rhode Island General Laws 43-3-15
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • State: means the state of Rhode Island. See Rhode Island General Laws 42-133-3
  • State agency: means any office, department, board, commission, bureau, division, authority, public corporation, agency, or instrumentality of the state; the term "state agency" shall not be deemed to include any department, office, or agency of a city or town. See Rhode Island General Laws 42-128.2-3
  • Statewide planning: means the statewide planning program established by § 42-11-10. See Rhode Island General Laws 42-128.2-3
  • Statute: A law passed by a legislature.
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • town: may be construed to include city; the words "town council" include city council; the words "town clerk" include city clerk; the words "ward clerk" include clerk of election district; the words "town treasurer" include city treasurer; and the words "town sergeant" include city sergeant. See Rhode Island General Laws 43-3-9

  • Training: means the pre-professional or professional-supervised experience received by the person at the pre- or post-doctoral level, that experience to have been obtained in an internship, clinic, or other similar professional setting. See Rhode Island General Laws 5-44-1
  • Trustee: A person or institution holding and administering property in trust.
  • United States: include the several states and the territories of the United States. See Rhode Island General Laws 43-3-8
