Terms Used In South Dakota Codified Laws 34-20B-39
- Administer: to deliver a controlled drug or substance to the ultimate user or human research subject by injection, inhalation, or ingestion, or by any other means. See South Dakota Codified Laws 34-20B-1
- Department: the Department of Health created by chapter 1-43. See South Dakota Codified Laws 34-20B-1
- Dispense: to deliver a controlled drug or substance to the ultimate user or human research subject by or pursuant to the lawful order of a practitioner, including the prescribing, administering, packaging, labeling, or compounding necessary to prepare the substance for such delivery, and a dispenser is one who dispenses. - Prescribe: an order of a practitioner for a controlled drug or substance. See South Dakota Codified Laws 34-20B-1
Each registrant manufacturing, distributing, or dispensing controlled drugs and substances in Schedules I, II, III, or IV shall maintain complete and accurate records of all stocks of such drugs and substances on hand. Records and inventories shall contain such information as shall be provided by rules and regulations promulgated by the department. All records required under this section shall be kept for a period of at least two years. This section shall not apply to practitioners who lawfully prescribe or administer, but not otherwise dispense, controlled drugs and substances listed in Schedules II, III, or IV of this chapter.
