Terms Used In Tennessee Code > Title 7 > Chapter 51 - Miscellaneous Governmental and Proprietary Functions

  • Acceptance: means notification by an authorized officer or employee of the state that the work completed has been in accordance with the terms and conditions of the state contract. See Tennessee Code 12-4-502
  • Adult: means a person who has attained eighteen (18) years of age. See Tennessee Code 7-51-1401
  • Adult bookstore: means a business that offers, as its principal or predominate stock or trade, sexually oriented material, devices, or paraphernalia, whether determined by the total number of sexually oriented materials, devices or paraphernalia offered for sale or by the retail value of such materials, devices or paraphernalia, specified sexual activities, or any combination or form thereof, whether printed, filmed, recorded or live, and that restricts or purports to restrict admission to adults or to any class of adults. See Tennessee Code 7-51-1102
  • Adult cabaret: means a cabaret that features topless dancers, go-go dancers, exotic dancers, strippers, male or female impersonators, or similar entertainers. See Tennessee Code 7-51-1401
  • Adult cabaret: includes a commercial establishment that features entertainment of an erotic nature, including exotic dancers, strippers, male or female impersonators, or similar entertainers. See Tennessee Code 7-51-1102
  • Adult entertainment: means any exhibition of any adult-oriented motion picture, live performance, display or dance of any type, that has as a principal or predominant theme, emphasis, or portion of such performance, any actual or simulated performance of specified sexual activities or exhibition and viewing of specified anatomical areas, removal of articles of clothing or appearing unclothed, pantomime, modeling, or any other personal service offered customers. See Tennessee Code 7-51-1102
  • Adult motion picture theater: means an enclosed building with a capacity of fifty (50) or more persons regularly used for presenting material having as a dominant theme or presenting material distinguished or characterized by an emphasis on matter depicting, describing or relating to specified sexual activities or specified anatomical areas as defined in this section, for observation by patrons in the building. See Tennessee Code 7-51-1102
  • Adult-oriented establishment: includes , but is not limited to:

    1. "Adult book stores" means any corporation, partnership or business of any kind that has as its principal or predominant stock or trade, books, magazines or other periodicals and that offers, sells, provides or rents for a fee:
      1. Is available for viewing by patrons on the premises by means of the operation of movie machines or slide projectors. See Tennessee Code 7-51-1401
      2. Adult-oriented establishment: includes , but is not limited to, an adult bookstore, adult motion picture theater, adult mini-motion picture establishment, adult cabaret, escort agency, sexual encounter center, massage parlor, rap parlor, sauna. See Tennessee Code 7-51-1102
      3. Adventure tourism activities: means outdoor recreational opportunities such as equine and motorized trail riding, rappelling, road biking, rock climbing, hang gliding, spelunking, shooting sports, mountain biking, canoeing, paragliding, zip lining and other such activities. See Tennessee Code 11-25-104
      4. Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
      5. Agency: means any entity of the state government, as defined in §. See Tennessee Code 12-4-702
      6. Agriculture: means :
        1. The land, buildings and machinery used in the commercial production of farm products and nursery stock. See Tennessee Code 1-3-105
        2. Airport: means and includes any one (1) or more airports or heliports and related facilities of an airport authority or municipal airport, including, but not limited to, land and interests in land, facilities for storage of air and space craft, navigation and landing aids, taxiways, pads, aprons, control towers, passenger and cargo terminal buildings, hangars, administration and office buildings, garages, parking lots, and such other structures, facilities and improvements necessary or convenient to the development and maintenance of airports and heliports, and for the promotion and accommodation of air and space travel, commerce and navigation. See Tennessee Code 4-31-603
        3. Airport authority: means those airport authorities created pursuant to title 42, chapter 3 and those metropolitan airport authorities created pursuant to title 42, chapter 4. See Tennessee Code 4-31-603
        4. Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
        5. Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
        6. Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
        7. Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
        8. Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
        9. Appraisal: A determination of property value.
        10. Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
        11. Arraignment: A proceeding in which an individual who is accused of committing a crime is brought into court, told of the charges, and asked to plead guilty or not guilty.
        12. Arrest: Taking physical custody of a person by lawful authority.
        13. Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
        14. Association: means the Tennessee insurance guaranty association. See Tennessee Code 4-31-803
        15. Authority: means the Doe Mountain recreation authority. See Tennessee Code 11-25-104
        16. Authority: means the Tennessee local development authority, a public agency and instrumentality of the state, created by this chapter, or if such authority shall be abolished, the board, body, commission or agency succeeding to the principal functions thereof or to which the powers and duties granted or imposed upon the authority shall be given by law. See Tennessee Code 4-31-102
        17. Auxiliary container: means a bag, cup, bottle, can, device, eating or drinking utensil or tool, or other packaging, whether reusable or single use, which is:

          1. Made of cloth, paper, plastic, including foamed or expanded plastic, cardboard, corrugated material, aluminum, glass, post-consumer recycled material, or similar material or substrates, including coated, laminated, or multilayer substrates. See Tennessee Code 7-51-2001
          2. Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
          3. Bailiff: a court officer who enforces the rules of behavior in courtrooms.
          4. Bench trial: Trial without a jury in which a judge decides the facts.
          5. Bequest: Property gifted by will.
          6. Bestiality: means sexual activity, actual or simulated, between a human being and an animal. See Tennessee Code 7-51-1401
          7. Blighted: has the meaning ascribed to that term in title 13, Chapters 2 0 and 21. See Tennessee Code 7-51-1902
          8. Board: means the board of directors of the authority. See Tennessee Code 11-25-104
          9. Board: means the adult-oriented establishment board, or, if there is in existence in the county a massage registration board appointed by the county mayor, such board may be substituted for the board. See Tennessee Code 7-51-1102
          10. Bond: means any bond authorized and issued pursuant to this chapter. See Tennessee Code 4-31-102
          11. Bonds: means all bonds, notes or other obligations issued by the authority under this part. See Tennessee Code 4-31-803
          12. Business: means a business organization in any form, institution, association, profession, occupation or calling of any kind, whether or not conducted for profit. See Tennessee Code 12-4-702
          13. Business owned by persons with disabilities: means a business owned by a person with a disability that is a continuing, independent, for-profit business that performs a commercially useful function, and is at least fifty-one percent (51%) owned and controlled by one (1) or more persons with a disability. See Tennessee Code 12-3-1102
          14. Capital improvement property: means any real or tangible property needed for a governmental purpose and having a useful life of one (1) year or more, and any real or tangible personal property with respect to which capital outlay notes can be legally authorized and issued by a municipality. See Tennessee Code 7-51-901
          15. Central procurement office: means the government agency established in §. See Tennessee Code 12-3-201
          16. Chief procurement officer: means the person holding the position established in §. See Tennessee Code 12-3-201
          17. claims: means a covered claim as defined in §. See Tennessee Code 4-31-803
          18. Clerk of court: An officer appointed by the court to work with the chief judge in overseeing the court's administration, especially to assist in managing the flow of cases through the court and to maintain court records.
          19. Code: includes the Tennessee Code and all amendments and revisions to the code and all additions and supplements to the code. See Tennessee Code 1-3-105
          20. Commission: means the procurement commission. See Tennessee Code 12-2-402
          21. Commission: means the prevailing wage commission. See Tennessee Code 12-4-402
          22. Commissioner: means the commissioner of general services. See Tennessee Code 12-2-402
          23. Commissioner: means the commissioner of mental health and substance abuse services when referenced in provisions relating to mental health facilities or centers and means the commissioner of intellectual and developmental disabilities when referenced in provisions relating to intellectual and developmental disabilities facilities or centers. See Tennessee Code 4-31-703
          24. Committee: means the state protest committee as established in §. See Tennessee Code 12-3-201
          25. Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
          26. Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
          27. Construction: means construction, acquisition, reconstruction, improvement, equipping, furnishing, bettering or extension of a facility, including paying engineering, fiscal, architectural and legal expenses incurred in connection therewith. See Tennessee Code 4-31-703
          28. Continuance: Putting off of a hearing ot trial until a later time.
          29. Contract: means any duly authorized and legally binding written agreement for the procurement of goods and services. See Tennessee Code 12-3-201
          30. Contract: A legal written agreement that becomes binding when signed.
          31. Contracting party: means any party to a contract, lease or lease-purchase agreement other than a municipality, and can include individuals, corporations, partnerships, other government agencies, and other business entities. See Tennessee Code 7-51-901
          32. Conviction: A judgement of guilt against a criminal defendant.
          33. Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
          34. Council: means the advisory council on state procurement established in §. See Tennessee Code 12-3-201
          35. County: means the county in this state in which Doe Mountain is located. See Tennessee Code 11-25-104
          36. County: as used in this part , means either a Class A county or a Class B county as classified in §. See Tennessee Code 7-51-1102
          37. County governing body: means that body in a particular county that is vested with the power to levy property taxes. See Tennessee Code 7-1-101
          38. County mayor: means and includes "county executive" unless the context clearly indicates otherwise. See Tennessee Code 1-3-105
          39. Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
          40. Data: means any recorded information, regardless of its form or characteristic. See Tennessee Code 12-3-201
          41. Decedent: A deceased person.
          42. Deed: The legal instrument used to transfer title in real property from one person to another.
          43. Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
          44. Department: means the department of general services. See Tennessee Code 12-3-1102
          45. Department: means the department of mental health and substance abuse services when referenced in provisions relating to mental health facilities or centers and means the department of intellectual and developmental disabilities when referenced in provisions relating to developmental disabilities facilities or centers. See Tennessee Code 4-31-703
          46. Dependent: A person dependent for support upon another.
          47. Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
          48. Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
          49. Docket: A log containing brief entries of court proceedings.
          50. Donee: The recipient of a gift.
          51. Donor: The person who makes a gift.
          52. Embezzlement: In most states, embezzlement is defined as theft/larceny of assets (money or property) by a person in a position of trust or responsibility over those assets. Embezzlement typically occurs in the employment and corporate settings. Source: OCC
          53. Employee: means a person who performs any service on the premises of an adult-oriented establishment on a full-time, part-time, or contract basis, whether or not the person is denominated an employee, independent contractor, agent or otherwise, and whether or not such person is paid a salary, wage, or other compensation by the operator of such business. See Tennessee Code 7-51-1102
          54. Energy efficiency standard: means a performance standard which prescribes the relationship of the energy use of a product to its useful output of services. See Tennessee Code 12-3-902
          55. Entertainer: means any person who provides entertainment within an "adult-oriented establishment" as defined in this section, whether or not a fee is charged or accepted for entertainment and whether or not entertainment is provided as an employee, escort or an independent contractor. See Tennessee Code 7-51-1102
          56. Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
          57. Escort: means a person who, for monetary consideration in the form of a fee, commission, salary or tip, dates, socializes, visits, consorts with, accompanies, or offers to date, socialize, visit, consort or accompany to social affairs, entertainment or places of amusement or within any place of public resort or within any private quarters of a place of public resort. See Tennessee Code 7-51-1102
          58. Escort service: means a "person" as defined in this section, who, for a fee, commission, profit, payment or other monetary consideration, furnishes or offers to furnish escorts or provides or offers to introduce patrons to escorts. See Tennessee Code 7-51-1102
          59. Escrow: Money given to a third party to be held for payment until certain conditions are met.
          60. Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
          61. Ex officio: Literally, by virtue of one's office.
          62. Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state.
          63. Facility: means "facility" as defined in §. See Tennessee Code 4-31-703
          64. Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
          65. Family recreation center: means any facility, which is oriented principally toward meeting the athletic or recreational needs of families and whose targeted customer is a minor child, including, but not limited to, the provision of one (1) or more of the following:

            1. Ice skating. See Tennessee Code 7-51-1401
            2. Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
            3. Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
            4. Forgery: The fraudulent signing or alteration of another's name to an instrument such as a deed, mortgage, or check. The intent of the forgery is to deceive or defraud. Source: OCC
            5. Fraud: Intentional deception resulting in injury to another.
            6. Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
            7. Goods: means all personal property, including, but not limited to, supplies, equipment, materials, printing, and insurance. See Tennessee Code 12-3-201
            8. Governing body: includes all bodies and boards, by whatsoever names they may be known, charged with the governing of a municipality. See Tennessee Code 12-2-301
            9. Governing body: means the legislative body of a county as defined in this chapter. See Tennessee Code 11-25-104
            10. Governing body: means the body in which the general legislative powers of a municipal corporation are vested, and in the case of counties means the legislative body of the respective counties. See Tennessee Code 12-10-103
            11. Governing body: means the board or body in which the general legislative powers of the municipality are vested. See Tennessee Code 7-51-901
            12. governmental entity: means any political subdivision of the state of Tennessee and any municipality, metropolitan government, county or airport authority. See Tennessee Code 7-51-1002
            13. Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage,
            14. Grant: means any grant awarded to the state or awarded by the state to any person to support a program authorized by law. See Tennessee Code 12-3-201
            15. Grantee: means a nonprofit, 26 U. See Tennessee Code 4-31-703
            16. Grantor: The person who establishes a trust and places property into it.
            17. Habeas corpus: A writ that is usually used to bring a prisoner before the court to determine the legality of his imprisonment. It may also be used to bring a person in custody before the court to give testimony, or to be prosecuted.
            18. Highway: includes public bridges and may be held equivalent to the words "county way" "county road" or "state road". See Tennessee Code 1-3-105
            19. Highway contractor: means any contractor, subcontractor, person, firm, or corporation engaged in a state construction project for the purpose of building, rebuilding, locating, relocating, or repairing any public highway. See Tennessee Code 12-4-402
            20. Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate.
            21. Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
            22. Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
            23. Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
            24. Insane: includes all persons of unsound mind. See Tennessee Code 1-3-105
            25. Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
            26. Invitation to bid: means all documents, whether attached or incorporated by reference, utilized for soliciting bids for the lowest cost, responsive and responsible bidder. See Tennessee Code 12-3-201
            27. Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
            28. Juror: A person who is on the jury.
            29. Lands: includes lands, tenements and hereditaments, and all rights thereto and interests therein, equitable as well as legal. See Tennessee Code 1-3-105
            30. Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.
            31. Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
            32. Legislative session: That part of a chamber's daily session in which it considers legislative business (bills, resolutions, and actions related thereto).
            33. Lessee: means any municipal corporation, the state of Tennessee, the United States, or any agency, authority, branch, bureau, commission, corporation, department or instrumentality thereof now or hereafter existing. See Tennessee Code 12-10-103
            34. Lien: A claim against real or personal property in satisfaction of a debt.
            35. Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
            36. Livestock: means all equine as well as animals that are being raised primarily for use as food or fiber for human utilization or consumption including, but not limited to, cattle, sheep, swine, goats, and poultry. See Tennessee Code 1-3-105
            37. Loan agreement: means an agreement providing for an authority to loan the proceeds derived from the issuance of bonds pursuant to this chapter to one (1) or more contracting parties to be used to pay the cost of one (1) or more projects and providing for the repayment of such loan by the other contracting party or parties, and which may provide for such loans to be secured by or evidenced by one (1) or more notes, debentures, bonds or other secured or unsecured debt obligations of the contracting party or parties, delivered to the authority or to the trustee under the indenture pursuant to which the bonds were issued. See Tennessee Code 12-10-103
            38. Loan agreement: means a contractual arrangement by and between an airport authority or a municipal airport and the authority and, in the discretion of the authority, the creating or participating municipality providing the guaranty, pursuant to and in accordance with this part. See Tennessee Code 4-31-603
            39. Local government: means a municipality, county or county having a metropolitan form of government. See Tennessee Code 7-51-1902
            40. Local government: means a county, municipality, or county with a metropolitan form of government. See Tennessee Code 7-51-2001
            41. Local government joint venture entity: means any entity created pursuant to this chapter, including, but not limited to, a self-insurance pool, trust, joint venture, nonprofit organization, or any other type of organization that is sponsored, owned, operated, or governed by two (2) or more local government entities as a separate and specific activity. See Tennessee Code 12-9-103
            42. Masochism: means sexual gratification achieved by a person through, or the association of sexual activity with, submission or subjection to physical pain, suffering, humiliation, torture or death. See Tennessee Code 7-51-1401
            43. Massage parlor: means an establishment or place primarily in the business of providing massage or tanning services where one (1) or more of the employees exposes to public view of the patrons within such establishment, at any time, the bare female breast below a point immediately above the top of the areola, human genitals, pubic region, or buttocks, even if partially covered by opaque material or completely covered by translucent material. See Tennessee Code 7-51-1102
            44. Metropolitan government: means the political entity created by consolidation of all, or substantially all, of the political and corporate functions of a county and a city or cities. See Tennessee Code 7-1-101
            45. Minor: means any person who has not attained eighteen (18) years of age. See Tennessee Code 1-3-105
            46. Minority: means a person who is a citizen or lawful permanent resident of the United States and who is:

              1. African American, a person having origins in any of the black racial groups of Africa. See Tennessee Code 12-3-1102
              2. Minority-owned business: means a minority-owned business that is a continuing, independent, for profit business that performs a commercially useful function, and is at least fifty-one percent (51%) owned and controlled by one (1) or more minority individuals who are impeded from normal entry into the economic mainstream because of past practices of discrimination based on race or ethnic background. See Tennessee Code 12-3-1102
              3. Month: means a calendar month. See Tennessee Code 1-3-105
              4. Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
              5. Municipal airport: means those county or municipal airports created pursuant to title 42, chapter 5. See Tennessee Code 4-31-603
              6. Municipal corporation: means an incorporated city or town. See Tennessee Code 7-1-101
              7. Municipal corporation: means any county, metropolitan government, incorporated city or town, utility district, school district, power district, sanitary district or other municipal, quasi-municipal or governmental body or political subdivision in this state, and any agency, authority, branch, bureau, commission, corporation, department or instrumentality thereof now or hereafter authorized by law to be created. See Tennessee Code 12-10-103
              8. Municipality: includes any county, city or town of the state. See Tennessee Code 12-2-301
              9. Municipality: means any county, or any incorporated city or town in this state with respect to which the authority may be organized. See Tennessee Code 11-25-104
              10. Municipality: means any county, incorporated city or town or utility district in this state with respect to which an authority may be organized. See Tennessee Code 12-10-103
              11. Municipality: means any county or incorporated city or town of the state of Tennessee. See Tennessee Code 7-51-901
              12. National Bank: A bank that is subject to the supervision of the Comptroller of the Currency. The Office of the Comptroller of the Currency is a bureau of the U.S. Treasury Department. A national bank can be recognized because it must have "national" or "national association" in its name. Natural disaster: means any hurricane, tornado, storm, flood, high water, wind-driven water, tidal wave, tsunami, earthquake, volcanic eruption, landslide, mudslide, snowstorm, ice storm, drought, fire, explosion, civil disturbance or other catastrophe that causes or may cause substantial damage or injury to property. See Tennessee Code 4-31-803
              14. No true bill: A legal procedure to dismiss charges against a defendant when the grand jury does not find enough evidence to charge the defendant with violating a law. Also called a "no bill."
              15. Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
              16. Not-for-profit corporation: means a general welfare corporation organized under §. See Tennessee Code 12-2-301
              17. Note: means any note authorized and issued pursuant to this chapter. See Tennessee Code 4-31-102
              18. Notice: means , when required by this part, placing the document in the United States mail with sufficient first-class postage to carry it to its destination to the address of the person being notified as contained in their application, unless such person has notified the board in writing of such person's new address. See Tennessee Code 7-51-1102
              19. Notice of meeting: means the notice of meeting referred to in this part. See Tennessee Code 7-51-901
              20. Oath: includes affirmation. See Tennessee Code 1-3-105
              21. Oath: A promise to tell the truth.
              22. Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
              23. Open office: means an office at the escort service from which the escort business is transacted and that is open to patrons or prospective patrons during all hours during which escorts are working, which is managed or operated by an employee, officer, director or owner of the escort service having authority to bind the service to escort and patron contracts and adjust patron and consumer complaints. See Tennessee Code 7-51-1102
              24. Operator: means any person, partnership, or corporation operating, conducting or maintaining an adult-oriented establishment. See Tennessee Code 7-51-1102
              25. Original bill: A bill which is drafted by a committee. It is introduced by the committee or subcommittee chairman after the committee votes to report it.
              26. other contracting party: means any party to a sale contract or loan agreement except the authority. See Tennessee Code 12-10-103
              27. other state entities: includes counties, cities, municipalities, and any other political subdivision of this state. See Tennessee Code 12-4-601
              28. Oversight: Committee review of the activities of a Federal agency or program.
              29. Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
              30. Person: means an individual, partnership, limited partnership, firm, corporation or association. See Tennessee Code 7-51-1102
              31. Person: means an individual, partnership, limited partnership, firm, corporation or association. See Tennessee Code 7-51-1401
              32. Person: means any individual, partnership, firm, association, corporation, or combination of individuals of whatever form or character. See Tennessee Code 11-25-104
              33. Person: includes a corporation, firm, company or association. See Tennessee Code 1-3-105
              34. Person with a disability: means an individual who meets at least one (1) of the following:

                1. Has been diagnosed as having a physical or mental disability resulting in marked and severe functional limitations that is expected to last no less than twelve (12) months. See Tennessee Code 12-3-1102
                2. Personal property: All property that is not real property.
                3. Personal property: includes money, goods, chattels, things in action, and evidences of debt. See Tennessee Code 1-3-105
                4. Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
                5. Plea agreement: An arrangement between the prosecutor, the defense attorney, and the defendant in which the defendant agrees to plead guilty in exchange for special considerations. Source:
                6. Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
                7. Policy: means an ordinance, resolution, regulation, code, or any other requirement imposed by a political subdivision of this state. See Tennessee Code 7-51-2101
                8. Political subdivision: means a municipality. See Tennessee Code 7-51-2101
                9. Political subdivision: means any city, town, municipality or county within the state. See Tennessee Code 12-3-902
                10. Political subdivision: means any authority, city, town, municipality, county or instrumentality of any authority, city, town, municipality or county within the state. See Tennessee Code 12-3-201
                11. Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
                12. Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
                13. Prevailing wage: means the rate of pay as determined according to this part. See Tennessee Code 12-4-402
                14. private club: means a club or organization that operates for the purpose of providing members of the club with the opportunity to engage in or view live specified sexual activities, as defined in §. See Tennessee Code 7-51-601
                15. Private property: means real property, or improvements to real property, not owned by the federal government or a state agency. See Tennessee Code 12-1-202
                16. Probate: Proving a will
                17. Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
                18. Procurement: means buying, purchasing, renting, leasing, or otherwise acquiring of any goods or services. See Tennessee Code 12-3-201
                19. Procurement and contracting: means the procurement of equipment, supplies, personal services, professional services, consulting services, construction contracts, and architectural and engineering services. See Tennessee Code 12-3-1102
                20. Procurement commission: means the state procurement commission, as established in §. See Tennessee Code 12-3-201
                21. Project: means and includes any building, structure, facility or permanent improvement, including the necessary equipment and furnishings therefor, which a municipality proceeding under this part is authorized to own, use or operate under any other provision of law. See Tennessee Code 12-2-301
                22. Project: means any outdoor recreational facility, or any other structure, improvement, or facility constructed, leased, equipped, renovated or acquired for any of the purposes set forth in this chapter, and also includes, but is not limited to, trails, roads, streets, bridges, towers, erosion control facilities, paths, signs, shelters, cabins, and utility services, such as water, sanitary sewer, electricity, gas and natural gas, and telecommunications that are constructed, leased, equipped, renovated or acquired as a supporting system or facility for any of the purposes set forth in this chapter. See Tennessee Code 11-25-104
                23. Project: includes an undertaking whereby a municipal corporation contracts with an authority respecting construction of improvements upon and/or for the operation and maintenance of property owned by or leased by other than the authority to the municipal corporation. See Tennessee Code 12-10-103
                24. Project: means any one (1) or any combination of the following: safety improvements for airports. See Tennessee Code 4-31-603
                25. Project: means the facility or portion of a facility, the construction of which is being financed or refinanced by a loan pursuant to this part. See Tennessee Code 4-31-703
                26. property: means every species of state property which is not either:

                  1. Real property, the disposal of which is subject to this title, governing the disposal of state real property. See Tennessee Code 12-2-402
                  2. Property: means anything of value, including, but not limited to, real estate, tangible and intangible personal property, contract rights, choses-in-action and other interests in or claims to wealth, admission or transportation tickets, captured or domestic animals, electric or other power and signatures which purport to create, maintain or extinguish any legal obligation. See Tennessee Code 12-4-702
                  3. Property: includes both personal and real property. See Tennessee Code 1-3-105
                  4. Proprietary: means a good or service that is used, produced, or marketed under exclusive legal right of the inventor, maker or service provider that is protected under trade secret, patent, trademark, or copyright law. See Tennessee Code 12-3-201
                  5. Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
                  6. Public agency: means :

                    1. Any political subdivision of this state. See Tennessee Code 12-9-103
                    2. public building authority: means any public corporation organized pursuant to this chapter. See Tennessee Code 12-10-103
                    3. Public construction project: means and includes a public works project as defined in the Local Government Public Obligations Act of 1986, compiled in title 9, chapter 21. See Tennessee Code 12-4-801
                    4. Public highway: means any street, road, highway, expressway, bridge, or viaduct, including an adjacent right-of-way, that is constructed or maintained by the state, or any municipality or political subdivision of the state, and that is funded in whole or in part with federal or state highway funds. See Tennessee Code 12-4-402
                    5. Publication: includes any newsletter, stationery, greeting card, report, or printed or electronic material produced in any format for distribution outside the creating department or agency, including those published by facilities not operated by the state. See Tennessee Code 12-6-101
                    6. Quorum: The number of legislators that must be present to do business.
                    7. Rap parlor: means an establishment or place primarily in the business of providing nonprofessional conversation or similar service for adults. See Tennessee Code 7-51-1102
                    8. Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
                    9. real property: include lands, tenements and hereditaments, and all rights thereto and interests therein, equitable as well as legal. See Tennessee Code 1-3-105
                    10. Recess: A temporary interruption of the legislative business.
                    11. Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in a perceivable form. See Tennessee Code 1-3-105
                    12. Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
                    13. Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
                    14. Representative: when applied to those who represent a decedent, includes executors and administrators, unless the context implies heirs and distributees. See Tennessee Code 1-3-105
                    15. Resolution: means any resolution duly adopted by a governing body pursuant to this part. See Tennessee Code 7-51-901
                    16. Respondent: includes a "bidder" or "proposer" that is a natural person or legal entity that has properly registered as required by the state. See Tennessee Code 12-3-201
                    17. Response: means a written response to a solicitation for goods and services. See Tennessee Code 12-3-201
                    18. Responsible: means a person who has the capacity in all respects to perform fully the contract requirements, as well as the integrity and reliability, which will assure good faith performance. See Tennessee Code 12-3-201
                    19. Responsive: means a person who has submitted a response that conforms in all material respects to the competitive procurement. See Tennessee Code 12-3-201
                    20. Responsive bidder: means a person who has submitted a bid which conforms in all material respects to all documents, whether attached or incorporated by reference, utilized for soliciting bids. See Tennessee Code 12-4-801
                    21. Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
                    22. revenue bonds: means bonds, notes, interim certificates or other obligations of an authority issued pursuant to this chapter, or pursuant to any other law, as supplemented by, or in conjunction with, this chapter. See Tennessee Code 11-25-104
                    23. revenue bonds: means bonds, notes, interim certificates or other obligations of an authority issued pursuant to this chapter, or pursuant to any other law, as supplemented by, or in conjunction with, this chapter. See Tennessee Code 12-10-103
                    24. Revenues: means all revenues derived from and on account of a project, directly or indirectly, including license or admission fees, payments under a lease or sale contract and repayments under any loan agreement, or under notes, debentures, bonds and other secured or unsecured debt obligations of a lessee or contracting party delivered as provided in this chapter, and any revenues pledged by a municipality. See Tennessee Code 11-25-104
                    25. Road: includes public bridges and may be held equivalent to the words "county way" "county road" or "state road". See Tennessee Code 1-3-105
                    26. Sadism: means sexual gratification achieved through, or the association of sexual activity with, the infliction of physical pain, suffering, humiliation, torture or death upon another person or animal. See Tennessee Code 7-51-1401
                    27. Sale contract: means a contract providing for the sale of one (1) or more projects to one (1) or more contracting parties and includes a contract providing for payment of the purchase price in one (1) or more installments. See Tennessee Code 12-10-103
                    28. Sauna: means an establishment or place primarily in the business of providing:

                      1. A steam bath. See Tennessee Code 7-51-1102
                      2. Savings and loan association: includes a building and loan association, a federal or state savings and loan association, a federal savings bank, and any other financial institution, the accounts of which are insured by the federal savings and loan insurance corporation (FSLIC) or any successor of such corporation. See Tennessee Code 1-3-105
                      3. Service: includes , but is not limited to: labor. See Tennessee Code 12-4-702
                      4. Service of process: The service of writs or summonses to the appropriate party.
                      5. Service-disabled veteran: means any person who served honorably on active duty in the armed forces of the United States with at least a twenty percent (20%) disability that is service-connected, meaning that such disability was incurred or aggravated in the line of duty in the active military, naval or air service. See Tennessee Code 12-3-1102
                      6. Service-disabled veteran-owned business: means a service-disabled veteran-owned business that is a continuing, independent, for profit business located in this state that performs a commercially useful function, and:

                        1. Is at least fifty-one percent (51%) owned and controlled by one (1) or more service-disabled veterans. See Tennessee Code 12-3-1102
                        2. Services: means all services and agreements obligating the state, except services for highway and road improvements governed by title 54 and design and construction services governed by title 4, chapter 15. See Tennessee Code 12-3-201
                        3. Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
                        4. Sexual conduct: means the engaging in or the commission of an act of sexual intercourse, oral-genital contact, or the touching of the sexual organs, pubic region, buttocks or female breast of a person for the purpose of arousing or gratifying the sexual desire of another person. See Tennessee Code 7-51-1102
                        5. Sexual encounter center: means a business or commercial enterprise that, as one of its primary business purposes, offers for any form of consideration:

                          1. Physical contact in the form of wrestling or tumbling between persons of the opposite sex. See Tennessee Code 7-51-1102
                          2. Sexual gratification: means sexual conduct as defined in this section. See Tennessee Code 7-51-1102
                          3. Sexual stimulation: means to excite or arouse the prurient interest or to offer or solicit acts of sexual conduct as defined in this section. See Tennessee Code 7-51-1102
                          4. Sexually-oriented escort: is a n escort that:

                            1. Employs as an employee, agent, or independent contractor an escort bureau runner. See Tennessee Code 7-51-1102
                            2. Sexually-oriented material: means any book, article, magazine, publication or written matter of any kind, drawing, etching, painting, photograph, motion picture film or sound recording that depicts sexual activity, actual or simulated, involving human beings or human beings and animals, that exhibits uncovered human genitals or pubic region in a lewd or lascivious manner, or that exhibits human male genitals in a discernibly turgid state, even if completely covered. See Tennessee Code 7-51-1401
                            3. signed: includes a mark, the name being written near the mark and witnessed, or any other symbol or methodology executed or adopted by a party with intention to authenticate a writing or record, regardless of being witnessed. See Tennessee Code 1-3-105
                            4. Small business: means a business that is a continuing, independent, for profit business which performs a commercially useful function with residence in this state and has total gross receipts of not more than ten million dollars ($10,000,000) averaged over a three-year period or employs no more than ninety-nine (99) persons on a full-time basis. See Tennessee Code 12-3-1102
                            5. Solicitation: means any type of document that invites responses and may include, by way of example, an "invitation to bid" a "request for proposal" or a "competitive negotiation". See Tennessee Code 12-3-201
                            6. Specification: includes , as appropriate, requirements for inspecting, testing, or preparing a supply, service, or construction item for delivery. See Tennessee Code 12-3-201
                            7. Specified anatomical areas: means :

                              1. Less than completely and opaquely covered:
                                1. Human genitals. See Tennessee Code 7-51-1102
                                2. Specified sexual activities: means :

                                  1. Human genitals in a state of sexual stimulation or arousal. See Tennessee Code 7-51-1102
                                  2. Specified sexual activities: means activities, services or performances that include the following sexual activities or the exhibition of the following anatomical areas:

                                    1. Human genitals in a state of sexual stimulation or arousal. See Tennessee Code 7-51-1401
                                    2. State: means the state of Tennessee and, unless otherwise indicated by the context, any agency, authority, branch, bureau, commission, corporation, department or instrumentality of the state, now or hereafter existing. See Tennessee Code 11-25-104
                                    3. State: means a state of the United States. See Tennessee Code 12-9-103
                                    4. State: means the state of Tennessee. See Tennessee Code 12-4-502
                                    5. State: means the state of Tennessee. See Tennessee Code 4-31-102
                                    6. State: when applied to the different parts of the United States, includes the District of Columbia and the several territories of the United States. See Tennessee Code 1-3-105
                                    7. State agency: means any department, office, institution of higher education, board, commission, or any other state agency that receives state funds. See Tennessee Code 12-3-1102
                                    8. State agency: means any state governmental entity, other than the central procurement office and those state entities exempted by §. See Tennessee Code 12-3-201
                                    9. State construction project: means any construction project for the purpose of erecting, remodeling, altering, repairing, demolishing, or making any additions to any building or buildings, any other type of building and construction work, or any construction project for the purpose of building, rebuilding, locating or relocating or repairing any streets, highways or bridges, wherein any state funds may be appropriated or expended for such building or construction work. See Tennessee Code 12-4-502
                                    10. State contract: means any contractual agreement, written or oral, inclusive of plans and specifications incidental thereto, entered into by any person, firm or corporation with the state for the performance of work on a state construction project. See Tennessee Code 12-4-502
                                    11. State contractor: means any person, firm or corporation engaged in a state construction project pursuant to a state contract. See Tennessee Code 12-4-502
                                    12. State governmental entity: means any agency, authority, board, commission, department, or office within the executive, legislative or judicial branches of state government or any autonomous state agency, authority, board, commission, council, department, office, or institution of higher education. See Tennessee Code 12-3-201
                                    13. State highway construction project: means any construction project for the purpose of building, rebuilding, locating, relocating, or repairing any public highway. See Tennessee Code 12-4-402
                                    14. State loan programs: means the activities and policies undertaken by the state pursuant to title 68, chapter 221, part 2 to provide assistance to local government units by making grants that are required to be repaid for the construction of sewage treatment works, or pursuant to title 68, chapter 221, part 5, to provide assistance to local government units by making loans for the construction of waterworks, or pursuant to [former] title 68, chapter 211, part 4 [repealed], to provide assistance to local government units by making loans for the construction of energy recovery facilities or solid waste resource recovery facilities, or both, or pursuant to part 4 of this chapter to provide assistance to local government units by making loans for the construction of capital projects.                                     15. Statute: A law passed by a legislature.
                                    16. Subpoena: A command to a witness to appear and give testimony.
                                    17. Subscription: includes a mark, the name being written near the mark and witnessed. See Tennessee Code 1-3-105
                                    18. surplus property: means that personal property which has been determined to be obsolete, outmoded, or no longer usable by the state and declared as such, by the commissioner or head of the releasing department or agency, in accordance with this part. See Tennessee Code 12-2-402
                                    19. taking: means the taking of private property by government action such that compensation to the owner of that property is required by either:

                                      1. The fifth or fourteenth amendment to the Constitution of the United States. See Tennessee Code 12-1-202
                                      2. Testify: Answer questions in court.
                                      3. Testimony: Evidence presented orally by witnesses during trials or before grand juries.
                                      4. Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
                                      5. Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
                                      6. Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
                                      7. True bill: Another word for indictment.
                                      8. Trust account: A general term that covers all types of accounts in a trust department, such as estates, guardianships, and agencies. Source: OCC
                                      9. Trustee: A person or institution holding and administering property in trust.
                                      10. Uniform Commercial Code: A set of statutes enacted by the various states to provide consistency among the states' commercial laws. It includes negotiable instruments, sales, stock transfers, trust and warehouse receipts, and bills of lading. Source: OCC
                                      11. United States: includes the District of Columbia and the several territories of the United States. See Tennessee Code 1-3-105
                                      12. User fees: Fees charged to users of goods or services provided by the government. In levying or authorizing these fees, the legislature determines whether the revenue should go into the treasury or should be available to the agency providing the goods or services.
                                      13. Vendor: means a natural person or legal entity that has been established by the department of finance and administration's division of accounts as a vendor through proper authority for which payment may be made by the state. See Tennessee Code 12-3-201
                                      14. Venue: The geographical location in which a case is tried.
                                      15. Verdict: The decision of a petit jury or a judge.
                                      16. Woman-owned business: means a woman-owned business that is a continuing, independent, for profit business that performs a commercially useful function, and is at least fifty-one percent (51%) owned and controlled by one or more women. See Tennessee Code 12-3-1102
                                      17. Writ: A formal written command, issued from the court, requiring the performance of a specific act.
                                      18. Writ of certiorari: An order issued by the Supreme Court directing the lower court to transmit records for a case for which it will hear on appeal.
                                      19. written: includes printing, typewriting, engraving, lithography, and any other mode of representing words and letters. See Tennessee Code 1-3-105
                                      20. Year: means a calendar year, unless otherwise expressed. See Tennessee Code 1-3-105
