  • Administrator: includes "executor" when the subject matter justifies the use. See Utah Code 68-3-12.5
  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • Appraisal: A determination of property value.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Articles of incorporation: include :
    (a) amended and restated articles of incorporation;
    (b) articles of merger; and
    (c) a document of a similar import to those described in Subsections (4)(a) and (b). See Utah Code 16-10a-102
  • Asset: means property of all kinds, real and personal, tangible and intangible, and includes:
    (a) cash;
    (b) stock or other investments;
    (c) real property;
    (d) equipment and supplies;
    (e) an ownership interest;
    (f) a license;
    (g) a cause of action; and
    (h) any similar property. See Utah Code 53G-5-102
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • authorizer: means an entity listed in Section 53G-5-205 that authorizes a charter school. See Utah Code 53G-5-102
  • Bequest: Property gifted by will.
  • Board: means the Wildlife Board. See Utah Code 23-27-102
  • board of trustees: means :
    (a) the board of trustees of:
    (i) the University of Utah;
    (ii) Utah State University;
    (iii) Weber State University;
    (iv) Southern Utah University;
    (v) Snow College;
    (vi) Utah Tech University;
    (vii) Utah Valley University; or
    (viii) Salt Lake Community College; or
    (b) a technical college board of trustees described in Section 53B-2a-108. See Utah Code 53G-5-102
  • Bylaws: includes amended bylaws and restated bylaws. See Utah Code 16-10a-102
  • City: includes , depending on population, a metro township as defined in Section 10-3c-102. See Utah Code 68-3-12.5
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Contract: A legal written agreement that becomes binding when signed.
  • Conveyance: includes a motor vehicle, a vessel, a motorboat, a sailboat, a personal watercraft, a container, a trailer, a live well, or a bilge area. See Utah Code 23-27-102
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • County legislative body: means :Utah Code 68-3-12.5
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Decontaminate: means to:
    (a) drain and dry all non-treated water; and
    (b) chemically or thermally treat in accordance with rule. See Utah Code 23-27-102
  • Devise: To gift property by will.
  • Director: means the director of the division. See Utah Code 23-27-102
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Distribution: means the following by a corporation to or for the benefit of its shareholders in respect of any of the corporation's shares:
    (i) a direct or indirect transfer of money or other property, other than a corporation's own shares; or
    (ii) incurrence of indebtedness by the corporation. See Utah Code 16-10a-102
  • Division: means the Division of Wildlife Resources. See Utah Code 23-27-102
  • Donor: The person who makes a gift.
  • Dreissena mussel: means a mussel of the genus Dreissena at any life stage, including a zebra mussel, a quagga mussel, and Conrad's false mussel. See Utah Code 23-27-102
  • Eligible entity: means :
    (a) a city or town with a population density of 3,000 or more people per square mile; or
    (b) a county whose unincorporated area includes a qualifying planning advisory area. See Utah Code 53G-4-901
  • Employee: includes an officer but not a director, unless the director accepts a duty that makes that director also an employee. See Utah Code 16-10a-102
  • Equipment: means an article, tool, implement, or device capable of carrying or containing:
    (a) water; or
    (b) a Dreissena mussel. See Utah Code 23-27-102
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Executive director: means the executive director of the Department of Natural Resources. See Utah Code 23-27-102
  • Facility: means a structure that is located within or adjacent to a water body. See Utah Code 23-27-102
  • Fiduciary: A trustee, executor, or administrator.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Grantor: The person who establishes a trust and places property into it.
  • Highway: includes :Utah Code 68-3-12.5
  • Infested water: means a geographic region, water body, facility, or water supply system within or outside the state that the board identifies in rule as carrying or containing a Dreissena mussel. See Utah Code 23-27-102
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Land: includes :Utah Code 68-3-12.5
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Month: means a calendar month, unless otherwise expressed. See Utah Code 68-3-12.5
  • Oath: includes "affirmation. See Utah Code 68-3-12.5
  • Oath: A promise to tell the truth.
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Person: means :Utah Code 68-3-12.5
  • Personal property: includes :Utah Code 68-3-12.5
  • Personal property: All property that is not real property.
  • Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
  • Property: includes both real and personal property. See Utah Code 68-3-12.5
  • Purchase price: means the greater of:
    (a) an amount that is the average of:
    (i) the appraised value of the surplus property, based on the predominant zone in the surrounding area, as indicated in an appraisal obtained by the eligible entity; and
    (ii) the appraised value of the surplus property, based on the predominant zone in the surrounding area, as indicated in an appraisal obtained by the school district; and
    (b) the amount the school district paid to acquire the surplus property. See Utah Code 53G-4-901
  • Qualifying planning advisory area: means a planning advisory area under Section 17-27a-306 that has a population density of 3,000 or more people per square mile within the boundaries of the planning advisory area. See Utah Code 53G-4-901
  • Quorum: The number of legislators that must be present to do business.
  • Record date: means the date established under 6, or 7, on which a corporation determines the identity of its shareholders. See Utah Code 16-10a-102
  • Share: means the unit into which the proprietary interests in a corporation are divided. See Utah Code 16-10a-102
  • Shareholder: means :
    (i) the person in whose name a share is registered in the records of a corporation; or
    (ii) the beneficial owner of a share to the extent recognized pursuant to Section 16-10a-723. See Utah Code 16-10a-102
  • Signature: includes a name, mark, or sign written with the intent to authenticate an instrument or writing. See Utah Code 68-3-12.5
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • Statute: A law passed by a legislature.
  • Subscriber: means a person who subscribes for shares in a corporation, whether before or after incorporation. See Utah Code 16-10a-102
  • Surplus property: means land owned by a school district that:
    (a) was purchased with taxpayer money;
    (b) is located within a city or town that is an eligible entity or within a qualifying planning advisory area;
    (c) consists of one contiguous tract at least three acres in size; and
    (d) has been declared by the school district to be surplus. See Utah Code 53G-4-901
  • Town: includes , depending on population, a metro township as defined in Section 10-3c-102. See Utah Code 68-3-12.5
  • United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
  • Vessel: means the same as that term is defined in Section 73-18-2. See Utah Code 23-27-102
  • Water body: means natural or impounded surface water, including a stream, river, spring, lake, reservoir, pond, wetland, tank, and fountain. See Utah Code 23-27-102
  • Water supply system: includes a pump, canal, ditch, or pipeline. See Utah Code 23-27-102
  • Writing: includes :Utah Code 68-3-12.5
