  • Acknowledgment: means a declaration by an individual before a notary public that the individual has signed a record for the purpose stated in the record and, if the record is signed in a representative capacity, that the individual signed the record with proper authority and signed it as the act of the individual or entity identified in the record. See
  • Act: means the Federal Financial Institutions Reform, Recovery, and Enforcement Act of 1989, Pub. See
  • Acutely hazardous waste: means those specification and off-specification commercial chemical products or manufacturing chemical intermediates that are listed at 40 C. See
  • Adjusted gross income: means an individual's adjusted gross income under the laws of the United States relating to federal income taxes for the tax year next preceding the school year for which a grant or loan is sought. See
  • Adjusted property tax: means the amount of education and municipal property taxes on the homestead parcel after reduction for any property tax credit under section 6066a of this chapter. See
  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • Allocable rent: means , for any housesite and for any taxable year, 21 percent of the gross rent. See
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Americans with Disabilities Act: means the federal Americans with Disabilities Act of 1990 and regulations promulgated under the Act, as amended at any time. See
  • Amortization: Paying off a loan by regular installments.
  • Amusement ride: means a mechanical device that carries or conveys passengers along, around, or over a fixed or restricted route or course for the purpose of giving the passengers amusement, pleasure, thrills, or excitement. See
  • Annual meeting: when applied to towns shall mean the annual town meeting in March or an adjournment thereof. See
  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Applicable individual: means , with respect to any month, an individual other than the following:

  • Applied behavior analyst: means a person who is licensed under this chapter to engage in the practice of applied behavior analysis. See
  • Appraisal: A determination of property value.
  • Appraisal: means an analysis, opinion, or conclusion relating to the value of specified interests in or aspects of identified real estate or identified real property. See
  • Appraisal management company: means an entity that acts as a broker in acquiring finished appraisals from real estate appraisers licensed under this chapter and that supplies the appraisals to third parties. See
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Approved postsecondary education institution: means any institution of postsecondary education that is:

  • AQB: means the Appraisal Qualifications Board of the Appraisal Foundation as referenced in the Act. See
  • Arraignment: A proceeding in which an individual who is accused of committing a crime is brought into court, told of the charges, and asked to plead guilty or not guilty.
  • Arrest: Taking physical custody of a person by lawful authority.
  • ASC: means the Appraisal Subcommittee of the Federal Financial Institutions Examination Council created pursuant to the Act. See
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Assistant behavior analyst: means a person who is licensed under this chapter to engage in the practice of applied behavior analysis under the supervision of an applied behavior analyst. See
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Attorney-at-law: A person who is legally qualified and licensed to practice law, and to represent and act for clients in legal proceedings.
  • Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
  • Audiologist: means a person licensed to practice audiology under this chapter. See
  • Audiology: means the application of principles, methods, and procedures related to hearing and the disorders of hearing, and to related language and speech disorders, which includes all conditions that impede the normal process of human communication, including disorders of auditory sensitivity, acuity, function, or processing. See
  • Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Bequest: Property gifted by will.
  • biennially: shall mean the year in which a regular session of the General Assembly is held. See
  • Board: means the State Labor Relations Board established under 3 V. See
  • Board: means the Vermont Community Broadband Board. See
  • Board: means the Board of Directors of the Vermont Student Assistance Corporation. See
  • Board: means the Board of Allied Mental Health Practitioners established under this chapter. See
  • Boxer: means an individual who participates in a boxing match. See
  • Break-open ticket: means a lottery utilizing a card or ticket of the so-called pickle card, jar ticket, or break-open variety commonly bearing the name "Lucky 7" "Nevada Club" "Victory Bar" "Texas Poker" "Triple Bingo" or any other name. See
  • broadband: means a mass-market retail service by wire or radio in Vermont that provides the capability to transmit data to and receive data from all or substantially all Internet endpoints, including any capabilities that are incidental to and enable the operation of the communications service, but excluding dial-up Internet access service. See
  • Burial: means the final disposition of human remains, including interring or cremating a decedent and the ceremonies directly related to that cremation or interment at the gravesite. See
  • Carbon intensity value: means the amount of lifecycle greenhouse gas emissions per unit of energy of fuel expressed in grams of carbon dioxide equivalent per megajoule (gCO2e/MJ). See
  • Certificate: means a certificate of compliance, affirmation, or exemption that is a part of the property transfer return. See
  • Childhood adversity: means experiences that may be traumatic to children and youths during the first 18 years of life, such as experiencing violence or other emotionally disturbing exposures in their homes or communities. See
  • Claim year: means the year in which a claim is filed under this chapter. See
  • Clean heat credit: means a tradeable, nontangible commodity that represents the amount of greenhouse gas reduction attributable to a clean heat measure. See
  • Clean heat measure: means fuel delivered and technologies installed to end-use customers in Vermont that reduce greenhouse gas emissions from the thermal sector. See
  • Clinical mental health counseling: means providing, for a consideration, professional counseling services that are primarily drawn from the theory and practice of psychotherapy and the discipline of clinical mental health counseling, involving the application of principles of psychotherapy, human development, learning theory, group dynamics, and the etiology of mental illness and dysfunctional behavior to individuals, couples, families, and groups, for the purposes of treating psychopathology and promoting optimal mental health. See
  • Clinical mental health counselor: means a person who is licensed to practice clinical mental health counseling under this chapter. See
  • Commercial operation: means the operation of a snowmobile on the SSTS by an individual participating in a guided tour or who has rented a snowmobile from an individual or corporate entity charging a fee for the tour or rental. See
  • Commission: means the Public Utility Commission. See
  • Commissioner: means the Commissioner of Disabilities, Aging, and Independent Living. See
  • Commissioner: means the Commissioner for Children and Families and "Department" means the Department for Children and Families. See
  • Commissioner: means the Commissioner for Children and Families. See
  • Commissioner: means Commissioner of Motor Vehicles unless otherwise stated. See
  • Commissioner: means the Commissioner of Liquor and Lottery. See
  • Commissioner: means the Commissioner of Taxes. See
  • Commissioner: means the Commissioner of Motor Vehicles. See
  • Commissioner: means the Commissioner of Vermont Health Access. See
  • Commissioner: means the Commissioner of Taxes or any officer or employee of the Department authorized by the Commissioner, directly or indirectly by one or more redelegations of authority, to perform the functions mentioned or described in this chapter. See
  • Commissioner: means the Commissioner of Taxes or any person authorized by the Commissioner (directly or indirectly by one or more redelegations of authority) to perform the functions described in this chapter. See
  • Commissioner of Health: means the Commissioner of Health appointed under 3 V. See
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Common level of appraisal: means the ratio of the aggregate value of local education property tax grand list to the aggregate value of the equalized education property tax grand list. See
  • Communication or language mode: means verbal or nonverbal communication that includes listening, speaking, American Sign Language (ASL), Signed English, Signed Support, reading, and writing in all domains of a language. See
  • Communication technology: means an electronic device or process operating in accordance with section 5380 of this chapter and any standards adopted by the Office pursuant to section 5323 of this chapter that:

  • compensation: means payment in any form except reimbursement for mileage or the normal salary paid to a person otherwise employed by the school. See
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contemplation of death: The expectation of death that provides the primary motive to make a gift.
  • Contestant: includes both amateur and professional mixed martial arts competitors. See
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contract: A legal written agreement that becomes binding when signed.
  • Controlling interest: means :

  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Corporation: means the Vermont Student Assistance Corporation. See
  • Council: means the Council for Equitable Youth Justice. See
  • Court: means the Family Division of the Superior Court. See
  • Covered wages: means wages paid to an employee by an employer. See
  • Custodial parent: means any person with whom a dependent child actually resides, whether or not the parent is receiving public assistance benefits under chapter 11 of this title, or the Commissioner for Children and Families if the dependent child is under the care and control of that Department. See
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • DCF: means the Vermont Department for Children and Families. See
  • Deaf: means having a severe or complete absence of auditory sensitivity that impairs processing of linguistic information through hearing, with or without amplification or cochlear implants. See
  • DeafBlind: means having concomitant hearing and visual impairments. See
  • Dealer: means a person, partnership, corporation, or other entity engaged in the business of selling or exchanging new or used motor vehicles, snowmobiles, motorboats, or all-terrain vehicles. See
  • Decedent: A deceased person.
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Deed: includes any deed, instrument, memorandum of deed, memorandum of lease, or other writing evidencing a transfer of title to property. See
  • Default delivery agent: means an entity designated by the Commission to provide services that generate clean heat measures. See
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Department: means the Department of Disabilities, Aging, and Independent Living. See
  • Department: means the Department of Disabilities, Aging, and Independent Living. See
  • Department: means the Department for Children and Families. See
  • Department: means the Vermont Department for Children and Families. See
  • Department: means the Department of Public Service. See

  • Dependent: A person dependent for support upon another.
  • Dependent child: means any child receiving assistance under chapter 11 of this title or any minor child for whose benefit the Office of Child Support has been authorized and requested to collect support. See
  • design: means planning the physical and operational characteristics of a potable water supply or wastewater system that requires a permit or designer's certification or license under the laws of this State. See
  • designer: means a person who is licensed under this chapter to engage in the practice of potable water supply or wastewater system design. See
  • Devise: To gift property by will.
  • Direct supervision: means sufficiently close and able to control, by communicating visually or orally, the operation of a snowmobile by an operator under 16 years of age, taking into account the noise created by snowmobiles and protective headgear worn by the operator. See
  • Director: means the Director of the Office of Professional Regulation. See
  • Director: means the Director of the Office of Professional Regulation. See

  • Distributor: means a person that purchases break-open tickets from a manufacturer and sells or distributes break-open tickets at wholesale in Vermont. See
  • Docket: A log containing brief entries of court proceedings.
  • Domestic: when applied to a corporation, company, association, or copartnership shall mean organized under the laws of this State; "foreign" when so applied, shall mean organized under the laws of another state, government, or country. See
  • Domicile: means the principal dwelling of a person who has established permanent residence in the State. See
  • Donor: The person who makes a gift.
  • Early care and education provider: means a licensed child care home provider, a registered child care home provider, or a legally exempt child care home provider, which is defined by the Legally Exempt Child Care Provider Requirements set forth by the Vermont Department for Children and Families, Child Development Division, who provides child care services as defined in subdivision 3511(4) of this title. See
  • Education property tax grand list: means the list of property determined pursuant to section 5404 of this title. See
  • Education property tax spending adjustment: means the greater of one or a fraction in which the numerator is the district's education spending plus excess spending, per equalized pupil, for the school year, and the denominator is the property dollar equivalent yield for the school year, as defined in subdivision (15) of this section. See
  • Education property value: means the aggregate fair market value of all nonhomestead and homestead real property that is required to be listed at fair market value as certified during that year by the Director of Property Valuation and Review under section 5406 of this title, plus the aggregate value of property required to be listed at a value established under a stabilization agreement described under section 5404a of this title, plus the aggregate use value established under chapter 124 of this title of all nonhomestead real property that is enrolled in the use value appraisal program. See
  • Education spending: means "education spending" as defined in 16 V. See
  • Electronic: means relating to technology having electrical, digital, magnetic, wireless, optical, electromagnetic, or similar capabilities. See
  • Electronic signature: means an electronic symbol, sound, or process attached to or logically associated with a record and executed or adopted by an individual with the intent to sign the record. See
  • Employee: means an individual who is:

  • Employee: means an individual who receives payments with respect to services performed for an employer from which the employer is required to withhold Vermont income tax pursuant to chapter 151, subchapter 4 of this title. See
  • Employer: means a person who is required to furnish unemployment insurance coverage pursuant to 21 Vt. See
  • Employer: means a person who employs one or more employees who is required to withhold income tax from wages paid to the employees pursuant to chapter 151, subchapter 4 of this title. See
  • Enforcement officers: shall include :

  • engaged in the business: means having sold or exchanged at least 12 cars or motor trucks, or a combination thereof, in the immediately preceding year, or 24 in the two immediately preceding years. See
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Entity: means any individual, trustee, agency, partnership, association, corporation, company, municipality, political subdivision, or any other form of organization. See
  • Equalized education property tax grand list: means one percent of the aggregate fair market value of all nonhomestead and homestead property that is required to be listed at fair market value as certified during that year by the Director of Property Valuation and Review under section 5406 of this title, plus one percent of the aggregate value of property required to be listed at a value established under a stabilization agreement described under section 5404a of this title, plus one percent of the aggregate use value established under chapter 124 of this title of all nonhomestead property that is enrolled in the use value appraisal program. See
  • Equalized value of the housesite in the taxable year: means the value of the housesite on the grand list for April 1 of the taxable year, divided by the municipality's common level of appraisal determined by equalization of the grand list for April 1 of the year preceding the taxable year. See
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Establishment: means any place of business that:

  • Estate: means the gross estate of a decedent as determined for the purpose of federal estate tax and the estate tax payable to this State. See
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Ex officio: Literally, by virtue of one's office.
  • Excess spending: means :

  • Exclusive representative: means the labor organization that has been elected or recognized and certified by the Board under this chapter and consequently has the exclusive right under section 3608 of this chapter to represent early care and education providers for the purpose of collective bargaining and the enforcement of any contract provisions.   • Executor: A male person named in a will to carry out the decedent
  • Exhibition: means an engagement in which the contestants show or display their skills without necessarily striving to win. See
  • Extremely low-income limit: means the limit as determined by the U. See
  • Fair Credit Reporting Act: A federal law, established in 1971 and revised in 1997, that gives consumers the right to see their credit records and correct any mistakes. Source: OCC
  • Fair market rent: means the monthly fair market rent for the area in which the claimant resides as determined by the U. See
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • Family: means persons whom the recipient of General Assistance is required by law to support. See
  • family: shall mean persons in a relationship to the transferor of grandparent, parent or stepparent, brother or sister, or natural or adopted child. See
  • farmland: means land that will be actively operated or leased as part of a farm enterprise, and "open-space land" shall mean land without structures thereon. See
  • federal adjusted gross income:

  • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
  • Fees: shall mean earnings due for official services, aside from salaries or per diem compensation. See
  • Fiduciary: A trustee, executor, or administrator.
  • Fiduciary: means executor, administrator of any description, and trustee. See
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • following: when used by way of reference to a section of the law shall mean the next preceding or following section. See
  • Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
  • Foreign state: means a government other than the United States, a state, or a federally recognized Indian tribe. See
  • Forester: means a person who is licensed to practice forestry under this chapter. See
  • Forestry: means the science, art, and practice of creating, managing, using, and conserving forests and associated resources to meet desired goals, needs, and values, including timber management, wildlife management, biodiversity management, and watershed management. See
  • Forgery: The fraudulent signing or alteration of another's name to an instrument such as a deed, mortgage, or check. The intent of the forgery is to deceive or defraud. Source: OCC
  • Found: means discovered, come upon, chanced upon, or met with by accident. See
  • Fraud: Intentional deception resulting in injury to another.
  • FTE: means the number of employees expressed as the number of employee hours worked during a calendar quarter divided by 520. See
  • Fuel pathway: means a detailed description of all stages of fuel production and use for any particular fuel, including feedstock generation or extraction, production, transportation, distribution, and combustion of the fuel by the consumer. See
  • Fund: means the Vermont Community Broadband Fund established by this chapter. See
  • Funeral: means the ceremonies prior to burial by interment, cremation, or other method. See
  • gender identity: means an individual's actual or perceived gender identity, or gender-related characteristics intrinsically related to an individual's gender or gender-identity, regardless of the individual's assigned sex at birth. See
  • General Assistance: means financial aid to provide the necessities of life, including food, clothing, shelter, fuel, electricity, medical care, and other items as the Commissioner may prescribe by rule, when a need is found to exist and the applicant is otherwise found eligible. See
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Grantor: The person who establishes a trust and places property into it.
  • Grievance: means the exclusive representative's formal written complaint regarding an improper application of one or more terms of the collective bargaining agreement. See
  • Gross estate: The total fair market value of all property and property interests, real and personal, tangible and intangible, of which a decedent had beneficial ownership at the time of death before subtractions for deductions, debts, administrative expenses, and casualty losses suffered during estate administration.
  • Gross rent: means the rent actually paid during the taxable year by the claimant solely for the right of occupancy of the housesite during the taxable year. See
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Hard of Hearing: means a reduced level of functional hearing and reliance on residual hearing and technology, including hearing aids, cochlear implants, FM listening systems, and other types of assistive listening devices to communicate via verbal language, with or without use of ASL. See
  • Health care coverage: shall mean any private or public plan that includes both hospital and physician services. See
  • Health care provider: means a health care practitioner licensed in Vermont who is permitted under the practitioner's statutory or regulatory scope of practice to conduct the types of examinations set forth in this subchapter. See
  • Health insurance: means any group or individual health care benefit policy, contract, or other health benefit plan offered, issued, renewed, or administered by any health insurer, including any health care benefit plan offered, issued, renewed, or administered by any health insurance company, any nonprofit hospital and medical service corporation, any dental service corporation, or any managed care organization as defined in 18 V. See
  • Health insurer: means any person who offers, issues, renews, or administers a health insurance policy, contract, or other health benefit plan in this State and includes third party administrators or pharmacy benefit managers who provide administrative services only for a health benefit plan offering coverage in this State. See
  • Hearing aid: means an amplifying device to be worn by a person who is hard of hearing to improve hearing, including any accessories specifically used in connection with such a device, but excluding theater- or auditorium-wide-area listening devices, telephone amplifiers, or other devices designed to replace a hearing aid for restricted situations. See
  • Hearing aid dispenser: means a person licensed under this chapter to dispense hearing aids. See
  • Heating fuel: means fossil-based heating fuel, including oil, propane, natural gas, coal, and kerosene. See
  • Higher Education Act: means the federal Higher Education Act of 1965, Pub. See
  • Holding tank: means a container or device designed to provide for the retention of wastes on board a vessel and to prevent the discharge of wastes into the waters of this State. See
  • Home care services: include room, board, safety services, household services, and any specialized services to meet the unique needs of the individual. See
  • Homestead: means the principal dwelling and parcel of land surrounding the dwelling, owned and occupied by a resident individual as the individual's domicile or owned and fully leased on April 1, provided the property is not leased for more than 182 days out of the calendar year or, for purposes of the renter credit under subsection 6066(b) of this title, is rented and occupied by a resident individual as the individual's domicile. See
  • Homestead: means a homestead as defined under subdivision 5401(7) of this title, but not under subdivision 5401(7)(G) of this title, and declared on or before October 15 in accordance with section 5410 of this title. See
  • House: means a structure in which people live, including a hospital. See
  • Household: means any individual or group of individuals who live together as one economic unit:

  • Household: means , for any individual and for any taxable year, the individual and such other persons as resided with the individual in the principal dwelling at any time during the taxable year. See
  • Household income: means modified adjusted gross income, but not less than zero, received in a calendar year by:

  • Housesite: means that portion of a homestead, as defined under subdivision 5401(7) of this title but not under subdivision 5401(7)(G) of this title, that includes as much of the land owned by the claimant surrounding the dwelling as is reasonably necessary for use of the dwelling as a home, but in no event more than two acres per dwelling unit, and, in the case of multiple dwelling units, not more than two acres per dwelling unit up to a maximum of 10 acres per parcel. See
  • Identity proofing: means a process or service operating in accordance with section 5380 of this chapter and any standards adopted by the Office pursuant to section 5323 of this chapter by which a third person provides a notary public with a means to verify the identity of a remotely located individual by a review of personal information from public or private data sources. See
  • In a representative capacity: means acting as:

  • income: means federal adjusted gross income increased by the following:

  • Income dollar equivalent yield: means the amount of spending per equalized pupil that would result if the income percentage in subdivision 6066(a)(2) of this title were 2. See
  • increased by inflation: means increasing the statewide average district education spending per equalized pupil for fiscal year 2015 by the most recent New England Economic Project cumulative price index, as of November 15, for state and local government purchases of goods and services, from fiscal year 2015 through the fiscal year for which the amount is being determined. See
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Inter vivos: Transfer of property from one living person to another living person.
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Intestate: Dying without leaving a will.
  • JJRA: means the federal Juvenile Justice and Delinquency Prevention Act of 1973 as reauthorized and as amended by the Juvenile Justice Reform Act of 2018, 34 U. See
  • Joint tenancy: A form of property ownership in which two or more parties hold an undivided interest in the same property that was conveyed under the same instrument at the same time. A joint tenant can sell his (her) interest but not dispose of it by will. Upon the death of a joint tenant, his (her) undivided interest is distributed among the surviving joint tenants.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Jurisprudence: The study of law and the structure of the legal system.
  • Justice: when applied to a person, other than a Justice of the Supreme Court, shall mean a justice of the peace for the county for which he or she is elected or appointed. See
  • land: is a ny land up to 10 acres, with the modification permitted by subsection (c) of this section, acquired by a person who will build on that land a house that, by the next succeeding sale, will be the principal residence of the occupant when the person purchases from the person who built the house. See
  • Late-payment fee: The fee that will be imposed when your payment is late. Source: Federal Reserve
  • Law clerk: Assist judges with research and drafting of opinions.
  • Law enforcement officer: means a person designated in subdivision 4(11) of this title and includes deputy State game wardens and auxiliary State Police officers. See
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Legislative session: That part of a chamber's daily session in which it considers legislative business (bills, resolutions, and actions related thereto).
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • License: means a current authorization granted by the Director permitting the practice of applied behavior analysis. See
  • License: means a current authorization granted by the Director permitting the practice of potable water supply or wastewater system design. See
  • License: means a current authorization granted by the Director permitting the practice of pollution abatement facility operation. See
  • License: means a current authorization granted by the Director permitting the practice of forestry pursuant to this chapter. See
  • Licensed acupuncturist: means a person who is licensed to practice acupuncture under this chapter. See
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Life estate: A property interest limited in duration to the life of the individual holding the interest (life tenant).
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Location: means an E-911 business or residential address connected to the electric power grid. See
  • Magistrate: shall mean any Supreme Court Justice, Superior judge, District judge, or Probate judge. See
  • Manager: means a person who receives compensation for service as an agent or representative of a professional boxer. See
  • Manufacturer: means a person that designs, assembles, fabricates, produces, constructs, or otherwise prepares a break-open ticket for sale to a distributor. See
  • Marine toilet: means any toilet on or within any vessel except those that have been permanently sealed and made inoperative. See
  • Masthead light: means a white light placed over the fore and aft centerline of the vessel showing an unbroken light over an arc of the horizon of 225 degrees and so fixed as to show the light from right ahead to 22. See
  • match: means a contest or training exhibition for a prize or purse where an admission fee is charged and where individuals score points by striking the head and upper torso of an opponent with padded fists. See
  • Mixed martial arts: means unarmed combat involving the use, subject to any applicable limits set forth in this subchapter and in any rules adopted in accordance with this subchapter, of a combination of techniques, including grappling, kicking, and striking, from different disciplines of martial arts. See
  • mixed martial arts event: means a mixed martial arts match or two or more mixed martial arts matches held at the same location on the same or consecutive dates. See
  • mixed martial arts match: includes amateur matches and exhibitions. See
  • Modified adjusted gross income: means "federal adjusted gross income":

  • Month: shall mean a calendar month and "year" shall mean a calendar year and be equivalent to the expression "year of our Lord. See
  • Month: means 30 days and "year" means 365 days. See
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Mortgagee: The person to whom property is mortgaged and who has loaned the money.
  • Mortgagor: The person who pledges property to a creditor as collateral for a loan and who receives the money.
  • Motor home: means a new or used pleasure car designed to provide temporary living quarters, built into as an integral part of, or permanently attached to, a self-propelled motor vehicle chassis or van. See
  • Motorboat: means any vessel equipped with machinery capable of propelling the vessel, whether or not such machinery is the principal source of propulsion. See
  • Municipality: shall include a city, town, town school district, incorporated school or fire district or incorporated village, and all other governmental incorporated units. See
  • Municipality: means a city, town, unorganized town, village, grant, or gore; or, in the case of property located within the territorial limits of an incorporated school district, "municipality" means an incorporated school district. See
  • National Boxer Registry: means an entity certified by the Association of Boxing Commissions for the purpose of maintaining records for the identification of professional boxers and for tracking their records and suspensions. See
  • Nonhomestead property: means all property except:

  • Nonprofit organization: means a nonprofit corporation that is qualified for tax exempt status under I. See
  • Nonresident: shall include any person who does not come under the definition of a resident. See
  • Notarial act: means an act, whether performed with respect to a tangible or an electronic record, that a notary public may perform under the law of this State. See
  • notarial certificate: means the part of, or attachment to, a notarized document that is completed by a notary public, bears the required information set forth in section 5367 of this chapter, and states the facts attested to or certified by the notary public in a particular notarization. See
  • Notarial officer: means a notary public or other individual authorized to perform a notarial act

  • Notary public: means an individual commissioned to perform a notarial act by the Office. See
  • Nursing home: means an institution, as defined in 33 V. See
  • Oath: shall include affirmation where by law an affirmation may be substituted. See
  • Oath: A promise to tell the truth.
  • Obligated party: means :

  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Office: means the Office of Professional Regulation. See
  • Office: means the Office of Professional Regulation. See
  • Office: means the Vermont Office of Professional Regulation. See
  • Office: means the Office of Professional Regulation within the Office of the Secretary of State. See
  • Office: means the Office of Professional Regulation. See
  • Official stamp: means a physical image affixed to or embossed on a tangible record or an electronic image attached to or logically associated with an electronic record. See
  • Older Americans Act: means the federal Older Americans Act of 1965 and regulations promulgated under the Act, as amended at any time. See
  • Older persons: means individuals who have attained the age of 60 years. See
  • open-space land: shall mean land without structures thereon. See
  • Operate: includes an attempt to operate and shall be construed to cover all matters and things connected with the presence and use of snowmobiles whether they be at motion or rest. See
  • Operator: shall include all persons 18 years of age or over properly licensed to operate motor vehicles. See
  • Original bill: A bill which is drafted by a committee. It is introduced by the committee or subcommittee chairman after the committee votes to report it.
  • Oversight: Committee review of the activities of a Federal agency or program.
  • owner: means a person who owns or controls or has the duty to control the operation of amusement rides. See
  • Owner: means a person, other than a lienholder, having the property in or title to a vessel. See
  • Owner: means any natural person, association, trust, or corporation with an ownership interest in a nursing home. See
  • Parents: means a student's parent or parents as determined by the Corporation consistently with the requirements of the federal financial assistance programs established under Title IV of the Higher Education Act. See
  • Part-time employee: shall mean an employee who works for an employer for fewer than 30 hours a week or fewer than 390 hours in a calendar quarter. See
  • Participant: means managers, seconds, referees, and judges in a professional boxing match. See
  • Participant: means individuals who participate, directly or indirectly, in mixed martial arts matches, including managers, referees, match makers, seconds, corners, and judges. See
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Permit: when used as a noun, means an authorization by the Agency of Natural Resources to operate a facility regulated under 10 V. See
  • Person: shall include any natural person, corporation, municipality, the State of Vermont or any department, agency, or subdivision of the State, and any partnership, unincorporated association, or other legal entity. See
  • Person: means an individual, corporation, business trust, statutory trust, partnership, limited liability company, association, joint venture, public corporation, government or governmental subdivision, agency, or instrumentality, or any other legal or commercial entity. See
  • Person: means an individual, partnership, firm, corporation, association, or other entity. See
  • Person: means any individual, partnership, association, joint stock company, corporation, government, political subdivision, governmental agency, or local governmental agency. See
  • Person: means any individual, firm, partnership, joint venture, association, social club, fraternal organization, estate, trust, fiduciary, receiver, trustee, or corporation. See
  • Person: means every natural person, association, trust, corporation, partnership, limited liability company, or other legal entity. See
  • Person: means an individual, partnership, corporation, or other business entity. See
  • Person interested in the estate: means any person entitled to receive, or who has received, from a decedent or by reason of the death of a decedent any property or interest therein included in the decedent's estate. See
  • Personal estate: shall include all property other than real estate. See
  • Personal property: All property that is not real property.
  • Personal watercraft: means a class A vessel that uses an inboard engine powering a water jet pump as its primary source of motive power and that is designed to be operated by an individual or individuals sitting, standing, or kneeling on or being towed behind the motorboat rather than in the conventional manner of sitting or standing inside the vessel. See
  • Persons with disabilities: means individual Vermonters who have functional limitations by virtue of physical, psychiatric, cognitive, or psychological conditions. See
  • place of business: includes any office, clinic, facility, salon, spa, or other location not otherwise exempted under section 5404 of this chapter where a person or persons engage in the practice of massage or the practice of bodywork. See
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Pollution abatement facility operator: means a person who is licensed under this chapter, or pursuant to rules developed pursuant to this chapter, to engage in the practice of pollution abatement facility operation consistent with a permit. See
  • Portable electronic device: means a portable electronic or computing device, including a cellular telephone, personal digital assistant (PDA), or laptop computer. See
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • practice of acupuncture: means the insertion of fine needles through the skin at certain points on the body, with or without the application of electric current or the application of heat to the needles or skin, or both, for the purpose of promoting health and well-being or to prevent or alleviate pain or unease. See
  • Practice of applied behavior analysis: means the design, implementation, and evaluation of systematic instructional and environmental modifications for the purpose of producing socially significant improvements in and understanding of behavior based on the principles of behavior identified through the experimental analysis of behavior. See
  • Practice of audiology: includes the following services, which may be provided to persons of all ages:

  • Practice of pollution abatement facility operation: means the operation and maintenance of a facility regulated under 10 V. See
  • Practice of speech-language pathology: includes :

  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • President pro tempore: A constitutionally recognized officer of the Senate who presides over the chamber in the absence of the Vice President. The President Pro Tempore (or, "president for a time") is elected by the Senate and is, by custom, the Senator of the majority party with the longest record of continuous service.
  • Principal residence: means principal residence as defined in section 10002a of this title, together with land that is beneath or directly contiguous to the dwelling and that is transferred with the dwelling. See
  • principal residence: means the principal dwelling of a person whose domicile is in the State of Vermont. See
  • Private investigator: means any person who, for consideration engages in or solicits business, accepts employment, or holds himself or herself out to the public as someone who will investigate, obtain information, or provide security of persons incident to, but not limited to, the following:

  • Privilege to operate: includes the privilege of a nonresident to operate a motor vehicle within the State and includes the privilege of a resident to obtain a license. See
  • Probate: Proving a will
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Promoter: means a person that organizes, holds, advertises, or otherwise conducts a professional boxing match. See
  • Promoter: means any person, club, corporation, or association and, in the case of a corporate promoter, includes any officer, director, employee, or stockholder thereof, who produces, arranges, or stages any mixed martial arts match. See
  • Property: means real property. See
  • Property dollar equivalent yield: means the amount of spending per equalized pupil that would result if the homestead tax rate were $1. See
  • Property tax: means the amount of ad valorem taxes, exclusive of special assessments, interest, penalties, and charges for service, assessed on real property in this State used as the claimant's housesite, or that would have been assessed if the homestead had been properly declared at the time of assessment. See
  • Property tax credit: means a credit of the prior tax year's statewide or municipal property tax liability or a homestead owner credit, as authorized under section 6066 of this title, as the context requires. See
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Psychiatric disability: means an impairment of thought, mood, perception, orientation, or memory that limits one or more major life activities but does not include intellectual disability. See
  • Psychotherapy: means the provision of treatment, diagnosis, evaluation, or counseling services to individuals or groups, for a consideration, for the purpose of alleviating mental disorders. See
  • Public assistance: means money payments furnished to or on behalf of dependent children by the Department. See
  • Public land: means all land that is either owned or controlled by a local, State, or federal governmental body. See
  • Purchase price: means the gross consideration, exclusive of the tax hereby imposed, that is to be paid for the motor vehicle, expressed in terms of U. See
  • Quorum: The number of legislators that must be present to do business.
  • Racing shell or rowing scull: means a manually propelled vessel that is recognized by national or international racing associations for use in competitive racing, and one in which all occupants row or scull, with the exception of a coxswain, if one is provided, and is not designed to carry and does not carry any equipment not solely for competitive racing. See
  • real estate: shall include lands, tenements, and hereditaments and all rights thereto and interests therein, and pews or slips in places of public worship shall be treated as real estate. See
  • real estate appraiser: means a person licensed under this chapter. See
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See
  • Rehabilitation Act: means the federal Rehabilitation Act of 1973 and regulations promulgated under the Act, as amended at any time. See
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Remotely located individual: means an individual who is not in the physical presence of the notary public who performs a notarial act under section 5379 of this chapter. See
  • Rental company: means any person offering pleasure cars for rent on a short-term basis. See
  • Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
  • Residence: means a person's domicile. See
  • Resident: as used in this title only, means any person living in the State who intends to make the State his or her principal place of domicile either permanently or for an indefinite number of years. See
  • Resident: means , with respect to a student, a student who has been domiciled in Vermont for the year preceding the date of commencement of the relevant semester or academic program. See
  • Resident: shall include all legal residents of this State and in addition thereto any person who accepts employment or engages in a trade, profession, or occupation in this State for a period of at least six months. See
  • Resilience: means the ability to respond to, withstand, and recover from serious hardship with coping skills and a combination of protective factors, including a strong community, family support, social connections, knowledge of parenting and child development, concrete support in times of need, and social and emotional competence of children. See
  • Responsible parent: means the natural or adoptive parent or stepparent, to the extent the stepparent owes a duty of support under 15 V. See
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Right of survivorship: The ownership rights that result in the acquisition of title to property by reason of having survived other co-owners.
  • road: shall include bridges thereon and their approaches. See
  • SAF: means the Society of American Foresters. See
  • said: when used by way of reference to a person or thing shall apply to the same person or thing last mentioned. See
  • Sailboard: means a sailboat whose unsupported mast is attached to a surfboard-like hull by a flexible joint. See
  • Sailing vessel: means any vessel under sail, provided that propelling machinery, if fitted, is not being used. See
  • sale or exchange of land: shall mean any transfer of title to land for a consideration. See
  • School year: means the year beginning July 1 and ending the next June 30. See
  • seal: shall include an impression of the official seal made upon paper alone or by means of a wafer or wax affixed thereto. See
  • Seasonal employee: means an employee who:

  • Secretary: means the Secretary of State. See
  • Secretary: means the Secretary of the Agency of Natural Resources. See
  • Secretary: means the Secretary of Human Services. See
  • Secretary: means the Secretary of Education. See
  • Secretary: means the Secretary of Natural Resources or any person authorized by the Secretary (directly or indirectly by one or more redelegations of authority) to perform the functions described in this chapter. See
  • Secretary: means the Secretary of State. See
  • Security: means a person engaged for compensation in the business of protecting property or persons by providing armed or unarmed security service, or armed transport service, or the use of guard dogs. See
  • Security services: includes :

  • Self-employed individual: means an individual who earns self- employment income. See
  • Selling price: means the amount of the full actual consideration for the transfer, paid or to be paid, including the amount of any liens or encumbrances existing before the transfer and not removed. See
  • Service of process: The service of writs or summonses to the appropriate party.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • sexual orientation: means female or male homosexuality, heterosexuality, or bisexuality. See
  • Sign: means , with present intent to authenticate or adopt a record:

  • Signature: means a tangible symbol or an electronic signature that evidences the signing of a record. See
  • Snowmobile: means a self-propelled vehicle intended for off-road travel primarily on snow, having a curb weight of not more than 793. See
  • Social Security Act: means the federal Social Security Act and regulations promulgated under the Act, as amended at any time. See
  • Speech-language pathologist: means a person licensed to practice speech-language pathology under this chapter. See
  • Speech-language pathology: means the application of principles, methods, and procedures related to the development and disorders of human communication, which include any and all conditions that impede the normal process of human communication. See
  • Stamping device: means :

  • State: when applied to the different parts of the United States may apply to the District of Columbia and any territory and the Commonwealth of Puerto Rico. See
  • State: means a state of the United States, the District of Columbia, Puerto Rico, the U. See
  • State: means any state, territory, or possession of the United States, the District of Columbia, and the Commonwealth of Puerto Rico. See
  • State Board: means the State Board of Education established by chapter 3 of this title. See
  • Statewide education tax rate: means the homestead education property tax rate multiplied by the municipality's education spending adjustment under subdivision 5402(a)(2) of this title and used to calculate taxes assessed in the municipal fiscal year that began in the taxable year. See
  • Statute: A law passed by a legislature.
  • Sternlight: means a white light placed as nearly as practicable at the stern, showing an unbroken light over an arc of the horizon of 135 degrees and so fixed as to show the light 67. See
  • Student: means any person who:

  • subdivision: means a tract or tracts of land, owned or controlled by a person, that the person has partitioned or divided for the purpose of sale or transfer. See
  • Subpoena: A command to a witness to appear and give testimony.
  • Summons: Another word for subpoena used by the criminal justice system.
  • sworn: shall include affirmed. See
  • Tax: means the federal estate tax and the estate tax payable to this State and interest and penalties imposed in addition to the tax. See
  • Taxable cost: means the purchase price as defined in subdivision (4) of this section or the taxable cost as determined under section 8907 of this title. See
  • Taxable year: means the calendar year preceding the year in which the claim is filed. See
  • taxes: shall include tax, interest, penalties, and late fees imposed under this chapter. See
  • Tenancy by the entirety: A type of joint tenancy between husband and wife that is recognized in some States. Neither party can sever the joint tenancy relationship; when a spouse dies, the survivor acquires full title to the property.
  • Testate: To die leaving a will.
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Title: shall include possession under a sale or purchase that reserves title as security to the seller. See
  • Title to property: includes :

  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • Tour: means a snowmobile ride led by a guide or leader over a defined route or routes lasting anywhere from one-half hour to less than a day and participated in by one or more individuals that have paid a fee to an individual or corporate entity for the privilege of riding a snowmobile. See
  • Town: shall include city and wards or precincts therein; "selectboard members" and "board of civil authority" shall extend to and include the mayor and aldermen of cities; "trustees" shall extend to and include bailiffs of incorporated villages; and the laws applicable to the inhabitants and officers of towns shall be applicable to the inhabitants and similar officers of all municipal corporations. See
  • Town clerk: means any town clerk, city clerk, county clerk, or other official whose duty it is to record deeds of property. See
  • Toxic stress: means strong, frequent, or prolonged experience of adversity without adequate support. See
  • Transfer: means every sale or change of ownership of a Vermont nursing home owned by the transferor during the entire 12-year period immediately preceding the change in ownership and providing services to the State under a contract during the entire period, after which transfer the home will continue in operation. See
  • Transfer: includes a grant, assignment, conveyance, will, trust, decree of court, transfer or acquisition of a direct or indirect controlling interest in any person with title to property, or any other means of transferring title to property or vesting title to property in any person. See
  • Transferor: means the owner of a nursing home who by the transfer has been divested of an ownership interest in the home. See
  • Transient: means an individual who does not intend to establish a permanent residence within the State of Vermont. See
  • Trauma-informed: means a type of program, organization, or system that recognizes the widespread impact of trauma and potential paths for recovery; recognizes the signs and symptoms of trauma in clients, families, staff, and others involved in a system; responds by fully integrating knowledge about trauma into policies, procedures, and practices; and seeks actively to resist retraumatization and build resilience among the population served. See
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Trustee: A person or institution holding and administering property in trust.
  • Underlying land: means the land from which timber or timber rights have been separated, whether subdivided or not. See
  • Value: means :

  • VAST: means the Vermont Association of Snow Travelers. See
  • Venue: The geographical location in which a case is tried.
  • Verification on oath or affirmation: means a declaration, made by an individual on oath or affirmation before a notary public, that a statement in a record is true. See
  • Very low-income limit: means the limit as determined by the U. See
  • Vessel: means every description of watercraft, other than a seaplane on the water or a racing shell or rowing scull occupied exclusively by individuals over 12 years of age, used or capable of being used as a means of transportation on water. See
  • Village: shall mean an incorporated village. See
  • Wages: means payments that are included in the definition of wages set forth in 26 U. See
  • Waste: means effluent, sewage, or any substance or material, liquid, gaseous, solid, or radioactive, including heated liquids, whether or not harmful or deleterious to waters of this State. See
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
