  • Active duty: means full-time duty status in the active uniformed service of the United States, including members of the National Guard and Reserve on active duty orders pursuant to 10 United States Code, Chapters 1209 and 1211. See Maine Revised Statutes Title 20-A Sec. 20102
  • Active ingredient: means any ingredient that will prevent, destroy, repel, control or mitigate pests or that will act as a plant regulator, defoliant or desiccant. See Maine Revised Statutes Title 7 Sec. 604
  • Activities of daily living: means activities as defined in federal and state rules including those essential to a person's daily living including: eating and drinking; bathing and hygiene; dressing, including putting on and removing prostheses and clothing; toileting, including toilet or bedpan use, ostomy or catheter care, clothing changes and cleaning related to toileting; locomotion or moving between locations within a room or other areas, including with the use of a walker or wheelchair; transfers or moving to and from a bed, chair, couch, wheelchair or standing position; and bed mobility or positioning a person's body while in bed, including turning from side to side.   • Activities of daily living: means tasks routinely performed by a person to maintain bodily functions, including bed mobility, transfers, locomotion, dressing, eating, toileting, bathing and personal hygiene. See Maine Revised Statutes Title 22 Sec. 7401

  • adult day care program: means a program of care, activities and protection maintained or carried out on a regular basis by a person or combination of persons in a private dwelling or other facility, for consideration, for any part of a day for 3 or more adults, 19 years of age or older, who are not blood relatives and are coming to the facility for the express purpose of participating in this program.   • Adults with long-term care needs: means adults who have physical or mental limitations which restrict their ability to carry out activities of daily living and impede their ability to live independently, or who are at risk of being, or who already have been, placed inappropriately in an institutional setting.   • Affiliated business: means 2 businesses exhibiting either of the following relationships:

  • Agreement: means a contract, grant or other method of payment. See Maine Revised Statutes Title 22 Sec. 7302
  • Ambulatory surgical facility: means a facility with the primary purpose of providing elective surgical care to a patient who is admitted to and discharged from the facility within the same day. See Maine Revised Statutes Title 22 Sec. 7932
  • Animal: means all vertebrate and invertebrate species, including but not limited to humans and other mammals, birds, fish and shellfish. See Maine Revised Statutes Title 7 Sec. 604
  • Assessor: means the State Tax Assessor. See Maine Revised Statutes Title 5 Sec. 13080-P
  • Assisted housing facility: means an assisted living facility, a residential care facility or an independent housing with services program. See Maine Revised Statutes Title 22 Sec. 7852
  • Assisted housing services: means the provision of housing, assistance with activities of daily living and instrumental activities of daily living, personal supervision, protection from environmental hazards, meals, diet care, care management, diversional or motivational activities, medication administration and nursing services.   • Assisted living facility: means a house or other place that, for consideration, is maintained wholly or in part for the purpose of providing assisted living services to residents in private apartments in buildings that include a common dining area, either directly by the provider or indirectly through contracts with persons, entities or agencies.   • Assisted living services: means the provision of assisted housing services by an assisted housing facility. See Maine Revised Statutes Title 22 Sec. 7852
  • Association: means a corporation organized under this subchapter, or a similar domestic corporation, or a foreign association or corporation if authorized to do business in this State, organized under any general or special Act as a cooperative association for the mutual benefit of its members, as agricultural producers, and which confines its operations to purposes authorized by this subchapter and restricts the return on the stock or membership capital and the amount of its business with nonmembers to the limits placed thereon by this subchapter for associations organized hereunder.   • Board: means a bureau, board or commission listed in Title 10, section 8001 or 8001?A, other licensor that is affiliated with or is a part of the Department of Professional and Financial Regulation, the Board of Overseers of the Bar or any other state agency or municipality that issues a license authorizing a person to engage in a business, occupation, profession or industry and any state agency, bureau, board, commission or municipality that issues a license or permit to hunt, fish, operate a boat, operate a snowmobile, operate an ATV or engage in any other sporting or recreational activity.   • Bond: means a bond or note or other evidence of indebtedness authorized under this article, whether issued under or pursuant to a bond resolution, trust indenture, loan or other security agreement. See Maine Revised Statutes Title 5 Sec. 13080-A

  • Child of a military family: means a school-aged child enrolled in kindergarten to grade 12 in the household of an active duty member. See Maine Revised Statutes Title 20-A Sec. 20102
  • child placing agency: means a facility which advertises itself or holds itself out as finding homes for or otherwise placing children under the age of 18, in homes where care is provided on the basis of 24 hours a day. See Maine Revised Statutes Title 22 Sec. 8201
  • Child support: means money paid directly to a parent, to another person or agency awarded parental rights and responsibilities with respect to a child or to the department on behalf of a child receiving public assistance and medical or dental insurance coverage provided on behalf of a child pursuant to court order.   • children: means persons who are not related by blood or marriage to, or who have not been legally adopted by, the licensee or administrator of any facility, defined in section 8101, 8201 or 8301?A, that provides services to these children. See Maine Revised Statutes Title 22 Sec. 7701
  • Client: means a person who receives services from a home health agency, personal care agency, long-term care facility, general and specialty hospital, critical access hospital, ambulatory surgical facility, hospice agency or end-stage renal disease unit.   • Commercial feed: means all materials except unmixed seed, whole or processed, when not adulterated within the meaning of section 717, subsections 1 to 4 which are distributed for use as feed or for mixing in feed, provided that the commissioner by regulation may exempt from this definition, or from specific provisions of this Act, commodities such as hay, straw, stover, silage, cobs, husks, hulls and individual chemical compounds or substances when such commodities, compounds or substances are not intermixed or mixed with other materials, and are not adulterated within the meaning of section 717, subsection 1, paragraph A.   • Commissioner: means the Commissioner of Health and Human Services, a designee or an authorized representative. See Maine Revised Statutes Title 19-A Sec. 101

  • Consumer assessment: means an evaluation of the functional capacity of an individual to live independently given appropriate supports with activities of daily living and instrumental activities of daily living or through the provision of information about service options that are available to meet the individual's needs.   • Contract feeder: means a person who, as an independent contractor, feeds commercial feed to animals pursuant to a contract whereby such commercial feed is supplied, furnished or otherwise provided to such person and whereby such person's remuneration is determined all or in part by feed consumption, mortality, profits or amount or quality of product. See Maine Revised Statutes Title 7 Sec. 712
  • Critical access hospital: means a hospital that must first be designated and approved by the State, as long as the State also has established an approved rural hospital flexibility program, and that meets the conditions in effect on March 1, 2004 for critical access hospital status under the federal Medicare program.   • Custodial parent: means a parent, caretaker relative or legal custodian of a dependent child who is the child's primary residential care provider. See Maine Revised Statutes Title 19-A Sec. 2101
  • Customer-formula feed: means commercial feed which consists of a mixture of commercial feeds or feed ingredients or both, each batch of which is manufactured according to the specific instructions of the final purchaser. See Maine Revised Statutes Title 7 Sec. 712
  • Defoliant: means any substance or mixture of substances intended for causing the leaves or foliage to drop from a plant, with or without causing abscission. See Maine Revised Statutes Title 7 Sec. 604
  • Department: means the Department of Economic and Community Development or its successor. See Maine Revised Statutes Title 5 Sec. 13080-A
  • Department: means the Department of Health and Human Services and its agents and authorized representatives. See Maine Revised Statutes Title 19-A Sec. 101
  • Department: means the Department of Education. See Maine Revised Statutes Title 20-A Sec. 1

  • Dependent child: means any minor child who is not emancipated. See Maine Revised Statutes Title 19-A Sec. 2101
  • Deployment: means the period one month prior to a service member's departure from the service member's home station on military orders to 6 months after return to the service member's home station. See Maine Revised Statutes Title 20-A Sec. 20102
  • Deputy: means either a full-time or part-time county law enforcement officer appointed under section 381. See Maine Revised Statutes Title 30-A Sec. 351
  • Desiccant: means any substance or mixture of substances intended for artificially accelerating the drying of plant tissue. See Maine Revised Statutes Title 7 Sec. 604
  • Designated beneficiary: means the beneficiary designated under section 18552. See Maine Revised Statutes Title 5 Sec. 18551
  • Device: means any instrument or contrivance, other than a firearm, that is intended for trapping, destroying, repelling or mitigating any pest or any other form of plant or animal life, other than a human being and other than a bacterium, virus or other microorganism on or in a living human being or other living animal.   • Direct access: means , with respect to an individual who is receiving services from an essential support worker in an institutional setting or in a home or community setting, access to the individual's property, personally identifiable information, financial information or resources or physical access to the individual.   • Disposable earnings: means that part of the earnings of any individual remaining after the deduction from those earnings of any amount required by law to be withheld. See Maine Revised Statutes Title 19-A Sec. 2101
  • Distribute: means to offer for sale, sell, exchange or barter commercial feed; or to supply, furnish or otherwise provide commercial feed to a contract feeder. See Maine Revised Statutes Title 7 Sec. 712
  • Distribute: means to offer for sale, hold for sale, sell, barter, ship, deliver for shipment or receive and, having so received, deliver or offer to deliver pesticides in this State. See Maine Revised Statutes Title 7 Sec. 604
  • distributor: means any person who distributes. See Maine Revised Statutes Title 7 Sec. 712
  • division: means the Department of Health and Human Services, Division of Licensing and Regulatory Services. See Maine Revised Statutes Title 22 Sec. 7701
  • Drug: means any article intended for use in the diagnosis, cure, mitigation, treatment or prevention of disease in animals other than humans and articles other than feed intended to affect the structure or any function of the animal body. See Maine Revised Statutes Title 7 Sec. 712
  • drug treatment center: as used in this subtitle , shall mean a residential facility, not licensed as a medical care facility under chapter 405, for the care, treatment or rehabilitation of drug users, including alcohol users. See Maine Revised Statutes Title 22 Sec. 8001
  • Earnings: means compensation paid or payable for personal services, whether denominated as wages, salary, commission, bonus or otherwise, and specifically includes periodic payments pursuant to pension or retirement programs, or insurance policies of any type, and all gain derived from capital, from labor or from both combined, including profit gained through sale or conversion of capital assets, and unemployment compensation benefits and workers' compensation benefits.   • Educational records: means those official records, files and data directly related to a student and maintained by the school or local education agency, including but not limited to records encompassing all the material kept in the child's cumulative folder such as general identifying data, records of attendance and of academic work completed, records of achievement and results of evaluative tests, health data, disciplinary status, test protocols and individualized education programs.   • Emergency: means a situation, physical condition or one or more practices, methods or operations which presents imminent danger of death or serious physical or mental harm to residents, including, but not limited to, imminent or actual abandonment of an occupied facility.   • Employment tax increment: means that level of state income withholding taxes attributed to employees employed within the base area, adjusted pursuant to section 13080?R. See Maine Revised Statutes Title 5 Sec. 13080-P
  • End-stage renal disease unit: means a facility that provides specialized services to assist individuals who have been diagnosed as having an irreversible and permanent kidney disease that requires dialysis or kidney transplantation to maintain life. See Maine Revised Statutes Title 22 Sec. 7932
  • Environment: includes water, air and land and all plants and human beings and other animals living therein and the interrelationships that exist among these. See Maine Revised Statutes Title 7 Sec. 604
  • EPA: means the United States Environmental Protection Agency. See Maine Revised Statutes Title 7 Sec. 604
  • Essential support worker: means an individual who by virtue of employment generally provides to individuals direct contact assistance with activities of daily living or instrumental activities of daily living or has direct access to provide care and services to clients, patients or residents regardless of the setting.   • Extracurricular activities: means voluntary activities sponsored by the school or local education agency or an organization sanctioned by the local education agency. See Maine Revised Statutes Title 20-A Sec. 20102
  • facility: means any of the places defined in section 8001, 8101, 8201 or 8301?A, subsection 1?A, paragraph B. See Maine Revised Statutes Title 22 Sec. 7701
  • Facility: means any assisted living facility, residential care facility or assisted housing facility subject to licensure pursuant to chapters 1663 and 1664, any nursing facility or unit subject to licensure pursuant to chapter 405 and any private psychiatric hospital subject to licensure pursuant to chapter 405.   • Family foster home: includes the home of a resource family whether the family provides foster care, kinship care, adoption or permanency guardianship services, as long as the home meets the requirements and standards for adoption of children in foster care.   • Feed ingredient: means each of the constituent materials making up a commercial feed. See Maine Revised Statutes Title 7 Sec. 712
  • Fiduciary: A trustee, executor, or administrator.
  • FIFRA: means the Federal Insecticide, Fungicide and Rodenticide Act. See Maine Revised Statutes Title 7 Sec. 604
  • Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
  • Foreign country: means a country, including a political subdivision thereof, other than the United States, that under its law authorizes the issuance of support orders and:

  • Foreign support order: means a support order issued by a foreign tribunal. See Maine Revised Statutes Title 19-A Sec. 2802
  • Fund: means the Loring Job Increment Financing Fund. See Maine Revised Statutes Title 5 Sec. 13080-P
  • Fungi: means all nonchlorophyll-bearing thallophytes, that is, all nonchlorophyll-bearing plants of a lower order than mosses and liverworts, including but not limited to rusts, smuts, mildews, molds, yeasts and bacteria, except those on or in living human beings or other living animals, and except those in or on processed food, beverages or pharmaceuticals.   • Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
  • General hospital: means an acute health care facility with permanent inpatient beds planned, organized, operated and maintained to offer on a continuous basis facilities and services for the diagnosis and treatment of illness, injury and deformity that has a governing board and an organized medical staff, offering a continuous 24-hour professional nursing care plan to provide continuous 24-hour emergency treatment and that includes the following services or organizational units:

  • Governing body: means , for a municipality, the municipal legislative body as defined by Title 30?A, section 2001 or, for a county, the board of county commissioners. See Maine Revised Statutes Title 5 Sec. 13080-A
  • Grantee: means the person to whom a freehold estate or interest in land is conveyed. See Maine Revised Statutes Title 1 Sec. 72
  • Gross employment tax increment: means that level of state income withholding taxes attributed to employees employed within the base area that is greater than the base level of employment. See Maine Revised Statutes Title 5 Sec. 13080-P
  • Habitual violation: means a violation of state or federal law which, due to its repetition, presents a reasonable likelihood of serious physical or mental harm to residents. See Maine Revised Statutes Title 22 Sec. 7932
  • Highly toxic pesticide: means any pesticide determined to be a highly toxic pesticide under FIFRA, Section 25(c)(2) or by the board under section 610, subsection 1, paragraph B. See Maine Revised Statutes Title 7 Sec. 604
  • home health care provider: includes any business entity or subdivision of a business entity, whether public or private, proprietary or nonprofit, that is engaged in providing speech pathology services. See Maine Revised Statutes Title 22 Sec. 7932
  • Home or community setting: means a place of residence or group home where adults with long-term care needs receive in-home and community support services. See Maine Revised Statutes Title 22 Sec. 7401
  • Home-based manufacturer of pet food: means a person who manufactures 10 or fewer product names in that person's home and sells the products directly to consumers. See Maine Revised Statutes Title 7 Sec. 712
  • Hospice agency: means a public agency or private organization that is primarily engaged in providing specified services to terminally ill individuals and their families. See Maine Revised Statutes Title 22 Sec. 7932
  • Imminent hazard: means a situation that exists when the continued use of a pesticide during the time required for cancellation proceedings pursuant to section 609 would likely result in unreasonable adverse effects on the environment or will involve unreasonable hazard to the survival of a species declared endangered by the United States Secretary of the Interior under United States Public Law 91-135.   • In-home and community support services: means health and social services and other assistance required to enable adults with long-term care needs to remain in their places of residence. See Maine Revised Statutes Title 22 Sec. 7302
  • In-home and community support services: means health and social services, including behavioral health, and other assistance required to enable persons with long-term care needs to remain in their places of residence or group homes. See Maine Revised Statutes Title 22 Sec. 7401
  • Income: includes earnings or other periodic entitlements to money from any source and any other property subject to withholding for support under the law of this State. See Maine Revised Statutes Title 19-A Sec. 2802
  • Income-withholding order: means an order or other legal process directed to an obligor's employer, as provided by chapter 65, subchapter IV, to withhold support from the income of the obligor. See Maine Revised Statutes Title 19-A Sec. 2802
  • Independent housing with services program: means a program of supportive services provided to residents in private apartments who receive funds through a written agreement with the department's office of aging and disability services. See Maine Revised Statutes Title 22 Sec. 7852
  • Indian foster family home: means a foster home licensed, approved or specified by the Indian child's tribe where substitute parental care is provided for an Indian child as defined in the federal Indian Child Welfare Act of 1978, 25 United States Code § 1901, et seq.   • Inert ingredient: means an ingredient that is not an active ingredient. See Maine Revised Statutes Title 7 Sec. 604

  • Insect: means any of the numerous small invertebrate animals generally having the body more or less obviously segmented, for the most part belonging to the class insecta, comprising 6-legged, usually winged forms, including but not limited to beetles, bugs, bees and flies, and to other allied classes or arthropods whose members are wingless and usually have more than 6 legs, including but not limited to spiders, mites, ticks, centipedes and wood lice.   • Institutional setting: means residential care facilities, licensed pursuant to chapter 1664; intermediate care and skilled nursing facilities and units and hospitals, licensed pursuant to chapter 405; and state institutions for individuals who have intellectual disabilities or autism or other related conditions.   • Institutional settings: means residential care facilities, licensed pursuant to chapter 1664; intermediate care and skilled nursing facilities and units and hospitals, licensed pursuant to chapter 405; and state institutions for individuals who have a mental illness or who have intellectual disabilities or autism or other related conditions.   • Instrumental activities of daily living: means the activities as defined in federal and state rules including those essential, nonmedical tasks that enable the consumer to live independently in the community, including light housework, preparing meals, taking medications, shopping for groceries or clothes, using the telephone, managing money and other similar activities.   • Instrumental activities of daily living: includes , but is not limited to, preparing or receiving of a main meal, taking medication, using the telephone, handling finances, banking, shopping, routine housework, laundry and getting to appointments. See Maine Revised Statutes Title 22 Sec. 7401

  • Kindergarten: means a one-year or 2-year childhood education program, for children at least 5 years of age, immediately prior to grade one. See Maine Revised Statutes Title 20-A Sec. 1
  • Label: means the written, printed or graphic matter on, or attached to, the pesticide or device or any of its containers or wrappers. See Maine Revised Statutes Title 7 Sec. 604
  • Label: means a display of written, printed or graphic matter upon or affixed to the container in which a commercial feed is distributed, or in the case of a bulk shipment the information shall accompany delivery. See Maine Revised Statutes Title 7 Sec. 712

  • License: means a license, certification, registration, permit, approval or other similar document evidencing admission to or granting authority to engage in a profession, occupation, business or industry, and a license or permit to hunt, fish, operate a boat, operate a snowmobile, operate an ATV or engage in any other sporting or recreational activity, but does not mean a registration, permit, approval or similar document evidencing the granting of authority to engage in the business of banking pursuant to Title 9?B.   • Licensee: means any person or any other legal entity, other than a receiver appointed under section 7933, who is licensed or required to be licensed to operate a facility. See Maine Revised Statutes Title 22 Sec. 7932
  • Life Safety Code: means the current edition of the National Fire Protection Association Life Safety Code 101. See Maine Revised Statutes Title 22 Sec. 7852
  • Local education agency: means a public authority legally constituted by a member state as an administrative agency to provide control of and direction for kindergarten to grade 12 public educational institutions. See Maine Revised Statutes Title 20-A Sec. 20102
  • Long-term care facility: means any facility program of assisted living licensed pursuant to chapters 1663 and 1664, and any nursing facility or unit licensed pursuant to chapter 405. See Maine Revised Statutes Title 22 Sec. 7922
  • Manufacture: means to grind, mix or blend, or further process a commercial feed for distribution. See Maine Revised Statutes Title 7 Sec. 712
  • Marketing contract: includes a contract related to the marketing of agricultural products and a contract by an independent agricultural contractor for furnishing services and facilities in raising or growing agricultural products. See Maine Revised Statutes Title 13 Sec. 1774
  • Medical support: means an amount ordered to be paid toward the cost of health insurance provided by a public entity or by another parent through employment or otherwise or for other medical costs not covered by insurance. See Maine Revised Statutes Title 19-A Sec. 1501
  • Member: includes the holder of a membership in an association without capital stock and the holder of common stock in an association organized with capital stock. See Maine Revised Statutes Title 13 Sec. 1774
  • Member state: means a state that has enacted the compact. See Maine Revised Statutes Title 20-A Sec. 20102
  • Membership: means active participation in the program of a school from the date of enrollment to the time the student withdraws or is absent from the school for 10 consecutive days for reasons other than illness. See Maine Revised Statutes Title 20-A Sec. 15001
  • Military installation: means a base, camp, post, station, yard, center or homeport facility for any ship, or other activity under the jurisdiction of the federal Department of Defense, including any leased facility, that is located within any of the several states, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, American Samoa, the Northern Marianas Islands and any other United States territory.   • Mineral feed: means a commercial feed intended to supply primarily mineral elements or inorganic nutrients. See Maine Revised Statutes Title 7 Sec. 712
  • Minority: when used in reference to age shall mean under the age of 18. See Maine Revised Statutes Title 1 Sec. 72
  • Multi-level health care facility: means a residential care facility and a nursing facility that are colocated on the same premises. See Maine Revised Statutes Title 22 Sec. 7852
  • neglect: refers to the definitions found in section 3472, subsections 1 and 11, and also incorporates exploitation, as defined in section 3472, subsection 9. See Maine Revised Statutes Title 22 Sec. 7701
  • Nematode: means invertebrate animals of the phylum nemathelminthes and class nematoda, that is, unsegmented roundworms with elongated fusiform or sac-like bodies covered with cuticle, and inhabiting soil, water, plants or plant parts; nematodes may also be called nemas or eelworms.   • Person: means any individual, partnership, association, fiduciary, corporation or any organized group of persons whether incorporated or not. See Maine Revised Statutes Title 7 Sec. 604
  • Person: means an individual, trust, estate, partnership, association, company, corporation, political subdivision of the State, instrumentality of the State or other entity. See Maine Revised Statutes Title 19-A Sec. 101

  • Personal care assistant: means an individual who has completed a training course of at least 40 hours, which includes, but is not limited to, instruction in basic personal care procedures, such as those listed in subsection 7, first aid and handling of emergencies; or an individual who meets competency requirements, as determined by the department or its designee; or, if providing service to a consumer receiving self-directed attendant services under chapter 1622, a person approved by the consumer or the consumer's surrogate as being able to competently assist in the fulfillment of the personal care assistance services outlined in the consumer's plan of care.   • Pest: means any insects, rodents, nematodes, fungi, weeds, and other forms of terrestrial or aquatic plant or animal life or viruses, bacteria or other microorganisms, except viruses, bacteria or other microorganisms on or in living human beings or other living animals, that the commissioner declares to be a pest under section 610, subsection 1, paragraph A.   • Pesticide: includes a highly toxic pesticide. See Maine Revised Statutes Title 7 Sec. 604
  • Pet: means any domesticated animal normally maintained in or near the household of the owner thereof. See Maine Revised Statutes Title 7 Sec. 712
  • Pet food: means any commercial feed prepared and distributed for consumption by pets. See Maine Revised Statutes Title 7 Sec. 712
  • Plant regulator: means any substance or mixture of substances intended through physiological action for accelerating or retarding the rate of growth or rate of maturation or for otherwise altering the behavior of plants or the produce thereof. See Maine Revised Statutes Title 7 Sec. 604
  • Plant-incorporated protectant: means a pesticidal substance that is produced and used in a living plant through genetic engineering and the genetic material necessary for the production of the pesticidal substance. See Maine Revised Statutes Title 7 Sec. 604
  • Primary impact community: means the municipalities of Caribou, Caswell, Fort Fairfield, Limestone, Presque Isle and Van Buren and Aroostook County. See Maine Revised Statutes Title 5 Sec. 13080-A
  • Primary impact community: means the municipalities of Bath, Bowdoin, Bowdoinham, Brunswick, Freeport, Harpswell, Lisbon Falls and Topsham and Androscoggin County, Cumberland County and Sagadahoc County. See Maine Revised Statutes Title 5 Sec. 13083-H

  • Professional firefighter: means an employee of a municipal fire department who is a member of the Participating Local District Retirement Program or who is a participating member under chapter 425 and who aids in the extinguishment of fires, whether or not the employee has other administrative duties. See Maine Revised Statutes Title 5 Sec. 18601
  • Protect health and the environment: means to protect against any unreasonable adverse effects on the environment. See Maine Revised Statutes Title 7 Sec. 604
  • Provider: means any entity, agency, facility or individual who offers or plans to offer any in-home or community support services or institutionally based long-term care services. See Maine Revised Statutes Title 22 Sec. 7302
  • Public assistance: means money payments and medical care furnished to or on behalf of dependent children by the State. See Maine Revised Statutes Title 19-A Sec. 2101
  • Public school: means a school that is governed by a school board of a school administrative unit and funded primarily with public funds. See Maine Revised Statutes Title 20-A Sec. 1
  • Qualified providers: means community-based agencies or a network of agencies with the organizational and administrative capacity to administer and monitor an array of in-home and community support services that will promote choice and portability with an emphasis on coordinating and implementing the services in the consumer's plan of care. See Maine Revised Statutes Title 22 Sec. 7302
  • Qualifying member: means a member in service or a former member who is receiving a disability retirement benefit. See Maine Revised Statutes Title 5 Sec. 18551

  • Rule: means a written statement by the interstate commission adopted pursuant to section 20112 that is of general applicability; implements, interprets or prescribes a policy or provision of the compact or an organizational, procedural or practice requirement of the interstate commission; has the force and effect of statutory law in a member state; and includes the amendment, repeal or suspension of an existing rule.   • Secondary school: means that portion of a school that provides instruction in any combination of grades 9 through 12. See Maine Revised Statutes Title 20-A Sec. 1
  • Self-directed care services: includes the hiring, firing, training and supervision of personal care assistants to assist with activities of daily living and instrumental activities of daily living. See Maine Revised Statutes Title 22 Sec. 7302

  • Spray adjuvant: means any wetting agent, spreading agent, sticker, deposit builder, adhesive, emulsifying agent, deflocculating agent, water modifier or similar agent that is intended to be used with any other pesticide as an aid to the application or the effect of it and that is in a package or container separate from that of the other pesticide.   • Substantial violation: means a violation of state or federal law that presents a reasonable likelihood of serious physical or mental harm to residents or clients. See Maine Revised Statutes Title 22 Sec. 7932
  • Successor business: means a business that has acquired the organization, trade or business, or 50% or more of the assets of the organization, trade or business, of another taxpayer. See Maine Revised Statutes Title 5 Sec. 13080-P
  • Superintendent: means the person in a school administrative unit or school union appointed and having the authority and responsibility under this Title and other applicable statutes. See Maine Revised Statutes Title 20-A Sec. 1
  • Support order: means a judgment, decree or order, whether temporary, final or subject to modification, issued by a court or an administrative agency of competent jurisdiction for the support and maintenance of a child, including a child who has attained the age of majority under the law of the issuing state, or a child and the parent with whom the child is living, that provides for monetary support, health care, arrearages or reimbursement and may include related costs and fees, interest and penalties, income withholding, attorney's fees and other relief.   • Support order: means a judgment, decree, order, decision or directive, whether temporary, final or subject to modification, issued in a state or foreign country for the benefit of a child, a spouse or a former spouse, that provides for monetary support, health care, arrearages, retroactive support or reimbursement for financial assistance provided to an individual obligee in place of child support. See Maine Revised Statutes Title 19-A Sec. 2802
  • Surrogate: means an unpaid agent of a consumer designated to assist with the management of the tasks associated with in-home and community support services. See Maine Revised Statutes Title 22 Sec. 7302

  • Unreasonable adverse effects on the environment: means any unreasonable risk to human beings or the environment, taking into account the economic, social and environmental costs and benefits of the use of any pesticide. See Maine Revised Statutes Title 7 Sec. 604
  • Veteran: means a person who served in the uniformed services and who was discharged or released therefrom under conditions other than dishonorable. See Maine Revised Statutes Title 20-A Sec. 20102
  • Weed: means any plant that grows where it is not wanted. See Maine Revised Statutes Title 7 Sec. 604
  • Wildlife: means all living things that are neither human, domesticated nor, as defined in this subchapter, pests, including but not limited to mammals, birds and aquatic life. See Maine Revised Statutes Title 7 Sec. 604
