61-2-506. Rulemaking authority. (1) The department shall adopt rules necessary for the administration of this part.

Terms Used In Montana Code 61-2-506

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Department: means the department of transportation provided for in 2-15-2501. See Montana Code 61-2-502
  • Emergency medical service: means an out-of-hospital treatment service or interfacility emergency medical transportation provided by an ambulance or nontransporting medical unit. See Montana Code 61-2-502
  • Process: means a writ or summons issued in the course of judicial proceedings. See Montana Code 1-1-202

(2)The rules must include but are not limited to:

(a)the weighting of the criteria listed in 61-2-504 for scoring purposes;

(b)allowable reasons for not awarding a grant;

(c)the appeal process for an emergency medical service provider that does not receive a grant; and

(d)reporting requirements for grant recipients.
